what? it is on its way to becoming more magical as it clears a hurdle for an expansion. of course, not everyone is thrilled. >> we have the pollution, the noise, the traffic. >> reporter: this is cbs news bay area with juliette goodrich. >> we begin with the infamous scott peterson case. more than 20 years after he was convicted of murdering his wife, laci, and unborn child and dumping their bodies in the san francisco bay. scott peterson was back in court with a brand-new defense team again, trying to prove his innocence. he appeared via zoom, wearing a blue prison suit, hair pulled back in a ponytail. proceedings low key and mostly attended by media. a stark contrast from what we saw two decades ago. it started in 2002 when a pregnant laci peterson disappeared right

before christmas. her body found in the bay months later. he was convicted of murder, sentenced to die but four years ago the sentence was overturned and peterson was ordered to serve life in prison without parole. the l.a. innocence project took up the case back in january suggesting that some evidence may have been overlooked. we were in court today in san mateo county. >> do we have your consent to proceed via zoom this morning >> absolutely, thank you, your honor. >> reporter: scott peterson appearing before a judge from prison as he seeks to fight his murder conviction with the help of attorneys from the l.a. innocence project. that is paula mitchell representing peterson. back in 2004, he was sentenced to death after he was convicted of murdering his pregnant wife, lacy and unborn son, conner, in 2020, the california supreme court overturn today sighting errors

with the jury process, a judge resentenced him to life in prison without the possibility of parole. in 2022, his defense team pushed for a new trial based upon an allegation of juror misconduct. after a series of hearings a judge did not grant him a new trial. then, at the beginning of 2024, the l.a. innocence project filed three motions including a request for post conviction dna testing and a request for reasonable discovery. >> we were very, very specific. we spent a lot of time trying to susout what is alarming defenses those are the items we are requesting. the nation is not a fishing expedition, they are precise and specific. >> reporter: dna testing is another part of the claim. access evidence connected to a burglary near his home that was around the time of laci's disappearance. >> if that testing shows what they think it is going to show,

it is a whole new ball game, so to speak. >> reporter: she says the fact that the l.a. innocence project even took on peterson's case is significant. >> that organization which only represents people who the project believes is innocent and can be exonerated by dna evidence has taken this up. >> the hearing date on the motion can be earlier. >> reporter: the supreme court judge hill set three hearings, one of the few times we heard peterson speak, when he opted to appear virtually for those hearings. >> that is fine, thank you, your honor. >> reporter: his sister-in-law and advocate was present but did not address the media. the statement was read, we have not commented on our motion and we will continue to present our case in court where it should be. >> peterson will be back in the courtroom, appearing virtually in april, may, and july. >> the whole thing feels like

yesterday, doesn't it? we should note the l.a. innocence project that is representing peterson is different from the innocence project that is not involved. so, for background on the case. over the years and more from today's hearing you can head to our website kpix.com. if you have noticed a slow down in is service lately, copper thieves might be to blame. the sheriff deputies say they busted two people this morning stealing copper wire from the rail lines in san jose. it is one of two dozen similar thefts just this year causing more than half a million dollars in damage. they say not only does it disrupt service but it is a safety hazard. >> we have to slow or stop the trains to make the repairs in the effected area. >> we have to protect the workers making repairs in the general public. deputies are asking riders to look out for copper thieves,

if it looks like someone is carrying something like a water hose it could be copper. some popular snacks may disa pore from school cafeterias across california. assembly member, a southern california democrat introduced a bill that would ban artificial dyes. he points to a 2021 study from the california protection agency that linked synthetic dyes to behavial problems and other health issues. >> the science is complicated but the purpose of the bill is not. protecting our students from chemicals that proven to harm children and interfere with their children to snroorn dorit on, s. flaming hot doritos, taki's, it is not a ban on the snacks it is a ban on the dyes. the assembly member was banning certain additives. now, that this data,

it shows 84% of californians have a high school diploma. a father of four is trying his hardest to be part of that statistic. in fact he has been studying up through the library. the program is now in jeopardy because of a lack of money. >> reporter: for me this is my high school. i know it looks like a kitchen. >> reporter: he is living out his high school dream. more than 30 years after dropping out. monday through friday cruz sits down for four hours straight, taking math, science, english and social study classes one after another. it is all part of a high school equivalency program run by the san jose public library. it allows him to work for his diploma right from his kitchen table. >> does not matter if it is math or science or history or

english. i am trying, i am trying my best to do a semester every week. >> reporter: he immigrated from mexico as a teenager with only a middle school education, he never went to high school because he had to work and send money to his parents back home. he married, raised a family and never found time to go back to school. he frequently took his kids to the library to help them succeed and they became high school and college graduates. >> he wears the school. >> his daughter, who now works at ibm volunteers at the library to teach english as a second language. it was at the library his other daughter, ashley, found out about the program and encouraged her dad to sign up. after years of getting turned down for better jobs because he had no high school diploma, he needed no convincing. >> i just applied to the program and they answer me

right away. the career online high school program graduated 155 adults since 2016. it has a 70% graduation rate, the highest in the nation for similar programs. full scholarships are awarded to each student. there is a waiting list to get in. the library's educational programs like this are in danger of downsizing or cuts. >> the funding for our librarieses it is a biz malcompared to our surrounding neighboring library systems. >> reporter: heading the library foundation that aims to raise $700 million a year to keep the high school program and others afloat. >> the high school program is almost entirely funded with fill . even with coaches that check in, are volunteers. >> i really, really, really

need this certificate. >> reporter: he started his program about the same time his 16-year-old son started in-person high school and pulled ahead of him in credits. >> it is going to feel a little weird because he took a shorter amount of time. >> reporter: he recently became a u.s. citizen and on track to graduate this summer. he hopes to get a job in san jose. >> they keep asking for a ged certificate. so i decided just to start over with the classes. >> reporter: he and his family owe a lot to hard work, dedication, and education and much of that was done for free at the library >> april 3rd, designed to raise awareness of all of the education that public libraries have to offer and raise money to support them. the next time you go to disneyland there could be more to explore. the big expansion

businesses. >> we are almost impacted by the pollution, the noise, and the traffic. >> reporter: dozens of neighbors lined up to speak out about disneyland forward at a planning commission meeting to possibly expand the number of attractions at the park by 50%. >> this is all land that disney already owns, they are not buying any additional land from the city. not requesting any additional land. land they already have. >> reporter: the commission met for hours with presentations, questions, concerns as the theme park offered renderings to turn existing parking lots already owned into attractions on the southwest side and the west side of the park where two hotels just opened. disney wants a public street called magic way that some neighbors say is their quickest way to the freeway. >> it is streets that really are primarily used for the visitors that come into the disneyland properties. >> for those that do not live here, many can not help but disney dream about a $1.9 billion project. >> i am excited for anything. means snow free weather for the sierra. spending st. patrick's day weekend up there. it looks crowded with everybody trying to take advantage of the fresh powder. nice view of downtown san francisco, patchy fog in the distance. we will see that as we head into tomorrow morning, some of the left over moisture of the rain over the last couple of days, now, heading into a drier, windier pattern. the winds kick in late tomorrow into thursday and early friday. then, we are going to be seeing a calmer pattern and warmer weather heading into the weekend itself. plenty of pollen across the bay area into the high category for the pollen count, thursday, friday, saturday. the windiest conditions occurring thursday into late thursday night. the map here at noon on thursday, we will have numerous 30-40 mile-an-hour gusts, higher elevations of the north bay and the east bay. winding it forward. temporarily, the

winds will pick back up into friday morning. before the sun comes up, 40-45 mile-an-hour gusts, some of the higher elevations, the east bay, once we are passed midday on friday. the winds noticeable, they should retreat, it goes into effect until 5:00 tomorrow and goes through 11:00 a.m. on friday. 20-30 mile-an-hour gusts for most of the valleys, that is where the wind gust approaches. be prepared for that. your lawn chairs might move around if you have that out. here is looking west on the mark hopkins hotel. middle to upper 50s on the map right now. dropping down mostly to the 40s by early tomorrow morning, but, with clearing skies over head, before the fog develops, temperatures inland in the north bay, the valleys collecting colder air dipping into the upper 30s. taking a look at tomorrow's forecast. high temperatures, warming up quickly. we will end up 1-3 degrees above normal after that

chilly start. upper 60s. mostly upper 60s in the santa clara valley. east bay, 63 for antioch and in concord as well. the temperature for both fremont and redwood city, hitting the 60s, lower 60s at half monbay. middle -- half moon bay. then you get the downsloping winds, the temperatures will climb faster than everybody else. cold spots in the morning and the warmest in the afternoon. the warming trend is just getting underway. the peak of it over the weekend. into next week. 10-day temperature outlook for san jose. one of the warmer spots around the bay area. middle 70s, even a trip into the upper 70s on monday. then, down the other side of the roller coaster back towards normal by the middle and end of next week. fantastic weather for st. patrick's day weekend. a lot of stuff going on. parade downtown in san francisco. market street, the temperatures

will start in the lower 60s. climb up to the middle to upper 60s with plenty of sunshine. the winds not as strong. it looks great. into the lower to middle 70s over the weekend. let's check out the inland forecast first for the entire bay area. a long stretch of temperatures into the 70s. just barely, continuing into the beginning of next week. not lasting forever. enjoy the taste of springtime. spring arrives a week from today in the evening. a little earlier thanks to leap day happening this year. march 19th for the first day of spring. around the bay, temperatures not as warm. up to around 70 degrees for several consecutive days and a cool down as the onshore breeze gets stronger. of course, a greater impact along the coast. the temperatures staying out of the 70s. you will be well into the 60s. additional clouds going with the breeze on monday and tuesday of next week. just a really nice forecast. you

. tonight, several bay area government agencies will discuss how to push back against a plan to end at&t land line service in california. proposal has been criticized over the impact during disasters and on people in rural communities. the supervisors in santa clara and napa county and the berkeley city council are discussing the issue today. the house is expected to vote tomorrow on a nationwide tiktok ban that already has bipartisan support the bill would effectively give the social media company six months to cut ties with byte dance, the chinese-linked parent company or face a nationwide ban. lawmakers said they are concerned that the company's foreign ties pose a security risk. >> we know that people enjoy the platform, we know small businesses use the platform. having the chinese communist
