those coming into the united states illegally. hunter biden on trial. prosecutors using his own voice to narrate his downward spiral into drug addiction. what the defense said about the alleged lie on a federal firearms form. and the southwest is sizzling, and it's not even summer. the first heat wave of the season is here with dangerously hot temperatures soaring into the triple digits. good morning, and good to be with you. i'm anne-marie green. president biden's aggressive new border restrictions are now in effect, and that means u.s. immigration officials can deport large numbers of migrants without processing their asylum claims. it is a sharp policy shift on a critical election year issue that is drawing sharp criticism from republicans. cbs' jarred hill now with more on how this plan is supposed to work. good morning. >> reporter: good morning. actually there's pushback from both sides of the aisle. this is limiting asylum claims

to specific points of entry along the southern border while numbers stay at a certain level. president biden is arguing congressional republicans have basically forced his hand after rejecting the latest border reform bill. overnight a major change to u.s. immigration policy took effect. president biden's new rule partially bans some asylum claims at the southern border. >> to protect america as a land that welcomes migrants we must secure the border and secure it now. >> reporter: the executive action allows the administration ban migrants from claiming asylum if they cross outside of official points of entry along the southern border. this would kick in when daily crossings reach 2,500, giving border patrol the authority to quickly reject and deport thousands of people. the new restrictions would be paused 14 days after the weekly average of daily illegal border crossings drops below 1,500. the last time that happened was in july 2020. >> this is a total disaster by biden. >> reporter: prominent

republicans called the move too little too late, while some progressive democrats argue it's a step in the wrong direction. >> this action falls short of our goal of a just and fair immigration policy. >> reporter: the president says his executive action is also meant to deter migrants from coming to the southern border. but venezuelan asylum seeker ramon eduardo who is still in mexico says he doesn't think the new policy will stop migrants like him from making the dangerous trek north. legal challenges are almost certain. the american civil liberties union tells cbs news it plans to sue to block the policy, calling it illegal. we've got to talk about the politics here. immigration consistently ranks among top issues for voters going into 2024, and naturally in a quinnapiac poll voters said they think former president trump would do a better job handling immigration compared to president biden. also worth noting, this decision from the white house comes less than a month before the first presidential debate. >> good reminder. thank you so much.

testimony resumes today in the first-ever criminal trial of a sitting president's child where we could hear from hunter biden's ex-wife and his brother's widow. hunter biden is charged with three felony counts for allegedly lying on a federal form required to purchase a firearm in 2018. here's cbs' scott macfarlane. >> reporter: an emotional first day in the trial of hunter biden with the first lady and hunter biden's wife seated behind the president's son. prosecutors and an fbi agent witness played long clips of biden's 2021 audio book of his memoirs in which he narrated his descent into crack-cocaine in 2018. >> i used my superpower finding crack any time, anywhere less than a day after landing the l.a.x. in 2018. >> reporter: former federal prosecutor tom dupree -- >> prosecutors will tell you there are few things more effective before a jury than being able to show the jury what the defendant said.

in this case hearing the defendant's own voice describing his struggles with addiction and the fact that he was using illegal controlled substances around the time he bought this gun. >> reporter: prosecutors for special counsel david weiss opened their case telling the six man-six woman delaware jury no one is before the law. addiction may not be a choice, but lying and buying a gun is a choice to. -- choice. biden has pleaded not guilty to unlawfully using a gun while using drugs and making false statements applying for the gun in october, 2018, for not acknowledging drug use at the time. his defense attorney argued the president's son didn't knowingly make false statements because he was seeking sobriety and like addicts experienced a deep state of denial. >> they're trying to point -- to paint hunter biden as someone who was making good faith effort to get himself clean, to get his life back in order. >> reporter: biden's ex-wife kathleen and hallie biden, his brother's widow with whom he was also romantically linked, will

testify and prosecutors warn the jurors it will be embarrassing for hunter biden. scott macfarlane, cbs news, wilmington, delaware. while attorney general merrick garland pushed back against what he calls dangerous attacks on the justice department. he appeared before the house judiciary committee yesterday amid threats from republicans to hold him in contempt of congress. garland accused republicans of spreading false conspiracy theories by suggesting the justice department was involved in donald trump's historic conviction last week by a new york jury. >> these repeated attacks on the justice department are unprecedented, and they are unfounded. these attacks have not, and they will not, influence our decisionmaking. i will not be intimidated, and the justice department will not be intimidated. >> garland also shot down the baseless claim that federal law enforcement was cleared to use deadly force against donald

trump during a search for classified documents at mar-a-lago. a record-breaking heat wave is hitting the southwest, and it's hitting it early. heat alerts are posted from california to texas. temperatures will be running 10 to 20 degrees above normal for this time of year. today's highs will soar above 100 degrees in sacramento, las vegas, and phoenix. tomorrow the heat cranks up above 110 degrees in parts of arizona and nevada. tomorrow las vegas could hit 112. that will tie the earliest date on record for 110 degrees or warmer. the u.s. is ratcheting up the pressure to persuade hamas and israel to agree to the latest cease-fire and hostage deal release -- release deal, rather, that president biden unveiled last week. cia director william burns and biden's mideast adviser brett mcgurk are in the middle east today meeting with qatari and egyptian mediators in hopes of getting a breakthrough in the

talks. it comes as president biden suggested in a "time" magazine interview that israeli prime minister benjamin netanyahu may be prolonging the war against hamas to ensure his political survival. biden seemed to dial back his criticism in a brief exchange with reporters. >> prime minister netanyahu playing politics with the war. >> i don't think so. he's trying to work out a serious plan. >> this latest plan calls for freeing the israeli hostages and would lead to the withdrawal of israeli troops from gaza in phases. hamas has said that it won't accept anything without a permanent cease-fire. netanyahu has said that he won't end the war without the complete destruction of hamas. the two members of netanyahu's far-right governing coalition have threatened to leave the government if he signs off on the deal. normal service has been restored to at&t customers. the company says that a problem prevented some customers from

calling or texting other carriers. it's unclear how many people were affected. the issue was resolved, though, by the evening. at&t says the network did not experience a nationwide outage saying calls between customers and to 911 were not impacted. and a new gambling scandal rocks major league baseball. san diego padres infielder tucupita marcano was hit with a lifetime ban for betting on his own team. the mlb says he waged more than $150,000 on games including more than two dozen bets on the pittsburgh pirates when he was an active player but out with an injury. four other players received one-year suspensions. and the former translator for dodgers superstar shohei ohtani has pleaded guilty to bank and tax fraud. ippei mizuhara admitted to stealing nearly $17 million from the baseball star to pay off gambling debts. mizuhara faces up to 33 years in

for -- from south jersey, entered the race in september right after senator bob menendez was indicted on bribery and corruption charges. on monday menendez filed to run as an independent in a long-shot bit to keep the seat he has held since 2006. "the wisconsin state journal" says former trump associates have been charged in a fake elector plot in the state. the attorney general filed charges against three people including an aide and two attorneys who worked for former president trump. they are accused of designing and executing a plan to overturn the 2020 presidential election by submitting false -- rather, a false slate of electors for trump. they're facing felony forgery charges and are set to appear in court in september. and "the new york times" reports an fda panel has rejected the use of the psychedelic drug mdma to treat ptsd. mdma and also known as molly or ecstasy. the panel said evidence fails to show the treatment's benefits outweigh its risks.
