from cbs news bay area, this is the afternoon edition. right now on the afternoon edition, it is a murder trial that captured the nation 20 years ago. now, it is back in the spotlight. convicted killer scott peterson returns to court as he fights to get his case retried . good afternoon. i'm elizabeth cook and for ryan today. today's hearing comes weeks after the los angeles innocence project took up his case. peterson is currently serving a life sentence without parole for the murders of his pregnant wife laci and their unborn son. max darrow is live outside the san mateo courthouse with the latest of elements in all of this. >> reporter: liz, more than 20 years later, this case continues to unfold. the court proceedings today were relatively brief, about 45 minutes or so. the judge really just set the stage for what

will be a lengthy process as peterson fights to overturn this conviction and prove his innocence. the judge said several dates for the prosecution and defense and also three hearing dates that we will be watching closely. one in april and one in may and one in july . let's take you into the courtroom right now from the proceedings this morning. peterson appeared via zoom for today's hearing. he did not really speak much outside of the formalities, saying things like yes, your honor . he did appear confident and collected. he is represented now by the alley innocence project. there are three big emotions pending. the big one at play here is a postconviction dna testing request, specifically surrounding the van that was near the peterson's home that was involved in a burglary either at or near the time of laci 's disappearance. a legal expert we spoke with after the proceedings wrapped up today says it is very significant that the l.a. innocence project took this case. >> what if he's not guilty, okay? what if he had an affair and he was a crappy husband but what if he didn't kill her?

>> reporter: peterson's case has stretched on since the early 2000. in 2004, he was convicted of murdering laci, eight months pregnant with their sunblock connor. in 2005, he was sentenced to death. in 2020, the california supreme court overturned peterson's death sentence after an issue with jury screening from that original trial. in 2021, he was resentenced to life in prison without the possibility of parole and then in 2022, he was moved off death row at san quentin. we were back in court after that happened as he and his defense team then pushed her a new trial based upon an allegation of juror misconduct. after a series of hearings in 2022, a judge ultimately denied him relief and did not grant him a new trial. fast-forward almost two years later now in 2024 and we are back in a courtroom as he now makes this bid to try to prove his

innocence. janie peterson, his sister-in-law, was present at the hearing today. she has been a fierce advocate, saying that her brother-in-law is innocent and has maintained that since the beginning of this case, 20 years ago. she did not speak to media, however, but this will be a lengthy process and we will be here as it unfolds. >> you remember 20 years ago. i don't think there is a person around the country or here in the bay area, especially, that does not remember the scott peterson case. think about everything that has been written about it. no doubt it will continue to capture a lot of attention. turning now to your first alert weather. a live look at our bay area bridges. the roads are starting to dry out after another round of rain hit the bay area. this is what it looked like early this morning on the bay bridge. time-lapse video shows drivers making their way into san francisco. they had to deal with a soggy commute. meteorologist jessica

burch is in our virtual weather studio with more. >> it is another cool and cloudy day for us, just like yesterday as we kicked off this work week with upper 50s and lower 60s for our daytime highs in communities like fremont, stretching into livermore. for our friends down to the santa clara valley, we have some thicker clouds and a light chance of showers in the forecast heading into the afternoon hours but slowly that blanket of clouds starts to move away. we will be left with sunnier skies right around the corner, starting tomorrow. high pressure is building in. let's get to today first. you might see a quick splash of showers in your local community but for the most part, we are looking up outside of our windows until around 5:00, 6:00 tonight. that is when we get to see a mix of sun and clouds. we are suddenly left with drier conditions into our forecast for wednesday. that will last into thursday, friday with daytime highs warming up a lot

too. upper 70s right around the corner as we head into next week for our inland areas. it will be beautiful but i want to mention this. the pollen count starts to increase over the next couple of days. match that with gusty winds moving in from the north and we are going to keep a close eye on this as we get closer to those days. let's take a live look at san francisco where a half hour ago, the city released the latest overdose numbers. they say 64 people died from an overdose in february alone. it is actually up from last february when 52 people died from overdose. health officials say the majority of those deaths were from fentanyl. a powerful meeting between the mother of a hit and run victim and the strangers who helped bring her family justice. a young woman was riding her motorcycle when she was struck by a hit and run driver on highway 101. her family offered a hefty reward for any information leading to an arrest. now, six years later, everyone is finally getting some closure. >> in the quiet confines of her kitchen in fairfax, connie is

preparing for a meeting, six years in the making. >> this is the one last detour -- detail of this whole deal. >> she is about to come face-to-face with two strangers who were instrumental in identifying the man responsible for her daughter's death. >> i am excited to meet them finally. i have never met them yet. >> drivers sped off after hitting a young woman on 101 southbound in mill valley. >> in 2018, her 29-year-old daughter, marie, was riding her motorcycle when she was struck by a driver who fled the scene. lying on the road, she was then hit by a second car and killed. that drivers stayed and waited for police. >> they said that she had been hit by a chevy suburban. they

figured that out the next day. >> the siegenthaler family offered a $50,000 reward for information leading to the arrest of the hit and run driver. the car was eventually found in a petaluma auto repair shop owned by the driver's uncle after two different women turned him in. the driver, identified as frank marone jr. was found guilty of two felonies and sentenced to prison. >> i am trying to find it in my heart to forgive this guy because i feel like it is poisoning me. >> it would be really great if we could get a sign. >> since then, connie has been busy honoring marie, honoring a foundation that provides art supplies to struggling college students. jason dunn is the department chair of fine arts and architecture at the college of marin. he says the project,

lawmakers on both sides of the aisle had critical questions for special counsel robert hur as he testified about his report looking for

president biden's handling of classified material. hur defended his probe, seeking not to prosecute president biden after finding he willfully retained classified materials after the end of his vice presidency. republicans on the committee called it a double standard. >> we did not, however, identify evidence that rose to the level of proof beyond a reasonable doubt. because the evidence fell short of that standard, i declined to recommend criminal charges against mr. biden. >> i think it would be toxic to the rule of law on its face of it was two ordinary citizens. the fact that the only person being prosecuted for this offense happens to be the president's political opponent, makes this an unprecedented assault on our democracy. >> the hur report noted president biden could not remember the timeline of certain key events. cbs news reviewed the transcript of the five-hour interview, shedding light on an exchange where president biden recalled the day and month his son beau died but white house lawyers reminded him of the year .

it is a cool and cloudy day for us in the bay area with lingering showers in the forecast as we head into the next couple of hours. those are like pockets of showers but will continue to sweep to the south. we are starting to dry up past heading into the overnight hours tonight. by tomorrow, that blanket of clouds becomes a thing of the past. it is actually a treat for us. this area of low pressure gave us a leftover shower in the forecast today and cool and cloudy conditions. right behind it is an area of low pressure that will create a heat dome for us heading into this weekend's forecast where daytime highs will hit the upper 70s. to add to that, our rain chance is completely diminished with high-pressure. i will say this. it gets gustier day by day as we head into wednesday and thursday. we are keeping a close eye on that pollen count because it is getting higher and higher day by day which leads us into the weekend forecast where we are expecting beautiful sunny skies with 70s in the forecast. take it slow. if you are sensitive like allergies -- if you are planning on heading out to wings over celano, it will be exciting near travis air force base. the blue angels will be

flying. it will be great flying weather but today, that is not the case. we need to take it a step back one more time to talk about today. it will continue to be a cool and cloudy day with upper 50s and lower 60s for our daytime highs from redwood city all the way up into the east bay near antioch and concord and all the way down into the santa clara valley. watch what happens as we head into the next seven days. sunshine, sunshine and more sunshine with that gradual warming trend into early next week with upper 70s around the corner. we will be tasting the 80s around the corner but we will get through today. high pressure builds its way in the starting wednesday. that will last throughout this weekend for any outdoor activities you have here in the bay. several spelling errors have been found on a new statue honoring baker's legend kobe bryant. coming up, the awkward typos that have fans questioning how this could even

the la lakers plan to fix a bunch of mistakes made on a new statue honoring legend kobe bryant. the statue was unveiled last month outside the crypto.com arena. it had some typos in the box score carved into the marble base. some of the players names are misspelled. a german nba reporter pointed out the spelling errors on social media. to baseball now. opening-day is a few weeks away and you can say the a's are the most controversial team in baseball right now. they are playing at the coliseum for one more year. after that, their future remains uncertain. these are the newly released renderings for their proposed new ballpark in vegas which includes a view of the sin city skyline but this new park is not expected to be ready for

the a's until 2028. meanwhile, our nicole zaloumis caught up with one longtime fan who loves the a's so much that he started a business around them. >> since the days of the bash brose, bryan johansen has love the a's. since a 2020 new york times article bashed the oakland coliseum, bryan took the negative things he had to say and turn them into a positive. >> they compared the coliseum to a dive bar when all the other stadiums were like cocktail lounges , so i saw a line that said baseball's last dive bar. we made a banner of that. little did we know the very graphic we used for that would go viral. >> not only did it go viral, it became profitable. banners, pins, calendars all inspired by the coliseum. a new business was born, the last dive bar. they even organized fan experiences like last month's fanfest.

>> it was magical. there was estimated 15 to 20 k that was there. you had passed players, all the oakland teams that were there. over 60 vendors, community members. >> some said it was the best fanfest they have ever been to. sadly, it will be there last. after 2024, the a's don't have a place to call home . will be spans travel to sacramento? vegas? salt lake city? will they support the team at the coliseum for the next four years knowing a new vegas ballpark will be ready in 2028? for loyal fans, this process is heartbreaking. >> it is horrible. it is like living everyday in a nightmare where the person you love most does not love you back but you are forced to live with them. >> despite the pain, bryan 's message, keep hope. he thinks a lot can still fail in vegas and he wants fans to continue to highlight the deficiencies of the ownership group in hopes that it will keep the a's rooted in oakland at the coliseum where they belong.
