drivers on whether they're independent contractors or employees with big implications on the industry's future. >> this is ktvu, fox two news at six. >> hello again everyone. >> i'm julie julie haener and i'm mike mibach. we begin tonight with a substitute teacher in the city of vallejo who has been arrested, accused of physically assaulting a student during class cell phone video taken from inside the classroom appears to show that teacher dragging a student out of the room. >> the student's family now says not enough was done to protect their child. new at six tonight, ktvu is crystal bailey joins us live from elite charter school in vallejo, where it all took place. crystal >> well, julie, the family of the seventh grader says she is still nursing her bruises after the incident, all caught on video by a fellow student. they also say she is extremely traumatized. a man seen dragging a student out of the classroom as other classmates shout, why

is she dragging her? dorina bernstein is the student's aunt. she says it happened monday at elite public charter school in vallejo. >> it was very disturbing. >> the man in the video is a substitute teacher. >> she basically has a knot on her head and she's kind of bruised up a little bit, but her neck, she keeps saying her neck hurts. >> she says her niece, just 13 years old, is traumatized because it's like somebody you're supposed to trust. >> actually throw you around like that. this is a school where you're supposed to be safe at. that's not okay. >> at the end of the video, the man is seen lunging toward the camera trying to take the phone. bernstein says it was initiated by a disagreement in which the teacher told her niece she was not supposed to be in that classroom. the school says a conflict ensued, and the substitute teacher physically removed her, the school spokesperson saying in a statement, we are deeply troubled by the occurrence they fail to give me the teacher's name and i was like, so, so baffled because how would you

protect this guy's innocence? >> and you clearly didn't protect my niece being attacked by this grown man. >> bernstein says the school did not call law enforcement. instead, the family had to file a report, the school spokesperson saying following the incident, immediate, decisive action was taken, resulting in the prompt removal of the substitute teacher from the campus and the performance of a thorough investigation. they went on to say the sub will not be reinstated at elite public schools in any capacity. vallejo police say he was arrested tuesday and the investigation is ongoing. >> i think that he needs to be punished because i do not want him to do this to nobody else's kid. it's not okay. >> and bernstein says that law enforcement told her the man is also a substitute teacher at vallejo public schools. at this time, the man's identity has not yet been released. >> julie crystal bailey reporting live tonight in vallejo. crystal. thank you. >> two people were rescued from a burning home in san francisco this morning. the fire

department posting photos of the flames on social media. firefighters say two adults were on the upper floors of the three story home on grove, right near fillmore that's close to alamo square. firefighters were able to rescue the victims despite the flames and the heat and poor visibility due to the smoke. both were taken to the hospital for treatment. the victims are the parents of popular city dog walker terry williams williams, who lives with his parents, says he has received two racist and threatening packages sent to the home in recent weeks. firefighters say the cause of that fire remains under investigation. we'll have a full report tonight on the 10:00 news. san jose police say they've arrested a man who appears to have shattered glass and throws punches at another man and a child at an ice cream shop. as ktvu south bay reporter anne ruben explains, police are still trying to track down the victims. >> san jose police call it a heinous attack inside this baskin-robbins. while a child sat waiting for ice cream, a stranger rushed up behind him, smashing the window, sending

glass flying. >> you see how traumatizing that probably was for the child, you see the glass shattering all over the child? they're trying to figure out what's going on. you're going there just for ice cream, but then you're assaulted with glass. it happened april 26th, but it wasn't until a week later that a tipster alerted police. >> authorities ultimately arrested 36 year old payam afsari at his home. he's now facing charges of assault with a deadly weapon and child abuse. police believe this was a random attack. >> we can't speak to the state of the mind of the suspect or what may have led him to do that. we just know it was a dangerous situation. >> the child and his guardian left quickly after it happened. investigators want to speak to them and hope maybe the public can help track them down. >> who knows what damage that could have caused physically or mentally to this child, again, we do ask that the victims please come forward so that we can really complete this. like, do a full circle, like just make sure we have some closure on this case. >> families at baskin-robbins say they're relieved there's

been an arrest. still, they can't believe something like this happened here. >> you just want to get your kids some ice cream, and then your kid, that's like you're attacking the kid. why? >> i feel like that wasn't right to do to a little kid. and it must have been really painful for the kid to experience. and really scary. >> we did reach out to baskin-robbins for comment, but haven't heard back anyone with information on this case is asked to contact san jose police in san jose. anne rubin, ktvu, fox two news san jose police also announced today that a 16 year old boy has been arrested on suspicion of stealing a car at gunpoint, and the alleged crime was all caught on a ring camera going up to north america. >> it's a car to lose your life. >> do not lose your life over a car. do not lose your life over. >> this happened on april 4th, about 130 in the morning. police say four suspects broke into the car outside a home on gary

avenue. one of those suspects can be seen holding a gun and is heard threatening to shoot the victims if they came any closer. investigators say a 16 year old suspect was arrested at their home last week. a gun was also recovered. >> a long time east oakland auto shop owner was killed nearly four months ago, and tonight his family is speaking out. the suspect opened fire right inside the business. ktvu crime reporter henry lee has more from the family as police tonight. still try to track down the killer. >> it's a battery at most. it was 60 bucks, 68 year old aristeo zambrano was shot and killed at his east oakland auto shop. his son in law, michael dugger, says because of a dispute over a car battery. by all accounts, this man's life was taken for non for nonsense, for a hot headed moment over a stupid battery. it happened at bay city alternators near 88th and international in east oakland. a customer found zambrano on the ground and called 911. oakland police identified a suspect, 33 year old robert lee moore, back in

march. he has not been arrested but has been charged with murder that does give some comfort, but it also raises the question, well, if you know who did it and why, and you've already got an active murder warrant out for this guy, then what's the problem? oakland police told ktvu it had no additional details to provide. dugger says the suspect apparently wanted his money back. he wanted a refund and something in that transaction. robert didn't like the way my father in law gave him the money back or something like that. zambrano worked in the 1970s as a farm worker in salinas, cutting broccoli and lettuce. he was also a leader with the united farm workers. he then switched gears and opened his auto shop in east oakland 33 years ago. this is the apron he wore every day at work. it was his apron. he he had it full of grease. still smells like old grease. and automotive. this is what this man wore. his killing has devastated his tight knit family, including his wife of 50 years in zambrano's 99 year old mother has outlived him as this

man wasn't a confrontational man, he wasn't an angry man. he was a hardworking, proud man who loved family. >> the best father i could ever had. >> silvia dugger says she wants justice for her father, hoping they get him so he can pay with what he did. >> even though i'm not going to get my father back. but he needs to pay. he needs to be accountable for what he did. >> michael dugger had this message for the suspect that he's a coward. robert lee moore, you're a coward. you shot an old man over a battery. that's what you are. i'm told the suspect may be out of state, and that the u.s. marshals may also be looking for him. anyone with information on his whereabouts is asked to contact oakland police. henry lee, ktvu, fox two news. >> federal regulators are investigating the fiery crash in pleasanton that killed a family of four taron george, his wife renee and their sons aaron and rowan died when their electric car burst into flames after crashing into a tree last month. the car was made by a vietnamese company called vinfast. the

national highway traffic safety administration says it has received multiple complaints about the vinfast model, steering and lane assist issues. the company told ktvu in a statement they are cooperating with the investigation. >> the state supreme court heard arguments today on the constitutionality of proposition 22. it is the voter approved law that classified rideshare and delivery drivers as independent contractors, not employees. gig workers rallied outside the state supreme court ahead of the case that could determine their future. under the law, drivers are considered to be their own employers. that designation frees companies including uber, lyft and doordash from paying a guaranteed minimum wage, overtime, or providing traditional benefits such as sick leave. the court must decide whether prop 22 unlawfully interferes with the state legislature's authority to provide workers compensation protections to those who are injured on the job. >> who gets to decide? does the legislature get to decide or or

do the people of california through the ballot process, get to ultimately decide? >> ahead of today's hearing, uber warned in a statement that a change to prop 22 would affect, quote, millions of californians who would see major service reductions and cost increases or lose ridesharing and food delivery entirely. legal experts say. the court could split. >> the difference could be something in between. perhaps the california supreme court will take out the most controversial parts of the legislation, particularly the 7/8 provision or perhaps the restriction directly on workers compensation, and let the rest of it stand. >> the state supreme court has to issue a decision in the case within the next 90 days. >> it should be dismissed before you even harry. >> the defense rests in the criminal trial against former president donald trump in new york, and the jury will soon have a difficult task ahead of them, and more back and forth

another herd video provided to us shows the car in flames after slamming into a tree and power pole. an officer responds to the scene and uses a fire extinguisher before pulling out the passenger. this happened around 1230 this morning at the busy intersection of fremont boulevard and thornton avenue. that's just about a mile east of 880, the intersection of reopen at 1230 this afternoon. the driver and his passenger have not been identified, and the cause of the crash is not yet known. bart trains running again after a medical emergency shut down service between pleasant hill and lafayette for hours. skyfox flew the scene over the walnut creek station as crews

worked to rescue a man trapped beneath a train. it's not clear how he ended up on the tracks. bart actually had to de-energize those tracks and then separate the train so that firefighters could get to the man and eventually pull him out. >> new at six tonight, a little sparring between san francisco's mayor and one of her rivals for office at this afternoon's board of supervisors meeting, supervisor asha sapphire asked the mayor about a $3.6 million sober housing project near chinatown that stalled after community pushback. >> help me to understand, what role are you looking to play in this operation and how does this have anything to do with your responsibility as the district 11 supervisor? i'm just interested in understand that. >> well, respectfully, madam mayor, i'm also a citywide supervisor. we are citywide as well, and we are responsible for the charge of the entire city. so as i did with the trp site in union square, nob hill area, we were directly involved in working with adult probation,

working with the nonprofit, working with the property owner to try to collaborate to make it happen. so this supervisor is ready to do the heavy lifting. so if you're if you're directing your staff to work with us, we're happy to collaborate. >> supervisors mayor breed said her office is committed to sober living program. she said the city has invested more than $20 million in abstinence based recovery programs at seven different locations. >> the alameda county district attorney's office is suing several insurance companies, accusing them of violating state law protecting homeowners. ktvu tom vacar has a look at the claims. >> district attorney price says insurers use preprogramed computer formulas that deliberately undervalue the homes they insure, and these insurance companies have utilized a software application that allows them essentially to defraud homeowners by charging them premiums for insurance that

does not adequately insure her. the software says price lowers the initial premium cost to induce customers to buy. consumers then believe they're adequately insured, but in reality, says price, the software calculates excessively low replacement costs. then, when there are major losses, such as a wildfire, the payout is inadequate to rebuild by offering these lower premiums based on inaccurate estimates, the insurance companies gain a competitive advantage at the expense of proper coverage. consumer watchdog says it's a direct violation of california law. its leader, harvey rosenfield, wrote the law. >> so for them to turn around after the fact and say, hey, yeah, yeah, you didn't, you don't have enough coverage. and we we're not going to pay the claim in its entirety. that's an outrage. that's why rosenfield is battling the insurance industry to forbid them from using new artificial intelligence rating software at the end of the day, you walk

away with far less than you're entitled to under that policy. it's a massive rip off, a accomplished by technology. >> this is another form of software that, unfortunately, could be used to build upon the fraudulent software that we have already identified. >> farmers responded saying the allegations in the complaint are simply incorrect and we do not seek to provide low replacement cost estimates. last month, price sued auto insurers over the software they use to appraise the value of cars that have been totaled. price alleges that insurers and software developers design the software to essentially undervalue the car refused to negotiate in good faith, which resulted in lower payouts. tom vacar ktvu fox two news. >> a warmer day today was noticeable from the get go. no fog to start with. there were a

little bit of patches of fog off ocean beach, but it basically turned out to be a sunny day everywhere. we had a little bit of fog down in monterey, but the temperatures today did increase. so these were the highs from today and they were up into the mid and upper 80s i mean 88 in concord that's up there, 89 in santa rosa, 84 in napa. so very warm. not record setting anything but just warmer than we've been for a while. so noticeable. and what will be noticeable tomorrow is going to be the temperature drop as we move into your bay area. wednesday temperatures come down five six degrees. they went up about that much, maybe a little more, and they go down the story this weekend is well, tomorrow this high stays put. but then this weekend this low does this move drops close to us. and it brings basically mixes out the inversion potentially. so the fog is not a thing. but that's a cold air mass. it's settling in. and so the cold air the cooler air mass will sit over us. despite the sun angle and the length of day. we're going to find temperatures generally in the 70s over the weekend might be a little bit breezy as well.

♪ was built off the coast of gaza has not been delivered to the broader palestinian population. population. according to the un world food program. deliveries from the pier were stopped sunday after saturday's aid convoy was unable to reach warehouses within gaza due to unsafe conditions. the un agency is now reevaluating, citing logistics and security measures and looking for alternate routes within gaza. >> the israeli government says it will return a camera and other broadcasting equipment to the associated press just hours after taking it from a news crew. authorities accused the ap of providing a live video feed of gaza to the news organization al jazeera, which is now banned in israel. the ap says its live feed was only of the gaza skyline and did not show military movement. the seizure by the israeli government was

the incident was captured here on video by her classmates at elite charter school. the girl's aunt says the incident started when the teacher told the 13 year old that she was not supposed to be in that classroom . the teacher's name has not been released. >> the family of an auto shop owner in oakland, who was killed four months ago is pushing for justice. oakland police identified a suspect, 33 year old robert lee moore, in march. he has been charged with murder but still has not been arrested. anyone who has seen moore is asked to contact oakland police. >> gig workers rallied right outside the state supreme court today ahead of a case that could determine their future. the court heard arguments on the constitutionality of proposition 22, the voter approved law classifies rideshare and delivery drivers as independent contractors, not employees, with workers compensation protections or health benefits. the court's decision is expected within 90 days. >> you're watching ktvu, fox two news at 630. former president donald trump's defense team has rested its case in his criminal

trial in new york. >> the former president did not take the stand. fox's arthur chen was inside the courtroom and has more on why the defense team stood down after calling just two witnesses. the defense rested after calling just two witnesses to the stand and not calling donald trump to testify in his own criminal trial. >> the former president, ignoring questions from reporters asking why he chose not to take the stand. mr. trump, why won't you testify? before the defense wrapped up their case, prosecutors continued their cross-examination of lawyer robert costello, who tried to represent michael cohen in 2018 as the feds were closing in. cohen never signed a retainer or paid. costello, concerned that costello's close ties to trump and rudy giuliani meant his best interests would take a back seat. jurors listened intently today as prosecutor susan hoffinger confronted costello over an email in which he wrote his mission was to quote, get cohen on the right page without giving him the appearance that we are following instructions from giuliani or the president.

>> we have a judge that's extremely, let's say, complicated, but let's also say conflicted. >> meanwhile, it's unclear how jurors are processing the entourage of republican politicians who come and sit behind trump in court each day. after jurors were released this morning, they filed out walking past the former president. none of them making eye contact. the five women and seven men will begin deliberations next week to see if prosecutors have proven their case. that trump falsified documents to cover up paying adult film actress stormy daniels $130,000 not to go public with information that would have affected the outcome of the 2016 election. trump denies any wrongdoing, including having ever had sex with daniels. legal experts say jury instructions are now the key to this case, as judge juan merchan decides how he'll explain to the jury what they have to agree on in order to reach a verdict. demonstrating the complexity here. while hush money payments are legal, prosecutor have to

prove the cover up was to conceal or commit a second crime, in this case, election interference. >> it's not a simple, straightforward robbery case for example. it has nuances. it has aspects of election law. it has aspects of falsifying business records. and the jury are going to have that complicated jury instruction before them. >> and that was arthur chen reporting. the jury will return next week after the holiday for closing arguments. >> rudy giuliani has pleaded not guilty to felony charges of election interference in the state of arizona. the former new york city mayor and trump attorney appeared remotely for the hearing after reportedly dodging an indictment for weeks. giuliani is one of more than a dozen people facing forgery, conspiracy and fraud charges for submitting a document to congress alleging that mr. trump won the election in arizona. a trial is set for october, and we have more coverage on this trial

indigenous people, especially women and girls. >> advocates say indigenous women vanish at a rate that is ten times that of white women. often, they say, the response for calls for help falls on deaf ears. >> and that's the problem. the police don't look for our missing and murdered indigenous people. >> this woman who wants her identity concealed points to the case of khadijah britton. she was last seen when she was 24 years old in february 2018, as her ex-boyfriend forced her into a car at gunpoint in mendocino county. the fbi is offering $10,000 in reward money for tips leading to her whereabouts. >> the family did most of the searching, yes, and the sheriff. i don't know why they didn't call in a helicopter. drones, horses, atvs. it's definitely a pattern. every time that's a family member goes missing or is found murdered, it affects the family. of course, deeply, but it ripples out and affects our whole indian community.

911 operators today supervisor asha sapphire joined essential workers outside zuckerberg san francisco general. his proposed ballot measure would allow full time registered nurses to apply up to three years of work as temporary nurses for retirement credits, and would provide 911 operators with the same retirement benefits as other first responders in the city. >> currently. right now, we have a 20% vacancy in our 911 dispatch system. we are down 40 911 dispatchers, which is absolutely impacting our public safety response system. >> the measure will have to be approved by the board of supervisors before it can be placed on the november ballot. >> the group behind a proposed new community in solano county announced $500,000 in community grants today. california forever says 45 different groups
