hour covering the big rig crash with strawberries and other stuff all over the roadway. that following up your commute this morning. it is on scene for us is part of our team coverage is kron four's michael thomas with the latest on the cleanup effort. michael. >> hey, good morning, everyone. thankfully, everyone in the scenario was safe. right now. we're just dealing with a lot of strawberries getting taken out of this big right. we're going to show you the strawberries. you can see these efforts of cleaning up started at about 7 o'clock or so. they're still going into that big rig. we're going to move the camera this way. you can see just exactly where that big rig hit. this is on the connector of northbound 101, going onto northbound 8.80, essentially chp does say the driver of this big break may have made too wide of a turn to connect onto northbound 8.80, heading over towards the east bay hit the railing bounced back and that big rig flipped over. so this all happened at about 3 o'clock in the morning, trying to get that big red right side up for hours. but they had to empty at first. so right now

you can see we've got tractors right next to us in the middle of they're taking out all of those strawberries, 40,000 pounds worth strawberries. okay. they're taking about that big pile. we'll have our photojournalist edgar show you all of those strawberries right there. unfortunately, they are going to but the good thing is, is that everybody in the scenario was safe when it comes to traffic. i know rain is covering that aspect and rain. if you can hear me from what i'm seeing on northbound 101. it is a small and only from what i can see, it looks, you know, not too bad, but lots of looking lowers the people wondering what this big stack of stack i should say is and it is strawberry. so as we get more details from chp of when this will open up. keep you updated. but right now that is all we know. and i'm going send it back to you guys live in the studio for now. all right. well, that's i mean, some good news. the pilot was not on the road right there. so that's good. at least some consolation, all the backup getting around. it's going plenty. plenty of

golden gate, something we're seeing all across the bay area today. >> and a huge change from yesterday morning today. crystal clear out there in downtown san francisco. you can actually see the full. transamerica building shrouded out by the low great. so visibility remains a nice thing today. and if you're heading out to san francisco to watch the giants great day for the game, some low 70's winds, not much of a factor as yesterday. still get a look at 20 miles per hour gusts. but compared to yesterday's winds, nice and calm 50's to 60's for current temperatures. we do have a few low 70's inland like in vacaville at 71 oakland and berkeley still hanging out in those cool 50's for the moment later today, we'll get on upwards into the 70's and 80's for your highs. i'll talk more in your forecast as we go back to you. >> thanks. a lot of 3 and today convicted murderer scott peterson returns to court for the second of 3 motion hearings. the group is asking the court to perform dna tests on pieces of evidence were found near the peterson home

at the time of the crime problems will tran is live at the courthouse in redwood city with the latest. will. >> now they claim james and area that key piece of evidence, including a mattress and a burned orange van that it will find him not guilty. eventualy of this that scott peterson is looking for a new trial. they just let people inside the courtroom. this will all begin at 9 o'clock this morning. and we will be inside as far as scott peterson. this is a huge day for him because depending on what the judge rules, it could be a victory for a victory for him. one step closer to possibly getting a new trial could. defeat him. i mean, fatal blow for his chances of a new trial because they are relying on that new piece of evidence. they claim that was show that he was not the killer despite being found guilty at this same very courthouse decades ago. and the los angeles innocence project, they are representing

him. they want the judge to force the prosecutors to turn over evidence so they can test the dna on the mattress found inside that orange fan as well as the orange van. they believe that dna will show that lays laci peterson was, in fact, inside that orange van. that's scott peterson was not the killer. that, in fact, on 12/24/2002, while his wife was very much pregnant, almost completely 9 months pregnant and ready to have their baby connor. that he actually went fishing at the berkeley marina and that he was not the killer. prosecutors say they have an airtight case on him that he was found guilty throughout the whole process, even his behavior showed no remorse. and that's why the jury at that particular fight time found him guilty. again. this is a big day for each side of the argument. we will be inside. this is supposed to last all day and depending on what happens, it could lead to

a new trial for scott peterson, who, by the way, will not be inside the courtroom. he will zoom inside the courtroom for a teleconference, but he will not physically be inside or a big day for the prosecutors. and just as importantly, a big day for laci peterson's family, who, after all this time still believe and claim scott peterson killed laci peterson. >> all right. will be following and see what happens. thank you. well, in the nation also has its eye on this court case happening in the bay area. david de pap he'll be back in state court for the attack on paul pelosi. opening statements are set to start this morning. he is charged with attempted murder, elder abuse, residential burglary among other felonies, prosecutors say that he admitted that he broke into the pelosi's holmes is here at home in san francisco with the intent of holding the former house speaker nancy pelosi

punishable by up to 4 years in prison. >e reporting in new york city, basil, john. >> one east bay fathers now suing the city of pittsburgh, accusing the police department of using excessive force on while he was suffering a mental health crisis. take a look at this. so the federal lawsuit is tied to this incident that was captured on video back in february of 2022, the body camera footage shows officers using a battering ram tear gas. and more at this hampton inn hotel. now the lawsuit states that ashton quarter refused to leave his room because he was experiencing a psychotic episode ii believe people trying to get him. and despite him telling police he needed more time to basically calm down. the lawsuit claims police aggressively forced him out of that room using tear gas and even firing several rubber bullets. porter suffered significant injuries. and in addition to the city of pittsburgh, porter's also

suing individual police officers, including officer ernesto mejia or roscoe, who you see here. he is the same officer who choked to bear to martinez to death back in 2016. that case led to pittsburgh settling a lawsuit for 7 0.3 million dollars and the fbi is says they also arrested the officer last year on suspicion of wire fraud. >> happening today, governor newsom will join bay area college officials and they're going to talk about generative ai. it's a summit bringing together government academic and other leaders to talk about how artificial intelligence can best serve. california residents, representatives from stanford university and uc berkeley will be there. the summit starts at 2 this afternoon. oakland summer food service program is back. >> any children under 18 in the area as well as adults with disabilities were enrolled in this program. they can get. >> free lunches during the

oakland, you'll be at 76 degrees. north bay temperatures vacaville at 88 our warmest spot today tomorrow, expecting vacaville to get up to the 90's and a lot of the rest of the inland areas to right behind you in those upper 80's bayshore cities in the upper 70's for thursday and friday before temps drop just a little bit this weekend. all right. thank you very much, john san jose state university. a professor now on administrative leave for her role in the ongoing pro-palestine demonstrations that have been taking place on campus. the professor is a student adviser for the activists on campus and she says >> that the schools trying to censor her coverage moment has more. >> well, spring semester may be over. graduations happened and many students have already left campus, including many who are part of this encampment protesting the war in gaza. meantime, though, the events are not slowing down. the professor was suspended by the university over her role in the encampment. she tells me she's denying all of the allegation felt like gaslighting.

>> to it felt disingenuous. doctors saying kills a professor at san jose state and the adviser to many activists, students on campus. she says the university put her on administrative leave after she made a speech to students protesting the war in gaza for some reason, they think i'm directing the students, which i'm absolutely not. i'm i'm supporting the students kill shared with kron 4. the e-mails that san jose state sent her. they say she encourage students to march to the campus and set up an encampment back with students will only hosting rallies. she is denying all of it saying her speech is only in support of what the students wanted to do. >> i really don't see any evidence or any any any fact that they're showing me to say that i violated any policy whatsoever. according to the letter sent the doctor killed, she is suspended with pay for a maximum of 60 days. >> we reached out to san jose state and they told us they

don't comment on personnel matters. i believe that their fat threatened by my exercise of my free speech think he'll says she's worried the school will try to extend her suspension so she can't talk to students next semester. i am mentally preparing for that possibility as last time we were here on campus with several weeks ago with many students here still protesting back then san jose state said it was working to decide what kind of punishment if any could be put on the students. but they say broke the time place and manner policy. we followed up again with the university to ask if they came to a conclusion. >> we did not hear back reporting on san jose state's campus. jack molmud kron. 4 news. >> well, new this morning openai has unveiled a new safety committee as it takes its next steps in training. a new ai model. so this next frontier models are calling it will replace the system that's responsible for the a i to understand and generate new outputs in chatgpt. the committee will advise the full board on what they say are critical safety and security

decisions for its projects and operations. that committee will evaluate and make recommendations to the board in 90 days where the company will then release which recommendations they will be adopting. meantime, the ceo of that company, sam altman, is now joining a list of wealthy philanthropist committed to donating more than half their fortunes. the giving pledge made this announcement yesterday. the terrible campaign was founded in 2010 by bill gates, melinda, french gates and warren buffett to help tackle urgent problems. according to forbes, altman has accumulated 1 billion dollars through investments. altman says he wants to focus on giving, quote technology that helps create abundance for people, end quote. >> as the bay area waits for our giant pandas, dc is getting theirs back. the national zoo just announced this morning they're getting to giant pandas from china by the new year. the zoo in dc has had pandas for 5 decades before they had to send it

back china about a year and a half ago. meantime, san francisco is trying to raise money to ready the francisco zoo for the pandas that china could send as early as this summer. they sure are cute. >> kron 4 is your local election headquarters in climate policy director, i trego. >> is leading the race for berkeley city council district 4. he has 31% of the vote voting in the special election ended last night. 100% of the precincts reporting. now the other 3 candidates include elaine auerbach solely out bird and ruben hernandez story. the seat was left open when kate harrison abruptly resigned in january saying that berkeley was broken, whoever finishes the race finishes the term. >> well, governor gavin newsom is facing criticism now over proposed budget cuts, but advocates say will hurt thousands of undocumented californians who rely on in-home support services about 94 million dollars would be cut from a program funding in-home supportive services for more than 2500

undocumented californians. the program helps pay for in-home assistance and care for eligible seniors in california's living with disabilities. the governor says he does not want to make these cuts but feels he has no other choice to help balance the budget advocates, though, are urging him to reconsider. >> if this program is taken away for undocumented recipients, it would be devastating news for many families. it is indefensible for governor newsom to eliminate services for population for no other reason. but for their immigration status. >> well, the legislature now has about 2 and a half weeks to review the governor's proposals and send him a fully balanced budget. >> it's a 21. and coming up on the kron 4 morning news paper or plastic might not be something they say anymore in california. so we're going to tell you what might replace plastic bags altogether. a 24

and new this morning, what you drive nissan is warning you. >> if you have an older unrepaired model, don't drive it. apparently there's a risk of an exploding airbag inflator about 84,000. nissan's could be affected. the inflators are at a risk of exploding in a crash. and if they do that, they could hurl the metal fragments >> certain 2002 through 2006, central half infinity q x fours. those are all on this list. the owner's contact a

dealer set up an appointment and they will replace that inflator for free. >> well, san francisco's health department now is encouraging people to get there and pox vaccinations ahead of the summer season. they recommend 2 dose vaccination vaccinations, especially for members of the lgbtq community ahead of pride. they say they are likely to be among those most affected. and while there is no currently a rise in m-pox cases in the city, the virus continues to circnlate across the country and we don't want to see a spike here. health officials say more than 50,000 doses of the vaccine were administered last year. and that helped stop the spread of m-pox them. california lawmakers, by the way, are banning reusable plastic bags from grocery stores across the state. now you can even use the reasonable ones anymore. both the state senate and the assembly said the move is needed after the eliminated the single-use bags. but that failed to reduce the pollution problem in landfills stores, though, will be allowed to sell other types of reusable

the breaking news is the accident. san jose that involved >> what was it? 40,000 pounds of strawberries on strawberries? yeah. he stood big rig on its side. we've got kron four's michael thomas at the scene right now with the latest on the efforts to get back on its wheels. mike, that pile. >> i hey, good morning, everyone. everybody is safe in this situation and has already mentioned that pile. take a look. this is probably about 20,000 pounds of strawberries because this was a lot higher. they brought in another big rig and took all of those strawberries and they took it to the trash. so if you are on highway 101, keep in mind. if

you see strawberries, that is why this is the scene of the actual big rig that tipped over. you can see it's northbound 101 connecting onto northbound 80. that drivers chp believes may too wide of a turn hit the rail tipped over and when they tipped over they also knocked over some of those sand bucket that you see there which spilled into the opposite connector of 80 going onto northbound 101. so this has been the scene since about 03:00am this morning. those strawberries that they were killed inside that truck. they've been slowly taking them out of the trailer and they've been doing this for the last 3 hours, everyone so lots of strawberries and the strawberries were all dumped into this huge pile from there. they're taking those onto another truck and taking them away so that way they can get this big break right side up and get these connectors back open. so as i mentioned, that driver is safe. there is no issues in that aspect. the biggest issue is just the traffic that we're seeing on northbound 101 and i'm sure aetn for plant can't see that visually. but i do. reyna has

those details. and darren james, when it comes to these strawberries, as we mentioned, 40,000 pounds of these, they go for about 3 bucks or so each. that's about $120,000 worth of strawberries. and keep in mind, when they filled other truck up to take it on to 101. some of those strawberries are actually flying out because they're all they're not package, around 101, northbound strawberries may hit you or something. it is because they're over filling on that truck that they're trying to take to the dot. >> you know what? that's going to create a strawberry traffic sorry, tucson. >> thank you very much. jokes or rubbing on speaking of traffic. that's the whole side of the story follows. yeah. what are the alternatives and how bad is it? i mean, it's really bad. we make those joke. maybe tomorrow when the traffic starts to die down out there. >> the connector ramps closed northbound 1, 1, 8, 88, 80 to northbound size right there. you can see all the highways pretty backed up 1, 0, 1, 2, 80 82 originally i was saying

take 2, 86, 80, however, look at them. they're both pretty backed up and chance. so i would take the service streets right now. i was certainly maybe have one. 82. a definitely wouldn't be on any of these highways. looks like everybody's doing just that. okay. police until they're able to write that and pull it out of the way. other highways and bridges are busy this morning. a 19 minute ride bay bridge, san mateo bridge, still at 30 minutes of in at 30 minutes for most of the morning crockett out towards the maze along 80 in the east bay. 35 minute ride 24 walnut creek down to 5.80, not as bad as the other highways. about 15 minutes. johnson over to you. being in that traffic. but at least you're under the sunshine as you may be air. >> having that slower commute into work this morning, we're definitely not held up out in walnut creek right now. take a look at that sunshine overhead. gorgeous view in the inland east bay this morning. and we're seeing those clear skies all the way up to the coastline. now, skies will stay clear today, boding well for the giants game. if you're

heading out to the ballpark, though, do expect winds to pick up towards around 20 miles per hour into the afternoon. temperatures right now are in the 50's to 60's for most of us couple spots like vacaville up into the low 70's already later on today. you will notice a subtle warm up from yesterday. not a big spike in temps just yet are warmer days are still ahead of us thursday and friday. back to you. thank you. it's a 33 and self checkout is no longer an option. >> for safeway shoppers at certain locations around the base safely says they took him out of select stores because there was so much theft and it's not the only thing they've done to prevent crime. they also at some stores they've installed exit gates that only open after you scan your receipt. retail theft is an issue here in the bay area and across california state senator lola smallwood quay. this has proposed a bill to prevent retail theft and if it passes, it would prohibit stores from having self-checkout lanes unless they follow a list of requirements.

>> regulating that you can only have 15 items or less, you know, coming through self-checkout and we think you need at least one worker for every to checkout lanes and my target. there 12 checkout and one worker. and so this this worker is trying to help. you know, folks who are less tech savvy, figure it out. while someone may be trying to bombard them with a cart pushing through to steal items, i always need help from that person who helps the people to self checkout. >> and this bill would also require stores to conduct a study before they implement any technology that could cut down on the number employees that they need. the bill is headed to the state assembly. if it passes there, then it goes to the governor. >> well, san francisco restaurant now having to delay its grand opening this week because of a break in their feeds, took off with thousands of dollars of items in one night. kron four's lezla gooden takes a look.

them. george explains that the thieves did not cause any physical damage to the restaurant. instead, he says they took liquor from the front and back of it. eventually they made their way to the kitchen where they were seeing looking through his recipe book. they even opened up the freezers. i don't know what they were searching for. they open up every door this pep table says police were here earlier investigating and dusting for fingerprints telling him they haven't seen anything quite like it. >> you know, having having this when the light is right, there's where we're at the finish line. and this kind of just. you know, breaks you are a little bit. but again, have to move forward. >> let's look good kron. 4 news. >> we have new details emerging now after a woman was found dead inside of a home in san jose. police say she and her suspected killer. i should say her suspected killer is now in custody and apparently knew each other. police responded to reports of gunfire at this home on north 20th street right near san

jose high school. about 6 o'clock monday night. police say when they got there, the man barricaded himself and it took hours of negotiation to convince him to surrender. once he did, though police went inside and that's when they found a woman with serious physical trauma. they say she died there at the scene. the exact cause of her death is still being investigated. >> we're still trying go through the entire investigation, determined you know what occurred in what order? that's again, part of the puzzle that we're trying to put together. we just know that was one last life that we didn't architect is again, are doing outstanding job trying to figure out what happened. what went down. do have the suspect in custody and we're just working together to make sure bring justice for the victim and her family. >> officers say the suspect also shot a man before they got there. that victim was treated at the hospital with minor injuries. the identities of the victims and the suspect have not yet been made public. >> a big step forward for solano county city of the

oversight committee. look over the sheriff's office. so the group wants them to look into in-custody deaths out of the jail and shootings involving officers. santa rita has come under attack for years. fact, several years ago to deputies pleaded guilty to abusing inmates. residents that we talked with want more transparency and they want this committee to be independent from the sheriff's office. >> a civilian body that has designated duties. for example, to look at trends to look at best practices to look at complaints as well as authority to get information. >> alameda county supervisors will talk about the committee during next week's meeting and we'll keep you informed about that. fentanyl laced with an animal tranquilizer is causing a surge now in overdoses across the country. and that has san francisco officials worried that we might see overdoses go up here as well. so health officials in philadelphia, chicago have reported spikes in overdoses

containing the drug called added that in mind. now san francisco supervisor matt dorsey is asking local health officials to monitor for that drug. fact, just last year, the san francisco health department. sent out an alert about xylazine which is another animal tranquilizer that was found mixed with fentanyl causing overdoses too. >> we could have predicted that the drug supplier he still believes what's alarming is that it's changing seemingly every few months or something. new that drive and more addictive and more data. >> from january of april, from january to april of this year, san francisco has seen now total of 250 fatal overdoses. >> this morning, investigators are trying to figure out how this fire got started in oakland saturday night. it was at a warehouse sorry, sunday night the start the fire started in lumber warehouse is
