peterson's bid for a new trial continues in san mateo county. the judge's decision on a request for new dna testing. >> this is ktvu, fox two news at 730. >> good evening. thanks for joining me, i'm greg lee. today, a judge rejected most of scott peterson's request to retest certain pieces of evidence, except for a piece of duct tape. peterson's new team of lawyers is trying to overturn his conviction 20 years ago of killing his wife and their unborn son. the judge is allowing a piece of duct tape found on laci peterson's body to be dna tested, but said other pieces of tape found in the san francisco bay were not connected to the case, and neither was a mattress found in a burned out van near the modesto airport, which peterson's team from the la innocence project also want to test. it >> in all of my years, i have never had to litigate a dna motion to this extent because dna is just a no brainer. it's very concerning that they are so

vehemently opposing dna testing in this case, repeated lie after lie after lie after lie of this defendant during the investigation of all of these different things that dealt with the disappearance of his wife and unborn son. >> so we're not saying, yeah, he's met this particular point because i don't think you can believe what he says. >> as he has in the past. peterson appeared in san mateo county superior court via zoom from mule creek state prison, where he's serving a life sentence. our legal analyst, michael cardoza, questions the efforts to deny the dna testing of potential pieces of evidence. >> we convicted him. we had the circumstantial evidence that said, why are we doing this? well, why are you not giving the dna up? if you're so positive about this, let them test it. >> cardoza says dna technology has come a long way since peterson was convicted. a

hearing has been scheduled for july, in part to address who will pay for the dna testing. the man convicted in federal court of attacking paul pelosi returned to court today in san francisco for a state trial on the same case. david depape was sentenced to 30 years in prison for attacking nancy pelosi's husband with a hammer in october 2022. the attack caught on police body cam and shared today in court. depapes defense team is not arguing against the facts of the case, but are instead arguing depape has a mental illness that caused him to get caught up in an elaborate conspiracy. >> so this is more like attempted murder requires a specific intent to kill, if at the worst it could be attempted. voluntary manslaughter, if he did not have the state of mind necessary to intend to kill him with with a level of malevolence . >> medical experts are set to take the stand tomorrow. the

fast paced trial could produce a verdict as early as next week. new at 732, brothers have been charged in connection to drug trafficking in the tenderloin. 36 year-old jose ramos orozco and 33 year-old jonathan ramos orozco from oakland, were arraigned today. they pleaded not guilty to all charges. san francisco police seized more than 18 pounds of drugs from the men when they were arrested last thursday, including fentanyl, methamphetamine and heroin. officers say they also found more than 17 pounds of drugs at their oakland homes. both of them face multiple felony charges of drug possession for sale. the san francisco mayor's office is celebrating the one year milestone of its drug market agency coordination center. since its launch in may 2023, the multi agency crackdown on open air drug markets has resulted in more than 3000 arrests, and the seizure of 200 kilos of narcotics. data from the dmcc shows fentanyl, methamphetamine, cocaine and heroin were seized in the

highest volumes. the group also arrested more than 1000 drug dealers. santa clara county sheriff's deputies arrested a man in san jose after he allegedly assaulted a man on a vta platform. this afternoon. authorities say this started around 1:00 this afternoon at the children's discovery museum. vta light rail station, where witnesses called 911. the male suspect ran off, then barricaded himself in a house nearby. authorities are still investigating the exact timeline of what led to today's assault. >> so we're currently gathering some information. we're not too sure right now, but it does seem that it may have occurred on the platform. start it there, and may potentially have went on into the street area. >> the victim is still in the hospital. the severity of his injuries remains unclear. police are asking the public to avoid that area. at this time. a man has filed a lawsuit against the richmond police department accusing a police sergeant of throwing him to the ground in retaliation for filming him on video. kwesi, gus's attorney,

provided us with this video. gus says he was standing at a smoke shop on mcdonald avenue in richmond on the night of sunday, may 5th, when he saw high speed police chase. that's when he said he decided to start recording with his phone. gus accuses a police sergeant of approaching him, tackling him and taking him into custody. >> standby. standby away. so sir, what was that? get out of the way. you're >> gus says he was arrested for obstruction of justice and resisting arrest. he was released from jail after one hour, but had injuries to his face and wrist force. >> man, it was it was scary because. cause they telling you to stop doing stuff and they not giving any type of orders, you know what i mean? and they keep on putting force putting force, force, force on me. >> the reason why this case is so troubling is that this was a cop who was out of control, who in many ways, is a throwback to an old period of time that i

thought we had resolved. where a cop can disrespect a community and the members of the community just because of who they were, he said. >> the junior officer, richmond police, say gus was arrested for obstructing a peace officer. the department says the officer involved has been reassigned to an administrative position while they investigate the incident. they continued, quote, the incident is currently under investigation to ensure that all actions taken were consistent with department policies and procedures. we are committed to maintaining transparency throughout this process. a busy thoroughfare through san francisco will partially close through daytime hours this week. 19th avenue is getting some major road repairs and it's causing traffic to slow a bit through the area. ktvu crystal bailey brings us a look at the work being done well. >> 19th avenue is one of the busiest streets in san francisco, but it's riddled with potholes. and where there used to be divots and bumps, now you can see fresh black pavement, something neighbors here are very glad to see. if you're

traveling on 19th avenue this week, you may notice the dump trucks, caltrans is closing two lanes of northbound 19th avenue from sloat to taraval on wednesday and thursday, from nine in the morning to three in the afternoon. one lane remaining open to traffic and all lanes reopening each day in time for the afternoon commute. caltrans says. the road, which turns into highway one, is owned by the state and has severe potholes. >> a lot of the traffic noise is from cars going over bumpy surfaces. >> i had to do a lot more on the motorcycle than would on cars. >> it's allowed inconvenience this week. >> we usually cross over here, but we can't really go over there. we have to go around and wait for lights to change and it's not fun. >> but most neighbors say it's long overdue. >> we have been waiting for years for this to happen. >> a couple of weeks of discomfort will drastically improve the pace of people coming through the area. >> this all follows a two year joint city and state project

completed last year to replace aging utility infrastructure and update traffic lights for pedestrian safety. >> once this has been paved, everything settles down. it's going to be a boon for the neighborhood, caltrans says. >> this part of the project will finish on thursday, with one more day in june to complete. striping the repaving of 19th ave will extend from golden gate park, all the way to san francisco state university. that work is set to take place next spring in san francisco. crystal bailey, ktvu, fox two news. >> new at 732, congressional republicans are pressing the u.s. department of transportation on federal funding approved for california's high speed rail project in december. president biden approved $3 billion for the long delayed rail system. congressman sam graves and senator ted cruz write that they're concerned the biden administration will keep funding the project despite indications there was, quote, no reasonable path forward for successful completion. they are asking for documents detailing the decision

carr spoke to surprised neighbors. >> at 2 a.m. wednesday, this mountain lion was caught on a security camera in milpitas friendly village mobile home park. it popped up on the homeowner's cell phone while he was working, and he showed it to a friend. >> i thought it a cat because a lot of cats in this area. i talked to my friend and he said no, it's a mountain lion. >> now, while it may be unusual for a lion to come down into a trailer park, the fact is if you look up here, you'll see that there's plenty of territory for mountain lions to roam. not so far away, most residents only heard about it later. >> i've been in this community in the last 24 years, and, it's just really surprising. surprising to find out that there's a mountain lion on the loose because there's a lot of kids out in this community. >> but wait, there's more. >> today, the milpitas police

department received two reports of sightings of a mountain lion in the residential areas of milpitas. the second sighting was at about 430 in the morning, and the residential area of fair meadow way. >> the second community is about two miles away from the first sighting. it's an easy walk for a mountain lion and well within the time needed to get there, especially since both neighborhoods back up against accessible rail tracks. the double sighting may seem somewhat unusual. consider this 51% of all american households have a security camera, or several, and 37% have a video doorbell that could account for all the sightings and video. >> the homeowners were only aware of the sightings through video surveillance cameras as brief as the sighting. >> was it was enough for residents to be concerned about. >> i think, like maybe they come back, they're looking for food or something. >> fact is, roaming house cats as well as raccoons, possums and other urban wildlife can attract

apex predators to their locations even in urban neighborhoods. tom vacar, ktvu, fox two news. >> all right, let's talk about our bay area weather with meteorologist mark tamayo. mark, i left the house today, was basking in sunshine. a regular summer day around here. >> leave the sweaters. the jacket at home. right. you want to dress in layers? yeah. it's a beautiful day today. and tomorrow could be a little bit warmer. oh, wow. there you go. some more 90s coming up for tomorrow. so. yeah. take a look at the highs from this afternoon. as you can see, some 70s and some 80s and even a few spots right around 90 degrees out toward fairfield, even san francisco. nice day at 70 degrees in santa rosa in the upper 80s. so it's kind of a three day stretch. it started today. it will continue into tomorrow and essentially into friday, but we will begin to trim back on those temperatures by friday. and that will set the stage for a cooler weekend as we start off, as we head, as we head into saturday. now, the satellite picking up on the low clouds and fog, mainly to the south of the bay area down towards southern california. we are in the clear for right now,

and it is still a mild evening out there for the 7:00 hour. right now it is 83 degrees in santa rosa, san francisco, 62, san jose. that looks nice at 75 and livermore in the upper 70s as we show you the wind reports, the winds have been picking up a bit. that onshore breeze strengthening this afternoon. and right now oakland airport westerly breeze at about 12 miles an hour. sfo a bit stronger at 25 and half moon bay gusting to 26 miles an hour. here is our live camera picking up a little bit of some haze, as you can see, but still, for the most part, mostly clear skies. we will bring in partly cloudy conditions overnight. some patchy fog returns and lots of 50s to start things off for your thursday morning. so here's kind of the breakdown tomorrow morning and then into the afternoon hours. these brighter colors do represent some warming temperatures. so as you can see, the eventual temperature range will be for the mid 60s. coast side the warmest locations inland back up into the upper 80s to right around 90 degrees. this area of low pressure this cool just off earlier in the

week, but this area of high pressure has been strengthening offshore. so as a result, we warmed up today. tomorrow still fairly hot for your thursday. and then on friday we begin to trim back on those temperatures. but still a warm day, especially inland and then more cooling by the weekend. take a look at the forecast highs for your thursday afternoon. san francisco 71, santa rosa 90 degrees. some more 90s for tomorrow and san jose at 86. so tomorrow about the same as today or a little bit warmer. it is still warm inland. on friday we trim back on those temperatures. this weekend. we bring in some more fog and some breezy conditions into the weekend, and maybe by monday we could be trending. some tracking, some warmer temperatures as we head into next week. so warming up in the short term and then definitely cooling things off as we head toward the weekend. >> all right. looks good mark. thank you. california highway patrol's latest enforcement period, yielding significant results will break down the numbers from memorial day weekend and yellow school busses going green. the bay area districts set to receive federal funding to ramp up clean energy efforts and thrive city in san francisco wants to make sure

dollars over the next two years. they also say the plan also leaves half of the state's rainy day fund untouched. in order to be used for future budget years, lawmakers have the next two weeks to finalize a deal with the governor. they have until june 15th to pass a state spending plan. the california highway patrol released the results of its latest maximum enforcement period, chp says thanks to the increased presence of officers on the road over the memorial day weekend, more than 100 people were arrested for driving under the influence. officers also issued nearly 32,000 citations. the vast majority of tickets were for

speeding. 27 people were killed in crashes across the state. although the maximum enforcement period has ended, chp still reminds people to drive sober, avoid distractions, follow speed limits, and buckle up. south san francisco police announced the creation of its first lgbtq plus liaison program in an effort to strengthen relationships with members of the lgbtq community and its officers. the program aims to open lines of communication and create mutual trust. the department hopes the creation of the program will foster an inclusive and collaborative environment, with ongoing training and community engagement. the lgbtq plus liaisons will work to establish a partnership with the community and work to make a more inclusive south san francisco. new at 730, the biden administration has announced the recipients of the epa's 2023 clean school bus program rebate competition with some bay area school districts making the list. the environmental protection agency selected about 530 school districts spanning

almost every state. washington d.c, along with several tribes and u.s. territories to receive nearly $900 million in funds to replace older diesel fueled school busses that have been linked to asthma and other conditions harmful to the health of students. the funds will help school districts purchase more than 3400 clean school busses. 92% of which will be electric. of the hundreds of recipients, 47 california schools will be receiving funds for right here in the bay area, including san mateo union high school district, fruitvale elementary school, old adobe union in sonoma county, and alameda unified. celebrating independent filmmaking. the event announced set to make its first cameo here in san francisco

just click on the web links tab. the indie night film festival is coming to san francisco for the first time this weekend to celebrate independent film making. the festival will be held saturday at the amc kabuki theater eight near japantown. it's a chance to bridge the networking gap between smaller filmmakers and hollywood executives. now in its 12th season, the festival is usually held in los angeles, but the festival's founder, san francisco native dave brown, wanted to bring it home after the pandemic. >> this thing, there's a lot of talent in the bay area, so it's time for me to come back there, you know, shine some light on the city, give us the opportunity to show that there are talented people in san francisco. so this is a great thing. >> there are also several documentaries on the program that highlight san francisco's evolution and what it has been challenged with the past few years. actor morris chestnut is slated to host the event outside lands released its daily lineups for this year's festival, and golden gate park. the killers
