during the investigation, the judge's ruling to retest one item of evidence has got some legal analysts by surprise. >> good evening everyone. >> i'm mike mibach and i'm julie julie haener peterson's new team of lawyers now attempting to overturn his conviction 20 years ago of killing his wife and their unborn son. our crime reporter henry lee was inside the courtroom and has today's developments overall. >> scott peterson lost his bid to have items of evidence retested to help clear his innocence in the killings of his wife, laci and her unborn son, as he has in the past. peterson appeared in san mateo county superior court via zoom from mule creek state prison, where he's serving a life sentence. peterson's family, including his sister susan claudio, sister in law janey peterson, and brother joe peterson, attended the hearing, but did not comment afterward. the judge, elizabeth hill, rejected the defense's request for dna testing on a mattress found in a burned out van near the modesto airport. the defense says blood was on the mattress, but the prosecution disputes this. the

judge did allow peterson to test a piece of duct tape found on laci's body, but said other pieces of duct tape found in san francisco bay were not connected to the case. the da says the van fire and other defense theories have nothing to do with the case, and that peterson's attorneys were relying on pure speculation in court. we heard from an attorney for peterson, as well as one of the original prosecutors in the case. >> in all of my years, i have never had to litigate a dna motion to this extent, because dna is just a no brainer. it's very concerning that they are so vehemently opposing dna testing in this case, repeated lie after lie after lie after lie of this defendant during the investigation of all of these different things that dealt with the disappearance of his wife and unborn son. >> so we're not saying, yeah, he's met this particular point because i don't think you can believe what he says. >> plenty of sparring with the da, accusing the defense of all

these theories, saying this won't stop until the court tells them no, and the defense saying the da is entrenched with their belief that peterson is guilty not being open to the truth. next step is having that duct tape piece tested in redwood city. henry lee ktvu, fox two news. >> the state trial against david depape began today. depape was convicted in federal court of attacking paul pelosi and was sentenced to 30 years in prison. and as ktvu christian captain reports tonight, depapes attorneys are arguing he is now facing double jeopardy. >> inside department 19, in san francisco's hall of justice, prosecutors and defense attorneys for david depape made their opening statements, as prosecutors said paul pelosi awoke to a nightmare on october 28th, 2022, when depape entered his bedroom. prosecutors played the body worn camera footage showing depape bringing the hammer crashing down on a paul pelosi's head. defense attorney randall knox has also served as a prosecutor and sat in to observe opening statements. he says that video is a critical piece of evidence.

>> he's a 21st century case because here you have the crime recorded on video. so if this was 30 years ago, you'd have to have police officers describing what they saw. but here it's clear and it's not disputed. >> depapes defense team didn't argue the facts in the case, instead saying he has a mental illness diagnosis and got caught up in an elaborate conspiracy fantasy and felt he had to act, in essence saying he didn't form the intent to commit the crimes for which he is now standing. trial >> this is more like a attempted murder requires a specific intent to kill. if at the worst it could be attempted voluntary manslaughter, if he did not have the state of mind necessary to intend to kill him with a level of malevolence. >> following opening statements, the prosecution began their case , first playing a recording of paul pelosi calling 911 the night of the attack. prosecutors then called the first officers to respond to the scene to describe what they saw that

night, and to break down the body worn camera footage of the attack. the defense team established that moments before the attack, depape appeared to be calm and didn't immediately present as a threat. the trial is set to resume tomorrow morning, with medical experts set to take the stand and the trial is moving at a brisk pace and could be in the jury's hands as early as next week in san francisco, christien kafton ktvu fox two news. >> now to developing news out of san jose, where a suspect is now in custody after an assault led to a standoff with police. police say the man who has been arrested assaulted another man at the children's discovery museum vta light rail station, before running off. witnesses say officers ran after the suspect, who then barricaded himself inside a home on ozeray avenue. >> a few passer bys had called 911 to report an active assault that was going on prior to our deputies arrival. the suspect did flee and our victim was still at the location, which our deputies did come in

correspondence with, and he was transported to a local hospital. >> the victim is still in the hospital, but the severity of his injuries is unclear. are unclear. police are still asking people to avoid that area and train service through the children's museum station is suspended until further notice. >> now to oakland, where police are investigating a shoing that left one man dead. opd says this happened around last ght, 7:00 foothill boulevard. this was right near talbert avenue and 106th avenue, just west of 580. video from the citizen app shows police officers responding to the scene. officers say they found a man with gunshot wounds. he was later pronounced dead at a hospital. a second man arrived at a hospital, also with gunshot wounds. investigators determined the second man was indeed involved in the shooting, but it's unclear how at this time, no word of any motive or any arrests in the south bay, deputies were engaged in an hour long standoff while trying to execute a search warrant. in a

man forced me to use this happening outside a home on snow drive, just a few blocks away from an elementary school. the santa clara county sheriff's office says there was no threat to the public. >> eight students have been arrested at a middle school in novato. police say the students are 12 to 14 years old. they reportedly launched a targeted attack that sent two other students to the hospital. we received cell phone video of what parents say is just the latest violent incident at sinaloa middle school. it happened friday, just after lunchtime. police say this was a planned assault by a group of students targeting a female student. a second student who stepped in to try to stop the fight was also assaulted. the eight students were booked into marin county juvenile hall on conspiracy and felony assault charges. >> busy thoroughfare through san francisco partially closing through the daytime hours this week, 19th avenue is getting some major road repairs, and it's causing traffic to slow a bit through the area. ktvu is crystal bailey joins us live tonight from the city where the

work is being done on a always pretty busy 19th avenue there, crystal. >> yeah, that's right on 18th avenue is one of the busiest streets running through san francisco, and it's riddled with potholes. earlier today, you could see there were still divots and bumps, but now it's been replaced by some black pavement there. that is fresh pavement there. and neighbors here in the area are excited to see that this is coming here. if you're traveling on 19th avenue this week, you may notice the dump trucks. caltrans is closing two lanes of northbound 19th avenue from sloat to taraval on wednesday and thursday from nine in the morning to three in the afternoon, one lane remaining open to traffic and all lanes reopening each day in time for the afternoon commute. caltrans says. the road, which turns into highway one, is owned by the state and has severe potholes. >> a lot of the traffic noise is from cars going over bumpy surfaces. >> it hits you a lot more on the motorcycle than would on cars.

celebrating the one year milestone of its drug market agency coordination center. since its launch in may 2023, the multi agency crackdown on open air drug markets has resulted in more than 3000 arrests and the seizure of 200 kilos of narcotics. data from the dma, cc shows fentanyl, methamphetamine, cocaine and heroin were seized in the highest volumes. the force also arrested more than a thousand drug dealers. >> tenants of an east oakland apartment building who were left without power for a month are now suing their landlord. the building, located on 26th avenue, lost power in january after an electrical fire in the basement. nearly 100 tenants say they went without power or hot water for nearly a month. they say the landlord and the building management company, selborne properties, has yet to reimburse them for thousands of dollars in out of pocket expenses due to lack of electricity and heat, including food, medicine, clothing, blankets and hotel stays. >> this is unacceptable in a city like oakland. no tenant, no

of throwing him to the ground in retaliation for filming him on video. gus's attorney provided us with this video. gus says he was standing at a smoke shop on mcdonald avenue in richmond on the night of sunday, may 5th, when he saw a high speed police chase. that's when he said he decided to start recording with his phone. gus accuses a police sergeant of approaching him, tackling him and then taking him into custody. stand by for, by the way, so. >> what was that? get out of the way. >> gus says he was arrested for obstruction of justice and resisting arrest. he was released from jail after an hour , but had injuries to his face and wrist. >> of course, man, it was it was scary because they telling you to stop doing stuff and they not giving any type of orders, you

know what i mean? and they keep on putting force putting force, force, force on me. >> the reason why this case is so troubling is that this was a cop who was out of control, who in many ways is a throwback to an old period of time that i thought we had resolved. where a cop can disrespect a community and the members of the community just because of who they were. >> he said his junior officer, gus complaint alleges violation of freedom of speech, assault and battery, false imprisonment and other civil rights violations. >> we have reached out to richmond police but have not yet heard a response. >> jury deliberations underway in the criminal trial against former president donald trump. but even with the jury asking for a couple of follow up questions, a verdict could come as early as tomorrow. fox's connor hansen joins us live tonight outside the courthouse. there in manhattan. and connor, that jury, they deliberated, what, about 4 or 5 hours today? >> yeah that's right mike, obviously getting a little bit of a bout of rain here now into the evening. but that jury was

dismissed around 4:00 new york time after their first half day of deliberations. already asking some questions, sending notes to the judge, asking to hear more about some of that key testimony from witnesses like michael cohen and david pecker about that meeting in trump tower. also asking the judge to hear some of those jury instructions again after hearing them for the first time this morning, after listening to more than a month of witness testimony and a marathon session tuesday of closing arguments, a jury of 12 will determine donald trump's fate. >> mother teresa could not beat these charges. these charges are rigged. the whole thing is rigged. >> prosecutors allege he was part of a business scheme to cover up hush money payments made to adult film star stormy daniels, to silence her claims of an affair before the 2016 election. >> i think that the prosecutors really failed up until closing argument to explain to the jury

what the actual crime here was and introduce the evidence they needed to prove it. >> the jury must be unanimous for any guilty verdict, whether it's all 34 felony charges or just some as they deliberate, the seven men and five women can ask follow up questions on handwritten notes. trump denies any wrongdoing, but if found guilty, he could always appeal. >> i think the far likelier outcome in the event of a conviction is either a sentence of probation, potentially home confinement. >> and if the jury does find trump guilty, it will be up to judge juan merchan alone to decide on what the sentence is. but obviously this could be an acquittal or a hung jury if those jurors can't all agree. mike connor hanson live tonight there in manhattan. >> connor. thank you. >> supreme court justice samuel alito is refusing to step aside from cases involving donald

trump and january sixth defendants. alito has faced calls for him to recuse himself after an upside down flag was spotted flying over his home in virginia in 2021, as well as an appeal to heaven flag at his home in new jersey last year. critics have pointed out that january 6th participants also flew upside down american flags, and the appeal to heaven flag, which has come to symbolize sympathies with the christian nationalist movement. alito said it was his wife who flew those flags and that he is, quote, not fond of flying flags. the appeal to heaven flag has been taken down outside san francisco city hall. the san francisco recreation and parks department says the flag was one of 18 initially raised on flag day in 1964, in civic center. each flag represented a key symbol in american history. the parks department says the appeal to heaven flag has been adopted by a group that doesn't represent the city's values, and american flag has been put up in its place. >> all right. it was a little

warmer today than yesterday. very noticeable. no fog at the coast, warmer day temperatures and some of the inland valleys. well, here they are. you got a 90 degree reading out in fairfield. so that's clearly the hot spot, especially when you get into fairfield. you're just just touching the central valley , which makes sense because you're seeing low 90s up in sacramento around the bay, temperatures mid upper 80s. that's how it is again tomorrow. another nice day tomorrow. it's going to be a little maybe a little warmer at the coast tomorrow. and then fog should return. and to some extent tomorrow night and into friday morning. so it looks like fog out there. but it's not. that's like a salt haze. you ever notice that? like when you when it gets warm and the sea surface temperatures are cool, the water evaporates. right. and so it leaves. and when the water evaporates out you sort of distill it down and you just get this, this particulate, this salt particulate, which is what fog or what moisture forms on to make fog. and what you're seeing there is the evaporated particles with not enough moisture to produce fog, if that makes sense. okay. so but there

>> palestinians in gaza face another round of mass displacement, with 1 million fleeing from rafah, many being displaced multiple times. overcrowded conditions and acute shortage of food, water and medicine have led to misery and spread of diseases. >> the un special coordinator also condemned this past weekend's israeli attack that killed dozens of people at a camp in rafah, calling it, quote, appalling. >> the white house is standing by its closest ally in the middle east, israel. despite heavy criticism over the country's ongoing offensive in gaza's southernmost city, rafah. and as fox news caroline shively reports now from washington, america's efforts to get humanitarian aid to palestinians in need also hit a major setback , with israeli strikes on two tent encampments in southern gaza have killed dozens of palestinians this week, including 21 on tuesday as israeli forces pushed deeper into the city of rafah. >> the biden administration says

a sunday night strike on rafah tent city that killed 45 did not cross any red lines for the us, but had this warning about any ground operations into the city. the president said that that should that occur, then it might make him have to make different decisions in terms of support, we haven't seen that happen at this point. israeli officials say they can't stop until they root out. all remaining hamas fighters dug into rafah. but relief agencies report the fighting has made it nearly impossible to provide aid there. and united nations officials warn displaced palestinians are on the brink of starvation. >> it must enter rafah on a massive scale through as many crossing points as possible. >> now a temporary floating pier built by the us to transfer food, water and aid supplies into gaza is out of commission after being damaged by rough seas. >> the rebuilding and repairing of the pier will take at least over a week and will and following completion, will need to be re anchored to the coast of gaza. israel's national security adviser said wednesday

the santa clara county sheriff's office says the suspect barricaded himself inside a home after running from the scene. he was arrested after a standoff with police. >> a judge in san mateo county has rejected all but one of scott peterson's requests for dna testing on certain pieces of evidence. peterson is currently represented by the los angeles innocence project and is attempting to overturn his conviction of killing his wife and their unborn son. the judge granted his request to retest a piece of duct tape found on laci peterson's body. peterson is serving a life sentence without the possibility of parole, and the man sentenced to 30 years in federal prison for attacking nancy pelosi's husband with a

solve their own problems with ai. and if it's open, then we help to bridge the digital divide. >> uc berkeley is building a new computing center that will house ai research, and stanford has a new human-centered ai department . but they say they lack the resources that private tech companies have. >> we estimate that it took about 10,000 graphics processing units, gpus to train chatgpt. and yet academia is struggling to obtain these. and for example, a school like stanford is in the low one hundreds. >> organizers say this summit hopes to bring all stakeholders to the table. >> what are we going to do for farm workers? what are we doing for our entertainment industry? what are we doing for our food supplies, and how do we make sure that also this is this is a all boats rise together. >> the national science foundation has started a pilot project to share ai infrastructure, something which many of these universities say

could go a long way to helping them catch up on ai innovation in san francisco. jana katsuyama, ktvu, fox two news. >> salesforce shares have tumbled in after hours trading after the company reduced its revenue outlook. the san francisco cloud based software company reported earnings today and missed wall street's expectations for the first time in nearly 18 years. salesforce says it expects revenue to be up in the current quarter by about $9.2 billion, which is $135 million less than analysts were expecting. now, despite softer demand for its product last quarter, the company raised its earnings forecast for the next fiscal year after market trading was down 16. overall, the market's finished lower as higher yields in the bond market and sluggish earnings from american airlines and oil companies dragged the indexes lower. the dow taking the biggest hit of the big three, down more than 400 points, or 1. the nasdaq dropped 99 and the s&p was also in the red.

>> san francisco's municipal transportation agency will get millions of dollars from the federal government to fix some of its muni platforms. ktvu sally rasmus shows us how that money will be used at the muni light rail stop on church and market. >> the platform isn't level with the street. to get on board a rail car, you have to walk up the steps or use a ramp. christine lawrence says she's seen some of her friends and fellow riders in wheelchairs struggle here. >> the ramps or, you know, even getting to the ramps. or as we can see here, there's a bike lane and then trying to drive a wheelchair across the bike lane. and if there's a lot of bikes, who has the right of way? >> now sfmta is getting a $4.6 million grant from the us department of transportation to make some changes. the goal to make muni platforms like this more accessible for people with mobility challenges. >> what this will allow us to do is construct platforms and a wheelchair boarding islands. >> the federal money will help

pay for things like better ramps and signs at several light rail stops. other improvements include making sure the gap between the platform and the rail car is more narrow, so it's easier for people with a wheelchair or a cane to get on board. >> say that you use a walker that little tip thing like, what did they get stuck in the middle? i'm legally blind and i'm using mobility. can >> ali choo is a longtime senior and disability rights advocate that benefits so many people, including mothers. >> use stroller, including older people who use those shopping cart things, including so many people, including people who injured their leg. and they have to get on crutches sometimes. so we have to really take that into consideration. >> this is a priority for us. we're really excited to hit the ground running. >> sfmta says construction has already begun at some of the muni stops slated for upgrades. five stops are on the j church line, three on the m ocean view line. the work is expected to be complete in the next two years. >> it will make a difference. we

korean tv shows into north korea. although no immediate damage has been caused by the balloons, the south korean military is advising citizens to not touch them. the white house announced today that giant pandas are returning to the national zoo in washington, dc. giant pandas were at the zoo for more than 50 years, but the capital lost their pandas last november when tintin and missing and their cub left for china. now, two pandas are set to join the national zoo. one of them, a two year old, is actually the grandson of the pandas that left back in november. the new pair represents successful diplomacy with china, but also optimistic preservation efforts. >> the pandas arrival is not just an exciting event, but it is proof positive of the success of our giant panda program. you have a very short window of reading, and you know, it's a game of trying to figure out when the right time is to put them together and if they will successfully breed naturally, which we hope this pair will for

security purposes, the exact date of the pandas arrival has not been released, but they are expected before the end of the year. >> well, people in part of iceland are seeing their fifth volcanic eruption since december, as fox's alex hogan reports tonight, the lava once again threatening a nearby neighborhood. >> another state of emergency in southwestern iceland after a major volcanic eruption. >> the area's fifth in the last six months. it started early wednesday afternoon when a one and a half mile long fissure opened up. it's part of the same volcanic system that forced the evacuation of the coastal town grindavik, about 30 miles south of iceland's capital, in november, the lava was seen shooting into the air, leading the popular blue lagoon geothermal spa to evacuate its facilities. >> fountain activity is usually most powerful. in the beginning it abates very slowly and maybe in the next 24 hours, the most of these lava fountains would be, lower.

that's a much cooler pattern. those are systems to the north. and as those systems go by right on on especially on friday saturday and sunday they start to cool us off. and that's that's where we are. and that's what the five day forecast will reflect. when we get to it. that cooling condition occurring on friday, saturday and into sunday. but there's the actual it's not a model. it's actually the satellite image. these are the current temperatures. and you can see the seabreeze is not very not very effective right now in terms of how far it's getting inland to cool tomorrow is going to be the same way. tomorrow is a carbon copy of today, essentially. maybe a little bit warmer on at the coast and around the bay. i think inland may be peaked have been will be about the same, but warmer today by a good five six degrees in many places. breezy, not out of control wind, but breezy. sfo is blowing pretty hard earlier. up to gusts to 35, but right now it's sustained winds at 23. the model tries to bring a little bit of fog back thursday morning. and then it goes away thursday afternoon.

and then friday morning more fog. and then you see how things start to see the ship. kind of everything starts to push this way. and now that's the cooling into saturday and into sunday. so and it's subtle stuff but it's you know, it's kind of classic spring pattern and in summer pattern too, except for the fact that fog is not really happening. i mean, this is a time of year where you expect just a robust fog bank, right? that's just really intact. and this one is not right now. here's the five day forecast. and you can see the cooler and breezy on saturday. on saturday most certainly. and that's going to drop a good 8 to 10 degrees from where we will be tomorrow which will be the warmest day of the week. and then next week it looks like it wants to warm up again. next week has a potential to be be pretty warm, and i think next week's going to be the first week that we sort of start talking more seriously and more concerned, lee, about the fire danger, because we're going to have this week to get the fuel moistures down, and then next week, if it heats up, fuel
