>> now to be convicted, murder of 12 year-old polly klass in court today. why his representatives are arguing that his death sentence should be reduced nearly 30 years after the initial verdict and the lawsuits filed against the owners of the half moon bay mushroom farm where one of the worst mass shootings in san mateo county has ever taken place. we're hearing now from the lone shooting survivor. plus baseball back in the bay. we are live at san francisco's oracle park fans are still pouring in as opening day is now underway. >> news station. he's calling for news 2. >> thank you for joining us here on kron. 4 news at just involvement. convicted murderer richard alan davis. his attorneys were in a south bay court today. they are attempting to have his death sentence reduced back in 1996, a jury found him guilty of murdering 12 year-old polly klass in petaluma. now kron 4 secure our ports from san jose

where his representatives are arguing that based on a new law, his sentencing enhancements should be dropped. >> i'm having to relive my daughters murder again and that that's just so terribly unfair. marc klass return to santa clara county superior court in san jose friday. his late daughter, polly is convicted. killer richard alan davis did not. i loved the prosecutors confidence with his absence. court-approved davis's defense requested the hearing arguing his death sentence should be reconsidered based on new law that disregards previous sentencing enhancements. prosecutors say he is not eligible and that the attempt to vacate a jury verdict is unwarranted. this individual has been given every consideration under the law from the moment that he was arrested and he's failed in all of his attempts to get. >> to to, to get relief, to get re-sentencing on. even gone to the california supreme court. but here we are.

>> yet again in 1993, polly klaas was kidnapped from her home in petaluma during a slumber party. 2 months later, davis confessed to killing and burying the 12 year-old girl in a shallow grave near cloverdale. on friday, a motion was filed by the defense to relitigate the sentencing. another filed by prosecutors disputing qualification the judge heard arguments but did not issue a ruling. marc klass never expected he would have to return to court for this case after davis was convicted. i might have said something to the effect that this is finally over. >> yet here we are 30 years later, this case returns to court at the end of may. >> in san jose, philippe djegal kron. 4 news. >> in the east bay police arrested a man accused of starting small fires around fremont and newark firefighter son fremont spending hours putting out these fires after some furniture was lit on

tuesday morning. then the same day in newark, a person put out a fire that was set on stairs at a vacant building. there are also reports of nearby dumpsters being lit on fire. police also then got a description of the suspect and found a man matching that description starting another fire in a wooded area. your foreign avenue and 80. 36 year-old joseph paulson, a newark resident, has been arrested now for our son. but no one has been hurt in all of this. hercules police have arrested a man that they say is connected to a number of car burglaries around the east bay officers stopped the 47 year-old yesterday morning after they say he was prowling around turquoise drive. they searched his car, but let him go after not finding any evidence of a crime. and then there was a woman who fled. police reporting her car was burglarized officers found them and that they had just let go circling a nearby neighborhood. and then he admitted to them to stealing from carson. hercules and pinole was arrested for charges including burglary.

happy friday. no rain from this shot right now. looking out towards the bay bridge here in san francisco. but it is quite chilly out there. we have meteorologist kyla grogan at here with details. it's friday. so whatever you got. good friday we made it everybody. >> notice the use of trees blowing around a little bit there. you kind of detect that here as well. we're getting a bit gusty right now. we do have that mix of sun and clouds out there. but yes, justin is right. still very chilly in many spots right now. san francisco. 51 degrees. my warmest number. the map right now. santa rosa coming in. it 59, but obviously no one in the 60's when we should be more in the upper 60's this time of year. here is that when you can see kind of rolling in from the northwest right now and then a bit of an onshore flow in san francisco about 28 miles per hour or so quite gusty. if you are anywhere near the water. we're also seeing what we're talking about a little earlier today is that we get the heat of the day. we start to get a little bit of convection because we still have a very unstable air mass that is over us. so you can see this right

now in napa getting a little bit of a shower. you can see a cell popping up there with some heavier showers right near fairfield and they're heading down into the east bay right now. so some scattered showers notice still very cold. so we look out at spots like about the album out hamilton, getting a few snowflakes up there, too. so we will remain unsettled as we get throughout the afternoon and evening. and then finally, this will start to move on. but right now we are still under the influence of low-pressure and some very, very cold air making things a little bit kind of not exactly like they should be right. so tonight the skies will start to clear a bit, but very chilly temperatures as we get into our overnight. in fact, so chilly that we are under a frost advisory up in the north bay, the interior portions of the north bay and the east bay because we could see temperatures get down again into the 30's tonight. so just make sure you're making your preparations and be ready for that. this evening is our last night. a really cold temps. i'll be back in a bit. we'll talk about a very big warm-up. that's on the way. all right. >> there are 2 new bills

aiming to help ease the symptoms of opioid withdrawal for people recovering from addiction. the bill introduced by san francisco assembly member matt haney would make the drug methadone more accessible for addiction treatment. the treatment is available in california, but patients are currently required to line up in front of specialized clinics to receive it. says drug dealers often gather in front of those clinics to sell drugs to vulnerable former users. he wants to expand methadone is readily available as narcan. and he was shot 5 times during a mass shooting, clued once in the face. and now he's speaking out. pedro perez worked at the mushroom farm in half moon bay. he was there last year when a gunman opened fire. his brother and 6 others were killed. and now a worker's been charged with their murders. kron four's theresa stasi reports that presses suing the farm for not protecting workers from harm and for deplorable living conditions that were exposed after the shooting. >> i have suffered a lot.

>> those i was 2 months in the hospital. >> speaking with the help of an interpreter pater perez shared how he lives in pain every day since the mass shooting in half moon bay last january. on that day, he says that the shooter identified by police disgruntled employee surely shao shot perez 5 times twice in the stomach once in the arm, hip elbow and face barely getting consent happened. and still not working. >> he's struggling emotionally from going through the experience of being a witness to his brother's any struggling financially because the injuries that he suffered are preventing him from working bres is now represented by coaches pitre mccarthy. >> they are suing tara gardens, the owner of the mushroom farm where they worked for negligence and wrongful death. perez's brother who say died that day leaving behind a wife and 4 children. perez says that he

no insulation or kitchens to prepare food to eat in half. moon bay, theresa kron, 4 news. the city of san jose has launched a pilot program that uses artificial intelligence to detect homeless encampments. >> city officials say the technology is used on one city vehicle to provide better essential services for those in need. but homeless advocates worry this will be used to push homeless residents out today on kron. 4 news at noon, we spoke to san jose mayor matt mahan about how this technology will work. >> and we have one car. we've got outfitted with a half dozen cameras were just beginning to test this one of the things we found we actually didn't set out initially to do this. we're really focused on potholes and graffiti to start. is that these cameras are pretty effective at identifying where people are living in vehicles. this is on road only. we're actually not focused on tent encampments with this pilot. but on on roads were able to figure out when people are living in their car, rv.

president of the san francisco board of supervisors and it's been on the board on and off since the early 2. thousands. he is joining incumbent mayor london breed supervisor ahsha safa a full and the rest and jewelry and former san francisco mayor and supervisor mark farrell. well, these are in detroit today taking on the tigers. but back here in the bay, we continue to follow the latest on the fallout from the organization's recent announcement saying that there are going to be moving this year will mark the final season that the team will play in oakland and with the a's moving to sacramento. the big question is what's going to happen to the oakland coliseum? alameda county leaders say the focus will be to bring in as many events as possible, such as sports with the oakland roots so they can play the coliseum, possibly even oakland, ballers, who are hoping for a chance to play there. but former longtime a's executive andy do lunch. he's an expert in this field. he says several 100 workers from security management operations, concessions and parking are going to be

impacted by this. >> coliseum was the last town square left in open that people of all backgrounds could get together and celebrate their sports teams. and now it is going to be a quiet location. >> all right. meantime, councilmember rebecca kaplan post on social media list of possibilities to fill the coliseum spaced. and that list was from an op-ed that she wrote 5 years ago, which includes affordable housing, a music venue and a convention site. so this will be the last a season for hundreds of vendors at the coliseum sellers, a beer hot dogs, peanuts and popcorn are now down to their final 74 home games for a long time. beer hawker and oakland native kendrick thompson. the a's moved to sacramento is heartbreaking. he says he's going to. this is going to cost hundreds of jobs, including his. he has no plans, though, to follow the team to sacramento.

>> i don't know if this is an earthquake. use it don't think >> some developing news now from the east coast as residents in new york and across the tri-state region rattled today by a 4.8 magnitude earthquake. it hit around 10, 30 eastern time that senator about 50 miles west of new york city people, they're posting videos to social media saying that the quake caused some cracks in the streets. no reports of any major damage or injuries and seismologists are saying quakes in the east coast can be felt at a greater distance and compared to those that happened here on the west coast because the rocks in that region are often older, harder and more debts. here's what it looks like outside right now across the golden gate bridge. big clouds out there. hope the people got a jacket or sweatshirt or hat. maybe chilly out there. cuyler your friends on the east coast saying what? >> yeah, that was they all wanted to do was going on. and, you know, i looked it up

and made this is the most impactful earthquake they've had since the 18 80's in new jersey. but like typical east coasters, do they have a little bit of a fit and then they get on with it, right. so everybody's okay. w heang of any damage. and that's the really good news, obviously. but definitely shook everybody up. >> literally and figuratively this morning, we're looking at some clouds out there. you can got a big fluffy clouds indicating that these are capable of producing some showers rig now. so we're still looking out for that shower chances we roll through our afternoon into the evening. cool temperatures today. tonight we're going to have the coldest night of the week. we are under a frost advisory for the interior north bay and east bay tonight. so get ready for that. and then once you're ready for that, get ready for this weather whiplash. we've got a wild warm up coming next week. so let's deal with these showers. this chance of showers through the afternoon. future cast here showing you most of the seems to be confined to parts of the east bay and north bay. at the moment. but as we go throughout the evening, that energy will finally start to shift away from us. and then we will be done with it. having said that, when we get

into saturday saturday looks really great. but as we get to the overnight saturday to sunday, a very weak front trying to throw just a couple more showers our way remaining unsettled. and even on sunday afternoon, you see just a little pop on the radar. so if you see a shower or 2, it's not likely to be high impact. but just keep an eye out for this as we go through our weekend. now, once the weekend is done, then it's a whole different story. and the system really fully moves on and we lose this kind of juice step air mass that's been causing all the cool temperatures and also giving a since the instability that is allowing for some of that shower activity to happen. so low pressure will move away. and then here comes high pressure to the rescue. everybody as we get into monday in particular, we're going to see the temperatures start to move up as high pressure is going to fully in control to the point where we get towards the end of the week, we're going get some really incredible temperatures just between now and monday. you can see i'm expecting things to go up about 10 to 12 degrees. but take a look at your extended forecast. by the time we get to next thursday

and friday. we're talking inland 80's bay 70's. yeah, that's a big difference. well, above average, we should be maybe about 70 degrees inland this time of year. alright, worked. now the national news as president biden is in baltimore today to offer his support following the collapse of the francis scott key bridge. >> our washington, d.c., correspondent raquel martin is in washington with more on the president's visit. president biden is pledging to help the port of baltimore rebuild following the collapse of the francis scott key bridge. the white house says rebuilding this bridge is a top priority. >> to reduce any economic blowback. >> the damage is devastating. the president got a firsthand look at recovery efforts and met with local leaders are here to say your nation has your back. and i mean, the president has promised baltimore that the federal government will pay 100% of the cleanup and reconstruction of the bridge. we're going to get this pay for, aren't how

much that will cause is unknown. the bridge collapsed after being struck by a container ship last week. 6 construction workers were killed, all the families and loved ones are grieving. come here to grieve with right now. federal and local authorities are racing to clear wreckage blocking ships from reaching the port. they've opened a temporary channel for smaller vessels. in the meantime, thousands of port workers are losing paychecks daily and the economic impact is spreading to local businesses simply put. fact, here is a significant impact everywhere. the u.s. army corps of engineers predicts the port will be partially reopen by the end of april and is aiming to return to full operation by the end of may now getting funding from congress may be easier said than done while the republican speaker of the house, mike johnson is showing support. not every republican is on board. some of the most conservative members in the house say they want to ensure

that the shipping company responsible for this crash also pays its share. >> for now in washington, raquel martin, back to you. and then southern california officials have been left puzzled in los angeles after what might be the largest cash heist in the city's history. >> thieves breaking into a vault and making off with 30 million dollars. this happened easter sunday and police say the thieves possibly enter the building through a side area. maybe even the roof. and then they managed to break into a safe storing all of that cash and it did not trigger the alarm system. it was not until monday that the company employees realized that that huge amount of money was all gone. and investigators say it's unknown how the burglars, that all that money was stored there. 30 million dollars. all right. check this out because these were some dramatic moments that were caught on camera as a small plane crash lands in a yard in florida. this happened yesterday afternoon after the plane took off from the tampa executive airport. and you could see there the plane's emergency

clocking into work. the survey by one poll says that the average american puts 84 hours a year. >> while battling a cold colder some of the virus. the poll also found the average person works more than 10 days per year when they feel sick. and nearly half admit they'd rather power through then take a sick day around 30% say they're worried. others may think they're being dramatic when they're feeling unwell and others say they hear negative comments made about other people who call out sick. and if you feel like your allergies are pretty bad this year, you are not alone. scientists at harvard are now saying not only are allergies intensify, more people are finding themselves allergic to airborne irritants for the very first time. and they're blaming global warming. researchers say a warmer in climate is increasing the growth on trees and plants higher temperatures also leading to earlier and prolonged blooming seasons increase. rainfall also plays a role causing plans to release more pollen when they bloom. a drug that's used to

pacifica police releasing body camera video following a deadly shooting in last week. officer shot and killed a mom who they say >> had just shot and injured her son kron 4. sarah stinson has more but a warning this could be difficult to watch. >> the daughter says her mom has never been violent before. she says the night prior to the shooting, they were celebrating her brother's birthday. she says that's when they learned their mom had bought a gun. they tried to convince her to return it. she says they're still in shock, but she's glad her brother's, ok, gunshots, gunshots.

>> newly released body camera video shows the moment leading up to a deadly police shooting in pacifica. it was before 8 in the morning on march 27th when a 23 year-old man called 9-1-1 after locking himself in the bathroom of his apartment. he says he got shot by his mother. police identified her thursday as 50 year-old michelle raise shot. you woman? >> believe that point a moment. >> police say a raise was just pulling out of the apartment complex on francisco boulevard. 2 officers tried to stop her one on each side of the driveway. >> stop police lowdown. the video to show a raise pointing a gun at both of them before officers shot at her. >> after this car came to a stop, officers say they removed the gun from a raise his hand and checked on suspects down. >> ambulance arrived for both the sun and mom, but a raise died at the scene. >> the son was taken to the

hospital after being shot in his left arm and right wris> a race car. police say they found a loaded handgun and 4 boxes of ammunition in the apartment. they found the family dog shot and killed the san mateo county district attorney's office is in the middle of an independent investigation to see if the shooting was in compliance. pacifica. police are also doing an internal investigation to see if officers followed policies and procedures while speaking with a race daughter off camera, she told me she believes her mom was going through a mental episode that morning and wishes she never had bought that gun. >> the da says it will take 8 to 9 weeks to complete its investigation. the 2 officers involved are on administrative leave. i'm sara stinson reporting in pacifica. back to you. >> man is dead following a stabbing at a san leandro safeway. this happened just after 5 tuesday evening at the store located on bancroft avenue san leandro. police say the victim got into a fight with another person in the store and that's when the

suspect, they say, took out a knife and stabbed the victim before leaving the store. police have not released the identities of the victim or the suspect. and police arrested a man that they believe was involved in a robbery of a peninsula business where the victims were tied up at gunpoint. investigators say carlos gonzales held up a business on terminal court in south san francisco last month. detectives have identified him as a suspect and then carried out a search of his home in hayward. gonzales is now in the san mateo jail facing charges of robbery and kidnapping. in the south bay. 2 men accused of selling drugs on the dark web were arrested following a monthslong investigation in san jose. so here are some of the items that were found in the homes. police say the investigation stemmed from a traffic stop in november where they found legal drugs in the car that led officials to get a search warrant to look at the suspect's homand that's where police say th fnd multiple guns large amounts of drugs that were intended for

sale. police say the investigation revealed the men sold these illegal drugs on the dark web and only accepted crypto currency as payment. protesters blocked the entrance of the lockheed martin research facility in sunnyvale. this is from yesterday where a group calling for a cease-fire in gaza says the facility is supplying israel with jets and missiles. about 250 people participated in the rally that lasted for about 5 hours. at one point, they say a driver sped towards them, got out of the car and then threatened them with a knife.

>> present. >> so the video then shows the man getting back into it, struck with protesters saying that he could park and walk into work and get the last top laptop that he said that he needed to work from home. no one was arrested during the protest. 2 palestinian owned businesses teamed up with the islamic relief usa for a fundraising event to support the people in gaza. one of the business owner saying he felt like it was his duty to lead an aid effort like this. >> i want people to to know and understand that there's a lot of people that are suffering from this war in gaza. people that are dying. i'm getting. massacre right now. and it's, you know, being that i'm i'm full steam. it's incredibly sad to go on with our daily lives with over

32,000 deaths since october. >> he says he hosted a similar fundraiser at his restaurant in november. and yesterday's event rates more than $30,000. now to another round of closures and layoffs hitting the bay area. this is coming as the san francisco controller's office released new data showing that the city alone has lost more than 20,000 jobs in a three-month period. a lot of the job losses are from the tech industry. and today, apple announcing that it will be adding to that number. apple is planning to lay off more than 600 of its workers from different locations in santa clara. this will start next month. the tech company recently notified state labor officials about these layoffs in february. the tech giant shut down its decades-old quest to build an electric car. and that resulted in more than 1000 job cuts or reassignments for those employees who are working on that project. and now to the closures because after more

than 40 years, $0.99 only stores are closing their doors. operators of the popular discount chains say they're just not making enough money to survive. so the closure will leave nearly 14,000 employees without a job bay area locations include richmond, antioch, fairfield, and fremont. the discount store had a wide variety of items from household goods, groceries. and officials have yet to release an official closing date. and then the east bay and oakland restaurant that featured in the michelin guide is closing line. dance cafes last day will be april 27th in an instagram post. they wrote over the past 12 plus years. we've got to be part of so many people's milestones from first states to wedding celebrations of life. clear coming out dinners. they say it's been challenging and it's been sweet and rewarding. asked for why the restaurant is closing. the instagram post said it was for family reasons. all right. cal fire did something pretty cool at rescued a horse that was stuck in the mud along the santa ana

river. cal fire riverside, blindfolded, the horse before using a helicopter to rescuei it. and we're told now that the horse is now home safe and sound. and we'll talk about our forecast on this friday with a live look outside of what's going on across the embarcadero. here was a chilly start to the day. we'll see if that trend will continue now with kyra. yeah, we definitely had a chilly start. let's talk about this. napa got down to 36 degrees this morning. 38. >> in santa rosa and livermore, you can see 39 in sandra fell. even the oakland airport got down to 40 degrees. and in san francisco downtown in the city to 42. so what's going on tonight? well, we have this still very cold air mass in place, which means that we have one more night of chilly temperatures, not just here, but you can see the central coast central inland areas to and certainly around the bay area. we have a frost advisory for the north bay and the east bay interior portions of we have a actually a freeze warning. well to the north of us. but still just an indication of how cold we're

going to be tonight. so just get ready for this. make sure you've got all of the pets inside and get those plants covered. if you have them out already next week will be very different story. but tonight, especially north bay. i think you're going to looking out in napa santa rosa area, some of those valleys for very chilly temps. having said that, the east bay is going to get down there, too. so just to show you the risk of freezing temperatures as we get into the overnight, you can see where we kind of hit in that 50, 50 shot here. so north bay and east bay. that's why that is up for you. now. once we get past tonight, the good news is amusing. santa rosa, as an example, we you know, we said those temperatures up in that we really brought it up as we get into next week because we've got a big pattern change on the way. meanwhile, we had some flakes flying here at diamond peak. we had some snow in the last overnight hours there. winter weather advisory judd did just drop, however. so we're making some progress there. i'll be back a little bit. we'll talk more about your weekend forecast. thank berkeley is now getting fined $130,000 over how the city managed its

we're not in the path of totality. so we're not going to see that full dramatic eclipse will be fun to see the coverage of it. that's for sure. a live look outside right now. you see some of those big fluffy clouds from the east bay and the east bay is one of the places we're getting a few showers that are rolling through as the heat of the day. access is just a little impetus for this unstable air mass to pop up some showers. and that's exactly what's happening. if we move into parts of the north bay as well. you can see a few showers there and a little bit of lightning, too. so some of these cells could potentially have a thunderstorm component to it. we are cool out there. no doubt about it. we are going to see a big pattern change in our weather as we head across the next few days. the weekend will start to pick the temperatures up at then it really soars as we get into next week. you can see by the end of next week looking at bayside 70's and inland 80's. we have not seen that for quite some time. all right. well, coming up here in the bay area will soon be in it. >> cherry blossom error where you can enjoy. >> the sights of full bloom.

japan is in full bloom right now. crowds are gathering in tokyo to enjoy the sea of cherry blossoms. >> this is coming a little bit later than usual for the country. but the view well, worth the wait and you don't have to go all the way to japan for a very similar site here in the bay area. cherry blossom season is underway and you can find them at the japanese tea garden and all throughout san francisco's golden gate park in the heart of japan town. you can also check out the cherry blossom festival that takes place the weekends of april 13th and april 20th. there will be traditional cultural activities, live performances and of course, you can see
