dangerous rail crossing on the peninsula. the request coming from the bay area leaders. also how the white house is reacting after dozens in a rafah refugee camp killed. station. >> he's calling for news 2. >> thank you for joining us here on kron. 4 news at 2. i'm justine waltman david de pap and back with federal courtroom to be re-sentenced today. this new hearing coming up to the judge in the case failed esta pap if you wanted to address the court prior to his first sentencing kron four's to do justice in court this morning. she's now live in our newsroom with what david de pap had to say for himself. thanks for joining us week and a half ago, david de pap did not have a chance to address a federal court before sentencing this morning. he did standing with his attorney by his side to pep seemed apologetic, telling the judge that he has reconnected with family and promises not to be violent. again, without saying in court he was influenced by the january 6 capitol riot

judge jacqueline corley stating the sentence needs to reflect the damage and seriousness of this crime. the pepper see the total of 50 years. the maximum allowed 20 years for the tempting attempted kidnapping of nancy pelosi and 30 years for assaulting paul pelosi with a hammer inside of their san francisco home. the 44 year-old will serve his sentence concurrently, meaning the total length will be 30 years. the paps ex-wife and son not agreeing with the sentencing today. a lifetime sentence. quite also white >> now, the path was also given credit for the 18 months. he's been in custody. he is also facing state charges with this as well and is expected to be back in court tomorrow morning at night reporting live in newsroom to be justice kron. 4 tiffany, thank you. happening

tomorrow. scott peterson, the man convicted of killing his wife and their unborn child is set to appear in court. his defense team, the los angeles innocence project. >> has been trying to get him a new trial. they want to dna test a rope and a stolen van that was burned near the petersons home around the time that laci went missing. the stanislaus county district attorney's office is opposed to this new testing and says nothing about the evidence has changed, will have reports from court for you tomorrow. and in the south bay. now a woman was fatally shot to the man accused of shooting her has now been arrested. this all started around 6 o'clock. last night. police arrived at north 20th street near san jose high school because of reported gunfire following 2 hours of negotiations, a man then surrendered and that's when officers entered that home and found a woman's body. the man and the woman knew each other, but their relationship has not been revealed. their identities have not been released.

>> happening now, new york. >> police are looking for this teenager who was reported missing yesterday. they're searching for this 14 year-old he's 5 foot. 8 weighs 130 pounds and police say he was last seen wearing a gray t-shirt, blue gym shorts, grey sox and blue running shoes. if you happen to know where this team is to chicago, newark police. on the peninsula. state senator josh becker as calling for more attention to dangerous. train crossings in the state. he's asking for crossing improvements and separation projects. kron 4 s charles clifford joins us now live from burlingame with the details here. thanks for joining us. >> well, good afternoon. i'm in burlingame right now. right behind me here. we'll get a train go by. that's fun. this is an intersection between broadway and the caltrain tracks. it's been a real problem in the past. cars have been hit here frequently. cars get stuck out on there between the lights thursday, 292 million dollar plan to rebuild this intersection. but

that money needs to come in part from the state about 70 million dollars. and right now the legislature has not approved that funding some local elected >> here in burlingame, the caltrain crossing at broadway in california drive is one of the most dangerous rail crossings in the state over the years. dozens of vehicles and pedestrians have been hit here with multiple fatalities. the state legislature had allocated 113 million dollars in funding to help pay for improvements. here and 2 other rail crossings, one in palo alto, one, another in mountain view. but that funding was recently pulled from next year's proposed budget. this is a massive problem. we have a chance to fix it. let's not miss that window. state senator josh becker who represents the area is leading the charge to try to get that funding reinstated because that's going to leverage hundreds of million dollars to both federal funds. >> county and local funds. so this is all ready to go. we're ready to break ground next

year, but we need the 70 million with the thought of losing funding. it really does put in jeopardy our ability to get the project done. caltrain executive director michele bouchard says the transit agency supports the proposed safety improvements were operating an all-time high level of train our ridership is coming back. and so we really do need to be able to provide the level of service that the community needs. it's unclear why the funding was pulled from the budget or if governor newsom supports putting it back in. the state legislature has about 2 weeks to decide if that money will be restored. all right, back live. now caltrain is also in the middle of a project to electrify all the trains along the peninsula, which could make them faster quieter and run more often. >> senator becker says that's even more reason to get the safety improvements made as soon as possible. but for now in burlingame, charles, clifford kron, 4 news time. that train arrival just perfectly charles.

>> all right. let's talk about our forecast now with this live look outside here in san francisco across. >> the street from us is the exploratory. that's a really nice day out there today. only going to get warmer as we get through the week. we'll get those details now from meteorologist kyla grogan. hey there. yeah, i sunshine today. rain we've gotten a little bit earlier today. we're looking good. the golden gate bridge. you can see we've got those blue skies. same story if i go to the east bay here we take a live look. >> it just looks lovely. so let's take a look at temperatures and see if they reflect that sunshine. you can see those upper 70's happening in concord right now. senator is at 77 little cooler around san francisco and oakland in the low 60's. but still pretty nice day out there. even half moon bay's picked up a few degrees sitting right now at 57. so we've got a little wind this afternoon. it's going to be a bigger kick that we've had yesterday and the day before. these are the gusts i'm expecting as we get into about the 5 o'clock 6 o'clock time frame. so if driving home a cross, any of the bridges get ready for that? because you sometimes feel that show me your shake, especially if you're in a high-profile vehicle and it goes throughout

the night tonight, even into the overnight hours. this is 6 o'clock tomorrow morning. so we start off a little breezy and that it should get a little bit better for stormtracker 4 showing that we've got some nice blue skies out there. any action? well, to the north of us up in the pacific northwest, where they're having a little bit of rain and i've been looking out for the possibility, a few high clouds that could come from the tail of that system. but so far we're looking good. we've even had the marine layer pull away from half moon bay, which has gotten a little bit of sunshine in there. so pretty nice night tonight. unlike last night, not expecting the marine layer to come in so strong tonight. so we'll talk about patchy coastal fog instead of kind of they area wide marine layer presents and breezy conditions. temperatures still in the upper 40's to the low. 50 should be a pretty good looking night tonight. i'll be back in a bit. we'll talk more about the warm-up. that's on the way. all right. workers at ucla uc davis now on strike. they claim their rights were violated by the university of california during recent pro-palestine protest. >> the strike began last week at uc santa cruz and it has now expanded to those 2 other

campuses. the union representing teaching assistants, tutors and researchers say the workers free speech rights were violated. when you see leaders called on police to remove the encampments. the university of california claims the walkouts are illegal. this is in the east bay organizations calling for a cease-fire in the middle east, put together this vigil at lake merritt at ampitheater in oakland. last night's event was called all eyes on rafah. >> following an israeli air strike that sparked a tent camp fire, killing dozens of people according to hamas. it's unclear if the airstrikes caused that fire or any secondary explosions possibly from hamas weapons. what's to blame here is still being investigated. the u.s., though, is weighing in on its response to those continued israeli air strikes in rafah, which sparked that massive fire on sunday. we're going get the latest now from our dc's raquel martin. >> and no policy changes to speak to. it just happenmd. the white house is not laying out any new consequences for

israel following a deadly israeli strike near rafah refugee camps. i would remind the president laid out, as i we don't want to see a major ground operation. we haven't seen that at this point. israeli officials insist the strike was targeted and eliminated to hamas. senior officials, however, the fire that erupted killed more than 40 civilians. 8 were children. israel course has a right to go after hamas. but as weve also said many times, almost take every precaution possible to do more to protect innocent life. >> israeli prime minister benjamin netanyahu is calling the strike a tragic mishap and it promising an investigation. we will be watching those results closely. the state department says it has many questions about how the fire started. israel suggest hamas stored ammunition nearby not fair housing night, especially as i said when it's over a kilometer and a half from the location of the strike. we

san francisco supervisor matt sounding the alarm on a new drug making its way into street level drug. so. >> medina is a powerful veterinary, a sedative. and last week, a nationwide public health advisory was issued stating that this drug has been driving the recent mass overdose outbreaks in philadelphia and chicago and other cities as well. so today dorsey issued a letter of inquiry into the city to monitor for the presence of this drug in san francisco. also new now to california law enforcement agency sees nearly 6 million fentanyl pills this year. that's according to governor gavin newsom's office. the california

national guard's counter drug task force confiscated 5.8 million pills since january. and 2.3 million fentanyl pills just last month. in a statement, governor newsom says, quote, illegal fentanyl has no place in our neighborhoods. california is tackling this problem head on by holding drug traffickers accountable and increasing seizures while at the same time expanding access to substance abuse treatment options and providing lifesaving affordable reversal medications, 2 californians across the state. now to about hush money trial of former president donald trump. it is wrapping up today, both the defense and the prosecution teams deliver their closing arguments are washington, d.c., correspondent hannah brandt is live now with details. thanks for joining us. hi, justine. soon that jury will begin deliberating to decide whether former president trump is guilty of the illegal hush money scheme. >> and today both sides got one final chance to try and win jurors over.

sacramento. >> officers say the victims were standing outside apartment complex when they were shot. officials say the victims are expected to survive. officers have not said what led up to the shooting. >> are big message is that that you saw something or heard something to please let us know, help us find individuals responsible for this. there's a lot of people that were involved in the shooting. we're not sure of all the facts circumstances surrounding this incident, what led up to the shooting. but there are a lot of people that were injured in this and we need to make sure that they receive justice. >> police say one of the shooting victims is a teenage girl. the others, 3 men and a woman now to the south bay where a driver is dead after a car got pinned underneath the truck. this happened yesterday afternoon in san jose on the corner of montague expressway and o toole avenue. the cause under investigation. but people who work near this intersection say they see drivers here travel fast and recklessly. >> i know that this is very dangerous because i usually walk to catch another bus when

there's no route here and i feel kind of and say, you know what i'm doing to cross road. so cars are coming really fast. >> police plan to offer some more details on this crash later on today. we hope to have an update for you during kron for news 3 bart service between 24 street mission and daly city. those stations are going to be suspended this weekend. this includes glen park and the balboa park stations. this suspension is going to allow. crews to make track improvements to and also clear nearby vegetation, free buses will be available between the stations, but travelers are advised to expect delays of about 30 minutes in the u.s. situations at those stations. a big milestone has just been reached for the oakland ballers, the team's first home game happening a week from today is sold out. the june 4th opener will be held that raimondi park against the yolo high wheelers tickets for other games are still available. such a big congrats to them. they're going to sell out on their first game live.

look here wide shot of san francisco so we can get an idea what's going on outside for the rest of this week as we have officially entered summer with highly here to chat about what's going that's right. it's really nice out there today, right? and we're only going to get warmer as the week goes on. so we do have a low pressure system, too. >> the north of us and it's kind of pressing on our ridge of high pressure. just a touch keeping temperatures in check. but tomorrow will be a very different story. and that's going to start to see the warm up big in the ridge strengthen and through thursday and friday, we're going to see some pretty warm temperatures before. right now we're getting absolutely beautiful blue skies out there. just gorgeous, even half moon bay, my friends out at the coast. we were really socked in yesterday. but boy, nice blue skies for you today. if you want to take a walk and enjoy it, it's a good time to get out there. temperatures out of moon bay about 55 degrees. we're at 78 morgan hill. we've got some nice 70's in spots redwood city. at 75 right now. 76 in conquer. pittsburgh. just hit 80 degrees. head up to the north bay. 69 in napa.

77 in santa rosa and my friends in cloverdale awfully warm right now to at eighty-four degrees. our micro climates are getting in gear, right? just like we do for our summer season. so obviously a little breezy out there. you can feel that if you walk out the door, we're going to see that pick up as we get throughout the afternoon. the trees right now not too bad. you see them wrestling a little bit here, but in the next couple of hours, i do expect that we'll see some of these teens turned almost 20 miles per hour gusts that are going to be rolling through san francisco. so be prepared for that. if you walk outside look to my sunglasses on of those instances that we don't get any of the dust in your eyes if you're headed out to the giants game tonight, taking on the phillies, it should be pretty good weather, although breezy conditions. so expect that about 59 degrees at 6.45. they throw out that first pitch a little coolerx when they finished. but the night it's going to be relatively clear tonight, comparatively speaking to what we've been seeing. so the a nice night for baseball, i think maybe just the jack in case the breeze get your. see those temperatures are going up thursday and friday peaking pulling it back a little bit on the weekend. but still a really nice forecast as we

health department is encouraging people to get their m-pox vaccinations ahead of the summer season. while

there is not currently a rise in m-pox cases in san francisco, the virus is circulating in other areas across the country. the san francisco department of public health is strongly recommending the 2 dose vaccines especially for the lgbtq+ community ahead of pride month. that community is likely to be amongst those most impacted here last july. the city had an average of 20 new cases per day. health officials say more than 50,000 doses of the vaccine were administered last year, helping to stop the spread of m-pox. california witnessing another surge in covid cases driven by the emergence of the new sub variants of the virus. they are nicknamed flirt and they're causing concerns about a possible summer uptick in covid infections, florida. now accounts for more than half of infections nationwide. the new mutations don't appear to result in more severe illnesses. but it is more transmissible than the winter

strain. experts say the current vaccine is expected to continue working. well, because the new strains only slightly different from the winter variants. and update now on the recall of nearly 70,000 cases of fiji, water bottles due to contamination concerns. the recall of the fiji natural artists and water bottles began in march. at issue was the discovery of 3 types of bacteria. customers were at first told not to drink the water and then return it for a refund. and the fda is now downgraded that danger, saying that the water is not likely to cause and the adverse health consequences. the affected bottles were sold between february 1st and march 3rd of this year. up next, concord police responding to to barricade incident just minutes apart from one another. plus safety issues with several on. >> airlines over the busy memorial day weekend, including a plane that caught fire on the runway. plus, a group of concerned citizens

citizens is calling on the alameda county board of supervisors to create an oversight committee for the sheriff's department. >> this body could investigate in-custody deaths at the jail or shootings involving officers kron four's theresa spoke with the grassroots organizers were spearheading this issue not only just for alameda but all across the state. >> we believe that the sheriff in all counties should be accountable transparency. >> all. >> and citizenship involved in

francisco's office of victim and witness rights now has a new director today. mayor london breed introduced ideally as the >> head of the office. he will be the development of criminal justice policies and represents survivors of violence. lee is a civil rights attorney and brings decades of experience working on public safety and victims rights initiatives. at the announcement today, she called on city leaders to step up and help the crime rates go down in the city. so we need the city every single department of this city. >> to stand up and put their money and they are make their words into actual action. they need to support the people in this room and beyond who are doing the work. the office of victim and witness rights was established by a ballot measure approved by voters and has a mandate to consolidate and coordinate city services. >> to advance the rights of victims and witnesses of crime. now to concord, where police responded to 2 separate

barricade situations within minutes from one another. people in both incidents have now been detained. kron 4 sarah stinson has the details. >> a busy night for concord police. 2 separate scenes with a barricaded suspect here on saint francis. drive a shelter-in-place has been lifted but investigators are still trying to figure out what happened here on rows brook court police got called to a home here just off of khalil road around 6 o'clock. police say a mom lives there with her 3 daughters and a neighbor came over. >> armed with a gun, threatening them. the family ran out of the home. thankfully they are safe. they called police officers on scene. then heard gunshots coming from inside the home. that's when they put a shelter-in-place for people who live nearby. police were making a plan to get the man out safely when he came out on his own around 8 o'clock, he was armed with a gun. he was then brought into custody. i'm told the man arrested is 47

year-old christian stewart and police are trying to figure out what his motive was drugs and alcohol involved. meanwhile, officers were also at the scene of another barricaded suspect in an apartment complex on detroit avenue. this scene started around 3 o'clock in the afternoon when neighbors called police saying a man was screaming acting crazy with a blowtorch and waving knives around. police responded and learned the man had been evicted from this apartment a couple of weeks ago and he returned and broke into that unit. police spent hours with a crisis negotiator trying to get him out. a police dog was used to get the man in custody. officers say he was bit by a dog around 8 o'clock tonight and brought to a hospital with minor injuries. police say 35 year-old ahmed davis will be booked into jail afterwards. we saw officers going door to door here on roseburg ourt, trying to talk with neighbors about what happened. police say a lot more to come with their investigation. i'm sara

stinson reporting in concord kron. 4 news. to san jose city council members are demanding that the city audit its spending on homeless services. this is coming after a state audit found in april. >> but the city spent more than 300 million dollars on its homeless response. the council members want to look at how much money is being divided into removing encampments and temporary housing. the california state auditor found the city could not identify the money it spent on homeless support, nor does it adequately measure the effectiveness of its systems. the report also says the city lacks enough in term or permanent housingsto keep up with the demand. san jose now has until september to begin publicly reporting data and also make a homeless plan. oakland fire crews are still cleaning up after massive fire broke out at a lumber yard on sunday night. the flames destroyed a portion of oakland's economy, lumber company kron four's lezla gooden showed us the damage.

>> planes filled the skies sunday night around the lumber company off of interstate 80 in oakland. while no one was injured, the fire spread quickly and ended up destroying at least one building has a large footprint so tight. it's showroom. it's administrative offices. >> warehouse and then a large lumber yard outside full of for what? so it burned for several hours like a hot with the oakland fire department says crews initially struggled gaining access to the lumber yard and the surrounding area property. >> sets the border. the borders are railroad we could put. all we can bring was hose lines on the railroad track put. on one side of the property and the that high street also borders, it's getting up or out as into the property was a challenge. fire crews were out on the scene all day monday working with the owners to go through the property for any additional hot spot excavation crews, the heavy equipment operators to assistant the part of the

property and officially make sure that any flare ups are being quickly extinguished throughout the process. on the part of the structure that need to to be demolished last night. you know, there were several small rican goals which were 15. >> and officials say it's still not clear at the fire started inside or outside of this property. and this remains as an open investigation reporting in studio going on for news. in a new ballot initiative. california businesses are trying to rein in government spending. the taxpayer protection act. >> would make it more difficult for state and local lawmakers to raise taxes. this prop would require two-thirds of voters to approve any city or state tax increase. but it is currently being challenged in california supreme court by governor gavin newsom. he wants the justices to kill this proposition before it goes to the ballot. the state argues the proposition would deny the government the money it needs for public safety or

fixing streets. supporters say taxpayers are done getting steamrolled by sacramento. >> the taxpayer protection act ensures that all new taxes have broad support from californians by empowering voters. >> the state supreme court must rule in the next few weeks. otherwise voters in november could send a message in california saying that they have had enough. it's rare for courts to intervene before a vote on a proposition that's already qualified for the ballot. opponents worry if passed, they will be able to undo the damage. they believe it percents to city and state governments. airlines and passengers reported some safety issues with summer airlines over the busy memorial day weekend, a united plane caught fire yesterday on the runway. this plane preparing to take off at chicago o'hare airport when smoke started coming out of the wing of the plane, a passenger recorded it on his phone and says he felt the impact on his window. once he

million travelers on friday alone. that is a single-day record. awesome. passengers experienced delays and some other issues. data from flightaware track, fewer than 100 flights canceled on memorial day over the weekend. and as the faa continues to investigate all those incidents from the weekend, they are continuing to assure travelers flying is still one of the safest ways to get around the u.s.. tornadoes continue to tear through the midwest and southern parts of the u.s. leaving. now dozens dead and hundreds of thousands of people without power. so this is what it looked like in dallas today where there was a disaster declaration and tornado warnings are in effect. this video sent in to our newsroom showing us what's happening there. we're going to go now to our meteorologist kyle growing for the latest. is texas still in danger today? you know, it's still in play, but it's really more around houston that we've had the trouble today. you can kind of see where all of the yellow boxes are. those are the severe thunderstorm

watches and the warnings are the solid boxes. >> and unfortunately, now i am getting some tornado warnings there in west texas and up in new mexico's. let's take a look at this. you can see the storms rolled across houston. but if we go to west texas right now, you can see this is west of san angelo east of pecos. a tornado warning that just popped up from this cell that's rolling through there in the heat of the day. right? so you get that juicing up. these storms and then we go to this is as mentioned the northeast corner of new mexico where another one has just flared up. so while this is going on in conditions are right for it can really pop just about anywhere that you see the storms starting to roll through. now, the good news is with what's happening in east texas is what rolled through. dallas is now pushing out to sea its push into louisiana as well. but at the moment, at least they're starting to get things pulling back rather than, you know, ramping up, although they are still under that severe thunderstorm watch. so obviously it's been a very active week in a very active tornado season and we are not done yet. that's for sure. thankfully. and the west coast, little bit quieter, although you do see a little lightning popping up right along the sierra where they're starting to get just a little

bit of this convection in the afternoon. just like happened yesterday. again, it's the heat of the day that tends to kick those things off. but we will be seeing any action from that in our neck of the woods. we are seeing some nice temperatures, though, are in the low 80's, as you can see, an antioch, some nice 60's around the bay. 59 in san francisco. and, you know, santa rosa, 77, san jose. 74 really nice day out there. and this is just the beginning of a warm-up that's going to be on the way this week. so you can see as we look at walnut creek for an example here, looking at tomorrow for some low 80's. and then as we get into thursday, that looks like when this will be the warmest day of the week for walnut creek, about 87 degrees. we will start to pull back a little bit as we get towards the weekend. but, you know, the next couple of days are going to be very sunny and very warm. if you are inland, that's for sure. back to you. coming up, a major street in san jose is going to get a whole new look at took a lot of pain, but we'll show you what it looks like when we what it looks like when we come back. looking for a smarter way to mop?

>> a major street in san jose is getting a whole new look. and today, hundreds of volunteers help paint a sidewalk. mural along pedro street. this replaces the existing blacktop volunteers have been working on this mural all week with the final product spanning 12,000 square feet. san jose blocked off the street to cars earlier this year. mayor matt mahan says this is all part of an effort to bring a community feel to downtown san jose and support small businesses on that street. >> creating these pedestrian mall infusing this area was with more, trying to create a

what i'm talking about. let's take a live look outside now. this is from mount tam. >> and we've seen a lot of marine layer with this shot this week where we actually are making out the entire city right now. and that just kind of shows you that our marine layer has compressed of it is giving us a little bit of a break, getting a little more sunshine in there. so as we take a live look from the east day, you see a little more blue sky today and you see some really nice temperatures out there. really mid to upper 70's is what i'm seeing. i did see one spot to get the 80 seconds. antioch made it up there. but that's about it. 60's in around the bay, oakland, san francisco and some 50's out of half moon bay. but a pretty nice day out there. we do have a little wind to contend with. that's been the usual. alright, this last couple of days today, breezy conditions still kicking up to the tune of about 15 to 60 miles per hour. but stormtracker 4 showing just how lovely and cloud-free a lot of the skies are right now. as we zoom out, you do see a little bit of marine layer, this kind you know, to the south of us. you do see a little bit rain to the north of us. but for the most part, our ridge of high pressure, which is really way out in the pacific right now. it's holding its going to start

building a bit as we get into tomorrow. that's why we're going to see some of these temperatures ramp up. but effect already is. here's our fog cast tonight. that's 11 o'clock tonight. so obviously we're not going to see this rebuild the way it has been rebuilding. tomorrow morning. we will see some of that patchy fog, but obviously not as pervasive and it moves on a lot earlier, which means we are free to get the sunshine in and start warming up. now, not only are we going to warm up this week, but this is looking ahead at next week and you see a good portion of the country is looking out for above average temperatures, including here in the bay area. and that is june second through 6th. can't believe the june starts already when we get towards the end of this week. but that's that's the this little kind of pattern of above average temperatures isn't just for the next couple of that they will peak as we get to thursday and friday. notice we're staying pretty warm right through the weekend and into next week. well, dodgers star shohei ohtani is giving an update now about his recovery from tommy john
