is underway. >> taking a look here at some of the ceremonies marking memorial day. these people in san francisco at national cemetery honoring those who have served and given their lives every year, 30,000 flags are placed on the graves. former house speaker nancy pelosi. you see here says that we should remember. >> well, several events happened across the bay area. memorials, celebrations, remembrances throughout the peninsula all the way to the east bay. yeah, rob nesbitt takes a closer look. >> memorial day is a federal holiday that gives many the day off from school and work. but you can't forget what it really stands for to honor the members of the u.s. military who died while serving their parades like the one held in hillsborough happen in cities all across the u.s. monday memorial day celebrations with
9:10 am
marching bands and onlookers. but most importantly, veterans men and women in uniform who help remind us to honor the heroes who died while serving their country. >> it's why navy veteran louis ross and others gathered on the uss hornet in alameda knowing that we are respected. and what we did is respected. that sentiment also ran true in san jose for memorial day ceremony at oak hill memorial park. tyler where major robert adam patterson with the united states marine corps read the names of fallen soldiers. john maloney to water them. remind us the cost of freedom is one day out of the year that we citizens and those privileged enough to be here. >> homage to those who gave their lives for our freedom and for our way of life >> from keynote speakers to city leaders, san jose mayor matt mahan also spoke at oak hill about the importance of the holiday may more day to be

an opportunity. >> to not only recognize and honor. those gave for our nation but to pass those to our children. and rachel. >> several memorial day events including the one at oak hill, had wreath-laying ceremonies honoring and remembering the fallen reporting in the newsroom. i'm rob nesbitt kron. 4 news. >> it's 9.10, and still ahead on the kron, 4 morning news, a fire investigation as crews are still now working to clean up this east bay lumberyard warehouse that caught fire and why city officials in san jose are demanding an audit of homeless services. >> and today is going to be the last of our cooler days. in fact, even cooler than yesterday for some of us like dublin, only getting up to 70 degrees. take a look at where we're headed thursday, though, back up to average in the mid 80's. i've got your forecast. and yesterday we were pretty slow. go out there on the highways and bridges today. >> lot of you heading back to work. things have been busy.
9:12 am
9:13 am
9:14 am
>> 9.13 right now and we're checking out the weather. everybody is eking out those last days where they get to wear sweaters and pants. and today's the day. and then by the end of the nothing but shorts and flip-flops. i think everybody's closet. capitalize on that cooler moment because we're going to be right back to the shorts. flip-flops weather, is nice, too. but just a lot of variety going on this week in some pretty quick temperature changes. one of the reasons to be so cool is aggressive westerly wind that is pushing right into the bay. not too bad right now. quite hours. you can see, but there's still a lot of cloud cover remaining over the city
9:15 am
as well as over berkeley, starting to burn off for most of the rest of us. this wind is being ushered in by a low passing to our north, which is really kicking it up, allowing the transport of that cooler ocean air right into the core of the bay. we'll see a little bit less of that starting tomorrow. and by the start of the week ends friday, especially looking especially hot near 90 degrees inland today are deep us marine layer tomorrow, a little more shallow. so burns off quicker. temperatures will be a little warmer, partly because of that come thursday and friday, not much of an ocean influence towards our inland areas. that's the warmer temperatures. as for today, daytime highs in the 50's to 60's for san francisco and for a coastal spots 60's to 70's for most of the rest of us in just a couple of 80's and today's forecast that makes today in some cases even cooler than yesterday was and certainly cooler than the rest of the forecast will be dublin as well as fremont and san ramon only at 70 today comparable the richmond state
9:16 am
time well, antioch vacaville youngsville and santa rosa are few spots reaching the low 80's tomorrow. it's low 80's on average. and by thursday and friday, our inland areas will be close to 90 bayshore cities close to 80. all right, john, thank you for hour. we're still pretty busy across highways and bridges. >> you see those a speckled spots of red. maybe we still have a little congestion out there, especially in the south bay in a long 1, if you're traveling 80's a little busy and 80 traveling through haber the bay bridge right now, 14 minutes. so that's down from the peak of the morning at 20 minutes, 7, ridge about up to 30. now we're at 18, lot of progress, but still just a little slow, 30 minutes, a silly at the data to 37 and check in on one for you. 85 up the middle part about 15 minutes. 2.80, might be a good option for you at this hour. darya james, back to you. help winners and losers with our financial expert rob black morning, rob. >> marinara. nasdaq's looking good now. >> yeah. 17,000 big round
9:17 am
number that we break through wall street likes and apathetic. i word retire today. it is on as that could be thrown. but you get the idea. big winner in nasdaq. its tech heavy nvidia's up another 5% today. the thought is that elon musk said that his i pulled another 6 billion. so it's now gotten like something like 18 billion dollar market cap. there's been a lot of money on nvidia chips and ai. that's the thought in may. we're closing out mayor right now. we have 3 records on the s p 500 and nasdaq and the dow. so a good times are rolling into the well, as his use a role with his porch rolling out. >> they got a new the porsche, 9.11, gts i was gonna look because that's not natural to me. i'm not a car guy $164,900 it this a hybrid. when i think portion, i think right think exhaust, i think allowed. but i to kind of quiet, but it 0 to 60 in 2.9 seconds and it
9:18 am
could hit a max speed of 194 miles per hour. when people are rushing to see daria. and and by the way, you said honors 64 grand. that's to start right. it. but i think the real story there for like hard to estes hybrid portion. really? it's were going that direction. hybrids hot, well, we're all going that direction as so. that gets me to your next story about the gas prices in california because they've been talking about how we get a fun. the roads when we're all driving electrics and that tax from gasoline goes to the rose in the talk and figure out how to make ends meet there. >> and you're talking about how we're paying so gas prices. can pay anymore? no, right. i mean, the gas stations are not going to able to make this up. when we all go electric. >> it will be interesting to be very prop 13 in california and i'm going off script hair. but the idea is that we don't have shop classes in our schools and we no longer have
9:19 am
driving and in our schools in california because prop 13 kind of said this is what you get no more same thing with gas prices. your toy, right? what second look like in 2035 and gas vehicles are banned in california with no gas tax. yeah. so anyway, back back to 5.14, in california are gas. the difference between united states $3 and $0.61 or about 53 just last year, the difference between california gas, the natural next national mean 25 10 years ago $0.35. so the numbers getting higher and higher because we're having fewer and fewer refineries. that's my belief. well, i'm going to stop you on that because i was worried about that. >> and it's like we've always paid so much more. and we've always had these refineries here and you kind of go other states that don't have any are fires that have to be trucked in. they're paying less. so i don't see how been. it's been benefiting us that we make the guests in our backyard. >> yeah, and we've back in 1983. we had 40 refineries in
9:20 am
california and i'm new to california the year now we only have 9 refineries in states like nevada are freaking out because soon we're going to mean, maybe will go to fewer and fewer. if we go. all electric in california. but a lot of the oil comes to the united states ports like la and san and that's where fighters tend to be. it's going to be interesting because it's easy to look at. chevron say they're the culprit, but i look at the lack of refineries. that's and that's part of the prophet. california wants to cap the profits that refineries like chevron making sharon saying that nickel supply disruptions just bush, everything even higher. i'm not sticking up for big i'm just saying this is a big, big problem that we're addressing the summer. and the whole model is shifting and we don't know what that's going to look like. so. >> favorite? i love talk business models. >> i didn't business model. that's so funny that you interpreted that way. that like. >> model of the world and how
9:21 am
we how it works. like anyway. that's a bigger i did want to get some, but for all right, because of memorial day, you know, we kind of move on to boating with like water sports. and we say goodbye to skiing. and so i want to take a look at how this case isn't was money wise, which is, you know, your forte. so how did the business end of that? do? >> last year was special. 64.7 million people on the slopes this year. just 60.0. 4 million. it's the 4th largest total ever. but it's not quite the record that ie got last year. but, you know, john and crime correctly talk about all the snow and people are definitely going out to the 60.4 million of note. the big business slopes do a lot better than the mom and pops up these >> i wonder if i can get a script for the last minute. i want a little advice to you, ok from you for kids coats, we know, they just graduated from college. that type of thing. so what do you tell a kid? i wonder because you have such business mind and you're all
9:22 am
about money. what do you tell a guy who's got a six-year gap before going to say grad school right? and he's 22 6 months. and he has a little bit of money, a little bit to pay for grad school, not enough. does he take the time to see the world is at a valuable thing to spend money on or do you hoard it? go to work and act like you're 40 and you need the job and that i don't. what do you what do you say? >> i'm the wrong person for this. i took a gap year after college. traveled europe's. i did exactly what you're talking about. yeah, i'm glad i did because and i got into career i got family got into kids. i like his stump since i was 22 years old. it's just been miserable. so have fun while you're younger, but then start saving. i've saved every year since ties. 22 years and now i can retire comfortably. need to all the clip, ok? i thought you were going to say kid get a job. >> he and the 6 months. but you're not. >> it's great if you can start saving earlier because it's exponential. it's the number
9:23 am
one thing that you have on your side. money doubles every 7.2 years getting money saved 2021. 22, it will quadruple by the time you retire. but it's live life. i'm not. i'm not that much of period starting out, well, you can't get that time. that's sure. all right. thank you, rob. i'm glad your time at that age was well spent. >> if you've got a question, were you want rob to philosophize about something for you? you can e-mail him, reach him on x or facebook.
9:24 am
9:25 am
>> 9.25 is the time in the south bay to san jose city council members are demanding the city audit its spending on homeless services. and this comes after a state audit
9:26 am
found that in april, the city spent more than 300 million dollars on its homeless response city council members bn don't. and our june botched how much money is divided into removing encampments and temporary housing. the california state auditor found the city couldn't identify the money it spent on homeless support, nor could it adequately measure the effectiveness of its systems. the report also says the city lacks enough interim or permanent housing to keep up with demand. san jose has until september to begin publicly reporting data and to build a plan on how that will address homelessness. >> a big cell phone merger is in the works. that will further consolidate the industry. t-mobile is buying most of us cellular this deal valued about 4.4 billion dollars. t-mobile says that this deal will give customers better coverage and speed. it's expected to close in mid 2025. it's 9.26. right now.
9:27 am
and coming up on the kron 4 morning news, a battle is brewing in the state's highest court over the effort to limit government overspending and how the governor is responding. we'll take a look. >> good morning. i'm michael thomas. coming up, we've got details on david de pap. is he re
9:28 am
9:29 am
>> i'm 28 right now and we're checking out the weather for you. i'm going to be starting to rotate my closet. actually. the more i hear is forecast the more like, okay. i really can't say goodbye to like least that. >> the puffy, the thick. yeah, wardrobe because john, we're talking what close to upper 80's at least by the end of
9:30 am
the week. yeah, it's going to be shorts, t-shirts for sure. keep it in the trunk in case you're heading to the coast. but if you're just hanging out the back yard, probably not going to to get too much after today for a lot of the bay area where we're sitting right now. you can see that we do have a lot of gray out there. a westerly push of winds still pushing a little bit of fog to the golden gate. most of it's burned off elsewhere, though. and it's just a cool, breezy one at this point. you can see that fog hugging the san mateo coastline are right here a little bit around san pablo bay, most of us along the bayshore nice and clear at this point, winds will actually pick up later today. so do know that it's going to be a blustery one for coastal areas, breezy one for the rest of us, too. temperatures are in the 50's to 60's right now. but climbing pretty quickly at this point for some inland areas. pittsburgh at 65 berkeley. 54 looking at low 50's along the coast. currently later today at 60's to 70's our last day were inland areas will be in the 70's talking. more in your extended forecast to come. all
9:31 am
right, john, thank you for that. a lot of progress happening out there as drive time start to dip down lower. >> a 12 minute ride into the city. got up to 20 minutes at the peak of the morning hours and 30 on the san mateo bridge. now we're down to 15 cut that in half. richmond, sandra fell bridge 7 minutes and the golden gate bridge no major issues. 24 minutes. 37 to the tolls. all right. james, back to you. thanks. a lot of rain as 9.30, and right now, david de pap is back in a federal courtroom to be re-sentenced him. then this new hearing comes after the judge in the case failed to give him a chance to address the court prior to his sentencing the last time around problems. michael thomas is following what's going on in the newsroom. michael? >> hey, good morning, everyone. that's right. this hearing started at 9.30. we do have a team there now. this sentencing essentially we'll have a federal judge allowing david up at the chance to speak, which was not originally given just a few weeks ago. we've got video on your screen now. the path was originally sentenced earlier this month and was given the maximum prison sentence after being convicted of attempting to kidnap nancy pelosi in her
9:32 am
san francisco home and for beating her husband, paul pelosi with a hammer in total. he would serve 30 years behind bars. but during that sentencing, the judge did make an error when she failed to ask past, if you wanted to make a statement before she gave the sentencing. now this morning, that error again is going to be corrected and depending on what he says, it could change the outcome. take a listen to our legal expert has to say. >> whether he, in fact, has contrition and then question will be if he expresses that to the court, will the court take that into consideration in reducing the are ready? given 30 years sends down? even if the pop says that he's sorry that she's going to reduce it by she. i mean, the judge in this case, he's going to reduce the sentence 2 lesser than 30 years. but who knows? maybe it might happen. maybe she not call 5 years or so. i don't know.
9:33 am
>> now, keep in mind, path was also given credit for the 18 months that he's already served in custody. and his ex-wife tells kron 4 that her hope is that the sentencing will be reduced. but again, he's just entering the courtroom now at the last hearing of the policies were not present, but their daughter was. so as to who is entering in the courtroom right now, we're still hoping to gather those details and we'll continue to keep you updated as they come here into the newsroom. that's the very latest. we'll send it back to you to live in the studio. okay, michael, thank you. time now is 9.32. and tomorrow, scott peterson, the man convicted of killing his pregnant wife laci. >> appears in court via zoom, his defense team, the los angeles innocence project has been trying to geo him a new trial introducing new evidence and say they want to tested. the dna test. they want to a rope and a stolen van that was burned near the peterson's home around the time that laci went missing. but the stands last county district attorney is opposed to this new testing. they say nothing about the evidence that

would require two-thirds of voters to approve any city or state tax increase. but he's currently being challenge right now in california supreme court by governor newsom. he wants the justices to prevent this proposition from getting on the ballot. the state is arguing that this proposition would deny the government whether state or local the money it needs for public safety and for fixing streets and other things. but supporters say the taxpayers are in their words done, getting steamrolled by sacramento. >> the taxpayer protection act ensures that all new taxes have broad support from californians by empowering voters. >> state supreme court has to rule in the next few weeks. otherwise voters will get that chance in november to decide what message they want to send to the state legislature. it's rare, though, for courts to intervene before a vote on a proposition that's already. qualify for the ballot. so we'll see what they decide. opponents are worried that if it's passed, they won't be able to undo the damage. they
