lawyers are working to get dna evidence they say will prove his innocence. kron four's rob nesbitt joining us live from redwood city. now with more. rob. dan and noelle, scott peterson and his lawyers are asking for access to dna that they say will prove that his wife laci, was still alive when he left their modesto home to go fishing in san francisco bay. 22 years ago today, the judge ruled that he will have access to one 2 years and the bodies of laci peterson and her unborn child. conner washed ashore in san francisco bay. >> her husband and the man convicted of her murder appeared in court via zoom wednesday. peterson's lawyers that the los angeles innocence project have filed motions for access to dna evidence they say will prove laci was alive on december 24th and vanished. while peterson was away fishing in san francisco bay. >> prosecutors with the san mateo da's office have refused to hand over dna evidence unless court ordered on wednesday. judge elizabeth hill ruled that a piece of

duct tape down the lacey's pants. we'll be able to be tested but denied dna testing on 13 other items. peterson's lawyers also claim shoddy police work saying the modesto police department's original investigation allegedly suppressed and lost court documents. they also claim that eyewitnesses who saw laci walking in the neighborhood at times after her husband left modesto, were never interviewed by the hearing ended just about 5 minutes ago. family members of scott peterson were inside the courtroom at the time. they did not want to talk with any reporters when they left the court room. scott peterson is being held at your creek state prison. that's about east of sacramento. the district attorneys office will now have to determine what lab will do. the dna testing reporting live here in the court room. i'm rob nesbitt kron 4 news. rob, thank you. another big story we're following. david de pap was back in state court.

>> for the attack on paul pelosi, he's charged with attempted murder, elder abuse, residential burglary. >> and other felonies. prosecutors say pap admitted he broke into the pelosi home with the intent of holding former house speaker nancy pelosi hostage and warning to videotape her admitting the government was corrupt. this trial is expected to last about 3 weeks yesterday and federal courts to pop was sentenced to 30 years in prison. >> happening right now, students at stanford holding a march in protest following the recent israeli strikes on the gaza city of rafah. dozens were killed in those bombings and those students are also protesting the disciplinary actions taking against some of their fellow students. kron four's less a good light at stanford tonight with the details. dozen. >> yes, we're right here from this tampa memorial church where over 50 students and supporters calling free palestine. they've been out here for the last 30 minutes. may tell me they have reasons

why their host a rally today where they what, where they part their the campus what looked like earlier. so again, they tell me the first reason, as you mentioned, it's because of the israeli strike that killed over 45 people in gaza. and they say they want to remind people that, you know, that this is still happening. also, students say they're coming together, calling for the ministration to not punish students for protests protesting. now, according to students i spoke with, they said the one of their fellow students was arrested earlier this week during a protest and has not been able to return to class. and they believe that this is unjust and they're asking for the administration to also. >> continue to hear what they want to talk about today. and they say they don't believe that a conversation will happen with the university anytime as well. and again, we are told that this protest will continue for the next hour hopefully we're going to hear more for those students live in. stanford going kron, 4 news. all right. let's i we look forward to hearing from them.

>> and strike you >> dozens of uaw union workers at ucla uc santa cruz and uc davis walk the picket lines for a second day today. there are striking over the treatment of students during pro-palestinian protests on campus university officials were criticized over their response to the protest, including ucla as police chief. they say their right to free speech was violated when police used force to dismantle the encampment and to remove those protesters. >> 8 middle school students have been arrested in connection to a fight on the sinaloa middle school campus in nevado. those students are between 12 and 14 years old. police say the fight happened last friday after lunch when a group of students assaulted another student. a second student stepped in to stop that fight and was also hurt. both of the victims had to go to the hospital for their injuries. yesterday police identified the 8 students who initiated the fight and they

were arrested there now in juvenile hall on felony assault charges. >> in the east bay tenants in oakland are suing their landlord after a fire in the apartment building left residents without electricity for a month. kron four's gayle ong joining us in studio with more cal. >> daniel, the fire happened back in january. and aside from no electricity for weeks, tenants say the landlord has not made any repairs from long-term problems and reimbursements from being out of power and thousands of dollars. >> i don't want to buy, you know, hundreds dollars of food for it to go to waste again, like in january. >> bolanos is one of the dozens of tenants on 26th avenue in oakland's fruitvale neighborhood who are suing the landlord for mold. cockroaches holes in walls, weeks, electrical issues that a lot of the tenants have been dealing with this after an electrical fire back in january. jackie's in erie is the tenants lawyer. they left tenants to fend for themselves

for weeks. they left them without utilities or even without real housing. the landlord is someone who doesn't live in oakland but bought this property in oakland hoping to >> make a profit off of not making repairs. and i think landlords should be on notice that that that isn't %oing to happen here, that there are real consequences to someone does that. the law no says electricity has been restored to most of the units, but 4 units have yet to be repaired and are being powered by a generator. >> that sits outside her window and it makes her family feel sick from the fumes. know we've been enduring for over 4 months >> being on temporary light, we don't know when this building with power power off again. the lawsuit is seeking compensation for the thousands of dollars in out-of-pocket expenses due to lack of electricity and heat, including food, medicine, clothing, blankets and hotel stays. tenants are also seeking assistance from the alliance of californians for

community empowerment, a nonprofit tenants rights organization that works with renters across california, including in oakland, valerie bachelor is the executive director. there are multiple families with multiple children. >> and these kids have had to go through not having power, not hot water, not having a refrigerator where they can store not only their food medicine, and that's deeply impacted. the education of these children. >> and kron 4 reached out to the landlord of this building. we have not yet heard back, but we are told the land more plans to meet with the tenants about the situation on friday in the studio. gayle ong kron. 4 news. >> gayle, thank uni is receiving almost 5 million dollars to help improve access to stations for people with disabilities. the federal transit administration has given 4.6 million dollars to the sfmta to help enhance accessibility at 5 muni light rail stops. those stops will be along the jade church

>> the san francisco sheriff's office is releasing new details about how a training exercise went wrong. the release of a chemical material spread to a san bruno elementary school and many kids got grant lotus joins us in studio with the very latest ramp. really scary. noel. the san francisco sheriff's office is though, defending its use of these. >> chemical agents during a training exercise that ended up adversely affecting a nearby elementary school here. and the chronicles reported the chemicals were decades-old. that happened on tuesday of last week. the uc

berkeley police department actually brought these canisters with chemicals in them for a training exercise at the sheriff's office jail property in san bruno, 20 students and a teacher at port whole elementary nearby experience burning sensations on their faces as well as scratchy throats. the sheriff's office says tht chemicals used do not change over time and had no expiration date on them. and they say the mechanism that deploys the material may have deteriorated over time and they say that means the stuff is less potent. the san mateo county board of supervisors, vice president says that should never have happened. >> they treated on site. that location is maybe a half mile away. and so here's issue. the issue is and i've said this from the game and had conversations with careful moto. could never happen again. were in 2024, there has

to be protocols and processes in place that way. now whats is deeply deeply more alarm. is that now we find out that was a multi agency >> you know, police, various police departments and that we're looking at canisters that are from the 1960's. that would be disposed. >> yeah. uc berkeley police brought them over and then the san francisco sheriff's office use san francisco sheriff's office says the canisters have been removed from storage, which is common practice now and will continue to follow the twists and turns with this one for now, no oil. and then back to you. >> grant, thank you. residents across the bay area are being warned to stay alert after a series of mountain lion sightings. yeah, there have been 2 and this month in the south bay, the lead is happening this morning. >> milpitas police sharing this video of a mountain lion

and a mobile home park on dixon landing road. you could make it a little bit there. officials music. officials use drones with thermal imaging to try to find this big cat is a better image of monday were unable to track it down. they say animal control officers have been notified. yeah, 11 days earlier on may 18th, a big cat was also spotted prowling through. >> a san jose yard. you see kind of on the fence there captured leaping up onto the fence, taking a look around before walking along that top rail. this cat eventually balances itself before making another athletic jump into some bamboo hedges >> got to watch out for your animals. yeah, officials are asking people in the area, though, bring those pets indoors, keep them on a leash. when you're out and if you do see a mountain lion running is not recommended, instead, try to look big. wave your arms around and speak in a loud from voice

>> i would say where you caron, you really should not. they will clearly catch taking a live look now at the bay bridge in the embarcadero. we've got a lot of wind out there, but nice blue dave spahr joining us with a look at the forecast today. while you have some high cloudiness trying to stream in here just a little bit. but on balance, we'll call it mostly clear going on for tonight, everybody and temps are going to vary across the pending on your location, which is true to form. our micro climates are checking in as we see the golden gate bridge. this is how comes in from the pacific right across the golden gate off towards the east and we'll see the winds follow suit with all of that. we have inland heating and mother nature wants to correct all of this. and it does so by bringing in our traditional onshore wind in some cases, a good clip. 2 now tonight, lows, lower 50's. it looks like half moon bay down to about 49 lower 50's up north. so good night there to open up the windows. maybe a little bit of, you know, how lines and so forth like that. and then for your visibility going on, we have a little bit of fog that tries to develop.

and it's very, very patchy. just a touch and some locations may be d wn around the peninsula or so. but that's not really the big issue. it will be in the afternoon. it looks like they'll be some scattered clouds to make note of and therefore the impact, although very modest, you may see it up there in the skies just a little bit here, you traverse across the region. that's not across the region. that's not much for temperatures. the quite warm along the bay fairly mild. so we'll go ahead and paint some scattered fog and their 52 san francisco tonight. also for oakland. 55, meanwhile for san jose, let's go and do it here for tomorrow morning at 6 or start at 06:00pm. we got the fog creeping on in and some bay fog one on inland by midnight. all right. here's a look at the highs for tomorrow. we've gotten in the near 90 antioch, upper 80's and where to build on this for tomorrow, too. by the way, 89 for santa rosa with 68 going on for san francisco. this is just a little trial run because next week bumping up against inland. yes. so make sure the ac is walking appropriately.

folks inland there. this is the week to prep. and right. and he says i can't get out to this weekend. that's fine. because it's still next week is when it's going to get a all right. thanks, jay well, federal officers with the alcohol, tobacco, firearms and explosives, his agency were in san francisco today providing critical incident training on the use of force kron four's theresa was there to get that firsthand training in action. >> the use of force seminar took place here at the san francisco law enforcement regional training facility key component. was this going through different scenarios where subjects confront officers and whether the use of force is allowed by law the same way. but this is different right? i was one of several media representatives that participated in drills and this scenario i was confronted with 2 suspects who drew weapons when i was answering a 9-1-1, call. one had to pretend gun the other a bad. it was only a drill. but as i discovered, the drill became serious quite fast as the actor in the situation

bill puts the brakes on companies that already own more than 1000 single-family homes from grabbing anymore for rental conversions. the bill will now head to the state senate. >> kron 4 is your local election headquarters. climate policy director, igor tre got is leading the race for berkeley city council district 4 with 31% of the vote voting in the special election ended last night. 100% of the precincts have reported. the other 3 candidates include elana, our back solely albert and ruben hernandez story. seat was left open after kate harrison abruptly resigned back in january. whoever wins will finish harrison's term, which runs through 2026. >> still ahead, shoppers saying bye-bye the self-check out why a grocery chain is doing away with do it yourself paying option.

>> roads are back open after a big rig carrying 40,000 pounds of strawberries overturned in san jose forcing lanes to shut down this morning on highway 101 and 8.18, traffic is diverted for at least 3 hours after the semi crashed around 7 o'clock this morning. the video here showing crews working to clear the roadways and get the truck off of the highway. they eventually flipped. the semi and all lanes are back open. >> san francisco leaders say they're seeing progress when it comes to drug-related arrests. mayor london breed and sfpd chief bill scott say police have made around 3,000 arrests and seize 200 kilos of narcotics over the past year.

and the tenderloin and soma neighborhoods, most of the drugs seized were fentanyl and mess. today marks exactly one year since san francisco launched its drug market agency coordination center, which brings together local, federal and state officials to crack down on the drug crisis in the city. chp says more than 1300 people were arrested during its memorial day. maximum enforcement period. officers say 1100 of them were dui related. that's an average of one dui. every 4 minutes. chp also issued nearly 32,000 citations for other violations like seat belt, distracted driving and speeding. officers say 42 people died in crashes over the holiday weekend. the agency says the 100 deadliest days for teen drivers and passengers is between memorial day and labor day. >> tonight the city of san leandro will host a live introduction, an interview with the new interim police chief angela averett. the city
