starting off the hour with a look at >> it's still in good. we are cooler than average. but that's nice little break from the warmth for some of our inland areas. those low 70's to upper 60's might kind of be a welcome change of pace. san jose today going to be one of those upper 60's spots after having been kinda warm so far this week. so a chance to get out there and maybe put on those long sleeves again, visibility is fine. even though we do have some fog along the san mateo coastline, winds from the coastline are contributing to a cool brisk, feel to it. so absolutely long sleeves full today and tomorrow. now temperatures right now we're still hanging out in the 50's. some slow movement going on here and will actually see minimal warmth into the afternoon today. not necessarily because things are cloudy. it's actually going to clear out pretty nicely. just a cooler air mass in place. so daytime highs, mostly 60's to low 70's and tomorrow, even cooler. i'll get to that in your forecast rain. all right, john, thank you for that. we've been tracking the morning commute now the

police say they received the report of this person apparently walking around with a rifle when officers arrived on scene, they found the suspect and it was in that interaction that an officer ended up firing their weapon. they say the suspect was not shot but was taken to the hospital for non-life-threatening injuries for what police described as a less than lethal use of force. they didn't elaborate, but maybe we'll find out more when the police department holds a town hall meeting. they say they're going to do that in the next 10 days. >> it is set to be a pretty busy week for attorneys representing david to pop the man convicted in federal level for attacking paul pelosi, the husband of congresswoman nancy pelosi. he set to be re-sentenced on tuesday for. >> his federal conviction. but at the state level, things are just getting started. in fact, kron four's ken wayne talked with attorney michael cardoza about what comes next. the judge in the federal case said she made a mistake. what happened? well, what she did was after she's sentenced a pop. she realized she didn't

give him the opportunity to make a statement to the court and then federal court, i think over 80% of defendants want to say something to the court. one of the big things. >> i noted was that the prosecution after the case said he showed no remorse at all. and a lot of people start to giggle that that. and so we'll wait a minute. didn't give him a chance to show any remorse or to talk. so basically it's not a small point. it's not going to reverse this case. it's not going i think have much of fact, i'd be shocked if the judge after listening hip-hop, if he decides to talk whether she reduces that or not, and he still has a state case which could add more prison time to what he's already. >> yeah, well, i i when i was a prosecutor a lot of state prosecutor to the case and the federal government had a case
9:06 am
they would often times just drop in and say, ok, you've got convicted in state court or vice versa. in this case, they're not doing that. a lot of people are asking. >> well, not double jeopardy. you're being tried for the same thing is really not because the state has added 4, 5 different counts. one of which is, of course, the attempted murder case and issue is, are elements to for an improving the cases in the state court in the elements are different and federal the south, the what's going on in state court. so i don't think jumper double jeopardy will hold. >> cardoza went on to say the judge in that federal case might be worried about the whole case been reversed. and that's why she's pushing for re-sentencing. we're going follow both the federal and state cases on air and online at kron 4 dot com. >> will not lay off or city workers, most of whom are open residents at a news conference in oakland yesterday. mayor sheng thao made it pretty clear her new budget will not lead to cuts in city jobs.
