>> and by the end of the week will be close to 90 degrees for some inland areas. so if you love the warmth looking outside at this fog this morning feels a little bit easier. knowing warmer temps around the corner. this is your look at the transamerica building. only a look at half of it. is it so shrouded in? this is a very dense marine layer scooting in from the coastline and a very strong coastal breeze at that. so it's pushing it well inland, making today, indeed, a very cool one, considering what time of year we're talking. we have a low to our north and that is stirring up this westerly wind that is making poor this onshore push right now. a vacaville at 22 miles per hour straight from the south and west san francisco also quite breezy. temperatures are down in the 40's to 50's. we have some very heavy fog and some mist and drizzle towards the coastline. so do watch for a few wet spots out that direction later on today. daytime highs into the 60's to 70's tomorrow. we start a trend of 80's. i'll get to

that. your full forecast all right. back to work. a lot of people are going today. so things are going to be a little busy this morning. a 15 minute ride of the bay bridge traffic already building at the toll plaza. >> just short of 14 80 to on your san mateo bridge richards over over to 8 minutes. thankfully, no hazards or accidents. there. 19 minutes across the golden gate. darya. james, back to you. thanks. a lot of rain at today. david de pap will be in a federal courtroom to be re-sentenced as this new hearing comes after the judge in the case failed to ask the pap if he wanted to address the court. >> prior to his last sentence and got to do it over again conference. michael thomas in the newsroom. what happens now, michael? hey, good morning, everyone. well, essentially it's round 2 in today's sentencing is set to happen in just a few hours. in which case a federal judge will allow david up at the chance to speak, which was originally not given a few weeks ago. now, the path was sentenced earlier this month and was given the maximum prison sentence. >> after being convicted of attempting to kidnap nancy pelosi from her san francisco home and for beating her husband, paul pelosi with a

hammer in total. he would be serving 30 years behind bars. but during that sentencing, the judge did make an error when she failed to ask pap, if you wanted to make a statement before her sentencing. now this morning that air is set to be corrected and our legal experts say that the judge could even shave time off of pap sentencing. and the paps ex-wife tells kron 4 at that original hearing that that is her hope for today. now the pelosi is were not present, but their daughter was. and as to who will be present this morning, we're still waiting to hear more details along with what comments to have made the making. the court hearing is set for 9.30 this morning. so as we get more details, we'll continue to keep you updated. that's very latest here in the newsroom. i'm michael thomas story. and james, we'll send it back to you. okay, michael, thank you very much. time now is 603. and tomorrow, scott peterson, the man convicted of killing his pregnant wife, laci. >> appears in court via zoom, his defense team, the los angeles innocence project has been trying to get him a new trial by gathering new

evidence that they want dna tested. there's a rope and a stolen van that was burned out near the petersons home around the time that laci went missing. and that's what they want considered. the stance was county da's office is against this testing saying that nothing about the evidence which convicted him has changed. >> lama side investigation continues in san jose now after police say they found a woman dead inside of a home and they responded to the scene around 6 o'clock last night. and a person is in custody. crawford moment has the story. >> well, neighbors tell us they heard more than 6 shots fired around 5.50, on monday evening right here on 20th street in san jose. police say they responded just shortly after 6 pm. now, meantime, this is supposed to be a holiday weekend, which families can be together. but as one san jose police officer put it on his way out, he called this incident, quote, family problems too. police say they responded shortly after 6 to reports of the

shooting. they found a suspect barricaded in the home. more than 2 hours later is when our cameras were there to show police taking someone out of the home in a gurney. and officer told me more than 100 officers were here as they waited for the suspect and they are now investigating this as a homicide. neighbors say the people living in that home where a mom in her 50's and a son in his 20's. now police say they will remain on scene here on 20th street for hours investigating this possible shooting. they call it now. meantime, they also say that a motive or factors leading up to this incident are still unknown reporting in san jose. jack moment. kron 4 news. >> time is 604. and a driver was killed after their car got pinned underneath the truck. when you can see this is yesterday afternoon in san jose, the corner of montague expressway toole avenue. people who work near that intersection say that the driver seemed to be driving very fast. >> i know that this is 3 they saw very dangerous because

usually walk to catch another bus when there's no route here and i feel kind of and save, you know what i'm doing to cross road. so cars are coming really fast. >> so they actually say that they've seen a lot of people drive too fast in that area section. we don't know the cause of this crash or if this car was speeding. but police are investigating. >> more developing news this morning. police say at least 5 people including a child, were shot in sacramento. police say it happened shortly after 8 o'clock last night in a neighborhood in south sacramento. officers say the 5 victims. we're standing outside an apartment complex when they were shot. officials say the victims are expected to survive. officers have not said what led up to that shooting. >> our main message is that that you saw something or heard something to please let us know. help us find individuals responsible for this. there's a lot of people that were involved in the shooting we're not sure of all the facts circumstances surrounding this incident, what led up to the shooting. but there are a lot of people that were injured in this and we need to make sure that they receive justice. >> well, police say one of the shooting victims as a teenage girl and 3 men and a woman

were also hurt in. >> that incident, time now is 606. and in concord, police responded to 2 separate barricade situations just within minutes of each people in both incidents apparently have been detained. we have kron four's sara stinson with a breakdown of what happened. >> a busy night for concord police. 2 separate scenes with a barricaded suspect here on saint francis drive. a shelter-in-place has been lifted but investigators are still trying to figure out what happened here on rose brook court. police got called to a home here just off of kowal road around 6 o'clock. police say a mom lives there with her 3 daughters and a neighbor came over armed with a gun, threatening them. the family ran out of the home. they fully they are safe. they called police officers on scene. then heard gunshots coming from inside the home. that's when they put a shelter-in-place for people who live nearby. police were making a plan to get the man

out safely when he came out on his own around 8 o'clock, he was armed with a gun. he was then brought into custody. i'm told the man arrested is 47 year-old christian stewart and police are trying to figure out what his motive was drugs and alcohol involved. meanwhile, officers were also at the scene of another barricaded suspect in an apartment complex on detroit avenue. this scene started around 3 o'clock in the afternoon when neighbors called police saying a man was screaming acting crazy with a blowtorch and waving knives around. police responded and learned the man had been evicted from this apartment a couple of weeks ago and he returned and broke into that unit. police spent hours with a crisis negotiator trying to get him out. a police dog was used to get the man in custody. officers say he was bit by a dog around 8 o'clock tonight and brought to a hospital with minor injuries. police say 35 year-old ahmed davis will be booked into jail afterwards. we saw officers

going door to door here on roseburg court, trying to talk with neighbors about what happened. police say a lot more to come with their investigation. i'm sara stinson reporting in aoncord kron. 4 news. >> well, palestinians gathered last night in the east bay organizations calling for a cease-fire in the middle east, put together this vigil at lake merritt at the amphitheater there in oakland. last night's event was called all eyes on rafah following an israeli air strike that killed at least 45 people in a tent encampment late sunday night. 2 of those people killed are said to be hamas terrorists. white house national security spokesperson says israel has a right to go after hamas, but they must take every precaution possible to protect civilian casualties. israel's prime minister is calling it a tragic mistake with an investigation now underway. >> it's 609. right now, newark police are looking for a teenager who is missing this is a 14 year-old or lock. he's

5 foot. 8 weighs about 130 pounds and was last seen yesterday wearing a gray t-shirt, blue gym shorts, grey sox and blue running shoes. bay area leaders are going to gather today and ask state leaders to help build safe crossings over railroad tracks along the peninsula. senator josh becker, who represents parts of san mateo and santa clara counties is calling on the legislature and governor newsom to include 100 million dollars in the state budget for this and that money will help build the crossings at locations that are high risk and also improve public safety. and they say alleviate traffic congestion as well. there's a conference set for 8.30, this morning at the berlin, a broadway train crossing on california drive and broadway. >> we're going take a break or 6.10, but still ahead on the kron 4 morning news, a fire investigation continues as crews work on cleaning up in east bay lumber yard warehouse. and also ahead, why city officials in san jose are demanding an audit of homeless

>> it's 6.13, and here are 4 things you need to know. nearly 10% economy, lumber company in oakland is gone. it was destroyed in this massive fire that happened over the weekend about 80 firefighters where they're fighting the flames and fire crews. even right now, they're still cleaning up a huge mess and investigating nobody was hurt. newark police are looking for this teenager reported missing yesterday. he's about 5 foot. 8 weighs 130 pounds. if you've seen him call the police a successful rescue in san francisco. raccoons chased a dog over the side of the cliff. >> this happened in the pictures. whole neighborhood. you can see the dog there. he was unhurt. but he needed to be saved and brought up to his owner. sonny bill voters have a tax measure on the november ballot to look at it for the renovation of the public library. the council voted to move forward with 290 million dollar general bond. and so voters will be choosing

whether or not to approve that. >> okay, 6.14, the time. let's get over to the weather center right now. no john's got a look at our forecast for this. back to work tuesday for everybody. pretty excited about the rest the weekend. a little warmer, john. yeah, it will get warmer towards the end of the week. today, though, might as well head back to work. it's just gray out there across more of the bay area than even yesterday was this is half moon bay right now looking at the grey overhead. of course, you expected out that direction, but we're seeing that push of cool ocean air all the way inland this morning. and this is going to have a cooling effect on temperatures making today. just a touch cooler than yesterday was low pressure to our north. oftentimes this time of year. when you see these lows passing to our north really stirs up those westerly winds. and that pushes in that cool air into the bay area. so very % typical pattern here after this, though, low exits, jet stream retreats to the north and along with it, temperatures will begin to climb. as for future cast, you can see out there. a lot of cloud cover this morning. good

dose of sunshine this afternoon should see less present marine layer tonight into tomorrow morning. and temperatures tomorrow will start to climb because of that by thursday and friday, sunshine even out to the coastline and some of our warmest temperatures of the forecast just a couple of days away. temperatures today 50's at the coast in most spots montero at 58. same for half moon bay. well, looking at 60's for most of the bay shore and after warmest, most of us will only be in the 70's, including the south bay with a comfortable 76 in san jose love that 70 in fremont dublin as well as in san ramon. so much cooler than average oakland, a comparable 67. only a few low 80's in antioch, vacaville youngsville and santa rosa. tomorrow, we're going to see a lot more 80's for inland areas. and by thursday and friday, inland spots will be close to 90 degrees. bayshore cities also in for the climb from 60's today to near 80 by thursday and friday. great. hi, john.

prosecution, the closing arguments will be important because they're putting on a complicated case and they're showing basically a 2 step case. first with the business records were falsified seconds and they were falsified in order to commit or conceal another crime, which they're pointing to a new york elections code. they're going to have to walk the jury through how everything they heard over the past few weeks adds up to those charges. >> well, following the closing arguments, the jury will then begin deliberations to reach a verdict all 12 jurors must agree with the decision, whether it's guilty or an acquittal. mister trump has pleaded not guilty to the 34 counts of falsifying business records related to payments made to star stormy daniels to hide an alleged affair. >> this was the scene yesterday as people paid their respects in san francisco's national cemetery on memorial day. every year, 30,000 flags

>> we're back 6.23. is the time into san jose city council members now demanding a city audit it's pending on when it comes to homeless services. and this comes after a state audit found in april that the city spent more than 300 million dollars on its homeless response. city council member being don't and our june bar trump want to on a look at how much money is being divided into removing encampments and into temporary housing. california state

auditor found the city could not identify the money it spent on homeless support, nor does it adequately measure the effectiveness of those programs. the report also says the city lacks enough interim or permanent housing to keep up with demand. san jose has until september to begin publicly reporting depending on that data. so. >> 6.24, is the time and for your health, california is witnessing another surge in covid driven by in the emergence of new visit subvariants. there are 2 new subvariants that we want to tell you about collectively. they're nicknamed flirt and they are becoming more prevalent. then what we saw over the winter, the dominant strain, then and this is causing a big concern about what's going to happen this summer as they are expecting an uptick in infections. flirt these 2 variants now account for more than 50% of the infections that doctors are seeing nationwide. the new mutations don't appear to to

result in a more severe disease. but they are more transmissible. it transmissible than what we saw in the winter. experts say the current vaccine is expected to continue working well, because these new strains are just slightly different from what we saw over the winter. an update now on the recall of 70,000 cases of fiji, water bottles because of contamination concerns. the recall a g natural artisan water began back in early march. this was because of the discovery, 3 types of bacteria. customers were initially advised not to drink tht water and return it for a refund. but now the fda is downgrading the danger that the water could pose. they're saying it's not likely to cause any adverse health consequences. the affected bottles were only sold between february 1st and march 3rd of this year.

socked in. >> yeah, here at the coast. but if it's anything like yesterday inland, john, by the afternoon of the sunshine and we'll get that good sunshine today. but it's going to be cool. sunshine. it's going take a little longer to get there because you're exactly right. >> pretty socked in across the bay area right now. and it's a very dense marine layer that is skewed in even further than yesterday. a look from above. this is mount tam looking down at the rest of us in the mix down there below. we are seeing a very strong winds from the coast pushing through the golden gate. now those gaps up and down the coastline and in many cases resulting in some dense fog that is resulting in reduced visibility as well as some coastal mist and drizzle. so watch for some wet spots. even to our north. we have a low pressure area and this is actually what stirring up the jet to really be pushing that cold ocean air on into the bay today. more so than we'll see for the rest of the forecast. winds right now around 25 miles per hour towards the coast and through the delta temperatures that's being affected right now. it's 40's

to 50's alameda and oakland at 53 fairfax, a cooler spot at 45 degrees. pacifica at 49 really cold ocean sea surface temperatures resulting in those chilly temps at the coast 60's to 70's later on today. so still comfortable just not as warm as usual for this time of year rain. all right, john, thank you for accident. i was tracking. >> 5, 86, 80. that is now clear. and a stark difference today than yesterday. much lighter conditions on a monday now that people are returning to work, things are starting to build 18 minutes at the bay bridge, mateo bridge, 14 minutes or other is just a light. it's the toll plaza and the meter lights and a slowing you down on the bay bridge. 12 minutes are golden gate bridge just short of 19. thankfully, we don't have any accidents or hazards on our bridges. darya. james, back to you. thanks. a lot 6.31. and the developing story is the investigation of a woman who died. she was killed in her home in san jose. at this point, police say they do have a suspect in

custody and kron four's will. tran is live for us at the scene. >> with what we know will. >> james, they have custody, but it took 2 and a half hours after they arrive to get him into custody. in fact, they had to bring out negotiators to talk to this particular person. you can clearly see police officers are still on the scene 12 hours after this all went down. and let me show you video of what's going on this morning. they have a command center here. they have police officers holding down the perimeter, not allowing anybody to contaminate the scene as they are still investigating. i did talk to one officer and he told me that the coroner's office is still not here will eventually get here, which is why this scene is still very much active, even though this started back at 6.30, last night. let me show you video from last night. no officers received a call of shots being fired on the 300 block of

north 20th street. it's off a julian, which is a main street in san jose. when they arrived, they realized that a man was inside a home. they tried to get him to give himself up, but barricaded himself for 2 and a half hours. officers were not willing to russian, of course, for their safety. instead, they call negotiators out to the scene. they talked to him and then eventually at around 08:30am, in the morning, this suspect gave himself up peacefully. he arrested. >> then they went into a home and that's when they realize that a woman was found dead inside the home. reportedly the 2 are not strangers to each other. their relationship not being released to the public at this particular time. >> but this scene is still very much active try to talk to an officer to ask him what time is the coroner's office going to be here? usually when the coroner's office arrives, that's when we start to see things wrap up. he did not

know which is why this scene here. you can clearly see blocked off on both sides of it with officers coming and going. >> all right. thanks a lot. we'll check in with you later. maybe gets more info 6.33. is the time. oakland fire crews, by the way, still cleaning up after that massive fire that broke out at a lumber yard sunday night. we brought that to you yesterday morning's fire at steroid, a portion of oakland's economy, lumber kron four's lezla gooden takes us there. >> flames filled the skies sunday night around the lumber company off of interstate 80 in oakland. while no one was injured, the fire spread quickly and ended up destroying at least one building has a large footprint so tight. it's showroom. it's administrative offices. >> a warehouse and then a large lumber yard outside full of for what? so it burned for several hours. michael hunt with the oakland fire department says crews initially struggled gaining access to the lumber yard and the surrounding area property. >> sits the border. the

borders are railroad we could put all we can bring was hose lines on the railroad track put water on one side of the property and the high street also borders. and so getting up or out as into the property was a challenge. fire crews were out on the scene all day monday working with the owners to go through the property for any additional hot spot excavation crews, the heavy equipment operators assistant to the park property at officially. make sure that any flare ups are being quickly extinguished throughout the process, pulling apart the structure that need to to be demolished last night. you know, there were several small rican goals which were >> and officials say it's still not clear at the fire started inside or outside of this property. and this remains as an open investigation reporting in studio going kron 4 news. >> thank you, leslie will 6.35. is the time for your money. this morning. a new ballot initiative to tell you

about california businesses are trying to rein in government spending. so the taxpayer protection act, which is what it's called, would make it more difficult for state and local lawmakers to raise taxes. the ballot proposition would require two-thirds of voters to approve any city or state tax increase. but it's currently being challenged right now in the california supreme court by governor gavin newsom. he wants the justices to kill the proposition before it makes it to the ballot. the state argues the proposition would deny the government the money it needs for public safety or for fixing streets. but supporters say taxpayers are done getting steamrolled by sacramento. >> the taxpayer protection act ensures that all new taxes have broad support from californians by empowering voters. >> the state supreme court must rule in the next few weeks. otherwise voters in november could send a message in california saying it had enough. it's rare for courts to intervene before a vote on a proposition that's already

qualified for the ballot. opponents worry that if passed they won't be able to undo the damage. they believe it pre of enslaved black americans now. so capitol correspondent eytan wallace takes a closer look at where the situation stands this morning. >> well, it's been mixed results for reparations bill so far. but back into the proposals, tell me they believe they're off to a good start. >> a standing ovation in the state assembly after lawmakers voted 62 to nothing to advance a reparations bill calling on the state of california to publish a formal apology letter to descendants of enslaved black americans. the most important thing is making sure we can we get it out there. south los angeles, a someone member reggie jones, sawyer authored the legislation while he acknowledges california was never formally a slave state. he says since its inception in 18, 50, the state has implemented policies negatively impacting black

causing the cause is under investigation. so we'll wait for the official word. driver, though, has been arrested in santa rosa after leading sonoma county deputies on a lengthy car chase saturday night. authorities say a deputy tried to stop a great bmw driving recklessly. the driver took off and eventually lost control and crashed. that driver was arrested on several violations. bay area leaders will be gathering to asked state leaders to help build safe crossings over railroad tracks in the peninsula. they're asking governor newsom to include 100 million dollars in the state budget for this project. that money will help build the crossings at locations that are at high risk right now and improve public safety and alleviate traffic congestion. firefighters put out a truck fire in napa happened about 3 o'clock yesterday afternoon off of cruz canyon road in napa. firefighters quickly put out those flames before it spread any further. >> no word on how the fire started. >> time now is 6 45 and in the east bay, many families are gathering by of the water
