more than two decades after scott peterson was convicted of murder, his case returned to a san mateo county courtroom today. good evening, i'm elizabeth cook. a crucial status hearing was held as peterson and his new defense team try to overturn his conviction. lazy laci peterson's body was found in the san francisco bay four months later. two years later scott peterson was convicted of murder. he was originally sentenced to die, but in 2020 that sentence was overturned, and peterson was ordered to serve life in prison without parole. the l.a. innocence project took up the case back in january. and max darrow was in the courtroom today and has all the latest developments. >> reporter: convicted murderer scott peterson was back in a san mateo county courtroom today nearly 20 years after he was sentenced to death. today's legal proceedings kicked off what will be a

lengthy process as peterson and a new defense team tries to prove he is innocent. >> do we have your consent to proceed via zoom this evening? >> absolutely. >> reporter: scott peterson appearing before a judge via video conference on tuesday from the state prison as he seeks to fight his murder conviction with the help of attorneys from the l.a. innocence project. that's paula mitchell representing peterson. back in 2004, peterson was sentenced to death after he was convicted of murdering his pregnant wife, laci, and connor. in 2020, the california supreme court overturned that sentence, citing errors with the jury selection process. in 2021 a judge resentenced peterson to life in prison without the possibility of parole. in 2022, his defense team pushed for a new trial based upon an allegation of juror misconduct. after a series of hearings, a judge did not grant him a new trial. then in the beginning of 2024, the l.a. innocence

project filed three motions including a request for post conviction dna testing and a request for reasonable discovery. >> we were very, very specific. we spent a lot of time trying to assess out frankly what are very alarming deficiencies in the discovery that's provided. and those are the items we're requesting. the nature of the request is not a phishing expedition. >> reporter: it is another part of their claim. they would like to access evidence collected to a burglary near the peterson's home right around the time of laci's disappearance. they followed the case closely. >> if that testing shows what they think it is going to show, it is a whole new ball game sort to speak. >> reporter: she says the fact that the l.a. innocence project even took on peterson's case is significant. >> and that organization, which only represents people who the project believes is innocent and can be exonerated by dna

evidence has taken this up. >> reporter: the hearing date on the motion can be earlier. >> reporter: the superior court judge set the hearing. one of the few times we heard them speak when they opted to appear virtually for those hearings. peterson's sister-in-law and fierce advocate was present, but did not address the media after the proceedings wrapped up. his attorneys provided a statement that read in part, we have not commented on our motions and we will continue to present our case in court where it should be adjudicated. peterson will be back in a san mateo courtroom, appearing virtually in april, may, and july. >> now we should note the l.a. innocence project, which is representing peterson operates independently of the national innocence project, which is not involved in this case. for background on the scott peterson case over the years and more from today's hearing, head to our website kpix.com. to the north bay now, novato police say they have

arrested a person accused of pepper spraying a worshiper at an islamic center. this happened at the islamic center of north marin yesterday. police say the victim was preparing to celebrate the first day of ramadan when the suspect ented and showed them a gun inside their bag. the victim tried to take that bag away and was pepper sprayed. police say they didn't find a gun on the suspect or enough evidence to consider hate crime charges. they were booked on charges of unlawful possession of pepper spray and disrupting a religious ceremony. now to san jose where santa clara county sheriffs say they are seeing an uptick in copper theft. deputies arrested two suspects accused of stealing copper wire from bta light rail lines. the bta has been hit by two dozen cases of copper thefts this year, costing more than half a million dollars in damage. in some cases they have disabled warning lights and gates. bta says this not only is causing disruptions to operations, but it also creates

a serious safety hazard. deputies share this tip with riders. they say if it looks like someone is carrying something that looks like a water hose, it could actually be copper. >> there is protective coating. so again it may seem like somebody is dragging a piece of water hose off the system. underneath that plastic coating is about one thick gauge of copper coating. >> investigators have not determined how cases the two suspects could be connected to. san jose's mayor is making a big push to address homelessness in the bay area's biggest city. but people living on the streets say it is just not that simple. >> i have a caseworker. and he is trying to get me to that place. and timing on something. so it is all a waiting list right now. >> coming up tonight at 5:30, the mayor's plan and why it is focused on rivers and creeks. to san francisco now where we are getting a snapshot of

the city's opioid crisis. new numbers on the people who have lost their lives to drug overdoses. the city says 64 people died last month from accidental overdoses. that's down slightly from january when 67 died. the city says they are working to make more treatment available and accessible to help people recover from addiction. >> these medications specifically morphine and methadone, each reduces a person's risk of dying by approximately 50%. >> the city's department of public health says they are working to make those drugs more accessible. a new rent control ordinance in concord has been put on hold just weeks after it was finalized by the city council. the move comes as the city has received a petition to put the measure before voters in november. it would have capped the amount landlords could raise rent. now petition organizers will have about a month to collect enough signatures to put it on the

ballot. turning to weather now. the rain has moved on after a bit of a messy morning commute. now some big changes are in stored. tracking warmer temperatures and the potential for damaging winds, paul? >> it is always something and it will be ushered in and they will kick in late tomorrow into thursday. let's add up the amount of rain because it's the back-to-back systems that dropped parts of the north valley, and maybe other amounts that were not quite that high and a nice amount of rain for marin county. and about three quarters of an inch for half moon bay and just over half an inch for downtown san francisco. and over the past 48 hours or so and now that rain is climbing down. 5:00 tomorrow is the wind advisory that will go into effect through 11:00 a.m. on friday

and for most of the north bay and the east bay including the foothills to the east of san jose as well. and the highest elevations, the valleys are talking mostly 20 to 30 miles an hour wind gusts. but again this is associated with the increase in our temperatures that are going to be noticeable tomorrow just a couple degrees above average. and by wednesday afternoon with more of a climb, more noticeable by the end of the week, continuing into st. patrick's day weekend with that full seven-day forecast in a few minutes. and with breaking news on the presidential election. the deal is just about sealed. a rematch for the white house. no big surprise here. but biden has now won enough delegates to win the democratic party nomination. that is the latest projection from cbs news and from doing the same on the republican side. georgia was just called for both of them. georgia is, of course, the state where trump is facing charges for his efforts to

overturn the 2020 election results after biden won the state. >> i'm going to go out and pick the best option. and it doesn't matter what happens today and that i don't believe that. >> the polls are still open in washington state and hawaii and trump is set to become the first candidate, to clinch them three straight times. they did it on the democratic side back in the late 1800s, liz? >> all right, thank you. on capitol hill today, lawmakers on both sides of the aisle had questions for special counsel robert hur. hur testified about his report looking into biden's handling of classified material. natalie brand has the details from washington. >> reporter: lawmakers grilled former special counsel robert hur for hours after the investigation into biden's handling of classified documents after the end of his

vice presidency. >> what new information did you learn? >> what new information? nothing. >> reporter: in the end, republicans and democrats heard exactly what they wanted to hear. >> joe biden kept classified information and failed to properly secure classified information, and shared information with people he wasn't suppose to. >> and that report says it all that we conclude that no criminal charges are warranted in this matter. >> reporter: committee members use the hearing to take shots at each other's candidates. republicans alleged a double standard with former president trump facing criminal charges. >> the fact that the only person being prosecuted happens to be the political opponent, which will make this an unprecedented assault on our democracy. >> reporter: even hur's report points out key differences in the trump case. >> according to the indictment, he not only refuses to turn the documents for many months, but also obstructed justice by enlisting others to destroy evidence and to lie about it. >> reporter: democrats criticized her for

characterizing biden as an elderly man with a poor memory. >> you made a choice that was a political choice. it was the wrong choice. >> reporter: hur defended the assessment as necessary. >> what i wrote is what i believe the evidence shows, and what i expect jurors would perceive and believe. >> reporter: hur resigned from the justice department following the investigation. >> today the white house council says it is time to move on, pointing out that hur was a trump appointed federal prosecutor. former president trump meanwhile said today that it is unfair that he is facing charges in his classified documents case, while biden is not. still ahead an unusual hazmat emergency in the east bay today. the concern over abandoned tanker trucks in contra costa county. everything flew up and what went down. it was like very shocking. >> we are hearing from passengers on board a boeing jet that made a sudden plunge as the company safety record comes under scrutiny. and we'll take you to the

the faa says an audit of boeing's production of the 737 max jet has uncovered a number of issues. the agency has given boeing until late may to come up with a plan to fix those problems identified in the audit and other reviews. we are now hearing from passengers on board that boeing flight that suddenly plunged during a flight from australia to new zealand. 50 people were hurt. they called it a technical event, causing him to briefly lose control. and it felt like, you know, when you are in a roller coaster and you go like this? that sensation. and everything flew up and went down. it was very fast. >> that plane was a boeing 787 from chile. meanwhile a flight bound

for sfo yesterday had to make a sudden return to australia. united says the plane had to turn around because of some sort of maintenance issue. first responders were seen assessing the tire area of the boeing 777 plane once it landed. hazmat crews in martinez investigating a mysterious liquid were finally able to identify the substance as cooking oil. the crew had been investigating an abandoned trailer near the water treatment plant on pacheco avenue since this morning. authorities asked neighbors to shelter in place while they looked into it. since then the hazmat crews were able to take a sample of the substance and do some testing. they eventually determined that the fluid was not hazardous. caltrain has tested their trains. the agency says the test runs started at 5 miles per hour to make sure the train and overhead wires were properly connected. caltrain says they aim to complete a

in school yesterday on fresh powder, so that was awesome. and now we're here. >> reporter: mother nature has not been convenient for this skier schedule. >> it keeps cramping my styles because that's when i could normally come up. just make for a great day today. >> reporter: unpredictable and unsettled weather for the rest of the day. get on the website to check the latest road conditions. back to you in the studio. >> thank you. rain a little bit closer to home here in the bay area d. you say a heat wave is coming? >> not necessarily a heat wave, but spring officially arrives a week away. we'll get a little early jump with that with temperatures jumping into the 70s across much of the bay area. not quite yet today. we do have emerging blue skies overhead giving way to those clearing skies. partly cloudy tonight with some patchy fog to begin the day tomorrow. once that clears out, we'll see plenty of sunshine and temperatures will start to warm

up tomorrow. more noticeable by thursday and friday. gusty offshore winds are going to kick in on wednesday night into thursday, continuing thursday night. that's why there is a wind advisory in effect. it will be dispersing all the pollen that the plants have been generating recently and the rain has helped keep that pollen count in check. now with the longer stretch of dry weather, it will be climbing significantly. and we're going to see a huge climb in our solar electricity generation numbers, basically making the most of 12 hours of daylight as we head towards the spring equinox. pretty much towards the top of the scale is possible this time of the year. this is from black mountain looking towards san jose. it's one of the warmer spots in concord and santa rosa. not a whole lot of variation in the upper 60s. clearing skies overhead and even that patchy fog would not happen. it would start the day wednesday with temperatures beginning mostly in the 50s, and some valley

spots dipping down to around 40 degrees. with that sunshine, temperatures will warm up. it will be a bit more noticeable tomorrow. that's why the wind advisory goes into effect at 5:00 p.m. here are the temperatures and the expected wind speeds during the afternoon. 67 degrees in san jose. but you see most of the winds are going to be less than 15 miles an hour. so not too strong yet for the bulk of the day. temperatures mostly reaching into the mid to upper 60s inland. even above 60 degrees at half moon bay. and for the north bay, temperatures are also going to reach up into the mid to upper 60s. we will sprinkle in a few more 70s. that will be beginning on thursday with more of those on friday. but the winds are what's going to occupy our attention in terms of any damaging weather potential for those inland locations, but you can see in our hour-by-hour clock on thursday, the strongest winds will be through the daylight

hours on thursday with gusts shaded in red. it's not strong enough to result in any significant power threat or wildfire threat either because of the humidity levels. because they will be low, they will not be critically low. we will see the numbers struggle overnight early tomorrow morning. we're staying above that 20% threshold. plus all the fire fuels recently have rob suffered a ton of moisture. one more day in the medium high category tomorrow. thursday, friday, saturday, the top tulipants of pollen. not that time of the year for ragweed just yet. beginning on friday, temperatures will continue through st. patrick's day weekend and the first few weeks ahead. windy conditions wednesday night, thursday. the only flaw in the forecast, otherwise it looks like it will be really nice. temperatures

opening day is just a few weeks away. the a's will play at the coliseum for one more year. after that their future is uncertain. the team just released these new renderings of the proposed ballpark in vegas. now the plan has drawn a passionate response from fans who want the team to stay rooted in oakland. one long-time fan is now tapping into that passion. arnold cole introduces us to the man who loves the a's so much he started a business around them. >> reporter: since the days of the bash brothers, bryan johansen has loved the a's. when a 2020 new york times article bashed the oakland coliseum, bryan took the negative things they had to say and turned them into a positive. >> they compared the coliseum to a dive bar when all the

stadiums are cocktail lounges. we decided to make a banner of that. little did we know the graphic was going to go viral. >> reporter: not only did it go viral, but it became profitable. banners, pins, calendars. all inspired by the coliseum. a new business was born. >> it was magical, you know, estimated 15,000 to 20,000 that was there. you had past players, all the oakland teams that were there. over 60 vendors, community members. >> reporter: some said it was the best fan fest they've f been to. sadly it could be their last. after 2024, fans won't have a place to call home. will they travel to vegas, salt lake city, or even support the team at the coliseum for the next four years knowing a new vegas ballpark will be ready 2028. for loyal fans, this project is heartbreaking. >> it's horrible. it's like
