>> from the bay area's local news station. you're watching kron. 4 news at 6. >> now at 6 for continuing to follow developing news out of san francisco. police are on the scene of a shooting in the bayview in which at least one officer fired his gun. this happened when police responding to reports of a man with a gun. police say nobody

jeopardy this summer. the union for the ferry workers who operate the only service to and from alcatraz island as voting to authorize a strike. our kron four's gayle ong joins us now live in san francisco with details. gayle. >> yes, they can. and vicki, the 2 sides were in negotiations all day long. they just were dismissed about 2 hours ago, according to the union. no movement from today's meeting. >> here today to get a contract and that did not happen at the bargaining table between the alcatraz ferry workers and the ferry company thursday. marina. second is the regional director of the union representing the alcatraz, very workers who voted to authorize a strike. they don't get overtime when they worked 40 hours a week you know the hire a bunch of people and then give everybody a little bit of work. even if you've been there a while. not everybody is pensions. the union says the ferry company has refused to make itself

available for regular negotiations. want to get this thing done as soon as possible. we do not want to advance disadvantage. >> the community and, you know, folks that are trying to to the island, but we have to take care of our members and, you know, get this fairground. i hope they don't go on strike while we're over there. i did to get but all jokes aside for 10 prouty who is visiting from new york if their worst, right? yes, i'd be upset, but i guess that's why you check out. check it out ahead of time before you go. but i didn't if i was traveli some place specifically to come here than it be more of an issue. but >> you its way life is a new step to deal with a statement to kron 4 from alcatraz city cruises reads in part, quote, we are disappointed the union with threaten our passengers, partners and the community with a potential disruption of those services. please take comfort that if there is a labor dispute, it will have no impact on our operations. meantime, it was business as

the business. in a lawsuit, the owner is asking for financial reimbursement of improvements to the 2 restaurants claiming that the upkeep was nearly 2 million dollars to put in floors, kitchen upgrades and much more. the lawsuit says that the port of san francisco has not brought the area up to code to protect against erosion or earthquake standards. they also blame homelessness in crimes in preventing the restaurants from being successful. the owner says that he has spent millions in upgrades a tour say that it's a shame to have the places shuttered. >> during this is a very it's always sad when cep shuts this is your first time thing. what so >> the city attorney's office releasing a statement in response to the lawsuit that reads over the last year. herringbone has attempted a number of maneuvers to get out

of paying the 1.7 million dollars. it owes the city in back rent. this appears to be yet another attempt. however, once we are served with the lawsuit, we will review it and respond in court. the opened back in 1935. and parent, he knows opened in 1946. >> new research from the university of san francisco shows a shifting landscape and how fentanyl is being consumed. data shows that locally and nationally drug users are moving away from injecting fentanyl opting instead to smoke. it. the belief among users is that smoking is safer and is less likely to lead to an overdose. however, usf researchers found that there's actually increased risk overdosing from the residue that sticks to the smoking equipment. researchers say the residue left by fentanyl resembles resident left by other drugs and that people are often going to smoke from a pipe or a piece, not knowing that there are traces of fentanyl left behind. the study from usf is the first to explore fentanyl resin as a key contributor to

overdoses. castro valley woman is relieved tonight after her stolen truck was recovered by police. the suspect has been arrested and police are offering. >> some advice to make sure that you don't fall victim kron four's. rob nesbitt spoke with a woman in the parking lot where her truck was stolen. there was so much garbage. ask stephanie goose eat hoops about her blue toyota tacoma and she'll call the trucker prized possession. >> that's why it was so upsetting when she could not find her keys after shopping at this petco in castro valley, she had triple and lock the vehicle in the parking lot but no keys inside. that's when she feared her keys had been stolen. the dot all the information in my truck. >> just in case somebody came back and stole that. sure enough 9.30, that night. her and 2 accomplices came back and stole my truck. she called 9-1-1 to report that a truck had been stolen. detective kristen fegley and the alameda county sheriff's regional auto theft task force began

investigating. >> searching for a blonde woman caught on surveillance video picking up to see toups keys from the ground. i think suspect just saw this crime of opportunity. she found these keys and just >> just driving around as if it was only able. detective fegley says the woman was identified, arrested and charged with felony vehicle theft. though the sheriff's office is not naming the suspect, the truck she allegedly stole was returned to its owner, jumping up and down. when i saw it coming down. >> the road because cops came in first and then the go. we've got we've got it. and they police using the crime as a reminder to always be vigilant. detective bagley says keep your keys on you and vehicle locked because thieves often look for crimes of opportunity in castro valley. rob nesbitt kron. 4 news. i'm meteorologist lawrence karnow. well, the unofficial beginning this summer coming our way, a big change in the weather pattern coming our way, too. pattern coming our way, too. network is no network for business.

>> travel expected to be even busier than last year. this memorial day weekend. san jose mineta airport expecting 375,000 travelers to pass through over the next week. transportation officials attribute the rise and travel. airfare being down 6%. hotel prices are slightly reduced and rental cars are down about 10% compared to last year. officials expect tomorrow will be one of the busiest travel days up to 3 million people are expected to pass through airport checkpoints. now, speaking air travel, here's a

live look at sfo. lawrence is here to talk about the weather. yeah. and memorial day. yeah. a lot of folks getting away today can see a lot of people out on the roads. if you do plan heading out about some place, you might want to watch very carefully. other places looking pretty good. >> as we sail in toward the holiday weekend and the unofficial beginning of summer. yeah. today we had a nice day. temperatures a little cooler around the bay area. they dropped off just a bit out towards sfo. right now, though breeze is blowing outside. in fact, we do have some delays this not because of the weather. they got construction going on the airports. that's 105 minutes. yeah, that's a pretty significant delay. their oakland, you're looking at the good conditions. also san jose looking good and overall, yeah. how about this in the monterey bay? we've got some 50's and some 60's tomorrow. if you're headed that direction, temperatures a little bit on the cool side. watch out for that cool fog. kind of hugging the coastline all day long. southern california. pretty pleasant. these temperatures below the average for a comfortable 64 san diego, 67 degrees in pasadena and 66 in downtown

los angeles in the high country should be pretty decent weather going to see 60's up their. of course, they're still sk ing some of the resort's up their palisades open up there to ski on as well. so you can do that. water ski in the afternoon into the lake. temperatures going to be pretty comfortable throughout the weekend. but do watch out for a chance of thunderstorms late in the day tomorrow. and again, i think on sundays, weak system kind of moves through. that being said here in the bay area looking good, couple high clouds begin to move on in. we'll see more clouds on the way overnight tonight and plenty of low clouds and fog as we head toward tomorrow morning. so with that being said, temperatures tomorrow going take a bit of a hit highs in the san francisco 50's couple low 60's patchy fog along the coastline of that cool fall kind of settling in not breaking up much out toward the beaches. get inside the bay a fine, a little more sunshine after morning fog. but that wind going to be kicking up in the afternoon through december gap. yeah, pretty blustery 2030, plus mile an hour gusts. i think by tomorrow afternoon about 63 degrees in mount to 63 in palo alto, fairly mild in the south bay. remember couple days ago there in the 80's now, i think tomorrow mainly in the 60's across much of the santa clara valley. still, some 70's be

found well inland by tomorrow afternoon, but that cool sea breeze in their work its way further on shore the next couple of days and starting out probably below average. i think as we begin your weekend, these temperatures in the running fairly cool around the bay area for the beginning with the unofficial beginning of summer. 69 degrees, one of the warmer spots on saturday will start to warm things up. those we get into sunday and by memorial day, those temperatures to come back up in the 80's in the warmest spots. thank you. cards. it is set to be a busy week for attorneys representing david de pap the man convicted at the federal level for attacking paul pelosi. the nancy pelosi to pappas said to be re sentenced on tuesday for his federal conviction. but at the state level, things are just getting started. for more on all this and more legal cases around the bay area. i'm joined now by michael cardoza. so the judge in the federal case said she made a mistake. what happened? well, what she did was after she's sentenced a pop. >> she realized she didn't give him the opportunity to make a statement to the court

and then federal court, i think over 80% of defendants want to say something to the court. one of the big things i noted was that the prosecution after the case said he showed no remorse at all. and a lot of people sort of giggled at that. and so wait a minute, didn't give him a chance to show any remorse or to talk. so basically it's not a small point. it's not going to reverse this case. it's not going i think have much effect would be shocked if the judge after listening hip-hop, if he decides to talk whether she reduces that or not. and he still has a state case which could add more prison time to what he's already. >> yeah, well, i died when i was a prosecutor. a lot of if. state prosecutor to case and the federal government had a case they would often times just drop in and say, ok, you've got convicted in state court or vice versa. in this

case, they're not doing that. a lot of people are asking. >> well, not double jeopardy. you're being tried for the same thing is really not because the state has added 4, 5 different counts. one of which is, of course, the attempted murder case and issue is, are elements different improving the cases in the state court in the elements are different and federal the south, the what's going on in state court. so i don't think jumper double jeopardy will hold but not withstanding. i think what you're doing this, i mean, you're worried been reversed and you want to be sure stays in jail for a long time because it's going to cost the county an awful lot of money to prosecute another case. this is just a heartbreaking case. a 3 year-old girl died her mother. >> and around go and grandfather allegedly participated in an exorcism to cast demons out of her at a church in san jose. a judge

has ruled there's enough evidence for this case to move forward. right? so people understand that before you actually get to a trial and state court, they have what they call a preliminary hearing. preliminary hearing is for the government puts their case and not the whole case. but enough evidence to show the court that there's enough to push it into a trial. now, the trial, the burden is beyond a reasonable doubt. >> at a preliminary hearing, it's only is there are reasonable suspicion that the accused did this. so the burden of proof is really low. it's unusual if someone is not held answer at the px, the defense and 99% of cases never puts on evidence but has a right to cross in this case. the judge heard the evidence. he put it over a week or 2 and then came back with a really that, yes, i have a reasonable suspicion. these 3 caused the death a homicide. and that's what it is. it in the jury selection process are. do you

think they're going to check jurors for their religious backgrounds and see if any of them? >> may believe exorcisms are real saying, well, i'm sure that they will it is going on in the catholic church and another churches and i know one of i think the grandfather came from south america and came up and exorcisms before. they may be a real thing. but my lord to suffocate the little girl to death in that belief, i think many down in santa clara county are going to buy into that and all if you really thought you were exercising the devil in you, you know, suffocated her to death them. put a lot of pressure on our body. nobody's going to buy that. in my opinion. they're going to get convicted of this. and that will be a first degree murder and off they go. 25 to life 3 year-old girl. all right. we have a we have a woman. her name sarah toman who died of a drug overdose. she was a

harvard silicon valley worker. >> an incredible pedigree education and business. died from a fentanyl overdose. and now the dealer. apparently there were text messages on her phone that led police to a dealer is now facing charges. what do we know about this case? well, what happened in this case, apparently she was buying drugs from him for a number of years and the drug she bought were laced with fentanyl. >> and she overdose before and they use narcan honor one time before and saved her life and somehow that information got to the drug dealer said, hey, you sold her drugs that were laced with fentanyl. so basically put him on notice. be careful, not that you should keep selling drugs. but here's what happened. apparently he sold drugs to are again and she o d done it. and you know that was that not should alert an awful lot of people. you know, you go to buy drugs, whatever they are,

this funding all as awfully dangerous. remember the little baby that was in the hotel. wright was crawling on the floor and people before that had rented that room had to use fentanyl and a little tiny bit of got on the floor and the baby ingested indict. that's how dangerous this is. i mean, i would think that most people that get into drugs like that go, should back off this because you're not going to tell. it's fentanyl is in until it gets here and you're not even going to go them because you're gone and you think >> stereo typical drug dealers and drug users are out on the streets in the tenderloin here. we a highly educated, affluent person in silicon valley right out there doing the same thing. i know what what they used to call recreational drugs. well, it's not so recreational. >> and the more because you're putting your life at risk doing that. i'm in for, you know, you get stressed or on the high on the weekend. i

you're gone because there's a little bit of fentanyl in there. i'm not sure the drug dealer may not have even known the the problem. enter the need of this case will be. we told you that the drugs you were selling before had they were laced with fentanyl and you continue to do it. that's where he's going to really get hammered. not going to have much of the defense had that not happened right we have a better shot getting out of the murder charge. but i don't think much chance now. michael cardoza, as always, thank you so much. a
