decision saying it undermines the rule of law. cbs's jarred hill joins us now with more reaction. jarred, good morning. >> good morning, anne-marie. chief justice john roberts insisted, quote, a president is not above the law, but now the courts have to decide what counts as an official act as former president donald trump's legal teams insist he should not be able to face prosecution. >> reporter: this morning, new questions around weather the supreme court's monumental ruling on presidential immunity could impact former president trump's felony convictions. trump's lawyers are asking the judge in his new york financial records case to delay next week's sentencing and toss out the convictions, claiming some evidence came from his time in the white house and should be considered official presidential acts. >> for those things that are just for the president, just within the president's ambit, absolute immunity. for official acts in general, at least presumptive immunity. >> reporter: the high court's 6-3 decision will likely slow

trump's january 6th election trial. >> there are things that will have to unfold over the next several months. that means the chances for a trial before the election are zero at this point. >> reporter: president biden criticized the supreme court's ruling. >> today's decision means there are virtually no limits on what a president can do. >> reporter: chief robert wrote the president may not be prosecuted for exercising his core constitutional powers without specifying the limits of his constitutional powers. >> predicting disastrous consequences as a result of the decision she called deeply wrong. trump celebrated the moment writing on social media, big win for our constitution and democracy. proud to be an american. >> so, jarred, let's talk about trump's three other criminal cases. possibly some of them in limbo?

where do things go from here? >> that's right. everything was already on hold. the supreme court will likely push all of this back even more. for example, the allegations in the florida documents case, particularly after what trump did in his tenure afthe white house, his legal team could look for ways to apply this ruling there. and in the federal elections case in d.c., the judge will have to go back through the evidence and decide what was and was not an official act. they say prosecutors would have to prove why it's not. the moral here, we're probably going to be in a very long wait for any kind of resolution with these. >> jarred hill in new york. thank you, jarred. well, president biden's brief remarks last night, a stark contrast to his disastrous debate performance last week. he didn't mention the debate, nor did he take any questions, but biden's family is urging him to ignore calls to step aside.

>> reporter: a new cbs news poll shows how the debate impacted voters with 72% saying biden does not have the mental and cognitive health to serve as president compared to 65% before the debate. 50% believe trump does. among registered democrats 54% think biden should run for president. 46% say he should not. trump weighed in on a radio show. >> they say getting around is very hard because he has the delegates, he has the votes, and if he doesn't want to get out, there's not a thing they can do about it. >> reporter: election expert david becker says the decision is for biden alone to make. >> the primaries were held. the voters have spoken. i suspect we'll see a rematch of president biden against former president trump. >> reporter: the biden campaign is circulating a new internal

poll. even though it only shows him leading by one vote, it shows that support of the president has not changed following the debate. top campaign advisers brought it up with donors during calls, trying to calm nerves about biden's viability. turning to our other top story now, hurricane beryl, the storm grew to a potentially catastrophic category 5, becoming the earliest category 5 hurricane on record with winds up to 165 miles an hour. beryl is on track to move across the southeastern and central caribbean today, passing near jamaica tomorrow. this video is from hurricane hunters' reconnaissance flight as it flies into the eye of the storm. and we're getting a first look at some of the damage on the islands of barbados in saint vincent. rooftops were ripped off, trees snapped in half. plus, we're learning of one death in grenada.

tom hanson is there keeping a close eye on the storm. >> reporter: the caribbean is on high alert. hurricane beryl made landfall, packing catastrophic winds of 150 miles per hour and a life-threatening 6- to 9-foot storm surge. >> we have reports of extensive storm surge. we have reports of extensive loss of roofs and damage to buildings. >> reporter: in nearby barbados, storm surge caused flooding and destroyed about 20 boats in this bay. it's the first since june that ever recorded damage and it's the first to increase from a tropical storm to an intense category 4 storm in just 48 hours before september. hurricane beryl is on a path to jamaica and hurricane experts are asking residents to prepare. >> wee keep an eye on the forecast, and the forecast says it's not supposed to be much.

we'll batten down and see what happens. >> reporter: the average date of the first major hurricane is september 1st. experts say the power of beryl this early is driven by abnormally warm waters due to climate change fueling the storm. now to the israel/hamas war, where it looks like the israeli military may soon launch a new ground assault in the city. they say this is after they had sent a barrage of rackets from the area into the border communities. that evacuation comes as israel released the director of the el shiva hospital. he was held for seven months without charge. israel alleged the hospital was used as a hamas command center. the decision to release the hospital director and dozens of other palestinians appeared to

singapore flight from london that killed one passenger. a mistrial in the karen read murder case, and what jeffrey epstein's victim said in secret documents. those are some of the headlines on the morning newsstand. the palm beach news reports on secret transcripts from one of jeffery epstein's underaged victims where a prosecutor blamed her for committing a crime. the transcripts are from a 2006 grand jury investigation. the documents contain firsthand accounts from victims, including payouts. but the jurors followed the prosecutor's lead by asking questions in an accusatory tone. one juror asked a 14-year-old victim, do you have any idea, deep down inside of you, that you, what you were doing is wrong? the victim then answered, yeah, i did. despite the testimony, epstein cut a deal in 2008 to avoid

charges of sex trafficking, enraging critics. he pleaded guilty to a lesser charge and was sentenced to 13 months in prison. epstein ultimately took his own life in a manhattan jail in 2019 while awaiting a trial to sex trafficking charges linked to a separate case. "the boston globe" has reported a judge has declared a mistrial in the karen read case after the jury was deadlocked. the massachusetts jury informed the judge yesterday they were unable to comreach a verdict. read was accused of running down her ex-boyfriend in her suv during a winter snowstorm in 2022. she said she was framed. the district attorney plans to retry the case. five members of a family were killed after a small plane crashed in rural upstate new york. the victims, including two children, were returning to georgia from cooperstown, new york, where the family had been for a baseball tournament. authorities had to use drones,
