sink. and so we have to wash our dishes for 2 weeks in the back to. >> no now at 11 black water spilling from a bath tub is one of just several problems. residents say they've been dealing with it. a senior living facility in oakley, a small group of them directly voice their concerns to the oakley city council tonight. thanks for being with us this evening. across 4 news at 11, i'm grant lotus and i'm noelle bellow. the senior living facility is where a sewage leak on sunday sent black hazardous liquid flowing out of a bath tub. >> and into the hallway, the situation at oak grove senior terrace shut off power and force 50 seniors to evacuate for more than 24 hours. the facilities management spoke at tonight's meeting saying the leak has been cleaned up and pg and e restored power to the building this morning. he also said residents have been allowed to return as for the hazardous leak management said it was restricted to one

apartment. >> so we please. mayor recommended the property management key route residents concerns and have an emergency plan put in place to help prevent what happened over the weekend. >> new at 11 and east bay father is suing the city of pittsburgh accusing the police department of using excessive force on him. well, he was suffering from a mental health crisis. federal lawsuits tied to this incident captured on video in february of 2022. police body camera video showing officers using a battering ram and tear gas at a hampton inn hotel. according to the lawsuit, ashton porter refused to leave his room because he was experiencing a psychotic episode at the time believing people were trying to get to him. despite porter telling officers he needed time. the lawsuit claims police aggressively forced him out of the room, used tear gas

and even fired several rubber pellets at him. porter suffered significant injuries. in addition to the city of pittsburgh. porter's also suing individual officers, including officer ernesto mejia rosco. he is the same officer who choked bartow martinez to death back in 2016. that case led pittsburgh to settle a lawsuit for 7.3 million dollars. the officer was also arrested last year by the fbi on suspicion of wire fraud. >> new details are emerging after a woman was found dead last night at a home in san jose. police say the woman and her suspected killer who is now in custody, knew each other. police responded to reports of gunfire at the home on north 20th street near san jose. high school is about 6 o'clock last night when they arrived. police say a man barricaded himself inside after hours of negotiating, he surrendered officers then found a woman with serious physical trauma inside the

home. she died at the scene. her exact cause of death is still being investigated. >> we're still trying go through the entire investigation, determined you know what occurred in what order? that's again, part of the puzzle that we're trying to put together. we just know that was one last life that we didn't i'm architect is again, are doing outstanding job trying to figure out what happened. what went down. do have the suspect in custody and we're just working together to make sure bring justice for the victim and her family. >> officers say the suspect also another person shot a man before police arrived. that victim was treated at the hospital for minor injuries. the identities of the victims and the suspect have not yet been released. >> and update on one of 2 standoffs in concord last night. police identified the man who forced his way into a home on rose brook court as 47 year-old christian stewart. police say a woman lived at that home with their 3 daughters. neighbors. we're

start bringing down all the bottles, handed them. they even opened up the freezers. i don't know what they were searching for. they open up every door this pep table. >> somehow the thieves didn't cause any damage to the restaurant, though the owner says he plans to add more security and will open in the next week. uc berkeley police are looking for 2 people who they say broke into a school facility through the roof and stole about $30,000 worth of metals and industrial equipment. this facility is located on regatta boulevard in police say the burglaries ha over the holiday weekend sometime between last thursday and today anyone with information is asked to call uc berkeley police. >> kron 4 is your election headquarters and climate policy director, igor trigg of is leading a tight race for berkeley city council district 4 voting in the special election ended at 8 o'clock tonight. the other 3 candidates include alana auerbach. so ali, out bert and

ruben hernandez story, the seat was left open after kate harrison abruptly resigned in january. whoever wins will finish harrison's term, which runs through 2026. >> san jose state university professor has been put on administrative leave for her role in the ongoing pro-palestine demonstrations taking place on campus. the professors and adviser to student activists there as kron four's jack molmud reports. the professor says the school is trying to censor her. >> well, spring semester may be over. graduations happened and many students have already left campus, including many who were part of this encampment protesting the war in gaza. meantime, though, the events are not slowing down. the professor was suspended by the university over her role in the encampment. she tells me she's denying all of the it felt disingenuous. doctors saying kills a professor at san jose state and the advisor to many activists. students on campus. she says the university put her on

administrative leave. >> after she made a speech to students protesting the war in gaza for some reason, they think i'm directing the students, which i'm absolutely the campus and set up an encampment back with students will only hosting rallies. she is denying all of it saying her speech is only in support of what the students wanted to do. >> i really don't see any evidence or any any any fact that they're showing me, according to the letter sent the doctor killed, she is suspended with pay for a maximum of 60 days. >> we reached out to san jose state and they told us they don't comment on personnel matters. i believe that their fat threatened by my exercise of my free speech think he'll says she's worried the school will try to extend her suspension so she can't talk to students next semester. i am mentally preparing for that possibility as last time we were here on campus with

>> another companies taking major precautions to combat theft. several safeway's in the east bay have removed self-checkout kiosks, god. so how will this affect people shopping? kron four's? sara stinson takes a look. >> i spoke with several safeway shoppers who had mixed feelings about self checkout being taken away. some complained while others said it's for the best. i spoke with a security guard at safeway who told me it's a blessing because he's seen a lot of people stealing. self-checkout is no longer an option for safeway shoppers at certain locations in the bay area, including this store in oakland off of pleasant valley avenue. the change throwing off regular customers. i was surprised enjoy using

self-checkout. they've had a lot of theft i don't know what the solution is that. >> this is not a good gary schulberg says this causes longer checkout lines. it's a >> pain to have to wait in line with full carton from the 5 minutes away. the safeway on grand avenue still has self-checkout kiosks. >> well, the safeway i from the target in emeryville. safeway did not confirm how many stores in the bay area it will remove self-checkout from. but a statement was released to kron 4 ying in part operational changes have been made at select stores throughout the bay area. given the increasing amount of theft. those updates include adjustments to the front end of the store to deter shoplifting. we see retail theft on the rise state. senator lola smallwood queen of us has proposed a bill that aims to prevent retail theft. if passed, the legislation

would prohibit stores from having self-checkout unless it follows a list of requirements regulating that you can only have 15 items or less, you know, coming through self-checkout and we think you need at least one worker for every to checkout lanes and my target. there are 12 checkout and one worker. and so this this worker is trying to help. you know, folks who are less tech savvy, figure it out. while someone may be trying to bombard them with a cart pushing through to steal items. the senator's bill heads to the assembly and if it passes there, it will head to the governor's desk. i'm sara stinson reporting in the newsroom. kron 4 news. >> bay area officials are pleading with state lawmakers to restore funding that was promised to improve caltrain crossings. this one here at broadway and california drive in burlingame is one of the most dangerous crossings in the state. it needs 70 million dollars. they say, for safety improvements. the state legislature had set aside

113 million dollars to help pay for improvements there. and at 2 other rail crossings on the peninsula. but that funding was recently pulled from next year's proposed budget. it is not clear why the funding was pulled from the budget or if governor newsom supports putting it back in the state legislature has about 2 weeks to decide if that money will be restored. >> stocks are in from the california highway patrol's maximum enforcement period over the weekend. the agency says they made more than 1350 arrests statewide from friday through monday night to more than 1100 of those arrests were dui related. 42 people were killed in crashes statewide. chp also issued more than 800 citations for drivers going more than 100 miles per hour. nearly 1900 citations were for not wearing a seatbelt. more than 2004 distracted driving.
