man convicted of attacking paul pelosi in federal court this morning for his re-sentencing. we've got the latest. >> from the local news station. you're watching you on morning team. >> and thanks for tuning in. the day after memorial day, i'm darya james, welcome back to work. if this is your first day back we've got john with a look at that weather that you expect today and beyond. and then rain is still following the news is that a better story? but, you know, mass shooting on sacramento. so talk about that. luckily, nobody died. yeah, thankfully, still all right. one of the big stories that we're following and this another cool day. but then about. >> mother nature said you thought it was the start to the summer. hahaha after this, though, we do warm up. but today is kind of a cooler one for sure. getting some sunshine out there. those of the east bay hills. take a look at those peaks of sunshine making their way down. now, we are still seeing some stubborn fog near the

coastline. you can actually see that right here in your radar view right now. and we've got a very persistent wind this afternoon. it's actually going to pick up more and more. so that makes a blustery coast. but it definitely moderates temperatures for the rest of us. that's are coolest temperatures. the forecast are expected today before we warm up 50's at the coast right now. a lot of 60's elsewhere and a few low 70's returning for the stimulant vacaville right at 70 degrees right now later on today at 60's to 70's for really or maximum daytime highs. only a couple of low 80's. i'll be talking are increasingly warm. rest of the forecast. still ahead, back to you. >> thanks a lot, john. and at 10 o'clock, developing story that we're following is the police investigation into a woman who died at a home in san jose. police say they do have a suspect in custody. >> our own will transmit following the story for us from the scene of the crime. >> police officers are still on the scene and we're talking more than 12 hours after they

arrived. they actually got here at around 6.30, last night and they're actually calling more officers to the scene as they continue to investigate. let me show you the video at around 8.15, this morning. the coroner's office finally arrived to the home. all this is approximately 12 hours after police officers were able to go inside the home this all started at around 6.30, last night with police officers from the san jose police department. they got calls about shots being fired in this neighborhood. 300 block of north 20th street just off julian when they got here, they try deal with the suspect that used to give himself up. >> instead, he barricaded himself inside the home. police officers obviously did not want to russian for their own safety. instead, they called it go. she 8 ers out talk to the suspect for about 2, 2, and a half hours. then finally at around 8.30, or so

the suspect gave himself up without any incident. he has been arrested. his name not be released to the public at this time. that's when they were able to make entry inside the home. and that's when they found the body of a woman inside. reportedly the 2 are not strangers to each other but their relationship not be released to the public at this particular time. now that the coroner's office hazard body, it will be up to the coroner's office to release her name to the public. and of course, it will be up to the san jose police department to find a motive behind us. and so far, no motive has been released. back to you. >> all right. thanks. well as 10. 0, 2 right now. and also this happened in san jose yesterday. look at this car pinned under a truck. this is a deadly accident that happened at the corner of montague expressway and o toole avenue. police are still investigating the cause. but people frequent that area say that a lot of people speed with way too fast and recklessly.

>> i know that this is 3 they saw very dangerous because usually walk to catch another bus when there's no route here and i feel kind of and save, you know what i'm doing the crossroads. so cars are coming really fast. >> we don't yet know who died in the crash, but police plan to offer some more details later today. >> well, developing news this morning. police say at least 5 people, including a teenager, were shot and hurt in sacramento. reyna harvey is in the studio with more. >> hadar and james. so police say it happened shortly after 8 o'clock last night in a neighborhood in south sacramento. police say the 5 victims. we're standing outside of an apartment complex when they were shot. officials say the victims are all expected to survive police have not said what led up to that shooting. >> are big message. is that that you saw something or heard something to please let us know, help us find individuals responsible for this. there's a lot of people that were involved in the shooting we're not sure of all the facts circumstances surrounding this incident, what led up to the shooting. but there are a lot of people

that were injured in this and we need to make sure that they receive justice. >> well, police tell us one of the shooting victims is a teenage girl and 3 men and a woman. they were also hurt. we'll continue to follow this story as it develops. we'll send it back to both the desk. thanks. reyna 10. 0, 4. and police responded to 2 separate barricade situations that happen. >> within moments of each other. people in both incidents have been detained. kron four's sara stinson walks us through what happened. >> a busy night for concord police. 2 separate scenes with a barricaded suspect here on saint francis. drive a shelter-in-place has been lifted but investigators are still trying to figure out what happened here on rose brook court. police got called to a home here just off of kowal road around 6 o'clock. police say a mom lives there with her 3 daughters and a neighbor came over armed with a gun, threatening them. the family ran out of the home. they fully they are safe. they

called police officers on scene. then heard gunshots coming from inside the home. that's when they put a shelter-in-place for people shelter-in-place for people who live nearby. police wer making a plan to get the man out safely when he came out on his own around 8 o'clock, he was armed with a gun. he was then brought into custody. i'm told the man arrested is 47 year-old christian stewart and police are trying to figure out what his motive was drugs and alcohol involved. meanwhile, officers were also at the scene of another barricaded suspect in an apartment complex on detroit avenue. this scene started around 3 o'clock in the afternoon when neighbors called police saying a man was screaming acting crazy with a blowtorch and waving knives around. police responded and learned the man had been evicted from this apartment a couple of weeks ago and he returned and broke into that unit. police spent hours with a crisis negotiator trying to get him out. a police dog was used to get the man in custody. officers say he was bit by a dog around 8 o'clock

tonight and brought to a hospital with minor injuries. police say 35 year-old ahmed davis will be booked into jail afterwards. we saw officers going door to door here on roseburg court, trying to talk with neighbors about what happened. police say a lot more to come with their investigation. i'm sara stinson reporting in concord kron. 4 news. >> palestinians gather last night in the east bay organizations calling for a cease-fire in the middle east. they put together this vigil out of the lake merritt amphitheater in oakland. last night's event was called all eyes on rafah following an israeli air strike that killed at least 45 people in a tent camp last sunday night. 2 of those killed were apparently hamas terrorists. white house national security spokesperson says israel has every right to go after hamas, though they say israel must take every precaution to protect civilians that israel's prime minister is calling the death of civilians. a tragic mistake. an investigation is now underway.

>> we are back 10, 13, the time. and as the weather warms up, blue whales are starting to migrate north from mexico for their summer feeding season tour guides say they spotted a number of them. a lot of these beautiful endangered whales along the california coast in the last 2 weeks or so. the mammals, these blue whales can grow up to 110 feet long and in some cases reached a weight of 200 tons. experts say they hope they'll stick around through july. it will make for some good viewing for folks out there at the coast. looking looking at the water, keep your eye on the state's history. we remember a major league baseball moment. yeah. plus. >> gladys knight also known as the empress of soul was born. newsnation's markie. martin takes a look back. >> today is may 28 fire up those grills and past the condiments, its national hamburger day in 1937, volkswagen vw was founded. did you know the manufacturer name actually means people's car

gym shorts, gray sox and blue running shoes. story that we're following, 2 san jose city council members are demanding that the city have an audit on their spending on homeless services. >> this after a stay on it found in april that the city of san jose spent more than 300 million dollars on their homeless responds. council members bn don't and nevada want to look at how much money is being divided into removing encampments and into temporary housing. the california state auditor found the city could not identify the money that is spent on homeless support. nor does it adequately measure the effectiveness of what it's doing. the report also says that the city lacks enough interim or permanent housing to keep up with demand. san jose has until september to begin publicly reporting its data and to build a plan on how to address homelessness. tonight, the berkeley city council holds a special

election for their district 4 seat that covers downtown and central berkeley. and that's after kate harrison resign saying that berkeley's processes are, quote, broken. she was first elected to the berkeley city council in 2017 and currently she is running for the city's mayor. there are 4 candidates vying for her seat. >> well, an update now all the recall of 70,000 cases of ji, water bottles due to contamination concerns. the recall of fiji natural artisan water bottles began back in early march. >> at issue was the discovery, 3 types of bacteria. customers were initially advised not to drink the water and return it for a refund. but the fda has downgraded the danger posed by the water saying it's not likely to cause any adverse health consequences. the affected bottles were only sold between february first and march 3rd of this year. also for your health this morning, california is witnessing another surge in covid-19 cases driven by the

emergence of a new subvariant. couple of them is a matter of fact. these 2 new subvariants collectively have been nicknamed flirt and they're increasingly becoming more prevalent than the winters dominant strain. and that's causing concern about a possible summer uptick in infections. flirt now accounts for more than half of the infections seen nationwide now than imitation doesn't appear to be any more severe than the old one. but it does seem to be more transmissible so it could spread a lot faster. experts say the current vaccine is expected to continue working. the strains are fairly similar to what the vaccine was program to 4 when it was fighting the winter variants. we should be ok as long as your updated on your vaccines. but i got to check yes. >> 10 18 is the time right now. and now let's take a look at the weather. we've got another chilly cloudy one. hey, john. and today is going to clear out a little bit more. but where we're sitting right now still per 85 done near the coastline. in fact, today's westerly wind is going to keep us cool all day long.

>> even with the departure of that fog noticeable this afternoon. so pretty comfortable day. high pressure. ridge builds in after this. temperatures are going to skyrocket nearing 90 degrees by the time that we reach thursday and friday for some of our inland areas. so cool. coastal breeze remains present today. very shallow marine layer tomorrow. temperatures will start to climb after that. really rising even further towards the tail end of the week. today's daytime highs 50's and 60's for san francisco in the immediate coastline. a bit of a blustery day out that direction breezy for the rest of us, but comfortable enough, especially in the south bay where winds will be comparatively calm and temperatures as mid 70's just right. fremont dublin, san ramon among a few spots. well below average for this time of year, only 70 degrees. oakland at 67, a few low 80's and antioch vacaville and santa rosa looking ahead at tomorrow, we'll have some low 80's inland after that nearing 90 by thursday and friday inland and nearing 80 along the bay shore. back to you.

store advertises pipes, bongs clothing. after they served a search warrant, well, that's when they found a lot more than that. arrested 2 men officers found illegal guns, marijuana, cocaine and a stolen dirt bike and code enforcement officials are implementing now fines and they are recommending the shop's business license be revoked. >> well, wireless carrier t-mobile says it's buying most of us cellular. it's a deal worth nearly 4 and a half billion dollars. t-mobile is set to acquire about 30% of wireless spectrum as part of this deal. it also includes some stores and customers. the company is expected to have deal close by mid 2025. so middle of next year, t-mobile merge with sprint back in 2020, that deal was worth about. 26 billion dollars. also for your money this morning, it could be a sweltering summer for investors as the probability of a rate cut doesn't look all that probable. it's all due to

>> 10 29 want to go out walking today. i so yes, there's really windy. this is from mount tam. i have a feeling i should not go there. it's another windy day. john's been talking about that. again, the live look here shows a got a lot of cloud cover still over, at least the mouth of the golden gate says we're supposed to be looking at san francisco the clouds this morning. but he says eventually it will pull back and we'll get some sunshine even in san francisco. so we'll have a full look at that forecast coming up. >> in about 15 minutes for now, let's get back to the news and happening now. david de pap is back in federal court to be re-sentenced. and this new hearing comes after the judge in the case failed to ask the pap if he wanted to address the court before the sentence was handed down. ashley has to rectify that kron four's. michael thomas tells us what's next. hey, good morning, everyone. will today's court hearing could essentially change thing at path was sentenced earlier this month and was given the maximum prison sentence after being convicted of attempted to kidnap nancy pelosi from her san francisco home.

>> and for beating her husband, paul pelosi with a hammer in total. he would serve a 30 years behind bars. but being that the sentencing judge did make an error at the time when she failed to ask the path of he wanted to make a statement this morning that air is set to be corrected. take a listen to what our legal expert had to say. >> whether he, in fact, has contrition. and then question will be if he doesn't express says that to the court, will the court take that into consideration and reducing the are ready given 30 years sends? i doubt even if the pop says that he's sorry that she's going to reduce it by she. i mean, the judge in this case, he's going to reduce the sentence 2 lesser than 30 years. but who knows? maybe it might happen. maybe she not call 5 years or so. i don't know. >> on the original sentencing didn't have was given a credit of 18 months, which has already been in custody and

his ex-wife tells kron 4. her hope is that the sentencing will be reduced during the original sentencing. the pelosi's were not present, but their daughter, however, was as we get more details regarding what the outcome is of this hearing. we will continue to keep you updated. that is the very latest here in the newsroom. i'm michael thomas will send it back to you live in the studio. thank you, michael. 10. 31 and happening tomorrow. scott peterson, the man convicted of killing his wife laci. it will be in court remotely. he'll appear in his defense, the los angeles innocence project is trying to get him a new trial. >> saying that there is new evidence that should be looked at. they want dna testing done to a rope and a stolen van that was burned out near the petersons home around the time that his pregnant wife, laci went missing. but the stands county district attorney's office is against this new testing. they say there's nothing new about the evidence that convicted him and nothing will change. >> oakland, fire crews still

cleaning up after that massive fire broke out at a lumber yard sunday night. and here we are tuesday. they're still investigating and figuring out exactly if there are any hot spots. economy. lumber suffered heavy damage. lezla gooden takes a look. >> flames filled the skies sunday night around the lumber company off of interstate 80 in oakland. while no one was injured, the fire spread quickly and ended up destroying at least one building as a large footprint. so tight. it's showroom. it's administrative offices. >> a warehouse and then a large lumber yard outside full of for what? so it burned for several hours like a hot with the oakland fire department says crews initially struggled gaining access to the lumber yard and the surrounding area property. >> sits the border. the borders are railroad we could put all we can bring was hose lines on the railroad track put water on one side of the property and the high street also borders. it's getting up or out as into the property

was a challenge. fire crews were out on the scene all day monday working with the owners to go through the property for any additional hot spot excavation crews, the heavy equipment operators assistant picking apart the property and officially make sure that any flare ups are being quickly extinguished throughout the process. all of the parking structure that need to to be demolished last night. you know, there were several small rican goals which were >> and officials say it's still not clear at the fire started inside or outside of this property. and this remains as an open investigation reporting in studio going on for news. >> thank you, leslie 10. 33 is the time for your money this morning in a ballot initiative now, has california business is trying to rein in government spending, the taxpayer protection act as it's called with, make it more difficult for state and local lawmakers to raise taxes. this proposition would require two-thirds of voters approve any city or state tax

increase. now, this measure is currently being challenged in california supreme court by governor newsom. he wants the justices to keep it off the ballot. the state is arguing that the proposition would deny the government the money it needs for public safety for fixing streets and other things. but supporters say the taxpayers are done with what they color are. they claim are being steamrolled by sacramento. >> the taxpayer protection act ensures that all new taxes have broad support from californians by empowering voters. >> well, the state supreme court has to rule on this in the next few weeks. otherwise it will go to the ballot in november. and voters will send sacramento whatever message they're going to send with that. it's rare for courts to intervene before a vote on the proposition. that's already qualified for the ballot. so we'll see what happens. opponents worry that if it passes, they won't be able under the damage. they think it will do to city and state governments. >> and meantime, at the state

capitol, some lawmakers hope to advance propose reparations for descendants of enslaved black americans. yeah, we've got our capitol correspondent eytan wallace with a look. >> well, it's been mixed results for reparations bill so far. but back into the proposals, tell me they believe they're off to a good start. >> a standing ovation in the state assembly after lawmakers voted 62 to nothing to advance a reparations bill callina on the state of california to publish a formal apology letter to descendants of enslaved black americans. the most important thing making sure we can we get it out there. south los angeles, a someone member ready, john sawyer authored the legislation while he acknowledges california was never formally a slave state. heisays since its inception in 18, 50, the state has implemented policies negatively impacting black californians to this day noting california's first governor peter burnett was a slave owner from the south to openly called for creating a whites only american west and helped put in place. a lot 10

slaves back to the south if they fled a not only. >> talking about california complicity and cattle slavery. but making sure that california actually east apologizes for what has happened not to make anyone feel guilty. but the be served at healing other reparations bills advancing include one requiring grocery stores to provide advance notice before closing down in underserved communities. >> and a proposal by senator steven bradford to formally create what would be called to the california american freeman affairs agency in charge of overseein a good foundation work from but several reparations related bills did not make it, including bradford's proposal to fund housing and property tax assistance for descendants of enslaved black americans. i disappointment reparations about. >> land. that's why we build generational wealth in this country african-americans have been denied ownership to

remove cancerous chemicals found in firefighting uniforms. so according to the bill forever, chemicals have been found uniforms. and as we know, they are kherson engines. previous studies have linked these chemicals to cancer and other serious health effects. they also found exposure to them leads to higher rates of cancer, especially among firefighters. if the bill passes, it would ban these chemicals are being used in firefighting gear starting in july next year. >> for 2026 rather. all right, 10 47 for your money. how much you to make if you stay home. a lot of people are working from home these days with the road jobs. but there are some studies that say you're not going to be able to ascend that corporate ladder and make as much money. if you stay home. a job listing site collateral dot com says that they've seen these remote and hybrid jobs go down as far as how many there are and how much they pay. also, about 90% of companies do say they want their employees to head back to work. now, 5 days a week by the end of the year, according
