>> mike, the santa clara county sheriff's office is now handling this case because it involved the transit authority. san jose police were here earlier when the suspect was barricaded, but it now appears that that person has been taken into custody. and right now, it seems that the police are working in this home that's located on willis street. and they told us that just before 4:00, they reopened the street after the suspect was taken into custody, and they don't think anyone else was inside with him. now, earlier this afternoon, deputies told us that they believe an assault happened on the vta platform near the station at the children's discovery museum of san jose, and witnesses called police. two men were involved in an altercation and then the suspect fled the scene. witnesses say they were they actually saw police chasing the suspect on foot at some point, and then the suspect barricaded himself inside of a home. we believe on willis here. now, here's what the sheriff's office told us earlier this afternoon. >> a few passer bys had called

911 to report an active assault that was going on prior to our deputies arrival. the suspect did flee and our victim was still at the location, which our deputies did come in correspondence with, and he was transported to a local hospital. >> now, we don't have any updated information about the victim's injuries, but we do believe that he is still at the local hospital train service near the children's museum has been suspended until further notice. i do believe that they are still investigating there now, so people are being asked to use an alternative route. mike. julie. >> all right. lamonica peters reporting live tonight in san jose. >> thank you. now to that breaking news in san mateo county where a judge has issued a ruling on a request by convicted killer scott peterson to retest certain items of evidence for dna. ktvu crime reporter henry lee live tonight outside the san mateo county superior courthouse. or inside, i should say, there in redwood city with the very latest on this. henry >> yeah. the judge mostly

rejected scott peterson's request to test about 15 pieces of evidence, except for one, peterson will be allowed to test a piece of duct tape that was found on his wife's body after it washed ashore in richmond. but overall, peterson lost his bid to test about a dozen items of evidence he's trying to prove his innocence in the killings of his wife, laci, and their unborn son, as he has in the past. peterson today appeared in san mateo county superior court via zoom from mule creek state prison, where he's serving a life sentence. now, peterson's family, including his sister susan, caudillo sister in law janey peterson, and brother joe peterson, attended the hearing today but did not comment afterward. theudge, elizabeth hill, rejected the defense's request for d testing on a mattress found in a burned out orange van nearhe modesto airport. the defense sa blood was on the mattress, but the prosecution disputes this. the judge did allow person to test a piece of duct tape found on laci's body, but said other pieces of duct tape found in san

fransco bay were not connected to the case. the da says the van fire and other defse theories have nothing to do with the case, and that peterson's attorneys re relying on pure speculatioin crt today. we did hear from an attorney for peterson, as well as one of the original prosecutors in the case . >> in all of my years, i have never had to litigate a dna motion to this extent because dna is just a no brainer. it's very concerning that they are so vehemently opposing dna testing in this case, repeated lie after lie after lie after lie of this defendant during the investigation of all of these different things that dealt with the disappearance of his wife and unborn son. >> so we're not saying, yeah, he's met this particular point because i don't think you can believe what he says. >> plenty of sparring today with the defense accusing the prosecution of being entrenched with its theory that peterson is

guilty and not being open to the truth. the da, meanwhile, saying the defense has all these theories and that it won't stop until the court tells them no. so the next step is to have that piece of duct tape tested live in redwood city, henry lee, ktvu, fox two news, and a lot of cases. >> henry. i mean, when you test dna, it can take months. do you think in this high profile case this is something they may expedite here? >> yeah. as with all issues, mike, they now have to settle on what dna lab to do this testing. what's the time frame? who's going to monitor it? so this is probably going to open up another round of legal sparring. and we'll stay tuned to see how that progresses. >> all right. big news coming out of san mateo county tonight henry. thank you. >> the case of the state of california versus david depape, the man already convicted in federal court of attacking paul pelosi in his san francisco home, got underway in superior court this morning. ktvu is christian. captain was inside the courtroom. he joins us now with the latest on what happened today. christian

>> very big day in court today for david depape. both sides in this case presented their opening arguments. their opening statements to the jury and the prosecution began laying out its case inside department 19. in san francisco's hall of justice. prosecutors and defense attorneys for david depape made their opening statements. prosecutors began by saying paul pelosi awoke to a nightmare on october 28th, 2022, when david depape entered his bedroom. they played the body worn camera footage from the police officers showing depape wrestling the hammer away from paul pelosi before bringing it down on his head. defense attorney randall knox has also served as a prosecutor in san francisco and says that video is a critical piece of evidence he's a 21st century case because here you have the crime recorded on video. >> if this was 30 years ago, you'd have to have police officers describing what they saw. but here it's clear and it's not disputed. >> depapes defense team didn't argue the facts in the case, instead saying he has a mental

illness diagnosis and got caught up in an elaborate conspiracy fantasy and felt he had to act. in essence saying he didn't form the intent to commit the crimes for which he is now standing trial. >> this is more like a attempted murder requires a specific intent to kill, if at the worst it could be attempted voluntary manslaughter. if he did not have the state of mind necessary to intend to kill him with a level of malevolence. >> following opening statements, the prosecution began their case, first playing a recording of paul pelosi calling 911 the night of the attack. prosecutors then called the first officers to respond to the scene to describe what they saw that night, and breaking down the body worn camera footage of the attack. the defense team established that moments before the attack, depape appeared to be calm and didn't immediately present as a threat. and the trial is expected to resume tomorrow morning with medical

experts and police officers ready to take the stand. in all, there were four officers that took the stand today. this case moving at a rather brisk pace. it could be in the jury's hands as early as next week in san francisco. christian captain ktvu, fox two news. >> back to you, christian. thank you. new at five tonight, eight students have been arrested at a middle school in novato. police say the students, who are 12 to 14 years old, launched a targeted attack that sent two students to the hospital. we received cell phone video of what parents say is just the latest violent incident at sinaloa middle school. it happened friday, just after lunchtime. police say this was a planned assault by a group of students targeting a female student. a second student who stepped in to try to stop the fight was also assaulted. the eight students were booked into marin county juvenile hall on conspiracy and felony assault charges. >> the california highway patrol is now releasing the results of its latest maximum enforcement period, chp says thanks to the increased presence of officers

out there on the road over the memorial day weekend, more than 1100 people were arrested for driving under the influence. officers also issued nearly 32,000 citations, the vast majority of those tickets were for speeding. 27 people were killed in crashes across the state, although the maximum enforcement period has ended, chp still reminds people to drive sober, avoid distractions, follow the speed limit, and buckle up. this just in southwest airlines says it has resolved an issue that led to flight delays across the country. the airline says a power outage at a data center in the dallas area caused the problem and apologized for any inconvenience to travelers. we are working to learn more, including how many bay area flights were affected. >> i thought if a cat you got a lot of cats in this area, i talked to my friend and he said, no, it's a mountain lion. >> multiple mountain lion sightings in the city of milpitas. the warning tonight from police plus a jury of 12 will decide the fate of former

california residents can benefit from the technology. ktvu jana katsuyama was there for the summit. she joins us now live from the city with the story. gianna >> julie. the sessions are just now starting to wrap up downstairs, and then they'll be coming here to the rooftop of the commonwealth club, right on the embarcadero for the final reception. this joint summit brought together people from both berkeley, stanford, the state and other areas to really talk about the main issues that are involved in generative ai as it revolutionizes the way that we use computing. governor gavin newsom, thank you so much for being here. the joint california summit on generative ai brought politicians, ai researchers and industry leaders together in san francisco for a frank discussion about the future. governor newsom discussed ways california hopes to harness the power of generative ai and balance innovation with regulatory guardrails. >> i don't want to cede this space to other states or other

countries. so if we overregulate, if we overindulge, if we chase a shiny object, you know, we could put ourselves in a perilous position. >> ai researchers discussed the challenges of ai, misinformation, digital divides, and open versus closed ai systems. >> democracy because of mis and disinformation or labor market shift or bias and privacy, issues. i think these are much more real problems. >> where ai is going is that it'd be, transparent where the data is coming from. >> california based tech company nvidia also participated, i think that's crucial for the development of ai, so that communities feel like that their voice is heard in this conversation. another issue was digital equity. >> we want to enable people in our communities to be able to solve their own problems with ai

, and if it's open, then we help to bridge the digital divide. uc berkeley is building a new computing center that will house ai research, and stanford has a new human-centered ai department . >> but they say they lack the resources that private tech companies have. >> we estimate that it took about 10,000 graphics processing units, gpus to train chatgpt. and yet academia is struggling to obtain these. and for example, a school like stanford is in the low one hundreds. >> organizers say this summit hopes to bring all stakeholders to the table. >> what are we going to do for farm workers? what are we doing for our entertainment industry? what are we doing for our food supplies, and how do we make sure that also this is this is a all boats rise together. >> governor newsom said there are some 20 different bills being proposed around ai

technology. so this is an ongoing conversation that they're having, and they hope summits like this will help them as they try and chart a path forward. julie. >> all right. jana katsuyama reporting live for us tonight in the city. jana. thank you. >> mount lions in two milpitas neighborhoods just this morning. and at least one was caught on camera. ktvu tom vacar as the story at 2 a.m. wednesday, this mountain lion was caught on a security camera in milpitas friendly village mobile home park. >> it popped up on the homeowner's cell phone while he was working and he showed it to a friend. i thought he had a cat because a lot of cats in that area. >> i talked to my friend and he said, no, it's a mountain lion. now while it may be unusual for a lion to come down into a trailer park, the fact is, if you look up here, you'll see that there's plenty of territory for mountain lions to roam. >> not so far away. most residents only heard about it later. >> i've been in this community

in the last 24 years and, it's just really surprising. surprising to find out that there's a mountain lion on the loose because there's a lot of kids out in this community. >> but wait, there's more. >> today, the milpitas police department received two reports of sightings of a mountain lion in the residential areas of milpitas. >> the second sighting was at about 430 in the morning, and the residential area of fair meadow way. >> the second community is about two miles away from the first sighting. it's an easy walk for a mountain lion and well within the time needed to get there, especially since both neighborhoods back up against accessible rail tracks. the double sighting may seem somewhat unusual. consider this 51% of all american households have a security camera, or several, and 37% have a video doorbell that could account for all the sightings and video. >> the homeowners were only aware of the sightings through video surveillance cameras. >> as brief as the sighting was,

it was enough for residents to be concerned about. >> i think, like maybe they come back looking for food or something. >> fact is, roaming house cats as well as raccoons, possums and other urban wildlife can attract apex predators to their locations even in urban neighborhoods. tom vacar, ktvu, fox two news san francisco city leaders are debating whether to spend more resources to examine the growing popularity of a new street drug. >> it's called medetomidine, a synthetic drug used by veterinarians as a tranquilizer and is often combined with other narcotics, including fentanyl and heroin. on the street. now, the city says it has worked hard to reduce the number of deadly overdoses in the city, but worried that this new drug could spark another trend. >> tiktok will have its day in court to try to stop a law that could effectively ban the app in the u.s. an appeals court will hear oral arguments this september. tiktok is challenging a law requiring its china based parent company, bytedance, to sell its u.s. assets by january

19th or be banned. tiktok argues the law is unconstitutional. some tiktok content creators also challenging the law, claiming it violates first amendment rights. it's and we are checking in on the weather. >> it was warmer today by a few degrees. you probably noticed that, especially if you're inland. a little breezy along the coast. where's the fog? right. that's how you get the warming up is when your fog goes away and it has fog is going to stay away for a little while and then it'll come back. i'll show you that in a few minutes. saratoga today. these are preliminary numbers, but 87 degrees, that's pretty nice. i mean, that's pretty warm. brentwood 85. we could hit a 90 tomorrow. i think most temperatures tomorrow will be a degree or two warmer. so yeah, we could get a 90 today. quite frankly. but in the, you know, more inland locations overall though, we're going to warm up as we go into tomorrow, especially in a place like san francisco or oakland, where you'll get an easily into the mid 60s. the trend then is that for tomorrow to be the warmest day of the week, i don't know if it's going to be quite that much

warmer. like it's not like it's not scaled. right. but but it will be the warmest day of the week. i mean, not scale, right? right if you're 86 here and that's a big bump. but anyway, thursday is your warmest day and then temperatures trend down. and this correlates with some fog showing up. and that comes back which is what should be happening at this time of year. and we got to look at the same show we had last night. it's beautiful. and you looking out towards marin headlands and you can see you can't really see i think that's duxbury reef, believe it or not. yeah. so that's bolinas. that's how clear it is. that's duxbury. i did my senior thesis on duxbury reef about a bolinas. and then stenson is right in here. and then in here is mira. and then in here is rodeo beach. so it's beautiful marin headlands, which are as they looked many years ago, hasn't changed much out there. when i come back, we'll do a full forecast and we'll take a peek at when things well, we know they're going to warm up tomorrow and be the warmest day of the week, but then as things trend down with that fog, we'll let you know how that times out. all right. >> sounds good bill. thank you.

chp says a truck carrying about 40,000 pounds of strawberries tipped over while taking the ramp from northbound 101 to 880. it happened around 3 a.m. and it took crews several hours to clean up the mess. no injuries were reported in san francisco. >> a $4.6 million federal grant from the government will help muni repair its platforms all across the city, the agency

wednesday, the white house announced it's official the pandas are coming back to dc. giant pandas have been a fixture in the nation's capital for more than 50 years, with the first of many coming to the u.s. after president nixon's historic 1972 visit to china. then last november, dc went panda free when tian chen and mae xiang and their cub left for china. one of the new pandas, bo li, is actually the grandson of tian tian and may xiang, and may be something more as part of the symbol of the friendship of us and china, because currently the us china still has a tension, but that the pandas returning back to the capital means that we still have friendship. the pandas returned will be a welcome sight for the nearly 2 million people who visit the national zoo. each year. millions more can watch them on the panda cam, but the main reason for bringing them back is preservation. the pandas arrival is not just an exciting event, but it is proof positive of the

cases at issue two past incidents in which an upside down flag, an appeal to heaven flag were flown at alito's home. the same flags were carried by january sixth rioters. but today alito sent letters to members of congress saying the flags were put up by his wife and that the incidents do not warrant his recusal. >> the us supreme court will hear a case involving water pollution regulations for san francisco. the city is at odds with the environmental protection agency. the epa accuses san francisco of violating the clean water act by allowing dangerous contaminants to flow through its oceanside water pollution control plan and into the pacific. san francisco says the regulations are too generic and exposes the city to fines and lawsuits. officials say the epa should just announce how much the city needs to control its discharges and comply with the clean water act. >> happening now. all classes at uc santa cruz will be online through at least tomorrow because of a campus strike. that strike is now a week old.

yesterday, protesters blocked the entrances to campus, filling the streets with tents and dumping rocks. debris and paint onto the pavement. union academic workers say they're upset about how university leaders have responded to pro-palestinian protests. the strike has spread to other uc campuses as well. an estimated 12,000 union employees are walking the picket lines at uc santa cruz, uc davis and ucla. the war in gaza has displaced nearly 2 million people since it began that, according to a special envoy to the united nations who emphasized the urgent need for all sides to change course, he said many of the nearly 2 million palestinians displaced from their homes have had to move multiple times, and some 100,000 israelis have been displaced from communities in israel's north and south. >> palestinians in gaza face another round of mass displacement, with 1 million fleeing from rafah. many being displaced multiple times. overcrowded conditions and acute shortage of food, water and medicine have led to misery and

spread of diseases. >> the un special coordinator also condemned this weekend's israeli attack that killed dozens of people at a camp in rafah, calling it, quote, appalling. >> and the biden administration says sunday's airstrike on that tent city in rafah did not cross any lines for the us, but is issuing a warning about any ground operations into the city. israeli officials say they won't stop their offensive until they root out all remaining hamas fighters dug into rafah. the white house says it is keeping close watch on the israeli ground operation. >> the president said that should that occur, then it might make him have to make different decisions in terms of support. we haven't seen that happen at this point. >> relief agencies are also having a more difficult time getting supplies to displaced palestinians in gaza. a temporary floating pier built by the us to transfer food, water and aid supplies is out of commission after being damaged by rough seas. the pentagon says the rebuilding and repairing of

exploded, killing at least one person and injuring seven others. you can see how strong the blast was, scattering debris all the way to the other side of the street. police say they believe the body recovered by firefighters is a bank employee. the other victims are in the hospital, one in critical condition. investigators also say this was a natural gas explosion. >> so, as far as we know right now, everyone one is accounted for. they got in the building,

even though the building was unsafe, unsecure. they got in there. they went room by room, floor by floor to ensure that everybody was out of that building. and they did it twice. >> the mayor says the ohio state fire marshal is taking over the investigation. officials also say there is no evidence of any suspicious activity leading up to the blast. >> nissan is warning owners of some older, unrepaired models not to drive them as their airbag inflators may be at a greater risk of exploding during a crash. nissan says about 84,000 vehicles may still be on the road in the u.s. that have not had their takata airbag inflators replaced. the urgent request comes after one person in a nissan was killed by an exploding inflator, which fragments. dozens of injuries have been linked over the past decade. nissan says owners should contact their dealer to set up an appointment to have inflators replaced for free. the city of oakland is encouraging kia and hyundai owners to take advantage of a new settlement

bear cub that snuck into his home, the department of fish and wildlife did investigate the shooting and says his actions were justified, but reporter leanne denyer tells us neighbors are still upset. >> the bear league says this is the young bear shot and killed in a residential neighborhood of south lake tahoe on monday. >> i feel bad for the bear. they don't usually get into those situations. >> fish and wildlife completed its investigation into the shooting tuesday. a spokesperson for fish and wildlife tells us they got the call monday afternoon, saying that a homeowner at a home off of

so for tomorrow, tomorrow will be the warmest day of the week. air quality is not too bad on this pattern. okay. yeah, there we are. i'm just checking where we are. we're kind of san jose. i think this is mission peak. looking back towards san jose. and then that would be downtown san jose. there and vollmer peak right there. we actually i don't know if that's warmer. yeah i think it is. you can see it. we have our doppler radar installation up there on vollmer out of santa cruz, which is basically the bay area doppler radar up on the mountain there. so the warmest day is going to be thursday. at least that is the plan. friday will cool down a little bit, saturday will cool down a bit. and the reason for that cooling will be the fog and low clouds come back. so when they leave like they are now or did now or did today, the fog is basically been. you can see it actually been chewed out by those north winds. right. but it's down in southern california. you see the clear along the coast. and of course, boom, that's not that's the beginning of a warm up. certainly when the fog leaves the it is and it is warming up and the temperatures today indicating that warmer you

didn't like, for instance, like not much of a sea breeze, right. you see, this green in the last few days has been, well, protruded inland, and it's not so ten degrees warmer in livermore. 11 degrees warmer in san carlos, eight degrees warmer at sfo. breezy, too. not so much north bay. i mean, it's breezy up there, but check out sfo. i was looking at it a few minutes ago, 33 miles an hour on the gusts. so that's pretty breezy. sustained at 2828 miles an hour, gusting in san jose, 17 miles an hour in mountain view. so it's kind of breezy. so and that's that north wind or north kind of north northwest. so a little bit of fog tomorrow morning and then goes away. tomorrow is the warmest day of the week. little bit of fog comes back into santa cruz on seven eight on friday morning and then kind of starts to fill in friday afternoon and then boom, the big cooldown is on saturday when the fog comes back. so what's happens tomorrow is warmest day and then temperatures trend down. subtle stuff though none of this is earth shattering at all. it's a good, good pattern for us. really because we're not we're not bumped up against really nasty fire danger. although it
