mounting concerns from democrats and voters. decision day. the supreme court closing out its term today with its biggest case of the year. is donald trump immune as a former president of charges of trying to overturn the 2020 election? and batten down the hatches. hurricane beryl, a dangerous storm taking aim at the caribbean. good morning, and good to be with you. i'm. -- i'm anne-marie green. we start with the presidential race and as we await a historic supreme court decisions on donald trump's fate. president biden returns to the white house today following thursday night's poor debate performance. a new cbs news poll finds an increasing number of voters say he shouldn't run along with some members of his own party. there democratic lawmakers coming to his defense. cbs' naomi ruchim joins us now here in new york. good morning. >> reporter: good morning. there are certainly growing concerns among party insiders and just regular american voters.

the democratic national committee held a conference call over the weekend trying to paint a positive picture going forward. but many democrats are simply uneasy about president biden's ability to campaign, more so than his actual decisionmaking. president biden departed south jersey after a fundraiser this weekend on his way to camp david. cbs news has learned he's had conversations there with family members who are urging him to stay in the race and keep fighting after his dismal debate performance. some democrats are also publicly voicing their support. >> and joe biden is not going to take himself out of this race, nor should he. >> reporter: a new cbs news poll conducted after the debate shows 54% of democratic registered voters say president biden should be running for re-election. and 46% say he should not. a 10% shift compared to february. of those who think he should not, the top reasons are age and decisions he might make in

office. some republicans say the debate is proof the president is experiencing cognitive decline. >> if you want to look at past performance to judge what's going to happen in the future, god help us all if joe biden gets re-elected. >> reporter: another factor in the election is the pending supreme court decision expected later today on whether former president donald trump has immunity from criminal prosecution. >> i think the president has immunity. it's not about whether he should pardon himself, it's about whether to be prosecuted in the first place for discharging his official duties. >> reporter: after fundraising after the debate, the biden campaign says it has not impacted efforts with $33 million raised since thursday night. >> let's go back to that supreme court ruling today on donald trump's claim of presidential immunity, how could that impact his campaign? >> reporter: well, at issue today is whether trump is immune from criminal prosecution for his actions on january 6th. it seems highly unlikely the

justices will determine that the former president has absolute immunity and cannot be criminally prosecuted at all. however, the timing here is crucial. even if the supreme court rules against trump -- and remember he appointed three of these justices -- it doesn't leave much time for the special counsel to try the former president on their indictment and expect a jury to reach a verdict before voters head to the polls in november. >> right. of course. naomi ruchim in new york. thank you so much. trump ally steve bannon is expected to report to federal prison today. on friday the supreme court denied bannon's bid to remain free while he appeals his conviction. a jury found the conservative commentator guilty on two counts of contempt of congress nearly two years ago. he had defied a subpoena in the congressional january 6th investigation. he'll serve his four-month sentence at a prison in connecticut. now to the powerful hurricane beating down on the caribbean. people were boarding up windows

yesterday in barbados ahead of hurricane beryl. the storm is being called extremely dangerous by experts, and people are being urged to take shelter. this morning it's expected to make landfall in the windward islands on its path to jamaica. hurricane warnings are in effect for several islands. it's a category-three storm but is expected to restrengthen to a cat four this morning. it is the earliest category-four atlantic hurricane on record. there's growing outrage in a small city in upstate new york following the police shooting and death of a 13-year-old boy. the teen moved to the united states with his family as refugees from myanmar, hoping for a better life. now they're struggling to comprehend his death. cbs' michael george is in utica where police released body cam footage of that deadly encounter. >> reporter: utica police say they stopped this 13-year-old and another teen friday night because they matched the

description of robbery suspects. >> make sure you don't got any weapons on you. >> reporter: the teen runs. police say he pointed what looked like a gun at officers. >> gun! gun! gun! >> reporter: it was later confirmed to be this pellet gun. police say designed to look like a glock with a detachable magazine. one officer wrestles the teen to the ground and punches him. another officer fires. [ gunfire ] >> oh, my god! oh, my god! joe, he just shot him! >> reporter: the teen identified as hyah mway died at the hospital. this witness who asked us to hide her identity recorded the video of the incident. from what you witnessed, do you believe the officer was justified in shooting? >> no. no. that's somebody's baby. and he didn't fight back even when y'all laid him on the ground and was punching on him and stuff. that boy didn't fight back. >> reporter: the officers are on paid leave pending an investigation to see if they followed protocol. after the shooting, officers

performed chest compressions. initially there's confusion about who was shot and who fired. >> i don't know if he shot me -- >> check him. body check him. >> any more shots? one shot? it was me. >> reporter: mway was a refugee from myanmar and part of an ethnic minority. at a vigil saturday night, cmmunity members prayed for mway and demanded justice. and community leaders are condemning the actions of utica police calling it excessive force. the new york attorney general's office is investigating. michael george, cbs news, utica. now to the middle east where all signs are ratcheting up the rhetoric. fears mount of a widening war. the u.s. is warning hezbollah which has been trading cross-border attacks with israel that they should not count on america or anyone else holding israeli leaders back if they decide to execute battle-ready plans for an offensive into lebanon. iran and israel exchanged threats saturday of what iran said would be an obliterating

war over hezbollah. meanwhile, protests in jerusalem turned violent between ultra-orthodox demonstrators and israeli police. the ultra-orthodox are protesting israel's supreme court decision allowing the jewish state to begin drafting seminary students into the military. they had traditionally been exempt. and rescued israeli hostage noa argamani is speaking publicly for the first time in a video message. she said her biggest concern during captivity was for her parents, and she called for the return of the remaining 120 hostages who include her partner. argamani is one of four rescued by the israeli military in a special operation last month. if you are heading out of town this week for the fourth of july holiday, be prepared for a lot of company. nearly 71 million people are expected to be on the move this holiday week. cbs' adam yamaguchi has more on the record-breaking travel from l.a.x. >> reporter: the holiday travel

rush is on at l.a.x. and airports across the country with long lines at tsa checkpoints and ticket counters. >> it's annoying but we expected it was going to be this bad. >> reporter: the surge of travelers has tsa screening passengers in record numbers. six of their busiest days in its history have been this june. record crowds are also expected this wednesday, july 3rd. air travel is up 7% from last fourth of july, helping to pack those planes. ticket prices about 18% lower than a year ago. >> we got ours like, what, two, three months ago? so i wouldn't say they were too bad. >> reporter: aaa official the that most americans, close to 90%, will travel by road this holiday. these trips cost californians the most with gas on average of $4.80 a gallon. overall prices are down about six cents. navigating traffic, weather, and airport crowds can be stressful, but for many the final destination justifies the travel headaches. >> our trip out here was really nice, and things weren't too crowded. and we spent a few days in l.a.

colorful costumes and floats and plenty of bands to keep everyone entertained. a florida man is bitten by a shark and a blow to french president emmanuel macron. those are some of the headlines on the "morning newsstand." bbc news report the far right in france is celebrating its election lead and seeks a majority in parliament. the anti-immigrant national rally party led by marine le pen is on track to win about one-third of the vote in the first round parliamentary elections. the result is a major blow for centrist president macron who called the surprise ballot. to form a government, national rally would need to win a majority in the second round of voting next week. "the florida times-union" said a man was critically injured after a shark attacks. the nassau sheriff said the man in his 40s sustained a severe bite to his right arm on friday. he was airlifted to the hospital in critical condition, but he is expected to survive.

points. the justice department is offering boeing a plea deal in connection with two deadly plane crashes involving its 737 max jetliners. under the deal, boeing would plead guilty to conspiracy charges, pay a fine, and agree to an independent monitor who would oversee its compliance with anti-fraud laws. a lawyer representing the victims' families say they object to the deal. boeing has until the end of the week to accept the offer or face trial. a judge would still have to approve it. a surprise strike this weekend at canada's second-largest airline and on one of the busiest weekends of the year. west jet was forced to cancel more than 800 flights leaving more than 100,000 passengers scrambling including here in the u.s. maintenance workers walked off the job friday after rejecting the company's latest job offer. and "inside out 2" scored another box office win raking in $57 billion, making it the first
