factory will soon say goodbye to sonoma county. >> nice to have you with me on this wednesday night. i'm heather holmes, our tom vacar tells us the mexican packaged food company plans to move production out of state, taking with it several jobs for almost a half century, la tortilla factory has been a stable, growing and beloved santa rosa business, which rose from a tiny restaurant and tortilla factory serving local stores to a national brand of packaged mexican foods. >> turning out 1.2 million tortillas a day will selling tortillas across the nation you know, 50 states, canada, some times puerto rico, we've been in hawaii, we sell our tortillas in japan through distributors last may, a ktvu zip trip featured the company, which has employed as many as 300 workers. what we learned was this company has a culture of cooperation and mutual respect. our people, you know, we're an amazing family.

from the bay street location in emeryville. you can see here the man in all black. he grabs the phones from the display tables, puts them into his pockets, and then he walks out of the store. he also walks past an emeryville police car before getting into a hyundai elantra. now we have since learned, though, that there was not an officer in that patrol vehicle at the time. now we go to novato tonight where a suspect has been arrested for allegedly burglarizing two businesses at a shopping center. 42 year old paul amy junior was arrested on two counts of burglary, identity theft and providing a false name to police . the stolen items were found after san pablo police pulled over the stolen car that amy was driving. he was booked into the marin county jail and the stolen items were returned to those businesses. well, nearly one year after former oakland police chief leronne armstrong was fired, he is fighting back in court. he filed a wrongful termination lawsuit against the city and mayor shengtao today. armstrong was first placed on paid administrative leave last january over allegations that he

mishandled some internal investigations into officer misconduct. mayor shengtao fired armstrong a month later on february 15th, nearly one year ago in september, an independent state report exonerated armstrong of any wrongdoing that his termination was based upon, and then in december, mayor tao rejected a short list of candidates for police chief, which included armstrong. our crime reporter henry lee tonight explains what's at stake with this lawsuit. >> former oakland police chief laurent armstrong is suing the city and mayor sheng tao, saying he was wrongfully fired. it's important that we filed this lawsuit to restore the chief's reputation. billy winter, an attorney for armstrong, says the lawsuit is bolstered by the fact that a neutral arbitrator ruled in the ex-top cop's favor, finding that the city should not have fired him. >> we believe that the case we brought has merit that the hearing officer has, um, confirmed that the criticisms against the chief were

unfounded. >> the suit says he was fired because he had the courage to speak out about alleged misconduct by the federal monitor, robert warshaw. warshaw had commissioned a report that said the chief failed to hold a sergeant responsive for two alleged cover ups. i caught up with the mayor, who referred me to the city attorney's office, but i asked her about the search for the next chief. >> i believe that, you know, getting having a chief just be named chief is not good enough. we need a chief who understands the intricacies of being under the federal oversight. >> in his lawsuit, armstrong said he led opd to the closest it's ever been to ending federal oversight, and that tao bowed to pressure from the monitor. armstrong accused warshaw repeatedly finding problems with the department in order to benefit financially and stay in his role, the suit says, in part, as long as warshaw opines that opd has leadership problems, warshaw can argue his continued supervision at great expense to oakland and its taxpayers remains necessary. the . consent process in oakland,

not everywhere, but in oakland, was adulterating reform, and kirkpatrick, armstrong's predecessor as chief, received $1.5 million from oakland after a jury found. she was wrongfully fired. you've seen a whole lot of police chiefs tumble under him. and i think that federal judge needs to take a very close look at his federal monitor. the federal judge has said he has full confidence in the monitor. the monitor does not comment to the media. the city declined to comment on the lawsuit, saying they have yet to be served and the oakland police commission hopes to finalize its shortlist for police chief by march. henry lee ktvu, fox two news and from oakland. >> now we go to san jose, where police there say two suspects. suspects are in custody, who they believe are responsible for at least 70 organized retail thefts. san jose residents jaime flores and thomas sapien oso are accused of stealing from big name retailers nike store surveillance footage appears to show the men leaving with

armfuls of merchandise. they also allegedly stole from target. best buy, rei and others. investigators say they're connecting these two men to dozens of cases from last july to january of this year, our san jose police department's organized retail theft detail has been tremendous. >> our detectives have been working around the clock utilizing our field resources forces, investigative resources, as well as technology to make sure that we combat these organized retail thefts. >> the loss from the thefts totals more than $75,000. flores was arrested back on december 16th for grand theft at westgate mall. espinosa was already in custody for an unrelated incident on january 31st, when detectives obtained a warrant for his arrest. pg and e says some customers may not have their power back on until this weekend. as crews continue to work to repair damage from sunday's big storm. there is some progress, though, to report this evening. total outages are now down to about 21,000. about

state 80 on all vehicles that don't have four wheel drive or snow tires between kingvale and placer county to the donner lake interchange. chain controls are also required on highway 50 from placerville to riverton in el dorado county. now, back here in the bay area, after a brief break from the rain, people grabbed their umbrellas once again today, this is what it looked like along market street in downtown san francisco this morning. there was rain, heavy at times, and then also kind of lightened up. i want to bring in our meteorologist, mark tamayo. and mark, we're going to talk a little bit about that. what the conditions are like here. but

before we do that let's talk a little bit about the sierra because boy they are just getting a lot of snow. >> it has been quite it was kind of bleak right about a week ago. and then all of a sudden these storms piled up. so yeah, they have been picking up the snowfall they need. and you can see these accumulations pretty impressive. as you can see coming up 4 to 5ft of snow over the past seven days. so that's a lot of snowfall to report. so it's kind of helping to save the ski. the ski season up there. you can see the radar imagery of course a lot of bands moving over the bay area and some snow showers out toward the sierra. now rainfall accumulations here. we're not talking about 4 to 5 to six inches like a few days ago, but we picked up a pretty good downpour earlier today. so as a result these we picked up most of these totals within a short amount of time. so that's why you probably notice some pretty good downpours and maybe even some hail or some thunderstorms. here's a radar imagery right now. some coverage out towards solano county. so we're not completely dry just yet. a few lingering scattered showers out there closer to pacifica as you can see with the live sweep trying to show you

the current pattern out there, it's cold enough that snow levels have dropped around 3500 or 4000ft. we've had a dusting of snow out toward mount hamilton. also some gusty winds. take a look at oakland airport right now, gusting to nearly 40 miles an hour. sfo so a stronger wind there gusting to 32, and half moon bay winds fairly strong as well, gusting to 30. in fact, our cameras right on cue shaking around a bit. so we do have some breezy conditions this evening. it's a cool pattern out there as well. santa rosa 46 degrees, concord 49 and san jose. checking in 50 degrees. cold enough for tomorrow morning. we do have a frost advisory for the north bay valley, so the coolest locations starting out tomorrow morning in the 30s. it should be dry, partly cloudy skies, some chilly conditions for tomorrow morning. and of course we're watching the weather closely out toward las vegas. it looks like a quiet weather pattern. thursday, friday and into saturday, and it looks like great weather for the super bowl on sunday with mostly sunny skies. so this area of low pressure, this will be moving out to the east tomorrow. we still have a chance of a shower
