8:05 am
believe key evidence was not presented in his trial, and that his conviction warrants a second look. now, some of the evidence to court documents, included his , evidence tied to a burglary from his home right around thet time his wife, laci, was first reported missing this morning, a san mateo county judge is expected to get an update on how the search for that evidence is going and where his defense attorneys want toúgo from here. now, peterson will be attending this status hearing this morning by zoom. so he won't be there in person, but his attorneys will be in the courtroom in person. less than an hour from now around 9:00. and cameras are going to be allowed in the courtroom. they won't be transmitting live, but we will be able to record it and have an spupdate online and in our later newscast, live in redwood city. allie rasmus, ktvu, fox two news. >> all right. so cardoza has spoken extensively on the scott peterson case. cardoza has sat

8:07 am
why in a minute. they are going to be looking at that van they want, and it's burned that van has been burned. >> there was a mattress inside. >> exactly. and that mattress may contain may contain dna evidence of laci. so if her dna is on that mattress, that's a big deal. proving circumstantially that the burglars. when were the ones that took her and killed her. >> now it's my understanding that dna from that van was already tested, and we, as far asúwe know, it didn't have anything. you know, laci's in the van, right? what can you tell us about that? >> well, they're going to retest the dna to see how accurate the dna testing was. you've got to keep in mind the fact that la innocence project is taking this case is a big deal, because they don't. a lot of cases come to them. they don't take every one of them. so what did they see in this case that they said, hey, we might be able to show the innocence of scott. so they took
8:08 am
this case on. >> go ahead. could it be the fact, though, that this case was was circumstantial? you know, it's long thought that there surrounding parts of it, seem that though he was guilty, which i know you have an argument as a lawyer saying that to prove that doesn't mean you're guilty. >> well, it doesn't mean you're guilty, but i always thought, and i've said all through the years, and keep in mind, right near the end of the trial, the defense asked me to cross-examine marin scott. and in my cross-examination, which i did for them after that, they decided not to put scott on the stand. but right from the get go, i thought, wait a minute, you're moving this case fromt& modesto to redwood city because too many people had opinions about scott's guilt or innocence in, modesto. i always thought, wait a minute, everybody in northern california at that time had an opinion about scott peterson. either they thought he did it or he didn't do it. i always thoughtúyou should have moved it to la. that was the
8:09 am
first thought in my mind that led to a goes on from there. >> and so you're thinking the spfairness of the trial already was was a big problem. but let me ask you this here, that that the burglary that happened across the street that peterson's attorneysúare now saying happened across the street from their home. and potentially those burglars could be tied to laci peterson's disappearance. that's one of the arguments that the that the la innocence project is making for scott peterson's innocence. >> yes. and keep in mind, if you all remember ted rowlands, he was a reporter here. ted wasc ot there the day that the police are saying the burglary happened. that was the day after laci went missing. the theory of the innocence project is no, no, that burglary happened on the day laci went missing. and that's . ted rowlands was out there the day after out
