hearing from that man at the center of the incident and police, bailey. >> hey mike and julia, that man, a richmond resident, is alleging that police threw him on the ground, pinned him there and then that resulted in injuries and he claims race was the motive went out of the way. >> he was like a pit bull. he wouldn't stop. >> on may 5th, richmond police were in the area of mcdonald avenue and first street, where they were arresting a suspect involved in a high speed chase. that's where casey gus, a 44 year old from richmond, was filming the arrest when he says police confronted him. this is richmond police body camera video obtained and edited by gus attorney, john burris, and then given to ktvu. the video depicts a chaotic scene and officers pinning gus to the ground before handcuffing him. according to gus, the use of force left him with head trauma, bruised ribs, and back pain. >> he wasn't giving me any orders when he was pushing me. it was like a fight, combat, fight. i could feel my face literally cutting in the ground. >> police arrested gus for

obstructing an officer. he was booked into jail and released after signing a promise to appear. but according to his attorney, the arrest wasn't justified. >> this is a person who was exercising his constitutional rights, one to be on in the city, on here in the community, the right to free speech, to say what he wants to the police officer and to exercise his rights to film the police. he was not interfering in any way. gus's complaint filed by his attorney alleges violation of freedom of speech, assault and battery, false imprisonment and other civil rights violations. >> in a statement, richmond police said the incident is currently under investigation to ensure that all actions taken were consistent with department policies and procedures, and we are committed to maintaining transparency throughout this process. our department takes all use of force incidents seriously, adding that the sergeant involved, alexander kane, has been temporarily reassigned to an administrative role where he will not have contact with the public. but gus's attorney said officers need to be held responsible for their actions.

>> the reason why this case is so troubling is that this was a cop who was out of control, who in many ways is a throwback to an old period of time that i thought we had resolved. >> now, it is important to note again that that was only a claim that has been filed, not a lawsuit, though claims do typically precede a formal lawsuit. gus says he is still not been able to return to work because of the injuries that he suffered that night. mike, back to you. >> all right, bailey, thank you. a judge rejected nearly all of scott peterson's requests for new dna testing in his bid for a new trial. in court today, the judge allowed only one piece of duct tape found on his wife's body to be dna tested. the judge rejected testing on other pieces of tape found in san francisco bay, and a mattress found in a burned out van near the modesto airport, saying those items were not connected to this case. peterson's new team of lawyers is trying to overturn his conviction 20 years ago of

killing his wife, laci and their unborn son. >> when we convicted him, we had the circumstantial evidence that said, why are we doing this? well, why are you not giving the dna up if you're so positive about this, let them test it. >> legal analyst michael cardoza also says dna technology has come a long way since peterson was convicted, and a hearing has been scheduled for july, in part to address who will pay for the dna testing. >> new at 11 san francisco police announced seven arrests today in connection to a theft at a pharmacy store in the ingleside district. police say that theft happened friday night on portola drive near sydney way. an off duty sergeant witnessed a group of entering the pharmacy with empty bags and then leaving in a chaotic manner. one suspect pushing a shopping cart filled with merchandise. six adults and one juvenile were arrested. officers recovered, stolen makeup, diapers, bath and body products, and vitamins. >> new at 11 tonight, bay area based lucid motors is cutting

its workforce by as much as 6. the maker of luxury electric vehicles says it will cut 400 employees in an effort to optimize resources. the company's ceo says the layoffs will impact employees at all levels, including management. several other electric automakers have also recently cut jobs due to a decrease in demand for more expensive evs. >> an assault suspect was taken into custody after barricading himself inside a south bay home. the santa clara cnty eriff's office says the assault happened right near the vta children's discovery museum station will on after. the suspect then barricaded himself in a nearby house on willis ue ktvu lamonica peters spoke with some of the residents in the area, who say they're relieved to hear about the arrest. >> santa clara county sheriff's deputies say they responded to the call about 1:00 wednesday afternoon. >> a few passerby had called 911 to report an active assault that was going on prior to our deputies arrival. the suspect did flee and our victim was

still at the location, which our deputies did come in correspondence with, and he was transported to a local hospital. >> police say the suspect then barricaded himself in a home nearby. this couple says they live on the next block from where the suspect hid himself inside. so i went outside and they told us that, you know, somebody got stabbed and he had a rifle, so he might have went in our backyard. >> so they told us we had to evacuate. so that's when we came out and left. >> the neighbors also say they've had run ins with the suspect before a couple of times. >> you know, he would come in our, you know, our backyard, you know, like trespassing and everything, like trying to start problems. he came at my father in law with a knife before. so, you know, it's like. and then by the time we came outside, he was already running back to his house. >> rafi clemente says he owns the auto shop off willis avenue. >> we've seen him walking down here once in a while with the dog, but this is the first time we see him. really aggressive. >> train service had been suspended while police

investigated, but we believe it was restored just a few hours later. police also did not confirm whether or not the victim was stabbed, and we don't know the extent of his injuries. lamonica peters, ktvu, fox two news san leandro's interim police chief says she wants the job permanently tonight. >> chief angela everett gave a virtual self-introduction and candidacy statement to the community before she became interim chief last month. everett was the police chief in los altos. she says. as san leandro's top cop, she will work to strengthen the relationship between police and the community . >> as a public safety professional, it's important to me that our community feels and is safe leveraging technology and existing resources will be critical in helping our crime fighting efforts moving forward. >> everett has also worked as the hayward police at the hayward police department and served as deputy chief of police for bart. her candidacy statement comes three months after chief abdul pridgen left

amid allegations of policy violations. >> new at 11 a state audit released today revealed the california labor commissioner's office is facing a 47,000 case backlog. state law requires that office to issue a wage claim decision within 135 days of filing, but the auditor says it took the office an average of 854 days to issue decisions. the audit also found nearly 3000 claims are more than five years old in the office, is understaffed. the department of industrial relations agrees with the audit's findings, but says wage theft claims have increased in complexity and complexity. complexity, and they need more time to investigate. >> still ahead tonight, it looked like a scene straight out of an action movie in tonight's west coast rap, how a sheriff's deputy vehicle flipped over another plus happened, my mother used to tell me, don't leave your purse in a car. don't leave anything in the car. >> tonight, the incidents in the last week caught on surveillance

this afternoon. the deputy's patrol vehicle was t-boned at an intersection in santa clarita, northwest of los angeles. the

collision lifted the suv and then it rolled several times. the deputy was rushed to a trauma center. his condition still has not been released, and investigation is underway now into the cause of that crash. >> a wildfire burning southeast of phoenix has prompted evacuation orders tonight for a couple dozen homes. the simmons fire is just one of at least three fires burning in arizona right now. tonight, the wildfire has burned more than 400 acres. officials say the winds are pushing the flames in this one. so far, at least five properties have been damaged, four destroyed. no injuries reported, and this fire is 0% contained. at last check. the cause is not yet known. >> las vegas officials say the timeline for the a's ballpark is set to open on time for the 2028 season. the las vegas review journal reports. financing is all set now for construction to begin on, mlb commissioner rob manfred said in an owners meeting last week that construction needed to begin in april to ensure that the ballpark would be ready for 2028. the president of the las vegas convention and visitors

and like i said, they're trying to make it bulletproof and it's going to be really interesting because as we know, when a grand jury is put together, it really signals that a case has reached a new destination and that in this investigation, it looks like it could could come to an indictment very soon, witnesses were notified they would be testifying before the jury in the southern district of new york, new tonight, a series of purse snatchings in berkeley, prompting a warning from police. >> several incidents were caught on surveillance video with striking similarities. ktvu is amber lee spoke with police, who are now urging residents to be extra vigilant. >> surveillance video from the shell gas station on university avenue shows a black lexus sedan pulling up to the victim's car on the passenger side on saturday, around 820 in the morning. then a passenger from the suspect vehicle gets out, opens the door to the other car, snatches an item and takes off. the next day, sunday, a similar scenario at the chevron station on telegraph avenue around 2:00

in the afternoon. again, the suspect vehicle is a black lexus sedan. the gas station markets assistant manager says the victim was upset when she came into the store for help. >> she just mentioned that, you know, somebody stole the purse out of her car and she had asked if we had cameras on the pumps. you know, i informed her that we did. >> this. gas station customer says she never leaves her purse in her car. >> it's getting dangerous. we have to be careful. you have to watch your back. just be real cautious. >> police say there have been a total of five similar purse snatchings at various gas stations in berkeley since friday, all during daylight hours. >> these crimes really have the appearance of being crimes of opportunity because they're they are happening in some cases, like 20 minutes one after the other. >> police say a surveillance camera at berkeley bowl west captured this black sedan, taking off from the supermarket parking lot on tuesday, around 1120 in the morning. police say the vehicle was used by suspects who had gone up to a car with a

caught on camera. ktvu tom vacar spoke with surprise neighbors. >> at 2 a.m. wednesday, this mountain lion was caught on a security camera in milpitas friendly village mobile home park. it popped up on the homeowner's cell phone while he was working, and he showed it to a friend. >> i thought he had a cat because a lot of cats in this area. i talked to my friend and

he said, no, it's a mountain lion. >> now, while it may be unusual for a lion to come down into a trailer park, the fact is if you look up here, you'll see that there's plenty of territory for mountain lions to roam. not so far away. most residents only heard about it later. >> i've been in this community in the last 24 years and, it's just really surprising, surprising to find out that there's a mountain lion on the loose, because there's a lot of kids out in this community. >> but wait, there's more. >> today, the milpitas police department received two reports of sightings of a mountain lion in the residential areas of milpitas. the second sighting was at about 430 in the morning, and the residential area of fair meadow way. >> the second community is about two miles away from the first sighting. it's an easy walk for a mountain lion and well within the time needed to get there, especially since both neighborhoods back up against accessible rail tracks. the double sighting may seem somewhat unusual. consider this 51% of all american households

degrees. these were the highs from today. highs tomorrow will be almost exactly the same, but mike was alluding to the fact that the following week is going to get hot as well. and when that happens, the fuel is going to dry out and we're going to start. you know, talking more about concerns for spot fires and things like that, just which is nothing unusual for the bay area this time of year. but just you get a couple warm, warm days in a row and then you get next week back up into the upper 80s, low 90s, and you've got an opportunity for just sparks to catch anything, which is part of the california landscape. so there is the salesforce tower. we were just looking at in the break. we were looking at, mike was pulling up some pictures of the train used to run on the on the bay bridge, if you can. i'm old enough, i do remember, i don't remember seeing the train, but i think i remember seeing the tracks in the 60s. but i'm may be wrong on that. but yeah, train used to go across the bay bridge and through yerba buena and over into berkeley, okay, so temperatures peaked tomorrow and that's it. then they drop off quick. and what's going to happen is the low is going to come in, get close to us. the marine layer gets deep and comes

back in. the reason it's warm now, the reason it's warmer tomorrow is because there's no fog to talk about. so without the fog it's easy to warm up. it's already what? well, four degrees warmer in petaluma, four degrees warmer in san carlos than it was last night. here we are. tomorrow morning. fog tries to form and then goes away. a little fog around. hum. that's like pigeon point there. and then the fog comes back more earnestly. friday morning and then more on friday evening and then more on saturday. and that is a subtle change. but that's going to create the cooling that's going to drop our temperatures by as much as 5 to 10 degrees from these temperatures, which we're going to see tomorrow. so numbers generally on on the weekend are going to be in the 70s for pretty much most cities, as you see here. you know, it's saturday, 82 will be the hot spot 82. and on sunday in the inland bay valleys. and then it starts to warm up next week right back up to 87 degrees. but a cooler weekend ahead with a pretty warm, probably the warmest day of the week tomorrow. or at least as warm as

today. >> all right, bill, thank you. caltrans began work this morning to repave a section of 19th avenue in san francisco to smooth out the potholes. two of the three northbound lanes will be closed across a three block stretch of 19th between sloat and taraval, while work is underway. this is taking place from nine in the morning till three in the afternoon for the rest of the workweek, drivers say they are looking forward to the improvements we have been waiting for years for this to happen. >> a couple of weeks of discomfort will drastically improve the pace of people coming through the area. >> 19th avenue, one of the busiest surface streets in san francisco. the roadways and extension of highway one, which is why caltrans is in charge of the repaving work. >> the biden administration has announced the recipients of the epa's 2023 clean school bus program rebate competition, with some bay area school districts making that list. the environmental protection agency selected about 530 school districts, spanning almost every
