are fighting for information to earn him a new trial. they're asking a judge for new dna testing. they say that can prove that he did not kill his wife and their unborn son. ktvu james torres following the ongoing court hearing. scott peterson is appearing in a san mateo county court again via video call. >> he'll listen to his new attorneys, members of the la innocence project ask a judge to grant new dna testing, specifically, the la ip wants testing on a mattress found inside a burned van spotted near the peterson's modesto home that van may have been part of a home burglary of peterson's neighbors . lawyers say the grounds of their argument come from a number of witnesses who say they saw laci peterson walking her dog and even saw her interacting with those burglars at least a day after prosecutors determined laci to be dead, they argued detectives either didn't do enough to vet the witness accounts or just flat out

ignored them. preliminary dna testing on that van did find human blood, but these attorneys are now asking new modern testing to reveal the identity of who that dna belongs to. and if any of it belongs to laci, then that could be enough to create an argument for a new trial. the call for dna testing legal expert michael cardoza says, isn't a far fetched request. >> it wasn't vetted, according to what i know about this case, as fully as it should have been. and then if it's denied, you're going to have people out there. the majority of people are absolutely convinced that scott peterson did this. okay the majority. but the other people that say, wait a minute, he didn't get a fair trial. let's put that to rest and say, no, no, no, they got to redo that. and now you have no more complaints. now we spend the rest of his life in prison. >> the stanislaus district attorney's office says they already cleared those burglars

for any involvement in lacey's case. so far, they've argued they convicted peterson on facts. not speculation, calling the la ip's claims a, quote, entitlement thing and legally flawed. a judge ruling is expected today, but that could change if the arguments last longer than the business day. a no to dna testing could be a dagger to the lips argument, but a yes to the testing could be a huge step forward in asking for a new trial. the parties are set to meet again in court in july. i'm james torres. ktvu fox two news. >> opening statements have begun in the state trial against david depape in san francisco. this comes as a federal judge resentenced depape to 30 years in prison for attacking paul pelosi, the husband of congresswoman nancy pelosi. earlier this month. the judge failed to give depape a chance to speak at the original sentencing. this time, depape addressed the court, saying, i never meant to hurt him and i

feel horribly for hurting mr. pelosi. >> they forgot to go through that formality and everybody agreed it was a mistake. so now it's been corrected. so yes, it creates a point of appeal, but it's not going to be successful because what an appellate court will do is they will say, yes, it was an error, but it was corrected. >> depapes lawyers are arguing that he should not be prosecuted in two separate courts for the same crimes and charges. san francisco's municipal transportation agency will get millions of dollars from the federal government to fix some of its muni platforms. ktvu erasmus shows us how the money will be used at the muni light rail stop on church and market. the platform isn't level with the street to get on board a rail car, you have to walk up the steps or use a ramp. >> christine lawrence says she's seen some of her friends and fellow riders in wheelchairs struggle here. the ramps or, you know, even getting to the ramps or as we can see here, there's a

bike lane and then trying to drive a wheelchair across the bike lane. and if there's a lot of bikes, who has the right of way now sfmta is getting a $4.6 million grant from the us department of transportation to make some changes. the goal to make muni platforms like this more accessible for people with mobility challenges. >> what this will allow us to do is construct platforms and a wheelchair boarding islands. >> the federal money will help pay for things like better ramps and signs at several light rail stops. other improvements include making sure the gap between the platform and the rail car is more narrow, so it's easier for people with a wheelchair or a cane to get on board. >> say that you use a walker. that little tip thing like, what if they get stuck in the middle? >> i'm legally blind and i'm using mobility. can. >> ali choo is a longtime senior and disability rights advocate that benefits so many people, including mothers, use stroller, including older people who use

those shopping cart things, including so many people, including people who injure their leg and they have to get on crutches sometimes. >> so we have to really take that into consideration. >> this is a priority for us. we're really excited to hit the ground running. >> sfmta says construction has already begun at some of the muni stops slated for upgrades. five stops are on the j church line, three on the m ocean view line. the work is expected to be complete in the next two years. >> it will make a difference. we need the access and we need it to look like an actual, platform where you can access easily and not be kind of looking dangerous in san francisco. >> ali rasmus ktvu, fox two news caltrans began work this morning to repave a section of 19th avenue in san francisco to smooth out potholes. >> two northbound lanes will be closed across the three block stretch of 19th avenue between sloat and taraval, while work is underway. crews will be working from nine in the morning to three in the afternoon for the next three days. drivers say they look forward to the improvements. >> sometimes it can be a pretty

bad street with potholes. i'm glad they're fixing it. >> what do you like the idea of it being repaved, sure. >> it makes it safer. >> according to san francisco county, this is one of the busiest surface streets in the city. the roadways and extension of highway one, which is why caltrans is in charge of the repaving work. today and tomorrow, all classes at uc santa cruz will be online because of a continuing campus strike there. it's now one week old. yesterday protesters blocked the entrances to campus, filling the street with tents and dumping rocks, debris and paint onto the pavement. the union academic workers say they're upset about how university leaders have responded to pro-palestinian protests. the strike has spread to other uc campuses as well. an estimated 12,000 union employees are walking the picket lines at uc santa cruz, uc davis and ucla . >> our decision to go on strike and to do it, you know, like like you said, like at this moment when we're all preparing to you know, i'm supposed to walk in my graduation this year, you know, for phd students say

the strike has led to research delays and withheld grades ahead of the final exams. >> the uc office of the president calls the strike illegal, says that its contract with the union includes a no strike provision to the north bay. now, as parents are frustrated following a string of violent incidents at sinaloa middle school in novato, they flooded a meeting last night after a fight in which one girl was attacked by three others. ktvu bailey o'carroll spoke with some parents who say the school hasn't done enough to keep students safe on campus. >> according to parents of students at sinaloa middle school in novato, violence on campus is a growing issue. this is video sent to ktvu of a fight on campus this past friday. according to multiple parents, three students attacked a fellow female student in an email from the principal sent to parents, it said students were aware the day before that a fight would happen. this resulted in a very large stampede of our students, several hundred of them rushing around campus to seek out the fight to watch it happen. this mob grew in size as they ran

through campus, causing some students to fall and literally be run over by others with us having boys, we they have volunteered the information that of course they would get in there, they would help. >> but in today's society you can't. they were worried about getting in trouble themselves. >> in that same email, the principal went on to say, please know that severe consequence have been issued for students culpable of causing physical harm to the other student. but all parents we spoke to say this is far from the only incident of violence on campus this school year and beyond. >> i had a violent incident with a boy who attacked my daughter. that was a grade above her. and honestly, from my perspective, the school didn't even deal with it at all. they brushed it under the rug. this was three years ago, and so for three years i've been watching systemic violence. as for what's being done to address the problem, well, parents say not much. a fight is one thing. when someone's attacked by a group of people, it needs to be dealt with a certain way. and i feel like the schools turned their head to it

and they've they've minimized it. minimalizing violence is a big problem. >> our ktvu crew was asked to leave the meeting before it started by novato school district's communication staff. parents outside told us they blame the administration for the upward trend in violence on campus, and after the meeting, parents said they felt just as frustrated as when they walked in. >> i believe they care, but i believe they're carrying a lot more about their reputation. >> in in novato. i'm bailey o'carroll, ktvu, fox two news nissan is warning owners of some older, unrepaired models not to drive them due to the airbag inflators having an increased risk of exploding in a crash, hurling dangerous metal fragments. >> nissan says about 84,000 vehicles may still be on the road in the u.s. that have not had their takata airbag inflators replaced. the urgent request comes after one person in a nissan was killed by an exploding inflator. in. as many as 58 people were injured since 2015. nissan says owners should contact their dealer to set up an appointment to have inflators replaced for free. the city of oakland is encouraging kia and hyundai owners to take advantage

tasked with deciding whether donald trump is guilty on charges he concealed hush money payments allegedly made on his behalf during the 2016 campaign. >> every crime, which is a creature of some statute has different elements. one is a mental element. and then there are the things that you have to do to commit the crime. >> the deliberations come after the jury listened to hours of closing arguments on tuesday. the panel can either convict or acquit trump on all 34 felony counts, or find him guilty of just some charges and not others. if they're not able to reach a unanimous verdict, the judge could declare a mistrial. >> if they do the right thing, and considering that we're in new york, i think we should get a hung jury. >> trump faces three other criminal cases, but his hush money trial may be the only one that happens before november's election. legal analysts say if trump is convicted here in new york, he will likely appeal a process that could take months. >> i don't think that this could make it through an appeal before the election. at least to its final to a final appeal. you

can't just, i think, leap over the new york appellate system. try to get to the supreme court. >> it's not clear if prosecutors will seek prison time if trump is convicted, but he could face a maximum of 20 years behind bars in new york. rebecca castor, ktvu, fox two news. >> new at noon criminal charges against scottie scheffler have been dismissed following his arrest in louisville during the pga championship. jefferson county attorney mike o'connell, a local prosecutor, asked a judge to drop the four charges against scheffler, who was not required to be in the courtroom. scheffler was charged with a felony for assaulting a police officer with his vehicle, along with three misdemeanors. the arresting officer, detective brian gillis, was outside the gate of valhalla golf course may 17th, directing traffic after a pedestrian death when he encountered scheffler. scheffler was driving a pga courtesy vehicle when gillis said he refused to comply and accelerated forward, dragging gillis to the ground. scheffler said he simply misunderstood the commands coming from traffic officers. there are still

thousands of people without power in north texas after yet another round of deadly storms tore through the area yesterday. fox weather correspondent robert ray has more from valley view, texas. >> everybody around the neighborhood is out of power. >> power outages have skyrocketed in texas after severe weather tore across the dallas fort worth area on tuesday, hitting communities with hurricane force wind gusts and baseball sized hail that forced officials to activate outdoor warning sirens. at one point, more than a million customers were left without electricity, and local officials say getting the lights back on won't be easy or fast. >> this is a broken lens problem brought about by straight line winds. this, unfortunately, will be a multi day power outage situation. >> tuesday's severe weather was an extension of deadly storms that swept across the central u.s. over the memorial day weekend, killing at least 24 people in seven states. and on tuesday, a 16 year old boy was

killed when powerful thunderstorm caused a home under construction to collapse. we see the houses like moving like bad and then we just hear a lot of cracking noises. meanwhile, folks here in north texas are still assessing the damage from the weekend tornadoes. entire communities were destroyed, and some are dealing with the loss of multiple family members. they say they'll be grieving as the recovery process ramps up. >> we try to stand firm. we try to stand strong. but when it comes to your neighbors, it comes to your friends, your family. if you try to hold it in too long, you're going to it's going to mess you up. >> and there is no relief in sight. as storms will continue to linger across the central u.s. in valley view, texas, robert ray ktvu, fox two news. >> here in the bay area, temperatures are ticking up just a little bit, aren't they, mark? >> yeah, you'll definitely notice that the change today gasia lots of sunshine. the fog has already cleared on out and we're setting the stage for the warm up for today. but it's

going to be the warmest day of the week. that will be for tomorrow as we head into your thursday and still fairly warm for the inland spots on friday. so the warmest day will be tomorrow. temperatures a good 6 to 12 degrees up above the average, and it is warm to hot inland. and that's where we're going to find a few low 90s, at least for today though, it is a nice wednesday out there, as you can see up and down the west coast, we still have the low clouds and fog closer to southern california and some patches from this morning. there's that fog bank closer to monterey bay, but you get the idea. just over the past hour or so, those clouds clearing out and as a result, more sunshine, even from monterey toward the bay area, toward san francisco as well. so we are in the clear right now and as far as the temperature change compared to 24 hours ago at this time, everybody a bit warmer, about 1 degrees warmer in san jose to ten degrees warmer up in the north bay. fairfield nine degrees warmer. and we'll show you some of the current numbers out there right now. san francisco's checking in 6579 up in santa rosa and san jose 74 degrees. we'll show you the wind reports. and these numbers will

probably go up a bit over the next few hours. right now, in the single digits for a good portion of the bay area. we'll check out sfo right now. winds out of the northwest at 14 miles an hour, and san jose winds out of the northwest at 12 miles an hour. here's a look at those current conditions. once again, we're showing you some nice readings out there with lots of sunshine and 60s and 70s warmest locations today will be approaching the mid to upper 80s, so here's the setup. this area of low pressure. this was sticking around a couple days ago, but this is moving on out of town. we had this area of high pressure building in. so we have that warm up for today. and then it's warm to hot on thursday. friday could still be fairly warm inland, but it looks like a cooling trend that will settle in as we start off the weekend. so tomorrow, the warmup for thursday, the warmest day of the week, still warm into friday and then into the weekend. we will cool back. we'll trim back on those temperatures. take a look at the numbers this afternoon. san francisco 69, santa rosa 87 degrees. fairfield 88, san jose, lower 80s and the coast mainly in the mid 60s.

here's the look ahead. your five day forecast tomorrow is the warmest day. friday. still warm, but we're going to trim back on those temperatures, especially for the coast. so it looks like the best beach day that could be for tomorrow for thursday, maybe close to 70 degrees. and then the weekend. we're to cool things off once again. we'll bring in those stronger winds, but at least the temperatures not a major drop off in the numbers, but definitely a noticeable cool down as we start off the weekend. so warming up in the short term and then cooling off as we head toward the weekend. >> gasia mark, thank you. an explosion and fire at a chase bank in ohio. the building destroyed wha we're learning about t

two people are still missing. the explosion damaged building, blowing the facade completely off. fire crews had to rescue people from the rubble. this happened at a chase bank in youngstown. firefighters evacuated apartments near the bank. the red cross is helping to relocate people who lived in the apartments above youngstown. fire initially characterized the incident as a natural gas explosion, later said the crews were working to determine if there was a gas leak. another volcanic eruption in iceland triggered an evacuation for thousands. the eruption followed a series of earthquakes in a nearby town. we see here smoke and red streams of lava shooting up more than 100ft into the air. it's the fifth time the volcano has erupted in the past six months. officials say the country sits on top of a volcanic hotspot, but they're ready to deal with disruptive

eruptions. neighbors in south lake tahoe are upset after a man shot and killed a bear cub that snuck into his house, people in the neighborhood say on memorial day, they saw the bear standing near the man's door at home. seconds later, the man shot the bear cub. wildlife experts say it's common to see young bears in the area this time of year. neighbors say should have been more patient because cubs are still learning where they can and can't roam, feel badly for the bear. >> they don't usually get into those situations on their own for the first time. >> the kind of clueless, and they don't know the rules yet. so we have to try and be a little bit tolerant for a while with this neighbor was not tolerant. >> fish and wildlife officials conducted an investigation into the shooting and decided the homeowner responded appropriately. an otter that went viral for stealing surfboards off the santa cruz coast is back. after disappearing for several months. otter 841, as she's known, has not been around all year. the marine animal disappeared at the end of last year before the county was hit with storms. the

otter was outfitted with a tracker, so wildlife experts know where she is. people in santa cruz say they try to give her some space for smaller animals, and we should try not to disrupt their ecosystem in their life. >> so i would certainly just deter leave it alone, don't touch it. >> don't get too close to it. >> otter 841 can usually be spotted in or near steamer lane. state park. rangers are trying to figure out where a black substance at folsom lake is coming from. thick, thick, greasy material covered some boats around the lakes. browns ravine ramp over the memorial day weekend. it's not an area where people swim. crews have been out cleaning the ramp and the nearby area. park rangers say they think that the material may be oil that leaked from a boat. >> it very well could have been that somebody purged their bilge out here around the ramp area. just a reminder to everybody to keep their boats clean and tidy because, you know, something like this could happen. >> the state park service says this is the first time it's had to deal with this type of spill

kyle peterson is appearing in a redwood city courtroom virtually from mule creek state prison in amador county, where he's serving a life sentence. he was convicted 20 years ago of killing his wife, laci, and their unborn son. peterson's lawyers have filed several motions, including requests for dna testing of items gathered during the original murder investigation. those items consist of a bloody mattress found inside a burned out van near the peterson's modesto home, and a tarp found in san francisco bay, near where laci's remains were found. the prosecution argues there is no need for dna testing, as other evidence convicted peterson. the judge's ruling is expected this afternoon. we'll have an update on what's happening in court today on the four. a truck carrying thousands of pounds of strawberries forced the closure of a freeway ramp this morning in san jose. it happened just before 3 a.m. on the transition ramp from northbound u.s. highway 101 to northbound

interstate 880. the chp says the truck was carrying about 40,000 pounds of strawberries. crews spent several hours cleaning up the mess. no injuries were reported. someone stole their tour van for an east bay rock band, one of more than 4000 vehicle thefts in oakland already this year. ktvu joey hoarder spoke with band members who say they're desperate to find their gear. >> east bay rock group wander, jamming out in one of their music videos with 14,000 views. >> it means everything to us, really doing music, but for now, the music is on hold. >> after the rockers ford van, which they rely on to get to each gig, was stolen. >> that's just upsetting, right? because because they're just musicians are just trying to spread positivity. >> the four filipino american bandmates who grew up in san leandro and oakland and have played together for the better part of two decades, loan the van to another local band called mao. >> we all try to support each other because, you know, it's

really hard to kind of make it, in music. >> a police report shows the van was parked in a garage at an apartment building on 12th street in oakland at 11:00 the night of may 22nd. the following morning, the van was gone. it was loaded with mao's instruments and equipment and priceless memories. >> oh, jesus, i mean, we've driven that thing across the country multiple times. you get in the van, you drive to the next place, you play the show for all of an hour, you find a place to sleep, you get up early, you're back in the van again, you know, on to the next city. >> after traveling thousands of miles in it while touring for albums across the country, these rockers hope to get their van back. and they don't want other musicians to be fazed by their bad luck. >> i want bands to still come through oakland. i still want music to happen in oakland because i think the oakland community deserves that. >> anyone who knows where the van may be should call oakland

can't stop until they root out. all remaining hamas fighters dug into rafah. but relief agencies report the fighting has made it nearly impossible to provide aid there. and united nations officials warn displaced palestinians are on the brink of starvation. >> it must enter rafah on a massive scale through as many crossing points as possible. >> now a temporary floating pier built by the u.s. to transfer food, water and aid supplies into gaza is out of commission after being damaged by rough seas. >> the rebuilding and repairing of the pier will take at least over a week and will and following completion, will need to be re anchored to the coast of gaza. >> israel's national security adviser said wednesday that he expects the fighting in gaza to continue until at least the end of the year. in washington, caroline shively ktvu, fox two news. >> assistance for palestinians is pouring in from across the globe, including here in the bay area. we heard from a doctor from san carlos who returned home after spending several weeks trapped in gaza. as ktvu

and rubin reports, the doctor says she often lacked medical supplies to treat her patients. >> san carlos doctor hala sheikholeslami traveled to gaza hoping to help. little did she realize she'd be trapped there when the border closed, which meant not only for us not getting being able to come out, but it meant no aid coming in. suddenly, an already meager supply of medicine in rafah dwindled. there was tylenol and not much else. often sheikholeslami could diagnose her patients, but had no way to treat them. >> we try to help patients as much as we can. it's hard when you don't have the tools to help patients or patients you know who should be hospitalized, but can't be because there's just no room for them back home. >> the doctors family feared for her safety and tried desperately to get her out. finally, on may 24th, after three and a half weeks in gaza, an armored convoy escorted her through to jordan. it was not a moment too soon, she says. there were airstrikes

for los angeles and san diego, we had some patchy fog this morning, but we have cleared out nicely this afternoon across a good portion of the bay area. quick check on some of the current temperatures across the state. it is 63. in eureka, south lake tahoe, 6494 in palm springs, and santa barbara. right now checking in 62 with some patchy fog nearby. back here in the bay area, it is warm out there. santa rosa getting close to 80 degrees. novato. one site is shown 81 san francisco in the mid 60s and san jose 74 degrees. we'll check out the wind reports right now and the winds are not too bad. you can see around eight to around ten miles an hour. these numbers will likely go up into the afternoon hours by mid-afternoon, and sfo and northwest wind at about 14 miles an hour. so this area of low pressure, this was start. this was here to start out. the week, but it's moving on out of town. this area of high pressure is offshore and this translates to a warming trend across the entire bay area. so warmer today, tomorrow, the warmest day of the week. and then we'll
