san jose. we have michael thomas leading off our coverage live at the scene. michael. >> hey, good morning, everyone. you can see behind me they're actually starting to get that big rig on its right side up and it is, as james mentioned, filled with 40,000 pounds of strawberries. you can see them trying to drag it over. that driver is ok and that drivers there and the black hoodie, we weren't able to speak with him, but he is doing ok now. it's causing a big headache for drivers on both 1, 0, one and 80. it's caused 2 connectors to be closed. and the senior looking at is that the connector of northbound 101, northbound 8.80. that driver was merging onto northbound 8.80, from northbound 101 heading towards the east when he somehow crashed into the railing and essentially tipped over that trailer. you can see it there with all those strawberries there in the back. now, at that point, it also knocked out multiple sand buckets which spilled onto the opposite connector. those coming from trying to get onto northbound 101. and that is

where we are now. so as you can see, it's going to be like this for the next few hours or so. and you can see the top of that trailer has ripped open. so those gentlemen are trying to figure out exactly how they can get that trailer on its right side up along with the actual big break in the front of that and again, that driver is fine. but when it comes to that traffic, this is going to be closed, at least for the next 2 to 3 hours, according to caltrans. so as we get more details this morning. >> we'll keep you updated. and it does look like they're trying to start taking actually take some of those strawberry 1000 of those properties actually fell out of the actual big break. but it does seem that they may be moving some of them out to get it on its right side up. that's a very latest here in san jose. michael thomas, i wasn't about to 2 in the studio. >> thank you, michael 601. and we want to continue now our team coverage on take a look at the traffic and we have weather. yeah, taking it over here in the traffic center what do you say? that's right. unfortunately, this morning we're already starting off to see a pretty. >> back up here along 101. so

that connector ramp to 1, 1, north and northbound 1, 1, to 8.80, north. those 2 connector ramps right there. shut down. if you are trying to get around this, i would say you can take 6.80, or even want to one to 2.80, right now. we have void that area altogether as you're trying up right, that big rig pretty much the only problem spot that we're seeing across the bay area right now. your bridges look fine, 15 minute ride into the city this morning. the 7 to bridge just short of 14, 80 to 101, richmond center fell bridge 8 minutes and the golden gate bridge around 18 minutes. 37 to the tolls. they'll be working on that for most of the morning. but, john, i'm glad it's not rain in the forecast morning. us is such a beautiful morning, actually. and that is definitely a nice note. if you're getting out there, hopefully not wait in delays are at least to many of them. >> behind me, we've got a look at the golden gate bridge that i'll show you a little closer right next to me, which is crystal clear right now. you can see there is no fog whatsoever at the coastline

currently. and what a change from yesterday. part of the reason that we are going to be seeing temperatures little bit on the warmer side. these next several days is less access to that cooler ocean air. still a bit breezy at the coastline, but not near as much as yesterday was. temperatures are in the 40's to 50's except for pittsburgh. and brett, would you held on to the 60's last night? so relatively mild morning and after this, a warmer afternoon than what we had yesterday back to the 80's for more of our inland areas and a lot more 70's along the big sure. back to you. thanks a lot, john. 602. and today convicted murderer scott peterson returns to court for. >> the second of 3 motion hearing as a group representing peterson is asking the court to re examine dna evidence found in a piece of evidence near the peterson's home kron four's will tran following it all for us live in front of the courthouse there in redwood city. >> well, >> james, this is a huge stay for scott peterson and his family. the court will open up

in about 3 hours from now. the judge. we'll make a ruling by the end of today. we do expect this to go on throughout the day, but what happens at the end could be a big step for scott peterson as he is looking for a new trial. you talked about evidence he and his attorneys from the las angeles innocence project. they want evidence that to be tested for dna. peterson claims that on christmas eve, 2002, when he left his pregnant wife, lacey to go fishing, that she was still alive at the time that it was someone else who abducted they claim that there was in orange van near their home and inside that burned. orange van was also a mattress. they would like dna testing on that mattress. they believe that dna testing will show that laci peterson was, in fact, inside that van. and if that's the case, then scott peterson was not the killer that prosecutors say he was

convicted. it's been proven that he was the killer and they refused to turn over dna evidence unless the prosecutors accuse me unless the judge orders them to. they say that everything was airtight as far as the evidence presented at the original trial and that he should not. he granted a new trial. so a huge day for scott peterson and a huge day, obviously for prosecutors because if the judge says no on the dna testing, it could strike a fatal blow for scott peterson's attempt for a new trial. we have network news here. obviously local news anytime scott peterson's name is mentioned. it draws a lot of media attention. we will be inside the courtroom and let you know exactly how the judge rules back to you. all right. thank >> 605, at the time. and the man convicted of a woman in massachusetts has been arrested here in the bay area

after spending 16 years on the run. the u.s. marshal service says that tune leave ran away from his trial back in 2007 after he was convicted of rape and kidnapping. lee was known as the bad breath rape us due to the victims describing their encounter after 16 years. investigators in massachusetts say they found information that lee was in. blow just east of danville. the massachusetts investigators to travel to the bay area yesterday morning and took him into custody. well, east bay fathers now suing the city of pittsburgh, accusing the police department of using excessive force on him while he was suffering from a mental health crisis. take a listen. so the federal lawsuit is tied to this incident which was captured on video back in february of 2022, this is police body camera footage showing officers using a battering ram and tear gas at a hampton inn hotel. the

lawsuit states that ashton porter refused to leave his room because he was experiencing a psychotic episode at the time believing people were trying to get and despite porter telling officers he needed time, the lawsuit claims police aggressively forced him out of the room, using tear gas and even firing several rubber bullets. porter suffered significant injuries in that encounter. in addition to the city of pittsburgh, porter's also suing individual police officers, including this one. this is officer ernesto. roscoe. he is the same officer who choked, who bertha martinez to death back in 2016. that case led pittsburgh settle a lawsuit 7.3 million dollars. the fbi also arrested the officer last year on suspicion of wire fraud. they are supposed work so backed up garbage in the sink. and so we have to wash our dishes for 2 weeks in the back oh, my gosh. and look at that bathtub. that cause where the source of the

leak came out. >> that was a resident who was talking about >> black water spilling from a tub and all the various problems that >> residents were dealing with at this senior living facility in oakley and a small group of them voice their concerns to the oakley city council last night that senior living facility is where, again, which leaks sent black hazardous liquid flowing. not only have that backed up and down into the hallway and it just got everywhere. the whole situation was happening in oak grove, senior terrorists. and they had to shut off power 50 seniors. residents had to evacuate for more than 24 hours. the management there spoke at the meeting saying that the leak was cleaned up mp jeanne restored power yesterday morning. and he said that all the residents were allowed to return. well, as for the hazardous leak management said it was restricted to one apartment. one electrical room and one elevator room. >> and that no one was exposed to that waste water. but some told oakley city council

happened over the weekend. time now 609. and today governor newsom joins bay area. >> colleges and speaks about and generative ai. it's a summit that's bringing together tech government and academic leaders to talk about how artificial intelligence can best serve. california residents, representatives from stanford and uc berkeley will be there. the summit starts at 2 o'clock this afternoon. oakland summer food service program is back. kids under 18 as well as adults with disabilities enrolled in school programs can sign up to get free lunches during the school year, thousands of children rely on the free and reduced meals. but you know what happens when school is out? oakland is hoping to bridge the meal gap this way to get a list of nearby meal o% sites. parents can download the ca meals for kids app on their phone. >> we're going to take a break here at 6.10, but still ahead on the kron, 4 morning news, a san jose state professor has

>> and we are back 6.13, is the time. and here are 4 things to know. self-checkout is no longer an option for safeway shoppers and certain locations across the bay. safeway says this is due to high theft. safeway has been installing exit gates which only opened after customers scan receipt at some locations, a new mediterranean style restaurant is having to delay its grand opening. now, which was originally set for today after thieves took off with $15,000 worth of items. the owner says he plans to add more security and will open the doors next week. investigators are still trying to figure out how this fire in oakland broke out sunday night. they say they did find where the fire started. crews are on the scene through monday to put out any hot spots. and park service between the 24th street mission and daly city stations will be suspended this weekend and that includes the glen park and balboa park stations, free bus rides. that will be

>> where we're sitting looking outside from the east bay skies are crystal clear. not a cloud in the sky in this view. so visibility is good. temperatures are mild and winds are relatively calm compared to yesterday. great day for the giants as they do. take on the phillies in san francisco today. high pressure ridge is in place and this is actually going to keep us dry and pretty warm for the extended forecast. much of the nation over the next 6 to 10 days. look at that is in for warmer than average conditions. so it's not just here locally, but the west coast, especially around the great basin is going to be in for a very warm start to june. and here in the bay area, 9 different. we will be looking at a warm start to the next month as we do round out her final days of may today into tomorrow and friday will be on that warming trend. that's for sure. near 90's tomorrow and friday. our warmest days of the forecast today, most of us will be 70's to low 80's, even downtown san francisco. like i mentioned around the ballpark

is going to be nice and mild at 72 montero, one of our cooler spots at 60 degrees. well, 60's to 70's along the bayshore burlingame at 72 saying carlos redwood city each at 76 today while south bay temperatures in the low 80's free, a san jose and santa clara, 80 degrees. also back to the low 80's for pleasanton and livermore andp from san ramon up to concord, oakland, 76 for your daytime high of a layover to antioch in the 80's vacaville or warmest by 88 degrees. that's actually going to be our averages come thursday and friday inland near 90% inland spots and near 80 along the bay shore. we'll back off the heat just a little bit into the weekend. but keeping that sunshine around, james. john, thank you. back to the news now at 6.17, and oakland, police are investigating a shooting that happened monday night on macarthur boulevard. >> authorities say they responded to the call at about 11 o'clock. there were reports of gunshots. but when they arrived, police say they found

2 victims. officers were on scene for a few minutes when the san leandro police responded to a vehicle crash near durant avenue and upon arrival there they found the crash victim suffering from a gunshot wound. despite life saving efforts, though, police say the victim died at the scene. no further details have been released at this point. opd, though, is investigating santa rosa. police are asking the community for help finding an at-risk teen who went missing monday morning. police say 16 year-old addison hide left her parents information indicating she left with her cat. and a cat carrier. they say hyde is at risk due to age and medical condition that requires medication that she may not have on her. addison stands 5 feet. 5 inches tall. weighs 145 pounds. she has brown hair and blue eyes. her parents say that addison goes by the name ace. if any idea where she is call police its 6.18 and a san jose state university professor is on administrative leave right now for her role.

>> in the ongoing pro-palestine demonstrations on campus outset. that professor is an adviser to student activists on campus and she says the school is trying to censor her kron. four's jack moment takes a look. >> well, spring semester may be over. graduations happened and many students have already left campus, including many who are part of this encampment protesting the war in gaza. meantime, though, the events are not slowing down. the professor was suspended by the university over her role in the encampment. she tells me she's denying all of the allegation felt like gaslighting. >> to it felt disingenuous. doctors saying kills a professor at san jose state and be adviser to many activists. students on campus. she says the university put her on administrative leave. >> after she made a speech to students protesting the war in gaza for some reason, they think i'm directing the students, which i'm absolutely not. i'm i'm supporting the students kill shared with kron 4. the e-mails that san jose state sent her. they say she

encourage students to march to the campus and set up an encampment back when students will only hosting rallies. she is denying all of it saying her speech is only in support of what the students wanted to i really don't see. >> any evidence or any any any fact that they're showing me to say that i violated any policy whatsoever. according to the letter sent the doctor killed, she is suspended with pay for a maximum of 60 days. >> we reached out to san jose state and they told us they don't comment on personnel matters. i believe that their fat threatened by my exercise of my free speech think he'll says she's worried the school will try to extend her suspension so she can't talk to students next semester. i am mentally preparing for that possibility as last time we were here on campus with several weeks ago with many students here still protesting back then san jose state said it was working to decide what kind of punishment if any could be put on the students. but they say broke the time

place and manner policy. we followed up again with the university to ask if they came to a conclusion. >> we did not hear back reporting on san jose state's campus jacmel but kron 4 news. >> and today at stamford, people will rally urging the university to drop disciplinary action against students who had protested the war in gaza. organizers sand top of the discipline. some students have been banned from campus. the rally is at 4 o'clock this afternoon at the memorial church on jane stanford. way time now is 6.20 and governor newsom is facing criticism over proposed budget cuts. advocates say they'll hurt thousands of undocumented californians who rely on in-home support services about 94 million dollars will be cut from a program. funding in-home services for about 2500 undocumented californians. the program helps pay for in-home assistance and care for eligible seniors and california to a living

disabilities. the governor says that he does not want to make these cuts, but he feels that he has to and has no other choice to help balance the budget advocates are urging him to reconsider. >> if this program is taken away for undocumented recipients, it would be devastating news from many families. it is indefensible for governor newsom to eliminate services for population for no other reason. but for their immigration status. >> the legislature now has about 2 and a half weeks to review the governor's plan and said he may fully balanced budget. it's 6.21. and coming up on the kron 4 morning news, plastic bags could become a thing of the past in california. >> we'll tell you what would >> we'll tell you what would replace them.

>> california lawmakers are bagging reusable plastic bags from grocery stores across the state. both the state senate and the assembly said the move was needed after the elimination of single-use bags failed to reduce plastic pollution. so stores would be permitted to sell other types of trees. will bags made of cloth or woven textiles? it can carry. 22 pounds for at least 300 uses. if governor newsom signs the measure, the ban would go into effect in january of 2026. >> it's 6.25. in for your health. the fda is updating a warning. >> about cinnamon products. several brands were recalled earlier this year because of possible lead contamination.

the first recall was new jersey-based brothers. and now the fda is bumping that to a class to health hazard because this recall the affected cinnamon was packaged in clear plastic jars, though there are no reports of anybody getting sick. just want to make you aware about that recall in the east bay. uc berkeley is getting 1.2 million dollars to help cultivate and develop diverse school leaders. the university says that they have been selected because of their dedication to social justice and equity in education. the berkeley program is also partnering with oakland, san francisco and west contra costa county unified school district in this effort, the money will help provide tuition assistance to aspiring leaders of color. kron 4 is your local election headquarters and climate policy director igor trade up. >> is leading the race now for berkeley city council district 4 with 31% of the votes and 100% of the precincts reporting voting in the

>> we are back 6.30, is the time and get right to that breaking news story this morning. the big rig carrying 40,000 pounds of strawberry overturning on highway one, strawberries. they got to clean up now to that's causing a delay. so robert, michael thomas is fine. as we do have team coverage will go to michael first right there at the scene. >> hey, good morning, everyone. this happened at around 3 o'clock this morning. you can see behind me they're already starting to take out some of those strawberries, essentially. this scene is right at the connector of northbound 8.80, northbound 101, on those connectors here in the south in san jose. the driver of the big break ascension was trying to make that turn when 2 white hit the railing and tipped over not only his semi truck, but also that trailer filled with those 40,000 pounds of strawberries. he also took out some of those containers and that was on the opposite connector of those on 8.80, trying to get on to northbound 1, 1, so those are

still trying to clean up. and you can see there now tossing out tons of those strawberries. that driver is okay. the driver is safe right now. they're just trying to really get the mess cleaned up traffic on 1, it's not looking too bad again. these are the northbound lanes that i'm looking at. and it's probably going to be at least 3 to 4 hours or so before they get all of this cleared up as we get more information this morning, we'll keep you updated. but you can see there as they take away those strawberries. i lots of inventory loss. but thankfully, everybody in the situation was safe. so once you get more word of a specific eta of when it will be cleared out, but keep you updated very latest here in san jose michael thomas starting send it back to they're going to stop. there looks like a farm field and just thank i know it's not a it's a minefield for drivers this morning. it is. it's going take a while to get around it. we've got rain. harvey now with that part of our coverage training. yeah. you heard michael saying 3 to 4 hours. so we'll be talking about this for some time.

proposed a bill to prevent retail theft. and if that passes, it would prohibit stores from having self checkout lines at all unless they follow a list of requirements. >> regulating that you can only have 15 items or less, you know, coming through self-checkout and we think you need at least one worker for every to checkout lanes and my target. there 12 checkout and one worker. and so this this worker is trying to help. you know, folks who were less tech savvy, figure it out. while someone may be trying to bombard them with a cart pushing through to steal items. >> so you can see that she's talking about, you know, the safety and well-being and jobs of the workers in all of this as well because they're affected. the senator's bill would also require stores to conduct a study before they implement technology that could reduce the number of workers they need. her bill is headed to the state assembly. if it passes, then it goes to the governor.

>> well, new details now emerging after a woman was found dead inside of a home in san jose. police say that woman and her suspected killer who is now in custody knew each other. police responded to reports of gunshots heard at the home of north 20th street right near san jose high school at about 6 o'clock monday night when they arrived. police say a man barricaded himself inside and after hours of negotiations, he eventually surrendered. officers say they then found a woman with serious physical trauma inside of the home. they say she died at the scene. her exact cause of death is still being investigated. >> we're still trying go through the entire investigation, determined you know what occurred in what order? that's again, part of the puzzle that we're trying to put together. we just know that was one last life that we didn't a kids again are doing outstanding job trying to figure out what happened. what went down. do have the suspect in custody and we're just working together to make bring

justice for the victim and her family. >> officers say the suspect also shot a man before police arrived. that victim was treated at the hospital for minor injuries. the identities of the victims and the suspect have not yet been released. an update now on one of 2 standoffs in concord. monday night. police identified the man who's accused of forcing his way into a home on rose brook court. as 47 year-old christian stewart. police say the woman lived. >> at that home with her 3 daughters. neighbors were asked to shelter in place when they heard gunshots. they say the standoff lasted for a couple of hours until stewart came out. no injuries reported. police say stewart told officers he entered the home because he was being followed by several armed suspects. investigation concluded there was no evidence to support that statement. stewart was booked on several charges. >> are developing story. is this fire that this morning is still being investigated in oakland? they're trying to figure out how it started on

sunday night. investigators say that they have found where the fire started. it damaged a lumber warehouse. it was at the economy, lumber company. this broke out. that's on high street right off of 80. it took long when it broke out and then they were still there yesterday, monday, putting out hot spots. the tesla factory in fremont is being sued by hundreds of workers. they alleged severe harassment against black workers at the factory in court documents, black workers say that higher ups called him the n word and fellow workers referred to the plant as the plantation where the slave ship workers also say they saw anti-black graffiti, including new, says racial slurs and swastikas. tesla has responded to the lawsuit saying that if it was informed about races, incidents, it took, quote, immediate and appropriate corrective action and quote. the class action lawsuit now
