is tasked with deciding the former president's fate. the key takeaways over the evidence and credibility of the prosecution's star witness. a bank building blows up. the explosion caught on camera. breaking information about an overnight discovery. and texas in the bull's-eye again. strong storms with damaging winds and hail pound the state still reeling from an unrelenting parade of violent and deadly weather. good morning, and good to be with you. i'm anne-marie green. this is it. after 21 days, 22 witnesses, and hundreds of pieces of evidence, we are just hours away from a jury getting the historic case of new york state versus donald j. trump. this morning the judge will instruct the jury. they will then begin deliberations to decide if the former president falsified business records tied to the stormy daniels -- to stormy daniels, rather, and if those payments were made to cover up another crime -- conspiracy to violate a state election law.

cbs' naomi ruchim is joining us from outside the courthouse in lower manhattan. good morning. >> reporter: anne-marie, good morning. court is set to reconvene here at 10:00 this morning after a very long day yesterday. at that point the judge will talk through all of the intense legal issues that the jury must consider in this case. that's expected to take about an hour, and then after that the former president's fate will be in the hands of this jury. today judge juan merchan gives instructions to the jury, and then they'll begin deliberation -- deliberations in former president donald trump's manhattan criminal trial. >> we'll see how it goes. >> reporter: trump is charged with 34 felony counts of falsifying business record to reimburse ex-fixer and key prosecution witness michael cohen who paid adult film star stormy daniels $130,000 to keep quiet about an alleged sexual

encounter in the lead up to the 2016 election, all of which trump denies. in his three-hour closing arguments, defense lawyer todd blanche attacked cohen's credibility calling him the gloat, greatest liar of all time. >> the jurors by closing arguments have a good idea of how they feel about the case. they are looking strictly at what's the evidence, what do i need in order to do my job. >> reporter: prosecutor joshua st at the -- steinglass argued that the case is about trump, not cohen. in his five-hour closing, he pointed to the evidence his side presented including other witnesses and documents. outside the courthouse, actor robert de niro railed against trump while representing the biden-harris campaign. >> this is the time to stop him by voting him out once and for all. >> apparently he needs attention because it's been a while since he's cranked out a good movie. >> reporter: trump's children came to his defense and made a show of support inside the courtroom.

and if the jury does come back with a guilty verdict, the former president faces thousands of dollars in fines and potential jail time. in this case, the judge has a lot of leeway in terms of what he can sentence, and he did note yesterday that even if there's a conviction, the former president will not necessarily face jail time. anne-marie? >> interesting. naomi ruchim in new york. thank you so much. breaking overnight, a body was recovered from the scene of a massive explosion in downtown youngstown, ohio. the explosion happened yesterday at a building which houses chase bank and several apartments. the man killed was an employee of the bank. seven people were hospitalized, one was in critical condition. witnesses reported smelling gas and hearing a boom. the fire chief said the cause of the blast is still unknown. another night of severe weather across a storm-battered texas. strong thunderstorms swept across the lone star state bringing pounding rain,

baseball-sized hail, and damaging winds. more than 500,000 homes and businesses are without power in texas where an oppressive early season heat wave is adding to the misery. tom hanson spoke with several people who took a direct hit. >> reporter: strong, powerful winds near 80 miles per hour slammed into garland, texas, damaging homes, uprooting trees. one came crashing into this neighbor's house. >> the next one come down on the house. the ceiling, rafters, everything joisting, everything came down. there's water running through there like a river. >> reporter: to give a sense of those powerful wind gusts, 80 mile-per-hour winds picked up this carport and folded it onto the house. the man inside is okay. the storm's power knocked out power to more than a million people across the state, including paige dugan's home where he rode out the storm in the dark. >> we were sitting there hoping and praying the window wouldn't bust. >> reporter: at dallas-fort

worth airport security video captured the moment wind gusts over 75 miles per hour easily spun this empty american airlines 737 away from the gate. there were no reports of injuries. the same storm system demolished this warehouse in terrell, and in hurst, texas, homeowners and drivers were pelted with baseball-size hail. heavy rain pummelled the dallas suburb and caused street flooding in houston as severe weather continues to hammer texas. >> there's been a lot more storms now than any other year. so i feel like it's just -- they're getting stronger. >> reporter: a construction worker was killed after a building collapsed north of houston. tom hanson, cbs news, garland, texas. to the middle east now as the fighting intensifies in gaza's sound city of rafah, the u.s. is defending israel's deadly and fiery attack at a tent camp. while calling the loss of life tragic white house spokesperson

john kirby said it did not cross president biden's red line that would prevent the u.s. for aiding israel. the israeli military, meanwhile, says its initial probe israel's munitions were too small to be the source and is looking at unintentional explosions from a hamas warehouse. as imtiaz tyab tells us in, israel is denying striking another camp near rafah. >> reporter: the grief is unbearable as palestinians weep for their dead after another israeli strike at this camp in rafah. at least 20 civilians were killed, according to the gaza health ministry. a short distance away at a different camp, local journalists report another deadly israeli strike. all the children in the tent were wounded, said this man, not a single one of them came out in one piece. israel insists it isn't behind the attacks on the encampments amid reports it's moving tanks

into rafah's city center. in the skies above, israeli warplanes continue to drop bombs on what was gaza's last safe haven. israel's sunday assault on the camp which killed 45 civilians also triggered a massive fire. a fire which was unintended, according to an israeli military spokesman who said an investigation is under way. while at least one million palestinians have now fled the violence in rafah in the last few weeks alone. a cbs news team met this family fleeing to a fate unknown. "the attack the other night was the darkest night we've ever seen since the war started," she says. "we have nothing to do with hamas." the mass displacement of civilians has triggered a humanitarian crisis the u.n. says it's struggling to contain. as u.s. officials say the $320 million humanitarian pier will be out of commission for at least a week after part of the causeway broke away in rough

originally left the lockheed martin facility in fort worth, texas, and it stopped to refuel. we are learning new details about the deadly shooting of former "general hospital" actor johnny wactor in los angeles. police say the thieves had his car raised on a floor jack trying to steal the catalytic converter when he approached them saturday. investigators say he was shot without any provocation. his former fiancee tessa farrell posted a message to his murderer. >> if you're watching, i'm sorry but you shot the wrong guy. >> so far no arrests have been made. and another american who was arrested in turks and caicos for possessing ammunition is coming home. tyler wenrich of virginia was sentenced to time served and fined $9,000 yesterday. the father of a toddler was arrested in april after two .9 millimeter rounds were found in his backpack as he was trying to board a cruise ship. he expects to fly home tomorrow.

and devastating news for some farmers in iowa. more than four million chickens will have to be killed after a case of bird flu was detected at an egg farm in sioux county. this is the latest outbreak of the virus that has also spread to cattle. the u.s. department of agriculture says more than 92 million birds have been killed since outbreak began in 2022. a rare apology from the vatican. pope francis is saying that he is sorry for reportedly using a slur directed at gay men. italian newspapers say the 87-year-old pontiff made the disparaging remark during a private meeting with bishops. a vatican spokesman said he didn't mean to use the homophobic term and apologizes to all who were offended. still to come, a game changer for major league baseball. the record books will have a new leader thanks to the inclusion of stats from the negro league. leader thanks to the inclusion of stats from the negro league. “r depression made me feel like

here's a look at the forecast in some cities around the country. ♪ major league baseball is expected to announce today that statistics from the negro leagues will officially be incorporated into mlb records, and that means josh gibson replaces ty cobb as the all-time career leader in batting average. gibson also becomes the career leader in slugging percentage, moving ahead of babe ruth. another big retailer cutting prices, and consumer confidence is up for the first time in months. here's shanelle kaul with today's cbs "moneywatch." >> reporter: u.s. stocks closed mixed on tuesday after the market reopened following the holiday weekend. the dow lost 216 points. the nasdaq was up 99, and the s&p 500 gained one point.

new numbers show consumer confidence grew in may. business research group the conference board says the index rose from 97.5 in april to 102 in may. it's the first increase in three months, though there is still concern about inflation and rising interest rates. a major merger in the telecom industry. t-mobile is buying almost all of u.s. cellular's wireless operations and certain spectrum assets in a $4.4 billion deal. the deal would give t-mobile more than four million new customers and is expected to close mid next year. and amazon has become the latest retailer to offer major summer savings. amazon fresh is cutting prices on 4,000 products with rotating weekly deals. the discounts will be available on line and in amazon fresh stores. the announcement comes after target and walmart also rolled out similar savings events.
