>> from the area's local news station, you're watching the kron. 4 morning news at 7. >> good morning, everyone. thank you for joining us on the kron. 4 morning news saturday theresa stasi and for stephanie land. it is december 16th. let's start to getting a look at the weather with dave sphar. so i notice that it was kind of >> drizzle early this morning that my imagination, ma'am. i've been some of the fog maybe along the coast, but for the most part, it's a pretty nice day today. tomorrow, different stories. so today is the day of the weekend that you really want to enjoy with the start of kind of blue skies before we may get some high clouds this afternoon and temperatures pretty much 60's bay area wide. so again for saturday looking good on that front from space. this is what it looks like. just some high cloudiness. we're going make note of just a touch before the the stuff comes in. it looks like tomorrow a little bit, but it is broken up. here's the view. you can see the east bay shoreline, little bit of haze as we start the day. there it is. the big low pressure system off the

pacific. now, this is relatively mild before the colder jolt gets here by the middle of the week. so it's too little players here. the second one being colder. and that's probably a bigger issue for our friends in tahoe, deliver the snows down to the resort levels. a look at your temperatures right now. little chilly off to the far east bay. you can see the middle to upper 30's. we've got a 51 mile degrees. san francisco in some chilly 30's up north as well. quick comparison. we're a little cooler this morning across a good chunk of the bay. we'll make up for it this afternoon. however, here's the breakdown for you. keeping it mostly sunny again. no taking a little in the way. some high cloudiness, high temperatures inland and the well mid to upper 60's coming up in a bit. of course, we'll take a look at this development for sunday and into next week, which looks quite unsettled. and i'll get into that theresa. >> thank you very much, to san francisco restaurants trying to bounce back after burglars ruined their year. the break-ins happened early friday morning in the city's soma neighborhood. and one of the cases nearly a dozen people were seen ransacking

restaurant kron four's. dan thorn has the details for us. >> nearly a dozen burglars are caught on camera breaking into se arate thai restaurant. the large group smashing in through a front window running through the dining area and ransacking the office friday morning. i'm nobody here. >> them do anything to become become a lot. >> restaurant owner chef kobe says the thieves stole a cash register and a safe filled with $10,000. they also caused thousands in damage. the chef says seeing one of the burglars with a gun was alarming. >> that's rest. many them in to see it in it was a full house. it's friday night. but it was a different story just blocks away. and brazilian restaurant volant happ room. they too fell victim to burglars. it's been very frustrating, as you know. >> only a small business. and san francisco is very challenging. the thieves pried the front door open.

video could be disturbing. police say that it was around 04:00am on november. 7th, a police sergeant was getting out of its unmarked car and then the video shows that someone a hood comes up behind the car and then tries to hit or kick it while reaching for an holding what looks like a weapon in his right hand with the police sergeant gets out of his vehicle. the man in the hood points, his weapon at the sergeant who ducks back into his car. some point, the officer opens fire from his vehicle, killing the man according to police. this is what the officer called in immediately after. >> district attorney 6. and this is a hamilton. 23. 00:07:08am, at opd. frank, i look like i just i mean, town shots have been fired or need a covid medical. and a bill to my leave. >> police say that they recovered a loaded weapon that you see right there from the body of the man. they have not released the person's

identity. new this morning, oakland public school officials warning families to be where of phone calls claiming that their children have been kidnapped and being held to ransom this week to families receive calls, claiming that their children have been taken. the caller knew the names of the students, but the reality is that the school, what the children at the school, the scheme first surfaced in november. in every case the alleged victim was safe. police say that if you do receive ransom demands, you should notify police and call the student school to confirm that they are there. we are learning this hour that the flaring up the martinez refinery may continue through the weekend. there was talks flaring friday morning at the refinery. the company says that the flaring released the smell of sulfur into the community are firing executives added that there is a potential for occasional flaring to continue throughout the weekend as employees work to restart affected equipment,

exact cause for friday's flaring is under investigation. but police people say that those who live in the community are furious at this keeps happening. >> today, i'm feeling it. it's in my chest. i'm coughing. i'm headache. e and i am. >> angry. our advice for people who are more sensitive to smell is to stay indoors, close the windows and doors. and if you have a hepa filter so he's run and it can the smells from the air. >> representatives from the martinez refinery will be attending a city council meeting on wednesday at 7. the public will be able to ask questions and voice their concerns. holiday travel season has officially begun. taking a live look outside. beautiful out there. triple a expects 7.5 million people to be traveling by air this holiday season. san jose's airport expecting thousands of travelers passing through the airport every day. kron four's justin campbell reports on

lots of questions and answers for us. >> jose airport officials are expecting nearly 40,000 travelers per day starting friday until new year's tons of people on the flight. savannah, sure. our traveled from hawaii to san jose to be home for the holidays in says she had no problems unlike last year when southwest had a meltdown in canceled over 16,000 flights, you were concerned about the meltdown like they had last. know, i didn't get stuck in that last year as well, though. but southwest always got my back. so airport officials plan to make it cozy for travelers like savannah. they will have live music performances on certain days, courtesy, courage for luggage in a time his personal vehicles between terminals in anticipation of thousands of travelers, volunteers will also be at the airport to answer any questions from travelers. usually we have, you know, >> 3 or 4 questions an hour. and today we've had like, you

being here. we really appreciate we are very excited to be in person like you said for the first time in many years. >> since the pandemic began in just a couple hours, we're going to have 1000 families come through here and shop for all the toys that you see behind you as as kids pick out the toys that they want for their holidays. 2000 families, teens, and children, about 4,000 presents. i read tell us everything that goes into well, this is a two-day event. so we started last night and we'll go through 01:00pm this afternoon. register clients of samaritan house and our and shop. but the program by i- really starts months beforehand as schools and companies and community groups get together and and raise all the money and the toys that we need to hand out today. and it's a special moment for these kids and teens that take park, right? yes, correct. we really want to add that element of dignity and to all of our work. so we're very excited to have kids be able to pick out the toys that they want for themselves and for

was beginning to sound a lot like christmas oakland, interfaith gospel choir returns this holiday season with a series of festive concert in joining us right now to talk more about how they're spreading cheer is artistic director parents, kelly and director of youth program when l martin, thank you very much for joining and we're just talking about what time we got up this really relate because we want to bring you so tell us a little bit about. >> the it. i mean, you really try and make sure that all face are being honored temp. but you guys tell me more when we started the oakland interfaith gospel choir, it was out of a cry for people that want be able to gospel but they were not in tradition that supported it. so we decided this. decided to start the choir anybody of any faith. and now have over 20 3 faith recognitions, which includes

>> what is it? baseball was vhe last last month. the rainbow a rainbow. buddy. that wants to gospel music and we have oakland youth chorus is part part of our youth programs. open up a quiet here today in oakland, youth questions. well, with with our program manager lynn else, he's amazing. how do you pick the music that you choose to participate in a lot of time we pick the music dealing with area. we like to make sure that areas supported and that's how we do respect with our singers. >> so a lot of time for make sure that we're doing a lot of world music make sure that everyone's top 10 so tweaked the bill that respect. and then was amazing. but the youth choir because he's always arranging his to his defferent pieces. so it's always something that's really the pulse of oakland, east bay. >> it's so nice to have that melting pot really represents the community and be able to make sure that we uplift those voices. it's some challenging

times he stay. so it's nice to have that positive reinforcement, yes, and >> gospel choir and the main part of for the organization is the gospel choir. and that's the group that has 23 faith recognitions on every political spectrum and show the world what can happen if people come together and just give up a little bit of themselves, educate us far as dew guice tore. tell me a little bit about that. well, i'm glad our our youth choirs together will be going to kind of the later on in. 24, we're going to go on a cultural trip. >> will experience a reserve and we'll have some youth interaction youth in canada. so that that our young people get to experience another culture that's very tell me about the schedule ahead so that once we listen to the music, the people can actually. >> you know, and person. today we will have our you'll tight youth concert is with all of

the assault in the fall of 2000. the president of the college at the time brother craig, from allegedly chastised her over the claims. the lawsuit says the university chose to handle the investigation internally instead of involving the police. the former student claims she remained silent in order to stay in school and keep her scholarship. my client first came to me. i'm learning about this statue and when we looked into it saint mary's college. >> we determined that there was a history of pattern and practice of both underreported things, assault silencing survivors who came forward and ultimately on a survivors to maintain their silence. 2006 brother, craig resigned as president of saint mary's university, minnesota. >> according to a letter from the saint mary's university board of trustees chairman at the time from admitted to inappropriate behavior with a student during his time leading saint mary's and

moraga. >> in 2011 students stage a strike at them around the campus against assault complaints after at least 2 female students reported being raped within 2 weeks of each other. a spokesperson told kron 4 at the time the college was concern in handling the situation through educating students about personal and social responsibility. this recent lawsuit was filed under a temporary law that eliminates the statute of limitations from assault cases. the statute of limitations for pursuing civil claims under this statute will end december 31st. know that it happens. we know that there are others out and i hope that they >> learn of their options and1 choose to to pursue this accountability if they if they if that's right for them. and in a statement to kron 4 saint mary says they are taking the allegations seriously. >> and they do not tolerate any type of misconduct in their community. they also say they've made improvements since the year 2000 to better protect students who have been victims of misconduct. gayle opong kron. 4 news.

>> on the call when chasing me. >> i on and crashes into a pole and flipped his car in oakland. the driver says he was being chased by someone who tried to rob him before losing control hitting the pole. a witness told us that this happened just before 7 o'clock friday morning at 5th and international boulevard they say that they saw up to 5 cars chasing the man. paramedics took the drive to the hospital. no word right now on whether anyone has arrested connection with us. a community members say that they are outraged after a beloved 7.11, security guard was murdered in oakland. >> 59 year-old james johnson was killed last friday trying to stop a thief and the gas station on harrison street friday, a small group of community members rallied outside the 7.11 saying that crime in oakland has gotten

out of hand and that elected officials need to do some things to fix it. >> and we have to look at poor administration, poor leadership. and most of all poor policies of all we need is more police presence. we need to do more prevention. >> and spending more time catching bad guys. >> no word on any suspect right now. anyone with information is being asked to call the oakland police. the city of alameda confirms it has reached a more than 11 million dollar settlement with mark mario gonzalez's mother and son agreement to settle the civil rights lawsuit happened thursday night. gonzalez died in police custody in april of 2021, the alameda county coroner's office ruled the death as a homicide and that the officers who restrained him contributed to his passing. >> on april 19th 2021 neighbors near a park in

alameda called police reporting a person acting 3 officers responded and eventually took. 26 year-old mario gonzalez to the ground. well, taking him into custody. he lost his breath when officers pinned him and he died at a hospital officers. eric mckinley and cameron legally remain actively sir james fisher has moved on to another agency. >> to this day, the community still leaves flowers with the tragic incident happened. and one chapter of that horrific day has now closed our research. >> so it shows it's the largest amount of money awarded to a single child in the last 10 years, at least in california, a civil rights case. attorney michael haddad and his law haddad unsure when negotiated 11 million dollar federal civil rights lawsuit against the city of alameda. >> and the 3 officers involved in gonzalez's death, which will be awarded to gonzalez is

7 year-old son. if law enforcement refuses to follow their training in generally accepted principles have to avoid us. fix you up. then there's going to be consequences like this again and again. and, you know, it's a large amount of money. >> but it doesn't bring back a life civil rights attorney adante pointer and his law firm lawyers for the people negotiating the $350,000 settlement with the city. >> and officers involved and gonzalez is mother's behalf. as many of us are preparing and have already celebrated some holidays as holidays in front of us. >> there's going to be empty seat at her dinner table. and she has to deal with that. like many people who've lost loved ones. that is that something that you can never replace? you just learn how to cope. in a statement, the city of alameda says, quote. >> the parties further agreed that the settlement should not be construed as an admission by any party of liability or of any fact that might give rise to liability for any purpose. the city of alameda remains committed to full

transparency and accountability in the tragic death of mario gonzalez and extends our heartfelt condolences to his family and loved ones. the alameda county coroner's office ruled the death a homicide and independent autopsy determined gonzalez died from restraint, asphyxia. the district attorney's office declined to comment on whether or not it is still considering criminal charges against the in alameda, philippe djegal kron. 4 >> well, following their announcement of relocating to las vegas. the oakland a's say that they will pay alameda county. the 45 million dollars owed from their purchase of half of the coliseum property. their final payment was scheduled for 2026, but officials say by moving out of oakland, the a's of well, they put that on a fast track in a timeline to 2020 for the a's plan to open their new ballpark on the tropicana site along the las vegas strip for the 2028 season. well, a

federal judge in san francisco is ordering elon musk to testify again over how he acquired twitter. the ruling after musk failed to attend a meeting into the investigation on whether he lied on paperwork about his twitter stock purchases. musk a bought the social media company for 44 billion dollars last year and has since rebranded. the platform as acsi testified back in july. but investigators say that they need additional testimony following the release of new documents. his attorneys have called the probe, quote, misguided and harassment well, the cdc says a new coronavirus strain called j and one is behind the increasing number of covid cases. infectious disease specialist doctor peter chin. hong says it is not a variant we should be super concerned about, but it could be dangerous if you're not vaccinated.

have been reporting a strange smell following them from the east bay into san francisco, particular around 12 straight in west oakland station. some have described it as a kind chemical smell. others say that it smells more like sewage riders have been noticing it for a couple months now. and nobody's exactly sure where it's coming from a bart spokesperson says that they are aware of the complaints and even some staff of notice the stench as well. they also tell us that their system safety department has been on site and reported nothing that cause some concern, adding that it's not clear if the smell is generated by bart, it could be something. >> and the neighboring area court. >> well, coming up on the kron, 4 morning news, hundreds of pets are looking for a forever home this holiday weekend. and we going to be joined live in the studio from the founder of month. bill senior dog rescue to talk more about how you can help out.

student at saint mary's college who filed a lawsuit thursdayyagainst the school. >> according to court documents, the victim reported the assault in the fall of 2000. the president of the college at the time brother chastised her over the claims. the lawsuit says the university chose to handle the investigation internally instead of involving the police. the former student claims she remained silent in order to stay in school and keeper scholarship. my client first came to me. i'm learning about this statue and when we looked into it saint mary's college. >> we determined that there was a history of pattern and practice of both underreported things, assault silencing survivors who came forward and ultimately punishing survivors to maintain their silence. 2006 brother, craig resigned as president of saint mary's university, minnesota. >> according to a letter from the saint mary's university board of trustees chairman at the time from admitted to inappropriate behavior with a

student during his time leading saint mary's and moraga. >> in 2011 students stage a strike at them around the campus against assault complaints after at least 2 female students reported being raped within 2 weeks of each other. a spokesperson told kron 4 at the time the college was concern in handling the situation through educating students about personal and social responsibility. this recent lawsuit was filed under a temporary law that eliminates the statute of limitations from assault cases. the statute of limitations for pursuing civil claims under this statute will end december 31st. know that it happens. we know that there are others out and i hope that they >> learn of their options and choose to to pursue accountability if they if they if that's right for them. and in a statement to kron 4 saint mary says they are taking the allegations seriously. >> and they do not tolerate any type of misconduct in their community. they also say they've made improvements since the year 2000 to print

to better protect students who have been victims of misconduct. gayle ong kron. 4 news. >> on the call when chasing me. >> so >> and crashes into a pole and flipped his car in oakland. the driver says he was being chased by someone who tried to rob him before losing control and hitting the pole. a witness told us that this happened just before 7 friday morning at 5th and international boulevard they say saw up to 5 cars chasing the man. paramedics took the driver to the hospital. no word if anyone's been arrested. community members say that they're outraged after a beloved 7.11, security guard was murdered in oakland. 59 year-old james johnson was killed last friday when trying to stop a thief in the gas station on harrison street

friday, a small group of community members rallied outside the 7.11 saying that crime in oakland is at a hand. up to look at. >> ministries poor leadership. and most of all poor policies of all we need is more police presence. we need to do more prevention. >> many wartime bad guys. >> no word on any suspect. anyone with information is being asked to call the local police department. the city of alameda confirms that it has reached more than 11 million dollar settlement with mario gonzalez's mother and son the agreement to settle the civil rights lawsuit happened on thursday night. gonzales died in police custody back in april of 2021, the alameda county coroner's office ruled the death a homicide and that officers who restrained him contributed to his passing. philippe djegal has the details. >> on april 19th 2021

neighbors near a park in alameda called police reporting a person acting erratically. 3 officers responded and eventually took. 26 year-old mario gonzalez to the ground. well, taking him into custody. he lost his breath when officers pinned him and he died at a hospital officers. eric mckinley and cameron legally remain actively officers james fisher has moved on to another agency. >> to this day, the community still leaves flowers with the tragic incident happened. and one chapter of that horrific day has now closed our research. >> so it shows it's the largest amount of money awarded to a single child in the last 10 years, at least in california in a civil rights case. attorney michael haddad and his law firm haddad unsure when negotiated 11 million dollar federal civil rights lawsuit against the city of alameda. >> and the 3 officers involved in gonzalez's death, which will be awarded to gonzalez is

tropicana site along the las vegas strip for the 2028 season. a federal judge in san francisco is ordering elon musk to testify again over how we acquired twitter. the ruling after musk failed to attend a meeting into the investigation on whether he lied on paperwork about his twitter stock purchases. musk bought the social media company for 44 billion dollars last year and has since rebranded. the platform is acsi testified back in july. but investigators say that they need additional testimony following the release of some new documents. his attorneys have called the probe, quote, the sky did and harassment. this weekend caltrain is suspending some service between stations in san jose for construction. caltrain officials say service will be caught off between the derision and tamarin stations. they say that free buses from the santa clara valley,

already, you know, made the bacon, my daughter to and you can use a cup of you could use a pound. there's too much quiche, you know, with you know, bacon says nobody ever at the base nobody ever writes. so there's too much good know. we want too much bacon. so we're going to add the bacon to it. and then all we do is we're going to add this delicious mixture to it and we're going to bake it just like this for about half an hour, but 10 minutes into it, theresa. yeah, i'm going at some really pretty slices of to made about events we at first just a little correct, correct. and then we're going to decorate it with these beautiful slices of tomato, which makes it more red and green and then, of course, when it fully baked. we've delicious, delicious quiche. i want to be putting on put a little bit of parsley because let's keep it right. so
