>> from the bay area's local news station. we now with breaking news. >> 10 o'clock now that 7 hours since this big rig crash in san jose and the backup still going on 40,000 pounds of strawberries overturned on highway 101 at on the connector. that's where coffers michael thomas is following the progress this morning. michael. >> this accident happened at 3 o'clock this morning. the good news is take a look. they already have that big rig on its right side up. we have been waiting for this moment since about 4 o'clock this morning. when we arrived here. >> and as we've mentioned more than or i should say, around 40,000 strawberries, take a look at those. they are actually, you know, we can't even show you those because they've already package most of them up into the dump truck. sorry about that. but that was 40,000 pounds of

strawberries. the driver is ok, essentially this driver was coming from salinas heading towards richmond. he took this curve a little bit too fast. we're right near now. northbound 101, going onto northbound 8.80. he took that curve a little bit too soon and essentially hit the railing and his tractor trailer did tip over. it also knocked over some of the sand buckets onto the opposite connector, which is 80 heading onto northbound at that he was safe, able to safely get out. however, they had to empty out this trailer filled with those 40,000 pounds of strawberries so that shoppers have been taken out the trailer and big rig itself have been lifted on its right side. they're working to get this out of here and then hopefully getting these connectors back open. they tell me should be done within the next hours south. that is the very latest that we have here in san jose and michael thomas, tara and james, i will send it back to you. and as a side note, all the strawberries for the most part have been taken and

they're already have cleanup crews here to pick up whatever is left they are actually in and the serious know caltrans did say they're worried that maybe as some may grow here because they're already out trying to clean up as many as they can. so they don't have any more issues in the future. they don't want and then people would want to pick potentially. right. michael, thank exactly. yeah. you wondered about you know where to start seeing strawberry plants start to pop up. so that's what it looks like. they're at the scene of the accident. but that's the impacts that everybody else is dealing you and rain has got that part of the story. all right. yeah. that connector ramp like michael just mentioned, still closed right now. >> northbound want to want 8.80, in 8.80, to 101. if you are trying to maneuver around that area, i would suggest potentially taking 6.80, hopping on one on one and then on to 2.80, z, 2.80, still a little busy side streets. going to be your best friend in this situation because the adjacent highways are still a little busy this morning. but we're seeing some improvement a bridge right now. 13

back to the hearing that's happening now for convicted murderer scott peterson. he's in court via zoom. >> this is the second of 3 motion hearings and it's been going on for about an hour or so fighters has. yeah. the group representing him is trying to convince the court to allow them to perform dna testing on pieces of evidence that were found near the peterson home. >> back at the time of the crime, our will tran has been live at the scene in and out of the courthouse seeing what's going on. what can you tell us? well, >> gerri, i just stepped outside of the courtroom. i was in there for the past hour and the lawyers for the las angeles innocence project, very passionate. they're calling this a post conviction investigation and investigation to search for the truth. now, right now it is their turn to talk to the judge later be the prosecution's turn to explain to the judge why they believe there should not be any dna turned over to the defense team. now, scott peterson was convicted at the same courthouse back in 2004. he

has maintained his innocence throughout claiming that, yes, he did take off fishing on christmas eve of 2002 while his wife was pregnant about to give birth at any time. but he went fishing that he claims someone else abducted laci peterson and he points to 2 pieces of evidence. one, there was a van that was set on fire near their home. and in,ide that van was a mattress. they are asking for the prosecution to turn over dna. they want to test that dna. and they say that it will show that laci was inside that van. and if so, then scott peterson was not the killer. now in court, the defense team says they want this because there are a lot of witnesses who they threw time, minor forgotten their testimony. some of them have already died since this whole trial began and ended back in 2004 that they need this evidence to prove their case that scott peterson is,

in fact, an innocent man. prosecutors, they will take their turn sometime this afternoon. and if you're curious about scott peterson, he never said a word in court. you're right, daria. he was in via zoom last time. i saw him. he was in court with a ponytail. this time his head was shaved where yes, tabs on it. he did not say a word and even did not flinch during the time when the defense team was talking about laci peterson's body, when it was discovered and the berkeley marina, they went into detail about how gruesome it was and why they need this evidence. i looked at scott peterson. he never flinched during that time. >> interesting. all right. we'll see how this plays out. will thank you very much for also what we're monitoring what's happening right now with david de pap was in court now in state court for his attack on paul pelosi. remember, he was already convicted and federal court, but now in state court, the opening statements just

started about an hour ago and he is charged with attempted murder, elder abuse, residential burglary and other felonies. prosecutors say dip app admitted that he broke into the pelosi's home in san francisco with the intent of holding former house speaker nancy pelosi hostage. but she wasn't home. and you remember what happened after that, you ended up hitting pa pelosi with a hammer and then he was arrested. this trial is expected to last about 3 weeks. and i already told you how in federal court he was convicted and he was actually re sentenced yesterday to 30 years in prison for that conviction. >> jurors across the country in new york are now deliberating in former president donald trump's hush money trial. dc correspondent basil john has the latest. the case is now reaching a pivotal point. we jury deliberations and a possible verdict making this the most important week of the trial. >> it's a very sad. this is a dark in america. the clock is ticking for former president

records. and these charges are punishable by up to 4 years in prison. >> reporting in new york city, basil, john. basil, thank you. 10 await the time and a man convicted of a woman in massachusetts was arrested here in the bay area some 16 years after the fact. >> the u.s. marshal service says that twin lee ran away from his trial back in 2007 when he was convicted of kidnapping and rape. now, lee was known at the time as the bad breath rapist. based on the description the victims gave police. but after 16 years, investigators there in massachusetts discovered that lee was living in the town of diablo, which is just east of danville in the east bay. the massachusetts investigators and came to the bay area yesterday morning and took lee into custody. and he's great father is now suing the city of pittsburgh, accusing the police department of using excessive force on him while he was suffering from a mental health crisis. and here's some of the video when that happened. the federal lawsuit

is tied to this incident that was captured on video back in february of 2022. police body camera footage shows officers using as you can see here, a battering ram. they also used tear gas at this hampton inn hotel. now, according to the lawsuit, ashton porter says he refused to leave his room because he was experiencing a psychotic episode at the time people leave. people were out to get him. and despite porter telling officers he needed more time before you open the door. the lawsuit claims that police in their words aggressively forced him out of the room using tear gas and even firing several rubber bullets. porter apparently suffered significant injuries. and then in addition to the city of pittsburgh, porter's also suing some individual police officers, including as you see here, officer ernesto rosco he is the same officer who choked humberto martinez to death back in 2016. that case led to pittsburgh having to pay 7.3 million dollars in

a settlement. the fbi also says they arrested the officer last year on suspicion of wire fraud. >> it's 10, 10 bart service between the 24 street mission and daly city stations will be suspended this weekend. that includes the glen park and balboa park stations. this will allow crews to make some track improvements and clear vegetation. free bus rides will be available between the stations. but you are expected work in a delay. they think it's going to be 30 minute delay for you get use the bus bridges. it's 10, 10 right now and open. the summer food service program is back on. so that means right now 18 and under as well as adults with disabilities enrolled in school programs can sign up and get free lunches all summer long. and that will fill the gap from the school year where thousands of kids rely on the free and reduced cost meals at schools. now that school is out. oakland is hoping this will make ends meet bridge. the gap. if you

show the actual incident. okay. this is the incident earlier this morning. you can see the overturned big rig there. >> well, we know about this is happened in the early morning hours around 03:00am big rig carrying thousands of pounds of strawberries. nonetheless, you can see all of the workers they're carrying the straw buyers out of the truck. reason why it took so long takes draw theirs out of the vehicle and they got right. the vehicle there now within the past 30 minutes, they've been successful friday. that big rig. that's the good news. however, that connector ramp still close. so the connector ramp is northbound a one. >> to 80 and then 8.80, to 101 north has been closed for most of all of the morning. >> i'm telling people if you want to get around it, you can take 6.80, that runs just adjacent to that. also want to one to 2.80, the surface streets. also a great option. if you don't want to take the highways at all. bridges right now, 14 minutes on the bay bridge. a richmond center fell bridge around 8. some of those highways like want to one of busy. we're still at about 40

student activists on campus and she says that the school is trying to censor, you know, with proper track moment to explain. >> well, spring semester may be over. graduations happened and many students have already left campus, including many who are part of this encampment protesting the war in gaza. meantime, though, the events are not slowing down. the professor was suspended by the university over her role in the encampment. she tells me she's denying all of the allegation felt like gaslighting. >> to it felt disingenuous. doctors saying kills a professor at san jose state and the adviser to many activists, students on campus. she says the university put her on administrative leave after she made a speech to students protesting the war in gaza for some reason, they think i'm directing the students, which i'm absolutely not. i'm i'm supporting the students kill shared with kron 4. the e-mails that san jose state sent her. they say she encourage students to march to the campus and set up an encampment back with students will only hosting rallies. she

is denying all of it saying her speech is only in support of what the students wanted to do. >> i really don't see any evidence or any any any fact that they're showing me to say that i violated any policy whatsoever. according to the letter sent the doctor killed, she is suspended with pay for a maximum of 60 days. >> we reached out to san jose state and they told us they don't comment on personnel matters. i believe that their fat threatened by my exercise of my free speech think he'll says she's worried the school will try to extend her suspension so she can't talk to students next semester. i am mentally preparing for that possibility as last time we were here on campus with several weeks ago with many students here still protesting back then san jose state said it was working to decide what kind of punishment if any, could be put on the students. but they say broke the time place and manner policy. we followed up again with the university to ask if they came to a conclusion.

buffett to try and help tackle urgent problems. according to forbes, altman has accumulated least a billion dollars through investments. altman says he wants to focus on giving, quote to technology that helps create abundance for people. >> it's 10 20 and governor newsom is facing some criticism over proposed budget cuts. advocates say is that some of these cuts are going to hurt thousands of undocumented californians who rely on in home support services about 94 million dollars will be cut from a program that funds in-home support services for about 2,500 undocumented californians. those programs help pay for things like in-home assistance and care for eligible seniors in california to have living disabilities. the governor says that he does not want to make these cuts, but that he has to. he says he doesn't have any other choice because the house to balance the budget advocates, however, are urging him to reconsider.

new details now emerging about a woman who was found dead inside of a home in san jose. police say the woman and her suspected killer who is now in custody knew each other. so police responded to reports of gunfire at this home on north 20th street right near san jose high school at about 6 o'clock monday night when they arrived, man had barricaded himself inside and it took hours to negotiate his surrender. but once he did come out, they went in and found that woman with serious physical trauma. they say she died at the scene. her exact cause of death is still being investigated. >> we're still trying go through the entire investigation, determined you know what occurred in what order? that's again, part of the puzzle that we're trying to put together. we just know that was one last life that we didn't a kids again are doing outstanding job trying to figure out what happened. what went down. do have the suspect in custody and we're just working together to make bring justice for the victim and her family.

>> officers say the suspect also shot a man before they got there. that victim was treated at the hospital for minor injuries. identities of the victims and the suspect have not yet been released. fentanyl laced with an animal tranquilizer is causing a surge now in overdose deaths across the country. and that has san francisco health officials worried we might see something similar. health officials in philadelphia chicago are both reporting spikes in overdoses. utilizing a drug called my dad in mind. now san francisco supervisor matt dorsey is asking local health officials to start monitoring for this drug. fact, it was just last year the city's department of health sent out an alert about xylazine, which is another animal tranquilizer. that was being mixed with fentanyl and causing overdoses from january to april of this year. san francisco seen more than 250 fatal overdoses. it's 10. 35 and we have an update now on one of 2 standoffs that happen in concord on monday night. >> police have identified the man accused of forcing his way into a home on roseburg court.

as 47 year-old kristen stewart. police say the woman lived in that home with her 3 daughters. neighbors were asked to shelter in place when they heard gunshots. and there was a standoff that lasted a couple of hours until stewart came out. nobody was hurt. police say this stewart told officers he went into the home because he was being followed by several armed people and an investigation concluded that there was no evidence to support that he was booked into jail on many charges. there is concerned citizen calling on the alameda county board of supervisors to create oversight committee for the sheriff's office. the group wants them to look into in custody, deaths at the jail and shootings involving officers. santa rita has come under attack for several years several years ago to deputies pleaded guilty to abusing inmates. residents. we talked to want more transparency and they want this committee to be independent of the sheriff's office.
