>> now from the area's local news station. this is kron. 4 news at 3. >> now at 3 fighting for a new trial convicted killer scott peterson back in court today. thank you so much for joining us here on kron. 4 news at 3. i'm justine waltman. more than 20 years after he was convicted of killing his wife and their unborn son, scott peterson back in a redwood city courtroom today. first charles clifford joins us now live from outside of the courtroom with what happened and how we got here. thanks for joining us. >> well, we've got here is a very long road, but that hearing is ongoing. let's go and take a look at some video from earlier today. scott peterson is appearing in court via zoom. he's currently serving a life sentence in prison to the east of sacramento, but he is appearing on a screen today in

the courtroom. the la innocence project, which is currently representing scott peterson, spoke this morning at length. they went through their interpretation of the investigation into this case, the disappearance death of laci peterson and they pointed out what they believe are in the investigation. initially they believe that witnesses weren't talked to evidence wasn't tested properly and they are seeking in court today. a chance to retest some dna blood evidence found in a burned out van near the peterson home around the time of lacey's disappearance examine some other evidence, including some duct tape that was found in another location. now the u.s. stennis lost the district attorney's office. they also spoke in, said that all of these evidence questions have been asked and answered in tonight in the past, they believe that this is just an attempt by scott peterson to drag out of the court proceedings. he was found guilty. he was sentenced to life in prison. they also don't want to put lacey's family through more court proceedings and drag this out. they also claimed in court today the lot of the evidence that the la innocence project

is seeking to examine doesn't exist as a 20 year-old case. they say a lot of that stuff doesn't exist or it has been contaminated by time. now, the judge today, we believe issue a ruling on whether or not the innocence project can examine and retest some of this old the court case still going. are they hearing right now still ongoing and could wrap up here in the next couple of hours. but that is the very latest here in san mateo county, charles clifford kron. 4 news. charles, thank you so much. >> back in court today for the state trial of the 2022 attack of paul pelosi opening statement set to start toy in this case to pap is facing charges, including attempted murder, assault with a deadly weapon, elder abuse and residential burglary. prosecutors say pap admitted that he broke into the san francisco home with the intent of holding former house speaker nancy pelosi hostage. the state trial is expected to last about 3 weeks. just yesterday he received a sentence of 30 years in federal prison for the attack.

now the jury and donald trump's hush money trial has ended its first day of deliberations without a verdict. the panel asked to rehear a potentially crucial testimony about the alleged hush money scheme at the heart of this history making case our washington, d.c., correspondent hannah brandt has more. >> just before noon today, the judge sent the jurors to a private room to start their discussions. now, both legal teams, the judge and the former president are left to wait the criminal fate of former president donald trump is now in the hands of the 12 person. jury mother teresa kidnapping charges. >> these charges thing trump is charged with 34 felony counts of falsifying business records. prosecutors say he misrepresented hush money payments to cover up an affair with adult film. actress stormy daniels. now the jury will decide if prosecutors prove that in court. the jury deliberation room has been called a black box. >> no one knows what's going

on in their gregory mize is a retired trial judge in a georgetown law professor. he says each jury deliberation looks different. but with 34 counts to consider, i think it's going to take a long time. my says the jurors will likely take a while to go over the testimony. they heard over the past 4 weeks and to discuss what believe, the witnesses who took the stand credibility of witnesses is he. >> element. the jurors have to reach unanimous decision on each one of the 34 counts. they're kind of probably have some dispute among themselves and they've got to resolve them. to reach a unanimous verdict. and it only takes one holdout to complicate the case. the judge will be hands off unless. >> he receives a note were deadlocked. >> if the jury does get deadlocked, the judge may ask them to keep trying to reach unanimous verdict. but if the deadlock continues, he could declare a mistrial in washington. i'm hannah brandt. >> the san francisco sheriff's office is releasing some new

details on how a training exercise went wrong with release of a chemical material spread to a san bruno elementary school. and many kids got sick. you might remember, we covered the story last week and now kron four's. tiffany justice is live in newsroom with the latest here. thanks for joining us. yes, law enforcement defending the use of chemical agents in francisco sheriff's office releasing a statement today addressing where the chemicals came from. >> officials say on tuesday of last week, canisters containing chemicals were brought over by the uc berkeley police department for a training exercise on the sheriff's office jail property in san bruno. now today report in san francisco chronicle indicated that some of the chemical agents involved in this exercise may have been decades old. the sheriff's office says that the chemicals used do not change over time. it had no expiration tabs on them, adding, quote, the mechanism by which the canisters deployed may in fact, be less effective rendering the product less potent. now 20 students and one teacher at for tolling

rights lawsuit. the plaintiff who was shot twice claims the shooting was unjustified and as kron 4 subject, all reports the officer who opened fire allegedly killed the person while in custody years before. >> saying we need more than a month in jail. and after posting bail exceeding $400,000, it took more than 2 years in court for ashton porter to have the criminal charges filed against him dropped. he was shot with rubber and live bullets by pittsburgh police officers february 24th 2022. well, those officers responded to a welfare check as puerto experienced a mental health crisis at the hampton inn and suites. all started. >> because mister porter was himself asking for help and he didn't verbally threatened anyone. attorney adante pointer is representing puerto in a federal civil rights lawsuit filed tuesday seeking monetary damages and demanding a jury trial. >> it lists the city of

pittsburgh, its former police chief brian addington, 2 police supervisors, officer ernesto mejia rosco and up to 50 doe's from the police department as defendants, porter and his wife who was called to the scene to help de-escalate the matter, but was also allegedly dismissed by the supervisors. the plaintiffs mejia rosco is accused of shooting puerto twice in the arm and abdomen nearly killing the father of 6. we have the body-worn camera now. >> and it shows there was no sprint. there was no run. and in fact, mister porter was just a mere feet outside of the hotel room door that the officers had spent all morning sending all kinds of tear gas and pepper spray into to flush a man out into the hallway only to shoot and nearly killed him. the lawsuit accuses police supervisors of dismissing contra costa county mental health team members who were working to peacefully

resolve the situation. instead, the complaint claims mejia rosco eventually fired puerto. >> in a separate case, mejia rosco was among several pittsburgh and antioch police officers federally indicted last year for obstruction of justice bribery and civil rights violations. back in 2016, he was also accused of choking a man to death. >> while in custody leading the city of pittsburgh to settle a 7.3 million dollar lawsuit with the man's family. as for ashton porter, all criminal charges against him have been dropped. mister porter had his hands above his head hand, holding a knife in a position of surrender when he was shot after taking one or 2 steps out of his hotel. the least department and former chief have not responded to our requests for comment. >> philippe djegal all kron. 4 news. >> the city of san leandro getting introduced to the new interim police chief tonight, angela leverett is hosting a self introduction live

>> federal officers with the alcohol, tobacco, firearms and explosives agency in san francisco today providing some critical incident training on the use of force. and our kron four's theresa stasi was there to see firsthand this training in action. the use of force seminar took place here at the san francisco law enforcement regional training facility key component. was this going through different scenarios where subjects confront officers? >> and whether the use of force is allowed by the same way. but this is different right? i was one of several media representatives that participated in drills and this scenario i was confronted with 2 suspects who drew weapons when i was answering a 9-1-1, call. one had to pretend gun the other a bad. it was only a drill. but as i discovered, the drill became serious quite fast as the actor in the situation with tended to open fire on me.

was arrested and booked on felony assault related charges. residents say that kids were suiting. these joe beads at each other during a barbecue. and that's when head or some other person allegedly shot back with real bullets. community activists are now reacting to this latest act of gun violence. >> guns, bullets have no name. so whoever you aiming at is probably not going to the person that you end up hitting and the consequences and repercussions of that are life changing. >> the shooting does remain under investigation. in the north bay. the sandra fell police department is warning people about thieves weren't person aiding federal agents and targeting people. they say the thieves come up to people both on the streets and in their cars and identified themselves as an agent and then demand their wallet or cash. the police department says no legitimate federal agents are involved in these incidents and that law enforcement agents would never demand your entire wallet.

purse or cash. uc berkeley about to get 1.2 million dollars to help cultivate and develop diverse school leaders. according to the university, it was selected because of its dedication to social justice and equity in education. the berkeley program is also partnering up with oakland to san francisco and west contra costa unified school district's for this. the money will help provide tuition assistance to aspiring leaders of color. oakland, summer food service program is back those 18 and under as well as adults with disabilities enrolled in a school program. can sign-up to get free lunches during the school year. thousands of kids rely on their school's free. a reduced cost meals. oakland hopes to bridge that meal gap throughout the summer and to get a list of all the nearby meal sites, parents can download the ca meals for kids app and other families across the bay area can also take advantage of summer meals for their children. thanks to a web site that is helping residents find where these

meals are available. the summer meal site finder created by the u.s. department of agriculture's food and nutrition service works is a map that shows which schools are offering on site and to go meals for people under 18. there are more than 20 spots in the bay area. all right. let's talk about bay area weather forecast with this really nice shot here of a sunny san francisco today. kyla grogan here now what's happening already starting to feel that warm up? yeah, it is. and this is just the beginning of this week. so if you like this warm weather, you've got a few more days of it and then a little break over the weekend. but right now, blue skies as we take a live look at our temperatures are getting very impressive. santa rosa, 87. >> 84 livermore. 85 in concord, even san francisco looking pretty good there in the upper 60's. oakland, 74 degrees. and yes, half moon bay's a little cool, but at least they've got the sunshine out there. they're coming in at about 59. this is the difference in temperatures from 24 hours ago to now. so obviously, this is the warm-up. i do expect that we'll see a little bit more of

this tomorrow. but really the big picture is just that we're going to be set with some really nice weather over the next few days here. so if you want to take the dog for a walk, i am using san mateo as an example here. really nice temperatures as roll through the next several hours even into the evening. so you can take a long walk tonight, right? because the weather is on your side. you don't have to worry about the marine layer kind of rolling in and changing things. we do have a changing things. we do have a little wind out there other than that, we're looking good. high pressure, bringing us that sunshine today and it's going to continue to our as i mentioned, and likely strengthen a little bit as we roll across thursday into friday and then pulls back as we get towards the weekend. so if we take livermore's example here as we take a live look of the east bay, you can see where the temperatures are obviously well, above average today. that's the first part of the story. but we stay there the next 3 days. then we're going to break this down as we go to the weekend and through monday that we're going to get some of that marine layer back a little bit. and then it goes away again as we move into tuesday, cut right back up to some really nice temperatures. so

as we look across the next 7 days, you get a lot of sunshine and a lot of warmth with a few days where will see the opposite of that, right? which will be that will get down to more seasonal temperatures. but really a very nice forecast, even though we do cool down a little bit over the weekend, it should be good weather for getting outside and even around the bay itself, looking at some beautiful 70's over the next 7 days. thank you. kylen bird flu spreading amongst cattle herds. and the cdc is now saying it's preparing for a possible increased. >> risks to human health from this virus. the doctors are cautioning there's still no evidence of person to person transmission in the u.s.. the cdc says bird flu has impacted herds in nearly a dozen states friday, the usda announced the virus had been detected in beef from a sick dairy cow but says the meat did not enter the nation's food supply. so far, only 2 people have tested positive for bird flu this year. >> we have specific guidance for those who work farms in

terms personal protective equipment and how to how did the state, how to monitor for symptoms what to do if they develop symptoms? >> last week, public health officials said that they are feeling about 4.8 million doses of a bird flu vaccine into vials. so they can store it just in case it's needed. still ahead, new regulations for stores that have self-checkout stations. the new plan to combat retail >> and unemployment on the rise amongst teens will tell you for your money is next.

>> money this afternoon, south, check out no longer an option for safeway shoppers at certain locations in the bay area safely says it took these out of select stores due to and increasing amount of theft. this is not the first time the safeway has done something to prevent crime first installed exit gates which only opened after the customers scan their receipts at some locations because 3 retail such an issue that plagues california. there's a state senator who is proposing a bill to prevent retail theft and if passed would prohibit stores from happening. self-checkout. and lest that store follows a list of requirements. >> regulating that you can only have 15 items or less, you know, coming through self-checkout and we think you need at least one worker for every to checkout lanes and my target. there 12 checkout and one worker. and so this this

patrol's maximum enforcement period led deputies to arrest r re than 1300 people o memorial day weekend. >> extra officers were patrolling from friday through monday, more than 1000 of the

arrests were dui related. that's an average of one dui arrest. every 4 minutes. the agency also issued nearly 32,000 citations for other violations, most of which were for speeding. and 42 people died in crashes over the weekend. san francisco leaders announcing some progress on drug-related arrests. mayor london breed and police chief bill scott today said about 3,000 arrests have been made and 200 kilos of narcotics have been seized over the past year in the tenderloi and the south of market neighborhood. most of the drugs seized were fentanyl and methamphetamines. today does mark one year since san francisco launched its drug market agency coordination center, which brings together local, federal and state officials to crack down on the drug crisis in san francisco. so concerns over drug overdose deaths in san francisco are coming because health officials believe that they could get worse before they get better. this is because starting to see this

new trend of mixing fentanyl with a new animal tranquilizer. and this is causing a surge in overdoses. kron four's dan kerman reports. >> san francisco's overdose in fentanyl crisis could get worse. a handful of cities across the country, including chicago and philadelphia are now starting to see fentanyl laced with melatonin. dean, a veterinary sedative that is causing a surge in overdoses. >> timing is striving overdose spikes. not all of those spikes are fatal but their spirits and wine and 600 people over a few days in philadelphia are sent to the hospital because they you know, to me encountered a drug which tone being as president we've got to take it seriously. san francisco supervisor matt dorsey sent this letter. >> asking the city's medical examiner department of public health and police department to answer the following questions. is san francisco's illicit drug supply being monitored from toma dean. and

if the monitoring is insufficient, how can the board of supervisors better fund and support that effort? could have predicted that the drug supplier stephanie, this and what's alarming is that it's changing seemingly every few months or something. new, that drive this and more addictive and more data. if this all sounds familiar, it should in february of last year, the san francisco department of public health sent out an alert that xylazine or tranq another animal tranquilizer was being mixed with fentanyl causing respiratory issues home. eating, which is also better better. an area. >> trent was actually more to the side scene from january to april of this year. san francisco seen more than 250 >> fatal drug overdoses. dan kerman kron. 4 news. >> in the north bay, santa rosa police arrested a man accused of trafficking guns from china following a months

long investigation. officers say 44 year-old been kim ordered gun parts from china. that was intercepted by u.s. customs last month and then handed over to investigators. officials then searched his house captain way yesterday where they found a number, a 3 d printers manufacturing tools and other privately made weapons. kim had a total of 19 guns and they say meth inside of his home. his charges include felony possession of a firearm, making an assault weapon and importing a handgun to california. a student led organization that stanford university protesting the disciplinary charges against the pro palestine student protesters. group is called stanford students for justice for palestine, organizing a rally today to urge university officials to drop the charges against the student protesters last week. muslim rights organization care center letter to stanford's president saying the charges go against

students right to free speech. according to care, 13 students received this notice of a possible probation or suspension. the rally set for memorial church on james stanford. way today. and a san jose university professor now on administrative leave for her role in the ongoing pro-palestinian demonstrations taking place on campus. the protester is an adviser to student activists on campus and she says the school is trying to censor her kron four's. jeff moment reports. >> well, spring semester may be over. graduations happened. many students have already left campus, including many who are part of this encampment protesting the war in gaza. meantime, though, the events are not slowing down. a professor was suspended by the university over her role in the encampment. she tells me she's denying all of the allegation felt like gaslighting. >> to it felt disingenuous. doctors saying kills a professor at san jose state and the adviser to many activists, students on campus.

she says the university put her on administrative leave. >> after she made a speech to students protesting the war in gaza for some reason, they think i'm directing the students, which i'm absolutely not. i'm i'm supporting the students kill shared with kron 4. the e-mails that san jose state sent her. they say she encourage students to march to the campus and set up an encampment back with students will only hosting rallies. she is denying all of it saying her speech is only in support of what the students wanted to i really don't see. >> any evidence or any any any fact that they're showing me to say that i violated any policy whatsoever. according to the letter sent the doctor killed, she is suspended with pay for a maximum of 60 days. >> we reached out to san jose state and they told us they don't comment on personnel matters. i believe that their fact threatened by my exercise of my free speech kill says she's worried the school will

try to extend her suspension so she can't talk to students next semester. i am mentally preparing for that possibility as last time we were here on campus with several weeks ago with many students here still protesting back then san jose state said it was working to decide what kind of punishment if any could be put on the students that they say broke the time place and manner policy. we followed up again with the university to ask if they came to a conclusion. >> we did not hear back reporting on san jose state's campus jacmel but kron 4 news. >> the tesla factory in fremont being sued by hundreds of workers. the case alleges severe harassment against black workers at that factory in court documents, black workers say the higher ups called him the n word and fellow workers refer to the plant as the plantation or the slave ship. workers also say they saw anti-black graffiti, including new says and racial slurs and swastikas. tesla did respond to the lawsuit saying if it was informed about racist incidents that took, quote, immediate and appropriate. corrective

actions. the class action lawsuit will not revolve around whether the judge can find a pattern of widespread racial abuse at the fremont factory. kron 4 is your local election headquarters and early returns and berkeley special election for a city council seat in district 4 show igor trade in the lead after ranked choice voting tallies came in. the latest numbers from the alameda county registrar of voters shows trey grub with more than 56% of the vote. elaine are back with more than 43% of the vote. ruben hernandez story and solely help or did not make the final round of ranked choice voting. the seat was left open after kate rupp abruptly resigned in january. whoever wins will finish her term, which runs through 2026. and as the bay area waits for summer, some pandas to come in the nation's capital is getting its back. the national

zoo announcing today it is getting to giant pandas from china by the new year. zoo and washington, d.c., had 5 had pandas for 5 decades before it had to send them back to china. a year and half ago. san francisco trying to raise money to ready the sf zoo for pandas. the china could send as early as this summer. for your health. right now, new research is showing bragging to co-workers how stressed out a busy you are. can make your colleagues dislike you. the study from the university of georgia sh ws people who do this tend to think taking on extra stress will make them look better to their colleagues and prove their worth at work. however, their peers often view them as unlikable and less competent at their job. researchers say this kind of bragging furthers the idea that someone needs to be stressed out at work leading to higher rates of burnout. now to some wild video out of texas showing

this unoccupied american airlines plane being blown away from the gate at dallas. fort worth, there were 80 mile an hour winds and this was a boeing 7.37. it weighs about 90,000 pounds. no one was hurt, but several flights were canceled out of dallas. fort worth do too powerful winds and hail more than a million customers in texas. that power as of tuesday as more storms unleash hurricane force winds across the dallas area and we'll talk about the forecast that part of the country with a quick live look here at sfo right now. kyle is in the weather center with what's happening. so dallas is in the clear, but that storms not done the right there in the clear for the moment they've had some flooding issues there today because of all the rain that they took on. you can see where the yellow boxes are. that's where we have severe thunderstorm watches right now. there are a few warnings popping as well. i mentioned dallas is doing okay, but >> if you head over towards that louisiana border, you can see there is a severe thunderstorm warning there. and then if we go in here can see right on the border there, right where they start to get going in the heat of the day.

people all across the bay are being warned to be on the alert after a series of mountain lion sightings there been to this month just in the south bay. >> the latest one happened just this morning. so take a look at the video of that milpitas police officer sharing this home video of a mountain lion spotted in the friendly village mobile home park and dixon landing road officials had to use drones with thermal imaging to try and locate the big cat, but they could not find it. they do say that animal control officers have been notified. and 11 days before that, a big cat spotted prowling through a san jose yard may 18th the mountain lion was captured leaping up on offense. taking a look around here and walks along the a top rail, their of the fence. the cat eventually starts to bounce it south before making this huge jump right into the hedges. there it goes. so officials are asking people in the area to consider bringing pets indoors and keeping them on a leash during walks. if you see a

contentious day at the state capitol as lawmakers took up a bill that would prohibit school districts from

notifying parents. >> if their children identify as transgender or come out as lgbtq+, capitol correspondent eytan wallace has a closer look at the bill. >> while emotions and passions certainly running high here at the state capitol. those on one side argue parents absolutely be notified. while those on the other side say doing so could put kids lives at risk. when you forcibly out a child, it harms them. that's it. parent christie hearst making that argument before the senate education committee. she's speaking out against policies requiring teachers and staff to notify parents upon learning their child identifies as transgender. what has come out as lgbtq+, this is harmful herself, a mother of 3 and co-founder of the nonprofit, our schools, usa first specifically came to the committee to urge members to support ab 1955. authored by san diego assembly member chris ward. the legislation would prohibit school districts, one forcing and

implementing lgbtq+ notification policies and would forbid teachers from outing children to their parents unless the child gives permission far. 8 school districts in california have implemented such policies. it is a safety issue. these policies are. >> harming our students. and i know that because they reach out to me and they tell me and they tell me how unsafe they are. and in fact, it makes all lgbtqia kids and safe home and the time in the manner. >> issues to be able to disclose any part of their identity is theirs to own always. but this group disagrees. opponents of ab 1955. say school notification policies are necessary to ensure parents are kept in the know about their children. if you triangulate the parents. >> from what's happening in the school with the teachers in the school counselors that how can a parent care for their child opponents of such notification policies argue kids could suffer emotionally and consider suicide of parents are accepting. but republicans on the committee believe the opposite is true. if a child is going through
