here are live pictures of the truck being offloaded. it was carrying 40,000 pounds of strawberries. they have to get the strawberries off the truck and then right it, and then they're going to reopen the ramp. this is probably going to be for the entire morning commute. going to be an issue here. 280 is your alternate route. and what happened to the strawberries you say? well, there they are. unfortunately they're a total loss. north seven 101 at 701, not 7101701. let's go back to garcia, sal. >> thank you. happening today, convicted killer scott peterson will get another chance in court to prove he did not kill his wife and unborn baby. a judge's decision on new dna testing could make or break the argument to give him a new trial. ktvu james torres in studio here, doing a good job of breaking down what lawyers are going to argue in court this morning. >> garcia lots to it. we try to break it down for you. we expect peterson to appear in court via zoom call or video call. rather, this is where lawyers defending

peterson say dna testing of evidence never done before needs to be done, because it could prove two major theories in the case one, that laci was alive beyond when scott was convicted of killing her, and two, she was possibly abducted and killed by someone else. they're calling for dna testing and retesting of a few items, but more notably, they want testing on a mattress found inside a burned van spotted across the street from the peterson's modesto home. that van may have been part of a home burglary of peterson's neighbors, and they argue it could be connected to her disappearance. l.a. lawyers say the grounds of their argument come from a number of witnesses who say they saw laci walking her dog, and even saw her interacting with those burglars after those prosecutors say she was killed, what witness went as far as saying on the record he saw the burglars push a pregnant woman into the van. the lawyers say that witness called in the crime, but it was never investigated enough. and they say they argued. detectives with the modesto police department either didn't do enough to vet the witness accounts or just flat out ignored those accounts,

passed dna testing on the van did find some human dna, but these attorneys are asking new testing reveal the identity of who that dna belongs to in its motion, the lapd wrote, quote, the results of the requested dna testing could help identify the actual perpetrators of the crimes for which scott peterson was convicted and or provide leads to other suspects. days after lacey's disappearance, modesto police did announce that they were clearing the two suspected burglars of having any involvement in the laci case. prosecutors, those trying to keep peterson in prison say this is all brought, or rather, all the points brought up by the lapd are all hearsay and all the evidence that they brought up was enough to win a conviction. they argue many people in the neighborhood could have been seen walking their dogs, and they could all fit lacey's description. today's hearing in redwood city is expected to start around 9 a.m. a judge ruling is expected today. a no to dna testing could be that final dagger to the la ips

argument, but a yes to testing could be a huge step forward in asking for a new trial. of course, we'll keep you posted on what happens. garcia james torres, thank you. >> the city of oakland is encouraging kia and hyundai owners to take advantage of a new settlement over car thefts. a lawsuit alleged the carmakers sold faulty easily stolen vehicles. those cars were popular targets for thieves during the pandemic because many models were missing an important security feature. kia and hyundai have since agreed to give out free anti-theft upgrades and to compensate customers who were victims of thefts or break ins. owners can submit a claim now, and the settlement won't get final approval until mid-july. >> well, a band in the east bay desperately searching for its stolen musical equipment after its tour van was stolen in oakland last week. the rock group wandered says their van was stolen the night of may 22nd from an apartment garage on 12th street in oakland, and at the time, wander was loaning the van to another local band. it was

last seen filled with instruments, equipment and years of memories. these rockers hope to get their van back, but they don't want other musicians to be hurt by their bad luck. >> i want bands to still come through oakland. i still want music to happen in oakland because i think the oakland community deserves that. >> so far this year in oakland, more than 4000 car thefts have been reported. if you have any information on where that stolen van is, contact oakland police. >> a south bay doctor is back at home this morning after spending several weeks trapped in gaza. san carlos doctor haleh sheikholeslam returned to the bay area this weekend. she originally planned to spend two weeks providing medical care to people in that war torn region, but got stuck when the border was shut down. then medical supplies began to dwindle, worsened an already critical situation. we try to help patients as much as we can. >> it's hard when you don't have

the tools to help patients or the patients you know who should be hospitalized but can't be because there's just no room for them. >> the doctor was able to secure a return after four weeks in gaza. she says on her way back home, there was an airstrike near the clinic where she'd been working. >> our time, now 706, will today and tomorrow, all classes at uc santa cruz will be online because of a continuing campus strike. now, this strike has been going on for a week now. yesterday, protesters blocked the entrances to the campus, filled the streets with tents and dumped rocks and debris and paint onto the pavement. union academic workers say they're upset about how university leaders have responded to pro palestinian protests. the strike has spread to other uc campuses as well. about 12,000 union employees are walking picket lines at uc santa cruz, uc davis and ucla. >> the decision to go on strike

and to do it, you know, like like you said, like at this moment when we're all preparing to, you know, i'm supposed to walk in my graduation on this year, you know, for phd, as students say, this strike has led to research delays and withheld grades ahead of their final exams. >> the uc office of the president calls the strike illegal, saying its contract with the union includes a no strike provision. >> the case involving water pollution regulations for san francisco is headed to the us supreme court. the city is at odds with the environmental protection agency, the epa accuses san francisco of violating the clean water act by allowing dangerous contaminants to flow through its oceanside water pollution control plant down in southern california and into the pacific ocean. the san francisco side says that regulations are too generic and exposes the city to fines and lawsuits. officials say the epa should just announce how much the city needs to control its discharges to comply with the clean water act.

>> our time now. 708. a climate change experiment aboard the deck of the uss hornet that had been on hold may be coming back soon. the project pumps drops of salt water into the air, as if it could make clouds more reflective. now, researchers from the university of washington started these tests on the upper deck of the uss hornet in alameda last month, but it was put on hold while the city conducted a second review of the safety. now, officials in alameda say the project does not threaten health or safety to nearby residents or wildlife. the alameda city council will vote on whether to allow the experiment to continue when they meet next week. >> time now 709 and we do have that truck crash with. that happened at about three this morning, northbound 101 on the connector ramp to 880. the truck you see there loaded down with 40,000 pounds of strawberries still being offloaded. they have to get all those strawberry

17 years ago in massachusetts was arrested in the east bay. is named twin lee. he was arrested near danville yesterday. now, he was originally on trial in 2007 for the kidnaping and rape of a young woman in massachusetts. back in 2005. he fled the state before he was sentenced. the victim originally helped arrest him because she recognized his bad breath from the restaurant where she worked, which his family owned. a jury still convicted him even after he fled the area. he's never served. any time in jail. investigators recently had a lead that he was living here in the bay area. >> an east bay man accuses pittsburgh police of using excessive force. ashton porter was staying at the hampton inn in 2022 when he says he suffered a mental health crisis and was too scared to leave. motel staff called police, according to porter's federal lawsuit, he was

involved in a prolonged interaction with police in which officers used a battering ram, pepper spray and tear gas in an attempt to get him out of the room. porter was also shot twice by officers. >> police should just have a little more compassion with someone that's going through a mental health crisis, because that's not how that person should be defined. asking for help but was met with harm was met with bullets. >> police who, if you will see things as if they're hammers, saw mr. porter as a nail. >> porter says just as he was leaving the motel room with his hands up, an officer shot him. police say porter was armed with a knife and charged at officers. the officer opened fire, identified as ernesto mejia orozco resigned from pittsburgh police that same year. charges against him in this case were dropped next month. he's expected to plead guilty to local bribery charges and to federal to paying someone to take online classes for him. so

he could increase his pay. 715 former president donald trump's future will be in the hands of a manhattan jury in the coming hours, as part of his criminal trial involving 34 counts, including falsifying business records and paying hush money. >> our fox reporter rebecca castor is joining us live from new york city with the latest on how these proceedings could go. rebecca, good morning. >> dave garcia. good morning. court is just starting here. and judge mershon will soon give the jury his instructions before they head into the deliberation room. >> jury instructions. this is what you use to evaluate the evidence. >> on wednesday, judge juan mershon is expected to direct the jury about how they should set off on reaching a verdict before the 12 members start deliberating the evidence, and former president donald trump's new york hush money trial. >> we have a judge who's conflicted. >> the former president is charged with 34 felony counts, prosecutors argued trump falsified business documents as part of an effort to hide a hush

money payment to adult film star stormy daniels ahead of the 2016 presidential election. daniels was allegedly paid to keep quiet about an affair with trump, which he denies a conspiracy to affect the outcome of the 2016 election by burying negative stories about him and then a cover up by labeling reimburse payments to his lawyer, michael cohen, as legal expenses when in reality, according to prosecutors, he was paying back cohen for a $130,000 hush money payment. the jury must reach a unanimous decision on whether to convict or acquit trump. if just one believes prosecutors haven't shown trump is guilty beyond a reasonable doubt, it could result in a hung jury. >> but like any hung jury, the judge is going to give them an allen charge. he's going to tell you to go back, restudy everything. >> if convicted, trump could face a maximum of 20 years behind bars. >> but it's not clear yet if prosecutors will actually seek prison time. garcia dave.

>> rebecca, is there any idea how long these deliberations could last? and secondly, are there any preparations around the courthouse where you are? i imagine some people have been watching the trial, but once that verdict comes in, it'll it'll be sort of the big moment. >> exactly. so there's no way to know how long the jury deliberations will go. they are considering 34 counts against trump, so that could take some time. i will say there is a strong nypd presence out here. they've been here throughout the trial and we all are already seeing a strong showing of trump supporters out here. and there's a line of police officers monitoring those protesters and making sure it doesn't get out of hand. okay >> rebecca castor, live in new york. thank you. >> all right, rebecca, thank you. our time is now. 718. a judge was left speechless after a man with a suspended driver's license died into a court zoom call while he was driving a car. >> mr. harris, are you driving? >> i'm ashley, i'm pulling into

my doctor's office, actually, so maybe i don't understand something. >> this is a driving license. suspended. >> that is correct, your honor, and he was just driving at. >> and he didn't have a license. >> incredible. during that hearing, the defendant was asking for an adjournment. it was denied. the judge also revoked his bond and ordered the man to turn himself in. by the end of the day. >> all right. 718. there is a tricky situation that you've been watching sal in the south bay that's involving the morning commute. >> that's right. garcia and dave, northbound 101, the connector ramp to northbound 880 is closed because of a truck that, overturned or actually flipped onto its side northbound 101 at 880. they also have the ramp from northbound 880 to 101 closed to take care of the issue. and you can see the traffic on 101 is slow. 280 is

getting slow as well, but i would still use 280 instead of 101. here is a live picture of it. you can see that the truck is on its side. there it was loaded down with 40,000 pounds of strawberries. they've successfully gotten a lot of those strawberries out. you can see that little loader thing is coming out of the truck. once they get all the strawberries out, then those two tow trucks you see there will write the trailer and hopefully get it out of the way. but for the morning commute, i'm not thinking it's going to be a very good one. so i would say use 280 instead. let's talk about the bay bridge. if you're going to san francisco and is a typical delay spreading all the way out to the macarthur maze. 880 oakland. 580 oakland. still looking good getting into oakland. and we take a quick look at the san mateo bridge. it's pretty crowded over to the peninsula. 720 let's talk to steve now about today's weather. >> you got the brooms out, sal got the broom out for today's. >> yeah. you know what? last night was a pretty good win and they got it done early. steve.

of cases is low. researchers want to monitor the strains and mutations. as summer approaches. counties including napa and sonoma are checking wastewater for traces of covid, including the new flirt subvariants, county told the press. democrat it has detected at least eight new cases of that strain since march. >> our time is now 724 san francisco city leaders debating whether to spend more resources to examine the growing popularity of a new street drug. it's called medetomidine, a synthetic drug that's used by veterinarians as an animal tranquilizer. it can dramatically slow down a heartbeat. this drug can be combined with other drugs like fentanyl and heroin. san

francisco officials have worked hard trying to reduce the number of deadly overdoses in the city, but they worry this new drug could cause another another trend. >> a humboldt county judge has resigned after admitting to several wrongful acts. superior court judge gregory crease presided over at least 44 cases in which he did not reveal his social or working relationships with the lawyers or their clients. the commission on judicial performance also cited a party in 2018 where there were drinks before and during the party, hosted by an attorney and his wife, crease was elected to a six year term in 2018. after serving as a deputy humboldt county public defender for seven years, the commission imposed a severe public censure on crease and said he'd permanently resigned as a judge on monday. >> our time now 726 lawmakers calling for accountability because of that troubled federal prison in the east bay. what they'll be looking at as they try to figure out how the abuse at fci dublin went on for so

truck as they're using equipment to get rid of the strawberries, they have to unload all the strawberries and put them in a big pile there before they can take the truck and that's a lot of strawberries, 40,000 pounds, just kind of sitting there. and right now the truck is not righted yet. once they get everything off the truck, they can ride it and reopen the ramp. i also want to mention that we have a typical commute here at the bay bridge, backed up to the maze when we come back, we'll take a look at some of the contra costa commutes that are loaded up. 731 let's go back to the desk. >> happening today, convicted killer scott peterson will appear virtually in a san mateo county courtroom as part of an effort to get a new trial. peterson is currently serving a life sentence after being convicted of murdering his wife, laci, and their unborn child in 2002, a team of lawyers with the la innocence project is working to overturn his conviction and is requesting dna testing for items gathered during the original murder investigation. prosecutors say there is no need for dna testing because peterson

was convicted on other evidence. >> our time now. 732 san francisco's muni will be getting millions of dollars from the federal government to repair muni platforms. ktvu sally rasmus is here now with a live report on what the money is supposed to pay for. good morning. ali >> good morning dave. it's nearly $5 million coming from the us department of transportation to help sfmta upgrade several muni light rail platforms, like the one here behind us. this is the one at church and market. and you can see it's not level with the street. we can show you some up close video in order to get on board a rail car. at this particular stop, you either have to walk up the three steps to hop into the train, or if you're wheelchair or mobility impaired, you have to go up the ramp. we spoke with some muni riders this morning who say they've seen friends and fellow passengers in wheelchairs struggle with platforms like this. the ramps or, you know, even getting to

the ramps. or as we can see here, there's a bike lane and then trying to drive a wheelchair across the bike lane. and if there's a lot of bikes, who has the right of way? the us department of transportation announced san francisco will get $4.7 million to add more wheelchair ramps and close the gap between the platform and those muni rail cars at several light rail stations. the goal to make sure people with mobility challenges can more easily board those rail cars. >> anything to help everybody, because the city is for everybody. >> now where will these improvements be made? specifically at five stations on the j. church muni light rail line and another three stations on the m ocean view line? we don't know which stops on those lines will get the upgrades. we also don't know when construction will begin or how soon these upgrades to these platforms will be in place, but we have reached out to sfmta this morning to get more details

on that. live in san francisco, ali rasmus, ktvu, fox two news. >> ali thank you. caltrans is closing a section of 19th avenue in san francisco starting today to repair potholes. two northbound lanes will be closed across the three block stretch between sloat and taraval. crews will be working from 9 a.m. to 3 p.m, after which all lanes will reopen. the closure is expected to last through friday. this week's closure is part of a more extensive repaving project planned for 19th avenue by the city's public works department. renovations include water and sewer main replacements, traffic signal work and curb ramp installations. >> all right, gasia time 734 starting today. opening statements begin in the state trial against david depape in san francisco. this comes as a judge in federal court resentenced depape to 30 years in prison for attacking paul pelosi, the husband of san francisco congresswoman nancy pelosi. now, earlier this month, the judge had failed to give depape a chance to speak at the original sentencing. this time,

depape addressed the court and said, quote, i never meant to hurt him, and i feel horribly for hurting mr. pelosi. >> they forgot to go through that formality and everybody agreed it was a mistake. so now it's been corrected. so yes, it creates a point of appeal, but it's not going to be successful because what an appellate court will do is they will say, yes, it was an error, but it was corrected. >> nanda papp's lawyer is arguing he should not be prosecuted in two separate courts for the same crimes in charges. >> parents in novato say they are frustrated by their schools response to a string of violent incidents at sinaloa middle school. we have video of what parents say is the latest incident that took place on friday. students engaged in a fight on campus in which one girl was attacked by three other students last night, parents attended a meeting. one ktvu was not allowed to attend. the principal said the schools handed out severe punishment for the students involved in that fight. on friday, parents tell

us more needs to be done. >> a fight is one thing when someone's attacked by a group of people, it needs to be dealt with a certain way and i feel like the schools turned their head to it and they've they've minimalized it. minimalizing violence is a big problem. >> afterwards, parents told us they were just as frustrated as they were before the meeting. >> well, ten members of congress want hearings to be held into abuses at the federal women's prison in dublin. prisons can be run in a way that are respectful of the process. >> obviously, but when they develop these cultures, there's lots of history that shows it's very hard to change it and people won't be truthful because if they are truthful, unfortunately they'll be held to account. so we have to get to that point. >> now. it's been six weeks now since the bureau of prisons announced the shutdown of fci dublin. it happened just after a special master was appointed to oversee compliance with federal law in response to a rampant culture of sexual abuse and the

settlements expected in dozens of sex abuse cases filed by women against more than 30 correctional officers. at that now closed federal prison in dublin, a lawyer representing 23 of the 106 plaintiffs says she wants to use some of the settlement money to create a first of its kind healing center for jessica. pride says she and a partner have already purchased land for that center in san diego. it would provide inpatient and virtual treatment for sexual assault victims. >> time is 737. let's see what's happening in the morning commute. do we start in the south bay again, sal? >> yeah, we're going to start with the truck that was flipped over this morning at about three in the morning, right now northbound 101, the connector ramp from northbound 101 to 880 is closed, and so is the ramp from 880 to 101 as they try to unload the truck that was filled with 40,000 pounds of strawberries. and here we are with the live picture. they're

now to explain how a judge's decision could determine how dna , dna testing could make or break this case. >> james dave. good morning. well, attorneys with the la innocence project are aggressively saying investigators and detectives may have botched the case against scott peterson. in court documents, they say tunnel vision led investigators to find ways to prove their story of what happened to laci peterson. while ignoring all other possibilities that could indicate laci was alive longer than when scott was convicted of killing her. today's hearing is formally asking a judge to allow dna testing on a number of new items, most notably, the la ip wants testing on a mattress found inside a burned van spotted near the peterson's modesto home. that van may have been part of a home burglary of peterson's neighbors. la ip lawyers say the grounds of their argument come from a number of witnesses who say they saw laci walking her dog and even saw her interacting with those burglars at least a day after prosecutors

said she determined to be dead. one witness saying on the record he saw the burglars push a pregnant woman into the van. the lawyers say that witness called in the crime, but it was never investigated enough. and they say the detectives either didn't do enough to vet the witness accounts or just flat out ignored them. preliminary dna testing on that van did find some human blood, but these attorneys are asking for new modern testing to reveal the identity of who that dna belongs to. in its motion, the lapd wrote the results of the requested dna testing could help identify the actual perpetrators of the crimes for which scott peterson was convicted, and or provide leads to other suspects. days after laci's disappearance, modesto police did clear the two suspected burglars of having any involvement in the case the stanislaus district attorney's office. those trying to keep peterson in prison say all of the points brought up by the la ip are hearsay, and all the evidence prosecutors brought

forth was enough to win a conviction. today's hearing in redwood city that sets a start in a little less than an hour from now, a judge ruling is expected. expected at the end of the day today, a no to dna testing could be a dagger to the la ips moment, but a yes to the testing could be a huge step forward in asking for a new trial. garcia and dave. >> all right, james, thank you. time now, 804. a fugitive who's been on the run for almost two decades was recently arrested in the east bay. twin lee was taken into custody yesterday near danville. he was originally on trial back in 2007 for the kidnaping and rape of a young woman in massachusetts. in 2005, he fled the state before he was sentenced. the victim originally helped arrest him because she recognized his bad breath from the restaurant where she worked, which his family owned. a jury still convicted him even after he fled, and he has never served

time. investigators recently received a lead that he was living here in the bay area. >> the city of oakland is encouraging kia and hyundai owners to take advantage of a new settlement over car thefts. a lawsuit alleged carmakers sold faulty, easily stolen vehicles. the cars were popular targets for thieves during the pandemic because many models were missing an important security feature. kia and hyundai have since agreed to give out free anti-theft upgrades and compensate customers who were victims of thefts or break ins. owners can now submit a claim the settlement won't get final approval until mid-july. >> our time is 805, a band in the east bay desperately searching for his musical equipment after its tour van was stolen last week in oakland. the rock group wander says their van was stolen in the night of may 22nd from an apartment garage on 12th street in oakland. at the time, wander was loaning the van to another local band. it was last seen filled with instruments, equipment and years of memories. the rockers hope to

part of an effort to hide a hush money payment to adult film star stormy daniels ahead of the 2016 presidential election. daniels was allegedly paid to keep quiet about an affair with trump, which he denies was a conspiracy to affect the outcome of the 2016 election by burying negative stories about him and then a cover up by labeling reimbursement payments to his lawyer, michael cohen, as legal expenses when in reality, according to prosecutors, he was paying back cohen for a $130,000 hush money payment. the jury must reach a unanimous decision on whether to convict or acquit trump. if just one believes prosecutors haven't shown trump is guilty beyond a reasonable doubt, it could result in a hung jury. >> but like any hung jury, the judge is going to give them an allen charge. he's going to tell you to go back, restudy everything. >> it's not clear yet if prosecutors will actually seek conviction or seek prison time. if trump is convicted, but he could face a maximum of 20 years

government will pay for things like better wheelchair ramps and improvements to close the gap between the platform and those rail cars. at several light rail muni stations, we spoke with a longtime transit and disability rights advocate about this. ali choo is legally blind and she uses a mobility cane. she told us how those simple changes will help all muni riders benefit. >> so many people, including mothers, use stroller, including older people who use those shopping cart things, including so many people, including people who injured their leg and they have to get on crutches sometimes. so we have to really take that into consideration. >> now, where will these improvements be made? at five stations on the j church muni light rail line and another three muni stations on the m ocean view line. we don't know which ones on those lines will get the specific upgrades to the platforms, and we don't know when construction will begin, but we have reached out to sfmta spokespersons this morning. we are hoping to get some more

information from them. live in san francisco ali rasmus ktvu, fox two news. >> ali thank you. caltrans is closing a section of the 19th avenue area of san francisco starting today to repair potholes. two northbound lanes will be closed across the three block stretch between sloat and taraval. crews will be working from 9 a.m. to 3 p.m, after which all lanes should reopen. the closure is expected to last through friday. this week's closures are part of a more extensive repaving project planned for 19th ave by the city's public works department. renovations include water and sewer main replacement, traffic signal work and curb ramp installations. happening today, convicted killer scott peterson will appear virtually in a san mateo county courtroom as part of his effort to get a new trial. peterson is currently serving a life sentence after being convicted of murdering his wife, laci, and their unborn child in 20. excuse me in 2002. a team of lawyers with the la innocence project is working to overturn the conviction. has requested dna testing for items gathered during the original murder investigation. prosecutors say there is no need for dna testing because peterson
