>> what supposed to be the american dream. is now not there. home insurance crisis. the north bay couple struggling to get their home insured. >> and a high wildfire risk area after being dropped by their insurance company of nearly 2 decades. when fun time. >> from the bay area's local news station. you're watching kron. 4 news. >> thanks so much for joining us on kron. 4 news at 10. i'm vicki liviakis. i'm ken wayne. we begin with a sad update to what's already been a devastating story. san francisco police the infant who was seriously hurt in a crash at a bus stop over the weekend has died the crash. happened saturday in the city's west portal neighborhood. police say a family of 4 was waiting for a bus to go to the zoo when a speeding suv barreled into them first killing the parents and their one year-old son, the youngest member of the family infant had been hospitalized since the crash. but again, police say that baby died today. meantime, the

78 year-old driver of the suv has been released from custody. mary fong lau is currently facing several charges that include vehicular manslaughter and reckless driving. her attorney says she has been cooperating with investigators. new at 10 antioch police are on the scene of a deadly dirt bi crash that killed one person and seriolyinjured. another. >> the crash happened shortly after 5.30, this evenig. police say a 20 year-old man was riding a di bike and then ran a stop sign t intersection of el and west 4th street andoided with van. the driver of the van only identified as a 52 year-old man was taken to the hospital. he is said to be in critical condition right now. police say they are not releasing both men's names until they can notify the victim's family ongoing problems of shoplifting and loitering. teens now have a bay area police chief reaching out directly to safeway executives. police chief of

sebastopol wrote a letter expressing his concerns. >> at the grocery store the safeway is just down the street from emily high school. the chief says that high school students have been loitering and stealing merchandise, creating an undesirable environment for paying customers chief also sayss partment has been providing additional patrols to area, but do not have any resources available to address the suatio suggesting safeway at a higher on-site security. a safeway spokesperson tells us that they're looking into the chiefs concerns. this comes after safeway stores across the bay area installed these gates at the self-checkout after customers finished purchasing the items they have to scan their receipt for that gate to open. state lawmakers from both sides of the aisle are launching a new effort they believe will help combat retail theft. our grant lodes joins us now live in the studio with how this top act would work. grant. yeah, they want shoplifting to stop this

bill authorizes an officer to make an arrest for a misdemeanor shopping offense, even if that offense was not committed. >> in the officers present, saw the cop would need is probable cause to believe this person stole something and then they can arrest them. the assembly member behind the stop act says in addition to protecting the public, the hope is he also protect jobs. it is a threat to our livelihoods. >> our hard-working california's and the blow to our economy in community, especially of color. supporters of this thing say would also allow officers to arrest in book shoplifting suspects into jail instead of just >> citing and releasing them. but still, some republicans believe any reform must include a repeal of prop. 47 passed by california voters in 2014 that law changed certain nonviolent crimes from

felonies to misdemeanors, including theft when the items stolen are valued, less than 950 bucks. while supporters have long argued the law helps reduce california's prison. overpopulation opponents say it allows criminals to receive little to no punishment. that really contributed to the problem. and so. in order to find a solution to have to first address the problem and that's front court. he's out. >> it's a big picture. the stop act will now head to the assembly. public safety committee and will. but you know what happens? vicki can back to you. all right, another big story we're following for you. more than 2 weeks after election day, prop one is officially projected to pass as of this evening. the measure is leading by about 29,000 votes after some 7 million ballots were cast. a prop one authorizes the state to borrow about 6.4 billion dollars to tackle the state's homeless crisis. that money would go toward housing and

treatment programs. now, opponents expressed concerns that the bond will simply throw more money at the problem without adequate results. but governor newsom argues the measure will make a difference in combating the state's mental health and homelessness crisis in san francisco. kron 4 talked with some of the city's unhoused after supervisors revive the homeward bound program. the passing of this ordinance pays for unhoused people or those living in shelters to get transportation back to their hometown. the program is voluntary, but the big question is 2 people want to leave. they get to work. the cause if they knew how excuse my language. >> their sons and daughters are out here. the highs that they probably want to home suffering from. >> you know, trauma from here, trauma from their childhood just makes it a trigger. you know, parents weren't allowed come back. will be. really good

>> homeward bound program was first initiated back in 2005 and assisted about 11,000 people. as to the details of how or when officials will begin to implement and use these resources to send people back home. right now it's all unknown. >> some lanes are shut down. and sonny bill, all because of a water main break there. as you can only one lane is open in each direction along fair oaks avenue between caliente drive and ahwahnee avenue just south of one to one. >> officials say that the lanes will reopen once crews can finish with the repairs. >> well, it turned out to be another nice day around the bay area. temperatures warming up in the 60's and the 70's again. can we do it again? tomorrow morning. we're starting out with a few more clouds early on tomorrow. so mostly cloudy skies to begin your day. not quite as cold generally in the 40's and low 50's toward the coastline by 08:00am. if you're headed on the commute, still a lot of clouds in our sky. staying mostly dry, though. temperatures warming up in the 50's by 10 o'clock. well, the

sky's going part just a little bit. partly cloudy skies, 50's and 60's. big change in weather is coming our way. we'll have more on that in a few minutes. this just in the highway patrol has released a dash cam video of a freeway shooting that happened on 8.80 near highway 2.38. in hayward. >> this happened about 4 o'clock yesterday. you can see the suspect rolled down his window and a handgun at the victim's car as he exits the freeway. the victim was not hurt, but you can see the damage done to their car. investigators say they have identified and arrested the suspect today. we don't have that person's name, but he does face a number of felony charges. >> paused the video before shots were fired. the napa county sheriff's office releasing this video of when a deputy shot at a suspect who they say was carrying a gun. they say the suspect suffered

non-life-threatening injuries and was given immediate medical care. the shooting happened back in january after investigators say 2.18 year-olds were involved in a police chase. and that started in american canyon and then ended with this crash video in valais how authorities say the police chase both of them until they crashed and tried to run away. the deputy who fired the shots was placed on administrative leave. efforts are being stepped up to try to clear out death-row prisoners from san quentin. the california department of corrections and rehabilitation says the. >> remaining 457 people incarcerated on death row will be sent to about 2 dozen other state prisons by this summer will be put into the general population and will have access to more rehabilitation programs and treatment services. governor newsom says he wants an quinton to become a facility that focuses more on rehabilitation education and job training.

>> $850,000 is set been secured to replace a nearly 100 year-old cupertino bridge of that bridge on mcclellan road. it's a major east-west connector in that city sitting right over stevens creek walk. bike cupertino has been pushing the city to create an underpass for pedestrians and cyclists. the group's chair tells us that the road is a blind curve and could be dangerous for people crossing, especially for those who choose to jaywalk. cars are just coming around the corner. >> and so if you're a senior citizen and you walk slow or you have small children and you walk a little slower, it can be a little bit scary to cross either of these intersections. unfortunately, the project is not fully funded yet. we are told that the city needs a little more than 2 million dollars before they can get started. >> a new class action lawsuit has been filed against french luxury over the how it sells its famous birkin bags. >> britons are only sold in

physical locations stores and can cost more than $100,000. the suit filed in san francisco's federal court this week unlawfully requires customers to buy as products before being allowed to buy a ber can. the lawsuit asked the court to as from engaging in the alleged actions. it also seeks an unspecified amount of monetary damages and restitution there are has stores in the bay area. one in san francisco's union square, another in palo alto and another one in sight. sfo. >> still ahead, a california community gathers to remember the life of a toddler killed after being hit by a car that had another toddler behind the wheel. a hidden camera found inside a starbucks bathroom in the south bay. how many customers? police say the camera caught on video and who camera caught on video and who they say put it there. would. i would not feel comfortable going to public. >> many in the south bay feeling that way tonight after more than 90 people are filmed inside a starbucks bathroom with a hidden camera. the man believed to have set up that camera now in custody. san jose police say he's a former starbucks employee kron four's. rob nesbitt has the story employee at the san jose starbucks on covid ave first noticed the hitting camera on january 31st under the restroom sink. >> and then called 9-1-1 to report officer tanya hernandez says the camera recorded 91 people the day before ranging from the ages of 4 to 85 years old. these craft, these this

recording is graphic and >> includes multiple juvenile victims fully exposed after nearly 2 months of investigating police arrested luis suarez junior on friday for possession of child. >> and installment of the hidden camera with audio or as is also facing several gun-related charges after police discovered roughly 20 firearms at his home, including high capacity magazines and assault rifle. i spoke with starbucks customers outside the coffee shop about the arrest and hitting camera first. heard about those like that's scary. >> i don't people are thinking world launched knots. i'm glad that thecaught the person. starbucks released a statement wednesday saying, quote. >> this is a deeply disturbing incident and we are grateful for the quick and thorough response from the san jose police department and apprehending the suspect. we cannot overstate the importance of providing a safe environment for our customers and partners. this incident is very scary. want the public to be aware just to be i'm aware

of their surroundings. investigators are hoping to speak with some of the victims. if you are at the san jose starbucks back on january, 30th between the times of 09:00am and 07:00pm and you think you might be one of them. you're asked to contact the san jose police department reported in san jose. i'm rob nesbitt kron. 4 a san francisco police officers been found guilty for groping a woman inside a marina district bar. >> according to prosecutors back in december of 2021. off-duty officer michael herrera was sitting next to a couple at a bar on lombard and webster >> investigators say herrera became aggressive and groped the victim. prosecutors say herrera faces up to a year in county jail and must register as a offender for 10 years. his sentencing hearing is scheduled for may. >> 3 women who claim they were sexually assaulted by a former bay area police officer have just won a 35 million dollar lawsuit against the city of san mateo in 2019, former san mateo police officer, noah winchester was convicted of sexually assaulting 4 women.

the attorneys for 3 of the victims say the san mateo police department ignored red flags when making the decision to hire winchester, including reports that winchester was a suspect in another and other assault while he was an officer in sacramento. attorneys say winchester rapes, the women under the threat of a resting or incarcerating them. winchester was sentenced to 81 years to life in prison. park officials in the east bay are warning visitors about harmful algae blooms detected in several parks, including >> lake chabot conditions like low water levels, limited water circulation, increased temperatures are causing the algae to bloom and then release toxins. but yes, wildlife can be impacted. >> people at are going to shuns depending upon their length of exposure. and then also what talks and it is. so you can have a scan our irritation. you can have ira taishan. you can also gastrointestinal issues. you

francisco. 52 in a bottle and 54 degrees right now in palo alto. but we're getting ready for a big change in the weather so far. so good is remaining dry out there right now. but you see little swirl off the coastline. that is a weak frontal system that is approaching the bay area and not not going bring us any rain, but what it will do is help them move that ridge of high pressure that's been sitting over head and move further east. and that means we're going to open up the door to what looks like a much wetter pattern developing in the pacific. you can see right now deep trough of low pressure out there. you've got another system following right behind. this will eventually be the one that brings a first round of rain that could come as early as friday. and then that opens the door to a series of storms that will likely impact the bay-area least over the next 7 to 10 days, maybe even longer than that. so tomorrow, high pressure is going to kind of just sneak its way all the way, but not before leaving another nice day ahead. i think tomorrow should be another nice one, although we'll see some passing clouds out temperatures ptill going to be moving up in the 60's and the 70's. but you can

already see that next storm off the coastline. that will begin to move on a little bit closer. and then as we get into friday, well, here comes you see here on the computer models tomorrow, wake up some clouds early on as we head throughout the day. still some clouds on and off throughout the day, but staying dry as we get to friday, that all changes here comes your next round of rain on the way wintry weather to make return. we'll have more on that in your 10 10 coming up in a few minutes. thank standard. 6% realtor commission on buying or selling a home is coming to an end. it's due to a massive 418 million dollar settlement with the national association of realtors. the settlement stems from a federal lawsuit accusing the trade group of inflating real estate agent commissions. >> most home sellers currently pay 5 or 6% commission fees, 4 million dollar home. that's between 50 $60,000 in fees. real estate experts say the settlement could create a more competitive housing market. >> the list a half or so.

tonight after police say she hit and killed an elderly man with her car while being under the influence and with a toddler in her car. it happened last night. investigators say the man was walking on highway 101 north of mckee road. the exit there when he was hit, the driver was arrested, but no charges have been announced. she is being held currently at the santa clara county jail in yolo county. police are investigating after a three-year-old somehow managed to get behind the wheel of a truck. >> and run over another toddler, candles and flowers are now at the site where the 2 year-old girl was hit and killed happened at a gas station in woodland ju outside sacramento. police say the 3 year olds father left the toddler in the driver's seat while the truck was running, stepped away to go to the gas station. the father has not been arrested. the 2

year-old girl was supposed to turn 3 next month. and internal audit firm. bart shows 3 employees who claim to be working 10 hour days with briefly report to duty before then going home. >> for mature portions of their ships. the report claims that the 3 employees collected and and earned base salary little extra earnings from shift pay over time and double time. pay on holidays. well, their specific roles were not released. bart says that the employees we're not approved for remote work and that their duties were not conducive to remote work. the report adds that one of the 3 employees retired once confronted by the bart police department, child marriage survivors are pushing for a law that would end child marriage in california. california is one of only 4 states in the nation with no minimum age for marriage. according to statistics in 2021, almost 9,000 children were married here in california loopholes in

>> and it's all due to our address being close to a wildfire area. >> the to quickly hired insurance brokers to find a new insurance company. the search that's getting more difficult by the day. and we were denied by 157 insurance companies. no one will take us. i mean, even today i received 7 o'clock. the niles, if the couple does not get insurance, they can lose their home. the state does offer a last resort option. the california fair plan and the ladies have applied for it. but they say it's not an affordable option. costa, 6% higher and it's less coverage for us. my husband is retired, run a fixed income. and we don't have a lot of options. gretchen says they can't even sell their home, putting them between a rock and a hard place. my home just got valued. nobody's going by my home. know if they can't get insurance and the melendez are not alone. thousands of californians are feeling the pain of the homeowners insurance crisis. many

companies have announced limiting or stopping new policies altogether due to inflation and increased risk of wildfires. janet ruiz with the insurance information institute says the insurance industry is working with the state to bounce back in the last 10 years for a very >> premium. that wheat, we pay down a so that's not really sustainable. but we would we want to be here. we're working with california department of insurance insurance commissioner ricardo, lara, announce a new strategy to keep private insurance companies in the state. all a part of the deal to consider future ris and climate change. one setting prices. >> senator mike mcguire says legislation needs to be passed to protect homeowners. we need a pathway for that homeowner. >> to get renewed once again in back into the traditional insurance policy. what i'd

doing enough to protect a jewish students from anti-semitism. pastor says his goal is to get the attention of the administration. >> i wanted to find a way to protest. that was not confrontational. that sent a very clear message of support for jewish students. that was perhaps a little uncomfortable of for campus administration. but i also didn't want to embarrass the campus in some way. the campus knows that at the summit is a serious problem at berkeley. the campus is trying to address it as best it can maybe needs to move a little faster. >> pastor says he is gaining support with professors from other schools like stanford who are now also sleeping in their offices. uc berkeley sent us this statement in response saying, quote, the university remains committed to fostering an environment conducive to robust free speech and in which all members of its community feel that they may engage in campus life without fear of harassment, including harassment on the basis of

religion, ethnic and or national identity members of the california legislative jewish caucus are introducing a bill they hope will protect all students from violence and hate. >> they've introduced a bill that would require state universities to update their student code of conduct conduct, rather to prohibit violence, harassment, intimidation and discrimination on campus and launch programs to facilitate constructive, yet respectful dialogue. the legislation comes amid a wave of anti-semitic and islamophobic incidents set university since the start of the israel-hamas war. >> i want to be clear. jewish students are being specifically targeted here. and being bullied and intimidated, harassed and sometimes attacked. so that they are not able to congregate associate learn. be who they are and that my past to stop. this is very much about the incredible

anti-semitism that has manifested itself. >> on our campuses, but he's also very much not a jewish issue because the idea that students should feel safe on campus should feel safe to express their ideas that we should have a robust exchange of ideas. that is something that is important for all students. california's public school systems have not taken an official stand on the bill. but lawmakers say >> they have received positive feedback from the uc and csu presidents. >> democratic lawmakers are proposing legislation that would guarantee 2 weeks of paid annual leave the protected time off act. it would grant the benefit to nearly 27 million americans who don't have any paid vacation time. it would require employers to provide one hour of paid annual leave for every 25 hours worked. critics claim a broad government mandate isn't the best answer for different companies with different needs. but supporters of the bill say that the u.s. needs to catch up to other industrialized nations, which

series of storms. spring storms rolling in and cold storms right through next week and they're going to bring with it a significant amount of snow, not just a few inches of snow. we're talking one to 2 feet of snow through the weekend. we're going to be adding up totals even higher than that by the end of next week, too. so if you're traveling up there, you've got a carrier change with you play. expect delays and really make sure you time out the weather. watch. kron 4 for the latest forecast to get over the mountains without much trouble right now. winter storm watches have been posted from friday until saturday night. that will soon likely become a warning as the storm gets a little bit closer. but yeah, you can kind of see the change. tomorrow is a nice day. some spring-like conditions. temperatures in the 50's. then as you get in toward friday, turning to some raindrops by friday night, that turns the snow. a look at the change in the temperature from friday to saturday. yeah, winter really kicks back in much colder temperatures on thursday. the high country. so be prepared. if you're traveling up there, make sure you have the dollars to pack. it's back to wintry weather across the sierra nevada up there right now. it's kind of quiet out toward the golden

gate bridge, looking good out there. so we speak. but i think overnight tonight we'll see a few more clouds floating on through tomorrow. another nice day, mild to warm and then the rain moves in on friday and cold showers continuing throughout the week. partly cloudy outside right now with the onshore breeze. long-range forecast, though. yeah, here's the big change tomorrow. one last good day. in fact, we'll see some high clouds streaming up above. still, i think we're looking at some 60's 70's by tomorrow afternoon. then the storm clouds roll in about the middle of the day on friday, bringing rain across the bay area behind that. that low kind of swings through too. that will keep the showers going on and off of that cold air moving in the sierra nevada, it will bring some snow in the high country that likely continuing now into sunday morning behind that, a little bit of a break. then another storm system drops in on wednesday. that another going to be a cold storm. and then yet another one moves in as we head toward next weekend. so you get the idea now of what we're dealing with back to some wintry weather around the bay area. temperatures looking like this by tomorrow afternoon be a nice day in the santa clara valley. enjoy this last one. 72 degrees in san jose about
