it's wednesday, august 28th, 2024. this is "cbs news mornings." new indictment. former president trump once again accused of trying to overturn the 2020 election. the changes in these accusations after the landmark supreme court ruling on presidential immunity. after ten months, he is finally free. israeli forces rescue an israeli hostage, the first one to be found alive in an underground tunnel in gaza. and growing concerns. the u.s. confirms the first death linked to a rare mosquito-borne illness, while federal officials sound the alarm on another virus transmitted by bugs that just landed on our shores. good morning, and good to be with you. i'm anne-marie green. we start with the new federal indictment against donald trump. with just ten weeks until the election, the former president is now facing charges related to the last election and his

efforts to overturn the will of the people. the revised charging document is intended to deal with the supreme court's decision granting presidents immunity for official acts. cbs news' jarred hill is joining us with the details and of course trump's reaction. good morning. >> reporter: good morning. so the charges are the same as before, but the details in the indictment have been tailored to try and fit that scotus immunity ruling. legal experts are saying these tweaks could take the case right back to the high court. as the 2024 race for the white house heats up, former president trump is now facing a revived and reworked legal fight over the previous election. tuesday another federal grand jury in washington reindicted trump on the same four charges in special counsel jack smith's case accusing him of conspiracy to hold onto power and to overturn the results of the 2020 election. the revised indictment meant to comply with the supreme court's july ruling that presidents have broad immunity for official acts.

>> the allegations relate solely to the actions that president trump took as a candidate. in other words, in his personal capacity, omitting allegations that involved alleged actions in his official capacity. >> reporter: the slimmed down charging document removed the allegations concerning trump's attempts to pressure the justice department into supporting his false claims that the election was rigged, one of the unnamed co-conspirators who cbs news identified as jeffrey clark, a trump ally within the dodge, has also been taken out. >> this is a persecution of a political opponent. >> reporter: trump has repeatedly denied all wrongdoing and last night again accused the special counsel of election interference. his 2024 running mate, j.d. vance, called the indictment putting lipstick on a pig. >> i don't think it changes anything legally. >> reporter: trump's lawyers are expected to fight it. now the timing of this indictment is also interesting.

the doj has this policy not to take new public steps in any politically related cases 60 days before an election. that would kick in nine days from now. as far the timing of the trial goes, that's up in the air. >> uh-huh. really interesting. thank you. well in a broadcast exclusive, norah o'donnell spoke with supreme court justice ketanji brown jackson about her blistering dissent in that landmark immunity case. in her first tv interview since joining the nation's highest court, this is what she said worries her about that decision -- >> in your dissent you wrote that the court declared for the first time in history that the most powerful official in the united states can, under circumstances yet to be fully determined, become a law unto himself. sounds like a warning. >> well, i mean, that was my view of what the court determined. >> you were concerned about

broad irksz -- broad immunity? >> i was concerned about a system that appeared to provide immunity for one individual under one set of circumstances. >> when we have a criminal justice system that had ordinarily treated everyone the same. >> you can see much more of norah o'donnell's interview with justice ketanji brown jackson this weekend on "cbs sunday morning." vice president kamala harris is set to return to the campaign trail today for the first time since last week's democratic national convention. she and running mate minnesota governor tim walz will take part in a two-day bus tour in georgia, ending with a rally in savannah tomorrow. meanwhile, we are learning there was a confrontation between members of donald trump's campaign team and an official at arlington national cemetery during the former president's visit to the cemetery monday. the trump campaign says the dispute started over the presence of a photographer in a section of the cemetery where

american troops who were killed in recent wars are buried. the cemetery says federal law prohibits political campaigning or election-related activities including photographers within army cemeteries. about 50 million people in the midwest and the northeast are under heat alerts. many for the second day in a row of unusually hot temperatures for late august. highs today are expected about 10 to 15 degrees above normal from arkansas to massachusetts. the heat could break records in washington, d.c., and nashville where temperatures are forecast to go above 100 degrees. tomorrow, the sweltering heat exits the northeast. but temperatures will still reach the 90s from the midwest to the carolinas, even cracking 100 degrees in nashville again. health officials are warning of an increased risk of a rare mosquito-borne illness in new england after a new hampshire man died. 41-year-old steven perry died from the first infection of eastern equine encephalitis or

eee in new hampshire in decades -- in a decade, rather. his family says he had no underlying health conditions. health officials in new hampshire are urging people to take precautions against mosquito bites. so far this year, people have also been infected with eee in massachusetts, vermont, wisconsin, and new jersey. meanwhile, u.s. health officials say more than 20 people returning to the u.s. from cuba have been infected with a virus transmitted by mosquitoes and small biting flies called sloth fever. they were infected after visiting forest areas. now to the daring rescue of another israeli hostage held in gaza for ten months. the 52-year-old arab man from the country's bedouin community is doing okay despite spending most time in the dark. his family is eager to welcome him home. skyler henry reports. >> reporter: israeli military

forces rescued 52-year-old qaid fahran al kadi after he was found alone inside of an underground hamas tunnel at an undisclosed location in southern gaza. >> he's back home in israel. he cannot go into many details of this special operation. but i can share that israeli commandos rescued qaid fahran al kadi from an underground tunnel following accurate intelligence. his family had been waiting 326 days. >> reporter: the father of 11 was taken by army helicopter to a hospital in israel. >> he appears to be in general good condition but will require another day or two of medical tests to make sure he is still okay. we are ecstatic with his family. >> reporter: his brother says the former hostage ate some baklava and visited with his newborn son. thank god, he said, thank god that he gave us news today after 11 months, news we didn't

imagine and didn't dream even. al kadi is one of 250 israelis and foreigners taken during a hamas attack october 7th. 1,200 people died. his rescue came the same day palestinian officials said at least 18 people, including eight children, were killed in israeli air strikes across the gaza strip. >> as we have been from the start, we remain intently focused on deescalating tensions in the middle east while remaining focused on securing a cease-fire as part of a hostage deal to bring all of the hostages home. and to end the war in gaza. >> reporter: more than 100 hostages are still being held. israel says at least a third of them have died. skyler henry, cbs news, washington. negotiations for a cease-fire and hostage release agreement are continuing. an israeli delegation is expected to head to qatar today where u.s., egyptian, and qatari mediators have been meeting. spacex is again delaying its

the january 6th rioter who was first to breach the capitol is sentenced, and a former "real housewives" husband is convicted. those are some of the headlines on the "morning newsstand." the "los angeles times" reports a federal jury found disbarred attorney tom girardi guilty of embezzling tens of millions of dollars from clients. the 85-year-old was convicted on four counts of wire fraud yesterday. his now-estranged wife, erika jayne, is a star of "the real housewives of beverly hills." prosecutors say he spent the money on a lavish lifestyle including private jets and country clubs. defense attorneys blame the law firm's chief financial officer. girardi faces up to 80 years in prison. "the hill" says the first rioters to enter the capitol on january 6th was sentenced to more than four years in prison. michael sparks was convicted in march on charges including interfering with police and obstructing congress from certifying the 2020 presidential election results. sparks jumped through a shattered window on january 6th
