over the financial brink. a growing number of california homeowners are being forced to turn to the so-called fair plan as insurance companies leave the state. this latest blow came last week when state farm announced it would not renew 72,000 policies across the state. john ramos has the heated debate over possible solutions. >> reporter: the california fair plan was created in 1968 as a place for people to get fire insurance when no one else would offer it to them, but now with climate change so many people have entered the program that just one major wildfire could wipe out every last dollar in the program. catastrophic wildfires have turned areas that were never seen as high risk into places where fire insurance isn't even available. sacramento is beginning to see the scope of the problem. last week the california department of insurance held a hearing about

the state of the fair plan and those who run the program didn't exactly have good news. >> the fair plan continues to grow in size as consumers find themselves without coverage. as a result, we have doubled in size in the last three years. >> reporter: by law every insurer operating in the state has to participate in the fair plan, but if losses exceed the plan's funding, the rest must be made up by the insurance companies who will pass it on to consumers as a surcharge. insurance broker carl sussmann says the size of the fair plan now makes that inevitable. >> fair plan has about $300 billion in total exposure, meaning how much they actually insure, and about $200 million in the bank. it's not hard to see that in the event of a large, catastrophic event they won't have the funds to be able to pay for it. >> for many companies this financial burden will be too

great and they may result in them pulling out and no longer writing insurance in the state. >> reporter: that's already happening. state farm just announced it will not be renewing another 70,000 policies in california. so the state is creating what's called the sustainable insurance strategy, changing regulations that would allow insurers to charge more for homes in high risk areas. >> what this is going to do is it will allow carriers to come back into the market. right now we have rates that are extremely high and this is what happens when you don't have competition, right? when you have basically no private industry working and people are relying on the fair plan, their rate's going to be high. so once the carriers all come back and start competing again, we'll see rates come down. >> reporter: but harvey rosenfield, the founder of consumer watchdog, says the insurance companies are intentionally forcing homeowners into the fair plan as a way of getting every homeowner in the state to pay

the fair plan's losses. >> from our point of view, we see this as creating a scare tactic to create an opportunity for the legislature to bail the insurance industry out by forcing every homeowner in the state to pay off the debts of the fair plan whether you're in a risky area or not. >> reporter: as wildfires grow in size, so does the cost of recovery. it is a cost that will eventually be borne by everyone which means no one will be very happy about it. >> tomorrow the department of insurance will hold a public hearing on the first set of guidelines for the new sustainable insurance strategy. i'm anne makovec in the newsroom following a couple healthcare strikes around the bay. hundreds of healthcare workers in daly city hit the picket lines today for a two-day strike. >> a little bit louder, three. we want justice for our -- >> now workers walking off the

job at seton hospital are demanding better benefits and ongoing negotiations. workers say the new health plan makes it hard for them to find hospitals that take their new plan. >> they do not accept our insurance here. i have been trying to get an mri myself and i have been unable to get authorization for that. >> we work for a hospital and we're not getting -- the workers are not getting proper healthcare. what does that say about the hospital? >> in a statement seton hospital said, "we are disappointed with the union's decision to walk off the job in the middle of our contract negotiations at the expense of patient care, despite seton medical care offing great pay, substantial benefits and time off." in santa clara county nurses are planning a three-day strike next week. workers say they want better pay and benefits. they say without it they aren't able to afford living where they work or able to recruit or retain new nurses to the area and they say they

do want better staffing levels. the county says they are working to minimize disruptions to health services if there is a strike getting temporary replacements for people on the picket lines. >> the county remains steadfastly committed to reaching a fair, sustainable contract with our nurses who are extraordinarily dedicated professionals who deliver the highest quality care to those in our community, especially the most vulnerable given the safety net services that the county operates. >> county administrators say they are facing a $250 million budget deficit, though, for the next fiscal year. to san francisco now where two people were found dead in the city's portola neighborhood. police responded for the report of a shooting last night on dwight street near san bruno avenue. so far no word who the victims are and

who arrests have been made. also in san francisco, one person was hurt after a car crashed into a bus stop near golden gate park saturday at fulton and park presidio. the victim was hospitalized but is expected to recover. the driver of the red nissan was cited at the scene. police have not said what led up to the crash. this all comes just a week after a driver crashed into a bus stop, killing a family of four in west portal. a high schoolteacher in san jose was arrested for rape and sexual assault charges police say happened more than 20 years ago. the suspect, shawn thomas, was a teacher at leigh high school in san jose as well as track and field coach at los gatos high. the assault happened between 2002 and 2003 police say with a female student at leigh high school. thomas was still a teacher there at the time of his arrest. >> a lot of questions will be asked why did it take so long? why are we investigating something that happened

sometime between 2002 to 2003? again, there is no statute of limitation for a crime so heinous as taking advantage of a juvenile, someone especially a person of trust like a teacher, like a coach. >> san jose police say they hope any victims of sexual assault can come forward no matter how much time has passed. in alameda county a teen accused of killing two brothers at a birthday party will be charged as a juvenile, that decision sparking anger from the victim's family. >> there's nothing anybody could do to bring back angel and jc. they can help us heal, help us feel as though there has been justice and closure for our boys. >> coming up at 5:30, the passionate debate over whether a teen should face the possibility of life in prison. we have breaking news right now. our chopper 5 is live over a crash at lakeshore and beacon in oakland. you can see a car has overturned and several people are out there, a huge

response of emergency crews. >> you see fire, police, ambulance. we're hearing four people are in custody and we are still working to get more details. once we get them, we'll bring them to you. switching gears and turning to the weather, a dry start to the workweek after on and off rain throughout the weekend. >> if you have outdoor plans this evening, go ahead, but we are tracking a pretty active pattern this last full week of march. let's look at futurecast and start the clock at 11:00 tomorrow evening because tomorrow looks like another dry day, but showers will move in wednesday with a band of heavier rain wednesday evening and early wednesday night. this will be a snowmaker for the sierra, but it's just the beginning of the unsettled pattern that carries us into easter weekend. we get to enjoy dry seasons this weekend. there is a preseason edition of the

battle of the bay tonight 6:40 p.m. at the coliseum between the giants and a's, mid-50s, layer up a bit, but you'll be dry and tomorrow also looks dry with near normal late march temperatures. everybody is within a degree or two of average, 60s across the entire bay area by tuesday afternoon. the big changes do arrive wednesday. we'll zoom in for a closer look at futurecast with that system and how much rain adds up over the next several days in a few minutes. >> thank you. in less than one month donald trump could become the first former u.s. president to face criminal charges in front of a jury. nicole scanga has the latest on the legal battles facing the republican party's presumptive presidential nominee. >> a lot of things happened today. this is all about election interference. were with former president trump addressed the media after spending the morning inside a manhattan courtroom. trump is accused of falsifying business records to cover up payments to adult film star stormy daniels who claims she had an affair

with trump. trump's lawyers were seeking to delay the trial, but judge merchan ruled jury selection will begin april 15th. >> i don't know how you can have a trial going on right in the middle of an election, not fair. >> reporter: trump did win a break in a separate case. an appeals panel ruled the nearly half billion dollar bond that was due monday can be reduced to 175 million and he'll have ten extra days to pay it. >> the appellate division was fair. it's a lot of money still. >> reporter: the presumptive gop nominee has already issued a fundraising appeal celebrating the reduced bond judgment, but he also claimed to supporters that they still want to arrest, fine, and stop him from running for president. >> if he's convicted, i will still vote for him. >> reporter: cbs news spoke with wisconsin voters as early voting is underway in that state's primary. many are looking at the likely november rematch between trump and president biden and don't like

their choices. >> if it's just between them two, i would pick trump, but yeah, no, absolutely, i'm concerned about it. i wish there was somebody else on the ballot. >> reporter: trump's april 15th trial date comes one week ahead of pennsylvania's primary which will be a battleground state this fall. >> trial dates are still pending in the three other criminal cases former president trump is facing and that includes one in the state of georgia and two federal cases. happening tomorrow in oakland, independent presidential candidate robert f. kennedy jr. is expected to announce his running mate. the list of potential vp picks include nfl quarterback aaron rodgers, former minnesota governor jesse ventura and former congresswoman tulsi gabbard, but the oakland times say nicole shanahan is a potential frontrunner. four men accused of carrying out a mass killing in

a russian concert hall appear in court. three suspects admitted to carrying out the deadliest terror attack in the country in nearly 20 years. more than 130 people were killed on friday night when men in combat fatigues burst into the concert venue near moscow and methodically began shooting the audience before setting the building on fire. isis has claimed responsibility for this. u.s. officials say they warned moscow a few weeks earlier that isis was planning to strike. experts say vladimir putin has not addressed the glaring failure of his security forces. >> not only did they fail to prevent the attack, but the response was sluggish with it taking almost an hour for federal forces to arrive at the site. >> putin has implied without evidence that the gunmen planned to flee to ukraine. u.s. officials say russia needs ukraine as a scapegoat to take attention away from their own failures. developing right now, israeli's defense minister is

in washington to meet with u.s. secretary of state antony blinken to discuss the conflict in gaza. it comes several hours after the u.n. security council passed a new ceasefire resolution. it demands an immediate ceasefire leading to a permanent sustainable end to the fighting and the unconditional release of all hostages from gaza. the u.s. abstained from the vote while other members voted in favor. two israeli prime minister benjamin netanyahu's top advisers were supposed to arrive in washington tonight. netanyahu canceled their trip after the u.s. decided not to veto the u.n. resolution. still ahead, a man dead and his brother severely injured after a rare mountain lion attack, we're now learning more about the victims, including how they fought to save each other during the horrifying incident. >> the information they had was the brother was pinned down and the lion had ahold of his neck. this afternoon federal agents spotted at this california mansion of a world famous music mogul, what we're learning about the raid

the feds have raided two homes belonging to hip-hop music mogul sean diddy combs. this is all part of a possible ongoing sex trafficking investigation. you can see homeland security agents around his home in homely hills in los angeles county. at one point a s.w.a.t. team was seen pulling a man in handcuffs away from the home. right now it's unclear if he was arrested. federal agent also raided combs' miami home setting up a command post right outside the property. combs has faced multiple sexual assault allegations in recent months. he has denied those allegations. now it's unclear what the feds are searching for, but the probe is led by the new york's homeland security investigations.

we're learning the brothers attacked by a mountain lion over the weekend in el dorado county, the brother who was killed has been identified as 21-year-old taylen brooks. his 18-year-old brother wyatt survived that attack. tori apodaca has more on the gruesome scene. >> a brother is a friend given by nature. these two brothers were driven by nature. >> reporter: the words from the family of the brooks brothers, taylen on the left and wyatt on the right, attacked by a mountain lion while out deer antler hunting on this trail on darling ridge road near georgetown. >> they fought for each other and did everything they could. >> reporter: the sergeant said the young men didn't have any antlers on them when the mountain lion came up from an embankment saturday onto the trail. >> and they did what they had always been taught to do. they raised their hands in the air. they yelled. they made themselves appear bigger than what probably the mountain lion thought that they were. >> reporter: wyatt even threw his backpack at the mountain lion to try and scare it off,

but instead it charged at him. >> the mountain lion attacked wyatt first and taylen out of that love for his brother began to attack the lion to try to get it off while wyatt was defending himself, also. >> reporter: the family says the mountain lion had bit wyatt in the face and clawed at his stomach. once it released him, it went for taylen's throat taking him to the ground. that's when wyatt returned the brotherly love and tried to grab the lion to release its grip on his older brother, braving it until he couldn't any longer. >> it's tragic, tragic for the community. >> reporter: first responders found the caught crouched by the body of taylen who laid dead. it sounds like the boys did everything right. so why did the lion still charge at them? >> i wish i could answer that question. >> reporter: it took the dogs

40 seconds to sniff out the lion 100 yards away from the attack and they killed it. dna testing matched the lion carcass to the sample taken from the scene, confirming they got the correct cat. >> we hear them all the time in the summer at night screaming. it's a little unnerving. >> reporter: taylen being remembered by his family as a talented young guitarist and wyatt on a long road to recovery after surviving a killer cat. >> you never know when your last day is. so just enjoy those that you're around with. live look at oakland coliseum where the a's are about to begin what could be their final season in the coliseum. oakland has a preseason match-up tonight against the giants. tomorrow the bay bridge series heads to san francisco. at 6:00 we'll hear from a's fans who have mixed feelings as the season gets underway. the stanford women's basketball team is advancing after a memorable battle in the ncaa tournament last night. >> yeah. today we learned who

the cardinal will face in the sweet 16. matt lively joins us now with all the details. >> after an overtime thriller last night in maples pavilion, stanford headed to portland to face north carolina state in the sweet 16. the wolfpack were cruising early up 18 at half on six seed tennessee. the vols fought back and cut the lead to two. final minutes baldwin with the bucket and foul puts the pack up seven. nc state wins 79-72 and sets up a future acc conference match-up with the cardinal. last night 49ers quarterback brock purdy was at maples pavilion rooting on his iowa state cyclones, but stanford stepped up in overtime. fine seconds brook demetri knocks down the huge three putting cardinal up two, stanford twinning 87-81 led by a career high 41-point performance from kiki iriafen. we'll have more on her big game a little later in sports and the men's program just

named a new head coach, but for now the women's season isn't over yet. that was such an incredible game. i was so happy i was there, electric atmosphere at maples. >> vanderveer called her a warrior. she just was lit up. >> she was awesome. she's from l.a., liz. >> there you go. an awesome group of girls. >> thanks, matt. let's check in with first alert chief meteorologist paul heggen. >> we've got a system heading towards us by wednesday, but we have one more dry day ahead of us tuesday. kind of soak it up. there will be gaps in between the waves of rain later in the week. wednesday, thursday, friday, saturday, and sunday is at least a chance of showers in the forecast every day. the first best chance arrives wednesday. this storm system will send a lot of energy to our north. it will be close enough to send rain into the bay area and pick up the wind gusts as well. we've had the sunshine today. our solar

electricity generation numbers have been doing pretty well once the morning cloud cover and fog broke up. we'll see more sunshine tomorrow and the numbers drop wednesday as clouds and showers arrive back in the forecast. a look outside now, not sure which camera this even is, just pointed at the sky, 50s and low 60s, a little cool for late march, but tomorrow looks like we return to almost exactly normal high temperatures, a little fog to start the day tomorrow. futurecast doesn't indicate it becoming too much of an issue for the morning commute. that won't take long to dissipate out of the inland valleys. we'll see sunshine midmorning through midday into the afternoon. low temperatures tonight dropping to the 40s by early tomorrow morning, very close to normal for this time of year, showed you a little earlier high temperatures tomorrow also very close to normal, pretty much everybody in the 60s. let's talk about the next chance of rain heading our way. futurecast as we look ahead does show cloud cover beginning to thicken as we go through tomorrow evening. we're still dry tuesday evening and

tuesday night. the next good rain chance is going to arrive in off-and-on showers during the daylight wednesday and the widespread rain holding off until late afternoon and evening showers with snow flying in the sierra and a little break in the action taking hold. thursday, still a chance of off-and-on showers. it doesn't look like a total washout. another system looms for friday and that will bring more wind energy to the bay area. the winds on wednesday are going to pick up. we're tracking wind gusts from 11:00 wednesday morning through 5:00 thursday and it's really the late afternoon and evening time frame we see the orange tiles indicating wind gusts over 20 miles an hour, not strong enough for significant impact, but strong enough it will try to move you around on the wet roads during the evening commute wednesday. adding up the rain over the course of the next several days, this first system it's going to bring a 0.1-inch to a quarter inch for

inland spots, quarter to half inch on the higher end of the spectrum. on friday the system will be more substantial and the weather friction center outlined a marginal risk of excessive rainfall. there is an elevated threat of maybe a little too much rain falling in a fairly compressed amount of time. that would lead to at least an outside chance of maybe some localized flooding, but widespread flooding does not look like a concern with i in of these systems, just something we'll keep an eye on. another dry day tomorrow. we're putting the finishing touches on the seven-day forecast. i'll have that coming up during our 5:30 half hour. >> paul, thank you. while some businesses are leaving oakland over crime concerns, a pair of natives are opening up shop, how they hope to show the town has much more to offer. >> oakland probably has one of the biggest hearts. the contra costa ice cream parlor celebrating its gr
