the testimony the panel wants to hear again. flag flap. supreme court justice samuel alito is refusing calls to recuse himself from january 6th and election-related cases. and a major move. israel says they have taken control of gaza's entire land border with egypt as we learn new details about sunday's deadly and fiery attack near a tent camp. good morning, and good to be with you. i'm anne-marie green. for the first time in history a jury is deciding whether to convict a former american president. right now it's a waiting game. so far the jury deliberated 4.5 hours in donald trump's so-called hush-money case. when court resumes this morning the panel will rehear testimony from two key witnesses -- former "national enquirer" chief david picker and trump's former fixer michael cohen. cbs' jarred hill is joining us from outside the courthouse in lower manhattan. it's quiet now. about as quiet as it's going to

be out there. good morning. >> reporter: good morning. this tends to be a bit of a zoo outside of the court. so many questions, though, now around what is happening in that jury deliberation room when they are in there. the only clues that we have come in the form of the questions they're asking of the court. what do they want to hear again, some of those answers should come in a few hours. the fate of former president donald trump now in the hands of 12 manhattan jurors. >> mother teresa could not be -- >> reporter: today at its request the jury is expected to have parts of key testimony read back to them from former "national enquirer" editor david pecker and trump's ex-fixer michael cohen. this includes passages related to a 2015 meeting the two had with trump to discuss an alleged scheme to kill negative stories ahead of the 2016 election. judge juan merchan is also expected to reread some of his instructions to the jury today. >> i think they are going to be

quite careful and spend some real time going through the evidence and the instructions. >> reporter: the seven men and five women who make up the jury are deliberating just feet away from the courtroom. no cellphones allowed in the jury room, but they do have a laptop with all of the evidence. during his instructions yesterday, judge merchan told the jury to set aside any opinions and bias in reaching their verdict which must be unanimous. trump faces 34 counts of falsifying business records which prosecutors say was done to hide reimbursements to cohen after he paid adult film star stormy daniels $130,000 to keep quiet before the 2016 election about an alleged sexual encounter. >> they have to come up with with a verdict on each of these charges, so it could take a while. >> reporter: trump denies the encounter and any wrongdoing. if convicted he could face fines and a sentence of up to four years in prison. so remember the jury here is being asked in -- i want to read this to get it right -- if trump

conspired to promote or prevent the election of any person to a public office by unlawful means. they've got to be unanimous in that verdict, but they don't have to be unanimous in exactly which unlawful means they are considering here. deliberation resumes at 9:30 this morning. back to you. >> all right. jarred hill in lower manhattan. thank you so much. supreme court justice samuel alito is rejecting calls to recuse himself from cases involving the january 6th insurrection and the 2020 election. democrats in congress demanded alito step aside after photos surfaced two of flags linked to the so-called "stop the steal" movement flying outside his homes. in a letter to democrats, the conservative justice blamed his wife saying he had nothing to do with flying any flags. he writes, quote, i was not even aware of the upside down flag until it was called to my attention. as soon as i saw it, i asked my wife to take it down but for several days she refused. turning to the israel-hamas war. and israel is increasing its

military forces in rafah as troops move deeper into the southern gaza city. the idf says that they have seized control of an 8.5-mile corridor along the gaza-egyptian border. the military says that they found about 20 cross-border tunnels which they say hamas has been using to smuggle weapons and other goods in for years. meanwhile, cbs news has learned u.s.-made bombs were used in sunday's israeli air strike that led to the deadly fire at an encampment. this is adding to the growing pressure for the biden administration to reassess its military support for israel. cbs' imtiaz tyab reports from east jerusalem. [ screams ] >> reporter: the attack triggered global outrage. horrifying scenes of bodies burned and mutilated beyond recognition. the scale of the devastation caused by the israeli air strike on the displacement camp also raised questions about the type of weapons used. images gathered from the blast

site show the remnants of what three independent weapons experts told cbs news is an american-made gbu-39 warhead with a payload of 17 kilos. all three agreed the distinctive shape of the gbu-39, especially its tail, helped them identify the remains, and that the clearly identifiable serial number or cage code on this specific munition traced it to a california-based weapons manufacturer. >> following the strike -- >> reporter: israel officials said the strike targeted senior hamas commanders and confirmed two munitions also weighing 17 kilos were used. >> absent a complete investigation i can't verify any of this. >> reporter: iensz eyewitnesses say israel is widening its offensive in rafah. tanks have moved into the heart of the city for the first time. and of the over one million displaced from there in the last few weeks, some are making their own shelters out of spent shells which are littered across gaza

in its cross path. the american airlines flight returned to the gate and eventually took off about 4.5 hours late, though. the world's number-one-ranked golfer, scottie scheffler, is in the clear after a kentucky prosecutor dropped all charges related to his arrest at the pga championship in louisville two weeks ago. as cbs' janet shamlian reports, the prosecutor agreed with scheffler the incident was a big misunderstanding. >> reporter: defending masters champion scottie scheffler vindicated. >> mr. scheffler's characterization that this was, quote, a big misunderstanding, closed quote, is corroborated by the evidence. >> guys, guys -- >> reporter: scheffler was booked on charges of felony assault on a police officer and three other criminal counts this month as the 27-year-old attempted to drive into the valhalla golf club after a fatal accident. >> why does it matter if he's a security guard or police officer? >> you're right. i should have stopped.

i did get impatient because i'm quite late for my tee time. >> reporter: his attorney confirmed this is scheffler talking to police after the arrest. the golfer saying he did not know the man was an officer and calling him over aggressive. detective bryan gillis alleged scheffler ignored instructions and continued driving dragging the officer to the ground. but there's no body cam footage. louisville police said gillis never turned it on, a policy violation. scheffler's attorney said neither side will pursue legal action related to the arrest. >> scottie scheffler doesn't want the taxpayers. want the taxpayers of louisville to have to pay a dime. he wishes to move forward from the case. >> reporter: scheffler reacted on social media saying he holds no ill will toward that officer, that he wants to put the incident behind him and hopes the officer will do the same. janet shamlian, cbs news, atlanta. coming up, new accusers against harvey weinstein. what that could mean for the disgraced movie mogul. and an alarming incident in new york city as a car appears to try and run down a group of jewish students.

disturbing surveillance video appears to show a driver trying to run down orthodox jewish men outside a brooklyn yeshiva. the sedan can be seen driving onto the sidewalk and crossing the yard yesterday. the men scrambled to get away. police say the driver used anti-semitic slurs in the incident, and he was later taken into custody. new accusers against harvey weinstein, and an update at scott peterson's bid for a new trial. those are some of the headlines on the "morning newsstand." "the mercury news" reports a california judge denied nearly all of scott peterson's requests for new dna testing. he appeared via video from state prison at his court hearing yesterday. peterson was convicted 20 years ago of killing his wife laci, and their unborn son. lawyers for the l.a. innocence project asked to test more than a dozen items, but the judge will only allow one -- a piece of duct tape found on laci's pants when her body was discovered.

cnn reports new accusers against harvey weinstein have come forward ahead of a retrial. manhattan prosecutors said a new indictment against the disgraced movie mogul is possible. they are actively investigating the claims by the new accusers. weinstein's 2020 sex crimes conviction was overturned. prosecutors were already planning to retry him sometime after labor day. and "the hill" says north korea sent a fleet of balloons carrying excrement to south korea. images from the south korean military showed inflated balloons with plastic bags tied to them. other pictures show trash strewn collapsed balloons. more than 260 balloons were detected. the north said the filthy fleet was sent in retaliation for an airborne propaganda campaign coming from activists in south korea. still to come, a virtual court hearing takes a left turn. how a michigan man shocked a judge in a case over a suspended license.

investors wait to see if new consumer data will bring interest rates down. the dow lost 411 points. the nasdaq was down 99, and the s&p 500 lost 39 points. an urgent warning from nissan about their airbags. the company is asking the owners of about 84,000 older vehicles to stop driving them because there's a risk the takata airbags could explode in a crash and hurl dangerous metal fragments. the warning comes after one person was killed by an exploding front passenger inlitigator in a nissan and as many as 58 people were injured since 2015. the "do not drive" call covers certain 2002 to 2006 centras, some 2002 to 2004 pathfinder suvs, and the 2002 and 2003 infinity qx4 suvs. remember that viral $18 big mac meal?

a top mcdonald's executive now says that price is the exception, not the rule. in a letter posted on the restaurant chain's corporate website, the president of mcdonald's usa said franchisees set menu prices but asserted the average cost of a big mac is up 21% from 2019, and prices, quote, remain well within the range of other quick-service restaurants. and walgreens has become the latest major retailer to slash prices. 1,300 items including snacks and feminine products will be marked down. target, will be marked down. target, amazon, and walmart also recently announced price cuts as they aim to bring an inflation -- in inflation-weary customers. that's your "money watch" report for this thursday morning. i'm shanelle kaul, cbs news, new york. a michigan man learne a tough lesson about what not to do during a court appearance. >> mr. harris, are you driving?
