freezing temperatures and the forty-niners held their second practice of the week as they prepare for sunday. we have a live report from vegas. about half the guys are feeling now 4 days away from the biggest game of the year. station. >> he's calling for news 2. >> appreciate joining us today on kron 4 news at 2 o'clock. i'm grant lotus. big story is in oakland today where fired police chief leronne armstrong is now taking legal action against the city and the mayor for stephanie lin joins us live with details. stephanie. >> hey, grant will this legal action comes one year after lebron armstrong was relieved of his duties. today we learned he's suing the city of oakland and mayor sheng thao alleging he was illegally fired in the 28 page civil suit. armstrong claims he was fired last february in retaliation for, quote, his courage in speaking out about misconduct by the department's federal monitor. robert

warshaw the lawsuit accuses warshaw of discrediting and minimizing the efforts of the more than 10 police chiefs oakland has had since 2013 for his own personal benefit. opd has been subject to federal monitoring for the last 2 decades. the lawsuit also alleges mayor thao was intimidated by warshaw and bow to his pressure and firing armstrong on kron. 4 news at noon today. we spoke with legal analyst michael cardoza for his perspective on this. and he says it's important to note that mayor thao is included in this lawsuit. the first thing i want to point out is the subtle to have this lawsuit. >> because the ex chief is bringing it not only against the city but against the mayor. personally know that's important because of beaches soon as the city. the mayor has has, as they say, no dog in the fight. but here's she's been personally, which means her personal assets are at

risk. and that sort of brings her to the side of the chief, the plaintiff in this case because she's going to want to get this settled so that she's not a risk where she has to pay some money. should she lose this lawsuit? >> really interesting ion there. now, the official reason mayor tells said that she fired armstrong is tied to a report released by a law firm working for the federal monitor. that report alleged armstrong is handled 2 misconduct incidents within opd. and when asked about that lawsuit earlier today, mayor thao said she could not comment on pending legal action. also, noteworthy here is that the police chief before armstrong and kirkpatrick was also fired. and she also sued the city and got a one and-a-half million dollar payment as a result. live in the newsroom. i'm stephanie lin kron. 4 news will be fascinating to see where this ends up. thank you, stephanie. >> as we take a live peek outside. take a look there

outside the crowd for studios. so along the embarcadero in san francisco. another dose of rain earlier today. but for most parts of the bay, things are clearing out nicely. and gayle ong is here with a look at the forecast to go. >> grant and yes, it was raining during our noon show during that exact shot. you can see the system. it was started here west and now it's moving south and east. so the santa cruz mountains look like they are getting drenched right now. see san jose at this hour. even snow. you see that shaded pink right over there. this out, some maybe some possible snow. now, hamilton, let's take you through rest of your afternoon. so this is right now 2 o'clock about an hour. we can expect more spotty showers pretty widespread here. and even like possibly for seeing cold system here. so we're on scene from pink on the map, which means they could see some local mountain snow is 6. we'll have to see. so this is 5 o'clock your rush hour drive. we still have some rain in the north bay, but everywhere else, some light rain and clouds out there. and

then by the evening, this activity starts to taper off and we'll see maybe like a shower or 2 like you see in oakland, 10:00pm, but mostly cloudy for the rest of the night. and then overnight things start to clear up so we could see some unsettled weather to thursday, but not as intense that it was the last couple of days. the next big story will be the wind. so you can even see mount tam here camera is shaking the see those tree branches moving point raises reporting 34 miles an hour right now. 22 and half moon bay and san francisco. so the winds are already starting to pick up. i don't see a wind advisory right now, but this is through the afternoon and evening. 36, 37 in half moon bay. and when i come back, we're also talking about chilly temperatures. there's a frost advisory in place for the north bay here. so temperatures will be in the low 30's. back to you. >> cold night at all, right. thanks, happening now, crews are still working to restore power to more than 28,000 customers locally. the

majority of those are in the north bay. more than 16,000 customers still without power. they're in the south bay. you currently have more than 7,000 outages that remain more than 4,000 people are without power. customers are without power on the peninsula. san francisco in the east bay combined. have about 500 outages. so relatively speaking, not too bad in those spots. more than 2000 customers in sebastopol are waiting to get their power back on for stasio spoke with folks. there has the latest. >> fire went out sunday afternoon sunday, monday, tuesday, wednesday, into the 4th day in sebastopol wednesday, dark, rainy cold conditions didn't help a bleak situation as thousands of residents continue to face power outages. >> due to the weekend storms first time the past, i've been here like 10 years and first time. >> no electricity, no water.

very hard. i mean, we have no heat. we have no water as a result because the well runs on the pump can't cook. >> on things that start like when the generator we can only around their fridge reader and the internet. take a look at this. an arborist told me his crew was waiting for heavy machinery to take out these giant redwood trees. >> this off of highway one, 16 and bloomfield road. he says of the wet soil, pushed up their roots. the krewe tied the trees together to try and make sure that they didn't fall and crush homes before they could be cut down nearby large branches from the trees and tore down power lines pg. e spokesperson megan mcfarland says widespread damage to so many lines has proven challenging to restore power throughout the found pg crews at work tired residents tell me that they are hoping for relief as soon as possible to tree down in my neighborhood clear yesterday. so hopefully

genie is out there today. maybe fix the fire >> i look on the pga web site. it says to be determined. >> it's a vast doubletree says stasio kron. 4 news. >> some schools in sonoma county are closed for a 3rd day in a row today because of power outages and other storm-related issues. the following schools or districts are closed for the day. severe weather conditions battered the county, of course, over the weekend forcing authorities to close roads said the school's no word yet on whether those schools will be reopening tomorrow. in the east bay. authorities say pleasant hill road has reopened after a lengthy closure for storm-related repairs. police posted this photo on social media earlier this week. you see the downed power lines blocking the road there. the thoroughfare between hamilton and cumberland drives. it's close for the past couple days. the closure allowed pg and e crews to make repairs to equipment

damaged in the store. on the peninsula. the majority of power has been restored to the town of mont era in san mateo county. this is video from yesterday where thousands of customers we're still without power because of damage like this, where that big trees just leaning on power lines speech. jeanne says the weekend storm we had was one of the biggest they'd seen in the area. francisco, a driverless car has collided with a cyclist crash was not life-threatening. but the company waymo is now being questioned about the risk. its autonomous cars pose to the public. according to police. the crash happened at about 3 o'clock yesterday afternoon near 17th and mississippi. streets in the city's hill neighborhood. in a statement to kron 4, a waymo spokesperson says the cyclist was the one who hit the car. adding that the person crossed into the waymo path at a

four-way intersection while the bike was they say kind of hiding behind a truck goes on to say our vehicle applied heavy braking that was not able to avoid the collision. waymo notified the police to the scene in the cycle is left on their own. to our knowledge reporting only minor scratches. san francisco supervisor shamann walton addressed the collision on facebook saying driverless waymo vehicle just struck a cyclist and 70 the mississippi so much for safety. on kron. 4 news at 3 o'clock today will be speaking with the san jose state university professor about what the future of waymo may look like in the bay area. in light of what has happened there. well, now we're just 4 days from super bowl. 58, we're waiting to hear from head coach kyle shanahan during the niners media availability this afternoon. but right now, kron four's kate rooney joins us. on the e

california attorney general rob bonta says he's trying to lend a helping hand to people renting their whole scott for charles clifford. >> is here with us live to break it down for us. what's this mean? well, you know, across california, their 17 million people who rent their homes and with home prices being high, it's difficult for them. >> to buy a house and the state wants to step up efforts to help renters stay in their rental homes. good morning, everyone. on wednesday, california attorney general rob bonta announced that the state is issuing 5 consumer alerts directed at renters and their landlords included in the alert. a reminders that under california law renters can not have their rent increased by more than 10% per year. they can't be evicted without a court order. and then only with just cause landlords are being reminded that they are responsible for repairing health and safety issues in the rental that they must return. security deposits

than 70 retail thefts in the bay area. police say 46 year-old jamie flores and 37 year-old thomas sepan do so have been targeting stores like nike best buy and target since last july. the suspects they say stole more than $75,000 worth of merchandise. both men are now in custody. the department says the organized retail theft detail actively investigated the crimes for more than 7 months. >> they go in court needed. they had a vehicle waiting for go in you know what? we're going to craft. obviously things like cost more front really helps us focus our resources, whether feel best way to protect the logical resources and personal to really focus on organized protests. >> takes money to do this. and last year, more than 8 million dollar grant to help fund the san jose police department's organized retail theft details as they caught. stay in the

south bay. a new ordinance in san jose will bring tougher penalties to people who are caught with unregistered catalytic converters. the city council approved this new bill this week. the changes will mean higher fines for catalytic converter thieves and to make it easier to charge suspects. council members argue the cost of replacing a catalytic converter is unreasonably expensive. residents agree it's time teams are held accountable. >> she worked for a shot. could go up to like 5, 6,000 put. >> convenience of other to get caught. we get the convenience that you know, we did try to get >> in 2023, more than 800 people in san jose reported having there catalytic converters stolen. south bay. residents against the war in the middle east are demanding a ban on city authorized travel to israel. there are no

scheduled trips for any officials to travel to israel, but speakers say they feel the city should not support israel due to the thousands of palestinians that have been killed. >> have humanity act for justice and do the right thing. >> the travel issue was not on tuesday's agenda. so the city council couldn't take any action on it. the san jose city council also has not considered a formal measure calling for a cease-fire in gaza. kron four's reached out to the jay crc for a response to this call to action and they released a statement saying jay crc bay-area is proud to have sponsored trips to israel and palestine for san jose and santa clara county elected leaders. and we expect that will continue. being elected leaders in direct relationship with diverse voices on the ground promotes understanding of the lived experiences of israelis

and palestinians. we need more bridges and not walls at this divisive time. that means ensuring everyone fields scene by building more bridges of understanding new at to the martinez refining company is warning the public. there will be intermittent flaring at the facility over the next few days. this will happen. well, crews temporarily shut down one of the processing units late last night. a flaring incident happened at the factory. it's not clear if the shutdown of the unit caused that. we've reached out to officials there and are awaiting response. the company says flares are an important part of the safety systems at the refinery to manage excess gases. all right. let's take a peek outside here on this wednesday afternoon. the view from our camera on sutro tower, a lot of clouds there. but sunshine has broken through. and gayle ong is with us to another dose of rain

that we saw this morning. yeah, it was soggy this morning and even this afternoon, in fact, for chuck clifford was standing, it was he said he felt hail. >> in the noon live shot. so as you can see across the bay area, we're starting to dry out. you see some blue skies and sunshine here. now we're dealing with the breeze. you can see it on the mount tam cam. so this was that radar activity of the last few hours zooming on. and it looks like the rain right now is heading east here and south east air. so san jose, south of san jose towards morgan hill, you're seeing some showers on 1, here. but then if you can even see some snow and about hamilton. but it looks like it's heading towards the central valley over there. and here's our future cast and what you can expect. so taking you through the afternoon. so this is a 5 o'clock for your drive. you'll notice some spotty scattered showers throughout the drive and most of the activity heading southeast, they're bringing some moderate rain towards east of san jose and even some possibly some ounce know this is a cold system. and then if you notice these lines here,

health. a new study says some plastics used in food containers and other items cause thousands of premature births in the u.s. every year. the lancet planetary health study looked at data from 5,000 mothers. researchers say the chemicals in plastics can disrupt hormones in pregnant moms that can influence hormone regulation as the child comes to term. chemicals in plastic car and everything from water bottles to

household items tupperware the american chemistry council which represents the plastics industry says just because there is an association between classics and premature births does not prove that plastic caused them. hundreds of workers at nasa's jet propulsion laboratory in pasadena are expected to lose their jobs today. tell them to prepare major funding cuts for the 2024 fiscal year. that caps jpl mars sample return mission spending. it just 300 million dollars. it was more than 820 million. lab. officials say more than 500 employees will need to be laid off as a result. that's about 8% of jp els. workforce when federal funding is approved, jpl will still get about 63% less money than it received last year. congressional members who represent portions of southern california are

>> is san francisco traffic safety advocates are urging the police commission to enact a policy that limits racially biased traffic stops. it proposes banning pre text stops as they call them for low level offenses, including failure to display are properly mount license plates, registration tags and driving with expired registration. most of the stops have been focused on black driver. according to the commission for more than 2 years, the policy has been put on hold today. community members sent a letter to the commission requesting the policy finally move forward for a final vote. the policy is set to be discussed at tonight's commission meeting and we'll keep you posted there. in the south bay gilroy. police are investigating vandalism at a high school where hate

graffiti was written on walls throughout the school. this is it. christopher high school on monday night. police say 3 suspects also ransacked multiple classrooms. anyone with info is asked to contact gilroy. police. in the north bay police in fairfield arrested a 15 year-old boy on suspicion of creating a swatting response that cause schools to go on lockdown for several hours. friday vanden high school in 2 other schools were placed on lockdown after police dispatch got a call saying that somebody of end and had a gun. police say they suspected the call may have been an attempted swatting and investigation was carried out by the school's rasource officer and that led to i d ing a 15 year-old bend and student as the suspect yesterday officers arrested the kid at his home and he was booked into juvenile hall. in

the north bay. the latest storm just ripped the roof off 150 year-old church in napa. the congregation work together to save the interior of first presbyterian church as rain came down hard sunday, chaotic scene. crowd force sarah stinson shows us the debt each. >> high winds ripped to parts of the roof off here at the first presbyterian church in napa. you can still shingles scattered along the street. now the church community is working together to restore this historic landmark first built in 18, 70 for the storm on sunday ripped through downtown napa, damaging the iconic first presbyterian church on 3rd street. when was over 40 miles an hour. >> and the wind got under these copper panels here and lifted him up over the roof onto the street onto the sidewalk. thankfully, no one was hurt, but pieces of the copper roof slammed into the

stained glass windows. breaking several panels. that was the windiest storm i've ever seen a nap and 47 years. david crawford served as napa city council member and interim mayor in 1988. >> he now volunteers as a youth leader at first presbyterian on sunday. he was among several people jumping in to protect the interior of the church from the rain. so i came down here. there are about 20 people from church that where they're putting plastic out putting buckets out draining water off the charts. >> trying to keep the pews, the him knowles, the carpet. >> dry crawford says they're working to patch up the roof, especially with more rain in the forecast. once insurance assesses the damage, they can hire a contractor. crawford says it will be a community effort to fully restore the historic church. the whole congregation is ready to help out a lot of people. the community love this church, even though they don't go here because it's such a >> beautiful landmark building. so i'm sure they'll be helping to sunday service

of multiple spinouts. chp truckee held traffic at castle peak. so plows could clear the roads of ice and snow both rest areas nearby were also close so they can get all that snow out of there. 80's back open. a chain controls are in effect for eastbound traffic from king veil to the donner lake interchange on highway 50 eastbound trucks are being screened at twin bridge. and here is a great example of why those chain controls are in effect. chp truckee shared this video with us this morning showing a truck barely hanging on dangling over the side of this. the point there, they say. miraculously, nobody was hurt here. they remind everyone take it slow on ice and snow. and we want to talk about the forecast there for the sierra gayle ong is tracking the conditions out only here in the bay, but also in the high country and gayle,

the snow is really started to pick up the past week or so. >> it isn't. you can tell us so many people are excited to get out there. this is happening again. it's beautiful out there. i want to busy it is. you can see all w the snow moving in towards the sierra. so there's actually a winter storm advisory in place. so it is not advised to travel east. want to be careful because as you saw chain controls are in place and travel could be difficult. as we saw with delays and those spinouts. so 6 to 12 inches above 4500 feet. and thus, we could see snow levels down to the 3,004 1000 elevation. and so keep that in mind. if you're heading out there. and here's the incline village on the nevada side and the north lake. so showers tomorrow night. and then when you get there this weekend, if you're going to be leaving, maybe like friday morning, once things settle down and trucks do their job. we have low 30's down there. mostly cloudy, partly cloudy skies for the weekend. back here in the bay area. we're starting to see some blue skies.

chopper departed creech air force base northwest of las vegas yesterday was headed for marine corps air station miramar in san diego. but it never showed up. the supreme court faces a crucial question about the presidential election. the justices will hear arguments about whether former president trump should be ineligible to run for office under the constitution's insurrection clause. kron four's washington, d.c., correspondent hannah brandt has a preview of the high stakes here. >> the supreme court is set to weigh in on a colorado ruling booting donald trump from the ballot. there are lots of implications for the 2024 election on thursday. the justices will hear arguments over the constitution's insurrection clause. it says anyone who engages in insurrection is barred from holding office. the colorado supreme court ruled that makes trump ineligible, but trump's legal team is appealing the decision he deserves to be on about the ballot is their argument and voters should

decide who becomes the next president and not courts. georgetown law professor michele goodwin says the case hinges on the question of whether the insurrection clause applies to the office of the president. this is a highly unusual case because we've not been presented before with the backdrop like january 6, donald trump's political fate could be decided by this case, but he isn't expected to be here at the supreme court for the hearing, though, his allies across the street at the capitol are jumping to his defense. they cannot beat. >> president trump. >> and an actual free and fair election. so they are tryirg to rig the game. >> and the courts, colorado congresswoman lauren boebert slammed her state's effort to keep trump off the ballot. absolutely absurd. completely un-american, completely unconstitutional. and congressman matt gaetz says he thinks the high court will side with trump. our expectation is that the court will not embrace the anti democratic impulses that we've seen elsewhere. we don't know when the court will issue its ruling, but there is pressure to resolve the case by early

march when colorado holds its primary election in washington. i'm hannah brandt. south carolina governor nikki haley, who's also a current republican presidential hopeful, will hold a campaign rally in southern california this evening. >> this comes after she lost in a vat is republican presidential primary yesterday, even though she was only the only major candidate on the ballot. more people chose the option. none. then hailey. she chose to compete in the state-run primary yesterday. instead of the caucus is run by the state republican party because the former president trump is expected to easily win the caucuses tomorrow. the primary is mainly symbolic. that is republican caucuses are the only contest that counts towards the gop presidential nomination. trump is the only major candidate on the ballot for that. why taylor swift is
