the temps here. it's going to be the warmest day of the week by far. if you thought yesterday was warm, today will be a little warmer. then we'll see. slight cool down tomorrow with a big cool down on saturday. but temperatures are on their way up and they're well above average 70s 80s to near 90 degrees. all right. sal is here. i can't think of anything except picking up cones unless he tells us differently. >> yeah, well, we do have mostly good traffic, steve, as we look at the maps here, i do want to mention that on state route 159 152 near crg nine, there is a crash. we're running that down for you. but that's in the coyote valley right now. the rest of the silicon valley looks good and the bay bridge toll plaza traffic also looks very good. so i think we're off to a pretty decent start here on an early thursday morning at 401. let's get back to the desk. okay, sal. >> thank you. a man from richmond has filed a claim against the city of richmond and its police department, saying he was injured when police used unnecessary force to arrest him.

ktvu bailey o'carroll has details. >> get out of the way. >> he's like a pit bull. he wouldn't stop. >> on may 5th, richmond police were in the area of mcdonald avenue and first street, where they were arresting a suspect involved in a high speed chase. that's where casey gus, a 44 year old from richmond, was filming the arrest when he says police confronted him. this is richmond police body camera video obtained and edited by gus attorney, john burris and then given to ktvu. the video depicts a chaotic scene and officers pinning gus to the ground before handcuffing him. according to gus, the use of force left him with head trauma, bruised ribs, and back pain. >> he wasn't giving me any orders when he was pushing me. it was like a fight, combat fight. i could feel my face literally cutting in the ground. >> police arrested gus for obstructing an officer. he was booked into jail and released after signing a promise to appear. but according to his attorney, the arrest wasn't justified. this is a person who was exercising his constitutional rights, one to be

on in the city, on here in the community, the right to free speech, to say what he wants to the police officer and to exercise his rights to film the police. >> he was not interfering in, in any way. >> gus's complaint filed by his attorney alleges violation of freedom of speech, assault and battery, false imprisonment and other civil rights violation. in a statement, richmond police said the incident is currently under investigation to ensure that all actions taken were consistent with department policies and procedures. we are committed to maintaining transparency throughout this process. our department takes all use of force incidents seriously, adding that the sergeant involved, alexander kane, has been temporarily reassigned to an administrative role where he will not have contact with the public. but gus's attorney said officers need to be held responsible for their actions. >> the reason why this case is so troubling is that this was a cop who was out of control, who in many ways is a throwback to an old period of time that i

thought we had resolved. >> bailey o'carroll, ktvu, fox two news. >> thank you bailey. eight students at a middle school in novato were arrested after a school fight went viral. the students, who are between 12 and 14 years old, are accused by police of a targeted attack on two students who ended up in the hospital. now we have cell phone video from sinaloa middle school of what parents say is the latest violent incident on campus. this happened friday, just after lunchtime. police say a female student was targeted by this planned attack by a group of students. a second student who tried to stop the fight was also attacked. the eight students who were arrested were booked into marin county juvenile hall on charges of conspiracy and felony assault. >> at our time now 404 new details from lake tahoe about the death of a bay area man who died in january in an avalanche at a tahoe ski resort, the san francisco chronicle reports that 66 year old kenneth kidd of point reyes was trapped and buried under the snow for as

long as 45 minutes before he died at palisades tahoe. the placer county sheriff's office at the time confirmed he died from suffocation, which is common for victims of deadly avalanches. >> we have an update now on scott peterson's bid for a new trial. 20 years after he was convicted of killing his wife, laci, and their unborn child. peterson's new attorneys were seeking to have some of the original evidence retested for dna, but a san mateo county judge ruled against testing all but one item. that one item is a piece of duct tape found on his wife lacey's body. the judge rejected the defense request for dna testing on a mattress found in a burned out van. prosecutors argued the defense was relying on pure speculation and had no proof that the items they wanted tested were connected to the case. >> repeated lie after lie after lie after lie. so we're not saying, yeah, he's met this particular point because i don't

think you can believe what he says. >> in all of my years, i have never had to litigate a dna motion to this extent, because dna is just a no brainer. it's very concerning that they are so vehemently opposing dna testing in this case. >> peterson is expected back in court in july. >> time is now 406 today, another day of online classes at uc santa cruz after pro-palestinian protesters blocked the main entrance to the university. now, yesterday, the west entrance to the campus reopen after a blockade was removed, even though there were still rocks and boulders and fake blood around the area. university officials have safety concerns, but the protesters say they're focused on keeping the attention on the crisis in gaza. >> we're still located at the base of campus with our. but we decided to stop here as well. so say no more business as usual that this is a genocide and all eyes need to be on it now.

>> tomorrow, classes at uc santa cruz may once again be online if the campus protests continue. >> world central kitchen is pausing its aid efforts in rafah at its main kitchen, continuing israeli attacks forced many of its workers and volunteers to relocate to northern gaza. despite those challenges, 100,000 meals were still served to palestinians on monday. senator lindsey graham met with israeli prime minister benjamin netanyahu, pledging more us support. the international criminal court is seeking an arrest warrant for netanyahu and his defense minister. >> i promise you that we will do all we can, mr. prime minister, to hold the icc to account for this outrage against the people of israel. >> israel's national security adviser says the war in gaza will continue for another seven months. us leaders are urging the israeli military to exercise restraint and develop a plan for when the war is over. in the

absence of a plan for the day after, there won't be a day after. >> if not, we'll have chaos, lawlessness and a vacuum. >> the palestinian authority health minister is calling on the international community to increase pressure on israel to make way for more humanitarian aid. >> time is now 408. if you own an older nissan car, you're warned. stop driving them until certain repairs on defective airbags are made. that warning from the national highway traffic safety administration includes 2002 to 2006 nissan sentra's, 2002 to 2004 nissan pathfinders and 2002 to 2003 nissan infiniti qx4 that were not repaired in the initial recall back in 2020. the defective airbags can explode in a crash, possibly causing injuries or death. >> federal regulators are seeking records from tesla as part of an investigation into reports of power steering loss. now, the national highway traffic safety administration

has received more than 100 reports of loss of steering control on the 2023 model three and model y, regulators told tesla they want the company's records on the vehicle's steering components by july 24th. they're request includes the company's process for identifying problems and creating solutions for potential defects, as well. >> drivers on 19th avenue in san francisco, which is one of the city's busiest roads, should expect delays today because of pavement repairs. caltrans is closing two lanes of northbound 19th avenue between sloat boulevard and taraval street between 9:00 this morning and 3:00 this afternoon. the far right lane will stay open in. neighbors in that area say it's about time potholes are patched up on this road, which is owned by the state. >> a lot of the traffic noise is from cars going over a bumpy surfaces. >> it hits you a lot more on the motorcycle than would on car. a couple of weeks of discomfort

will drastically improve the pace of people coming through the area. now >> today's repairs follows a two year joint city and state project that was finished last year to replace aging utility equipment and improve traffic lights for pedestrian safety. caltrans will once again close this area for one day in june to finish the lanes striping. >> skies are clear. no fog at all. if there's any that forms, it won't last very long. so we're all set for sunny and warm day. a few locations inland will be near 90, maybe slightly above. if you're almost outside my forecast zone, little cooler coast in bay friday than much cooler on saturday as the system sweeps in a couple of warm days, i wouldn't really call it a stretch, but a couple of warm days and then it comes right back down. nothing new. we've seen that going all the way back to april. we do have have mainly clear skies. there might be a few high clouds, but they won't do much 60s for some already, 50s for most. so we are running about except for over the coast where there's some cooler temps.

election still more than five months away. however south bay state assemblyman evan low announced he just picked up an important endorsement in his race to win a congressional seat against former san jose mayor sam liccardo. there, in a runoff election for the congressional seat of anna eshoo, who is retiring. >> everyone, i'm outside the california democratic party headquarters and just got the amazing news that i'm the sole endorsed candidate for the california democratic party, for congress. let's go. >> now, evan, low advance of the runoff after finishing second in a vote recount just ahead of santa clara county supervisor joe simitian, who was endorsed by anna eshoo. this 16th california congressional district seat area covers parts of san mateo and santa clara counties.

>> medical experts are expected to take the stand today in the state trial against david depape. in the first day of testimony, jurors heard from four san francisco police officers who responded to the october 22 break in at the home of congresswoman nancy pelosi. prosecutors say her husband, paul pelosi, was asleep when depape broke through a glass patio door and confronted him in the bedroom, demanding he see the congresswoman. the defense is expected to argue that depape suffers from mental illness, which caused him to act on an elaborate conspiracy fantasy. >> this is more like attempted murder requires a specific intent to kill, if at the worst it could be attempted voluntary manslaughter. if he did not have the state of mind necessary to intend to kill him with a level of malevolence. >> legal experts say the prosecution is moving quickly with the case. at this pace, the trial could wrap up next week.

cohen and former national enquirer publisher david pecker regarding a 2015 meeting at trump tower with the former president. >> pecker says he pledged to look for negative stories about donald trump so that they could be suppressed. prosecutors say that was the crux of the alleged hush money scheme. >> trump is charged with 34 counts of falsifying business records to hide an alleged payment to adult film star stormy daniels ahead of the 2016 presidential election. prosecutors say daniels was paid to keep quiet about an affair with trump, which he denies. and they claim trump violated a new york election law, which makes it illegal to quote, promote or prevent the election of any person to a public office by unlawful means. >> it'll be talked about in the history books. >> the jury is also asking to rehear judge juan gershon's instructions about how they're to go about reaching a verdict. >> i am glad, though, that they're being diligent. >> deliberations could take hours, days or even weeks. all

12 jurors must agree for the verdict to be accepted. dave, thank you. >> rebecca. it we'll talk to you later. >> federal funding and california's high speed rail project. now being questioned by lawmakers in december, president biden approved $3 billion for the long delayed rail system. now, congressman sam graves and senator ted cruz say they are concerned that the biden administration will continue to fund the project despite indications that there is, quote, no reasonable path forward for successful completion. now they're asking for documents detailing the decision to be released by june 12th. the state agency spokesperson says they're taking the concerns seriously and they're ready to respond to the department of transportation. >> our time is now 418. the biden administration announced the recipients of the epa's 2023 clean school bus program rebate competition, and some bay area school districts made the list. the epa selected about 3530 school districts around the

country. those school districts will divide almost $900 million in funding to replace older diesel fueled school busses. they'll replace them with more than 3400 clean school busses, 92% of them will be electric busses. well, 47 california schools will be getting funds for them right here in the bay area, including san mateo union high school district, the fruitvale elementary school, old adobe union in sonoma county, and alameda unified for 19 is the time. >> back over to steve paulson as it warming up or cooling down today. what do you think? i'm hoping it's cooling down. not yet pam. all right, dave, not yet. >> a warm few days. that's it. and then it'll start to cool down a little bit tomorrow. a lot on saturday, but today will peak it out. there's not much of a breeze. yesterday was definitely wind driven, but did bump the temps up a little. napa

game was all tied at three, then rays outfielder jose siri made a great catch, leaping against the wall. wow. got that ball to keep the game tied in the bottom of the ninth that siri. then he drove home a runner on third with a walk off single to end the game. the a's lost 4 to 3. they've lost 17 of their last 23. >> all right, pam, speaking of the a's, officials in las vegas say the ballpark for the a's is due to open on time. but the 2028 season, the las vegas review journal reports financing is in place for construction. to begin, construction needed to begin in april to make sure that ballpark would be ready for 2028. however, the president of the las vegas convention and visitors authority says the timeline will be met as construction is expected to be completed in double shifts and on weekends. the review-journal reports. two key documents still have to be approved by the las vegas stadium authority board.

it is friday friday eve. that's right. yes. and over there is steve paulson. he has your thursday forecast. >> i do indeed. and it's a warm one here. we're starting off clear skies 50s and after today we'll see a little cool down. tomorrow more so on saturday 50s on all the temps here and is clear again i can't find any fog so get ready for the warmest day. although the breeze is not as strong as it was yesterday. so we'll go upper 80s to near 90 and then 70s, coast and bay, maybe a few 80s as well. all right. sounds here at 430 to tell you and me. it's quiet out there. i hope. >> yeah it is quiet out there. it's nice for the most part, steve. we do see that traffic is moving. well, the bay bridge, there have been no major issues here. and if you're driving on interstate 880, it is also a nice looking drive right there in front of the coliseum. and we've also been looking at the san mateo bridge. that looks pretty good. one of the first signs of slow traffic is highway

four, but right now you're still doing well. people are definitely beginning to show up on this commute. heading over to concord. it's 430. let's get back to the headlines. >> thank you. sal. we're now following some breaking news out of castro valley. there's a massive response at the lake chabot public market. ktvu james torres now live at the scene showing us what's happening right now. james pam, a massive response because there's a massive fire here. >> we're at the corner of lake chabot and quail avenue here in castro valley, right across the street from the castro valley community park, where you can see behind me just how much activity is going on here. several fire trucks, most of which seem to come from the alameda county fire department, which has a station just a block over from where we're standing here. and you can see what is happening at the lake chabot public market. if you've never been here. it's a large food court. it has about 6 or 7 different food vendors inside, open for lunch every morning here. something that a lot of

people here in the neighborhood love to go to. they frequent now , now under some massive flames and lots of water and pressure being just poured onto this building. we can still see flames at this point. we're talking to fire department, the firefighters out here right now to get an idea about how long they've been here. but as far as we know, it's been deemed a second alarm fire so far, possibly a third alarm to ring soon, which just gives you an idea of how much a response has been required to handle what has been going on here this morning. some flames here on the right hand side of the building. now again, this is a pretty busy intersection. it's not far from the freeway here in castro valley. an easy way to connect you to different parts of the east bay here. and this food court, i guess, is the best description for this food court alone is something that brings in a number of different people. in fact, i spoke to some neighbors who woke up early this morning, people who live nearby not even that close nearby. one guy says he lived about a mile away, had the windows open

because it was cool outside, he and his partner woke up because they started experiencing that really thick smoke that started creeping into their window. so they woke up at about 3:00 this morning. they noticed some alerts that this building had been on fire. they came to check it out and were heartbroken to see that it was, in fact, the lake chabot public market that was suffering all of this damage here, a lot of which you can't even see because of how thick this smoke is as a result of the water getting onto the fire and those neighbors tell me that this place is packed all the time for lunch, especially because people are so interested in getting, some of the meals and foods that these vendors inside the building will always have available to them. so we are still working with the fire department to get some of the more specific details in that, how long they've been here, how much longer they will be here. and of course, what started this fire in the first place. it's certainly unusual in size and unusual in scope, but once we have those details, we will bring them to you, pam and dave.

911 to report an active assault that was going on prior to our deputies arrival. the suspect did flee and our victim was still at the location, which our deputies did come in correspondence with, and he was transported to a local hospital, police say the suspect then barricaded himself in a home nearby. >> this couple says they live on the next block from where the suspect hid himself inside. >> so i went outside and they told us that, you know, somebody got stabbed and he had a rifle, so he might have went in our backyard. so they told us we had to evacuate. so that's when we came out and left the neighbors also say they've had run ins with the suspect before a couple of times. you know, he would come in our in our backyard, you know, like trespassing and everything, like trying to start problems. he came at my father in law with a knife before. so you know, it's like. and then by the time we got came outside, he was already running back to his house. >> raffy clemente says he owns the auto shop off willis avenue. >> we've seen him walking down here once in a while with the dog, but this is the first time

we see him really aggressive. >> train service had been suspended while police investigated, but we believe it was restored just a few hours later. police also did not confirm whether or not the victim was stabbed, and we don't know the extent of his injuries. lamonica peters ktvu, fox two news thank you. >> lamonica san mateo county's homeless population has increased over the past two years. data from the one day homeless count conducted in january found more than 2100 people experiencing homelessness. that's an 18% increase from the same count conducted in 2022. now, the report is mandated every two years by the department of housing and urban development. officials say the data helps determine where to allocate resources. >> our time now for 36. a key committee of california lawmakers approved a measure to ban force outing policies at schools, and this was the first formal debate on this legislation. the bill would ban school district policies that require teachers and staff to

the northern california accused of leading law enforcement on a dangerous pursuit that ended in a fiery crash. and they did it while live streaming the chase to social media. the sacramento county sheriff's office released these photos of how the chase ended on a freeway in downtown sacramento. the sheriff's office says armed gang members led detectives on a pursuit. both the gang members were 16 years old. we're also told one of the people in the car live streamed part of the chase on their instagram feed. sheriff's department says no one was hurt in that chase, and the two of those teenagers were arrested. >> a warning from berkeley police about a series of purse snatchings. now, several incidents were recorded by security cameras, and they have

of two mountain lion sightings within a few miles of each other. now one of the sightings was caught on camera yesterday at 2 a.m. in milpitas friendly village mobile home park. take a look after the big cat roamed through the neighborhood, police say they tried to search for it. they could not find the cat. then about 4 a.m. there was a second sighting just two miles away on fair meadow way. as brief as both sightings were, they were enough to concern the neighbors. >> i've been in this community in the last 24 years, and, it's just really surprising, surprising to find out that there's a mountain lion on the

san mateo bridge looking good and likewise for the bay bridge. 501 let's get back to the headlines. >> all right. thank you sal. we continue to follow the breaking news out of the east bay. a huge fire at a popular food court in castro valley has been burning for hours. james torres has been live on the scene now and has more details. james >> yeah. pam. a fire that's been burning for almost two hours at this point. or at least that's how long firefighters have been on the scene trying to get a handle and all. and it seems like they're making a good amount of progress in terms of actually just getting the flames out. we haven't seen flames now for quite a little bit, but when we first got here, we can certainly see them shooting out of this building. all of this happening at the lake chabot food court here, i should say public market. it is a food court that holds about 6 or 7 different food vendors here. you would get anything from ramen to korean barbecue to poke. there was a dessert shop in there as well. all vendors here. so most

of those locations, most of those vendors have their own location in different areas, but they were housed in here as well too. spoke to some neighbors who, were kind of talking to us about what this place means to them. they say they see it very busy all the time. they caught wind of what was going on here. one neighbor in particular, who lives about a mile away, said that he noticed that the fire was happening almost right away while he was asleep. >> we had our windows open. we smelled smoke, and then i looked outside and it was super hazy outside. so, i looked online and somebody had posted that, the market was on fire. so we came down to take a look and it was fully engulfed in flames when we when we first got here around 345. >> and that was the case for firefighters who the earliest reports i've been here since about 320 this morning. as we take you back live out here in castro valley at the lake chabot public market here, where you

see at least three different ladders hovering above the building, still shooting water from the inside. and from where we're standing, we can see at least two different vantage points where firefighters are shooting from the ground water inside that building. they had to break open some of those windows so they could shoot some of that water in, and all they did was get a ladder, smash them the window there, use the water to kind of break it up some more, and they continue to try to douse this building to get rid of those flames, get rid of those hot spots. you can actually still see a couple of those flames from the right side here. so those hot spots certainly working much faster than what the firefighters would like to see. now, we haven't had a chance to get an official update from the fire department here. it's probably way too soon to find out. and determine what exactly started this fire, but an absolute massive response from the fire department, not just in castro valley, but this place is actually just a block away from an alameda county fire department station. so a very quick response from them. third alarm fire here that is bringing in a whole ton of personnel.

once we have updates on what happened here specifically, of course, we'll let you know. we're live this morning in castro valley. i'm james torres, ktvu, fox two news. >> okay, james. thank you. time is now. 504a man from richmond filed a claim against the city of richmond and its police department, saying he was injured during an arrest back on may 5th. 44 year old kweisi gus says he was filming the police as they were arresting a suspect involved in a high speed chase. now you're looking at police body cam video obtained and edited by mr. gus and his lawyer that was given the ktvu. the video shows police confronting him, pinning him to the ground and then handcuffing him. according to gus, they used unnecessary force, leaving him with a head injury. bruised ribs and back pain. >> he wasn't giving me any orders when he was pushing me. it was like a fight, combat, fight. i could feel my face literally cutting in the ground.

>> the reason why this case is so troubling is that this was a cop who was out of control, who in many ways, is a throwback to an old period of time that i thought we had resolved. >> now, police arrested mr. gus for obstructing an officer. he was booked into jail and later released. but the claim filed by mr. gus alleges violations of freedom of speech, assault and battery, false imprisonment and other civil rights violation. richmond police told ktvu the sergeant involved has been temporarily reassigned to an administrative role where he won't have contact with the public. >> eight students at a middle school in nevada were arrested after a school fight went viral. the students, who are between 12 and 14 years old, are accused by police of a targeted attack on two students who ended up in the hospital. we have cell phone video from sinaloa middle school of what parents say is the latest violent incident on campus. this happened friday, just after lunchtime. police say a female student was targeted by

this planned attack by a group of students. a second student who tried to stop the fight was also attacked. the eight students who were arrested were booked into marin county juvenile hall on charges of conspiracy and felony assault. >> time is now 507. new details from lake tahoe about the death of a bay area man who died in january in an avalanche at a tahoe ski resort, the san francisco chronicle reports. 68 year old kenneth kidd of point reyes was trapped and buried under the snow for as long as 45 minutes before he died at palisades tahoe. the placer county sheriff's office at the time confirmed he died from suffocation, which is common for victims of deadly avalanches. >> we have an update now on scott peterson's bid for a new trial, 20 years after he was convicted of killing his wife, laci, and their unborn child. peterson's new attorneys were seeking to have some of the original evidence retested for dna, but a san mateo county judge ruled against testing all

>> they've told us that they've been here since about 2:00 this morning. someone had driven by here. they had called in that, that fire, letting them know just how bad it was. and when they got here, the building was fully engulfed in flames. you can see behind me now, now that we have a little bit of a closer look and a tiny bit of dead light, daylight, you can see through the windows of the lake chabot public market at the roof of this building. the ceiling just practice. gone at this point. fire. just shooting through that for hours before firefighters actually got onto the scene here. once they got here, they say they immediately aggressively tried to get a handle on that fire. good news is the fire is now contained at this point, but these firefighters still have plenty of work to do. they're still managing a number of hot spots. they have three ladder, engines here that are just still shooting some water from above, just to make sure that they continue to have a handle on it. we saw a number of these firefighters who were walking in and out of the building to, as they take a closer look at just how much damage was done here, the battalion chief that we

spoke to just a few minutes ago, he told us he grew up here in this area. he'd been coming to this public market for a while. he's been coming here since before he was even a public market. it used to be a supermarket, quite a few years ago. he actually knows the guy that owns this place. they haven't actually been able to connect with the owner just yet, so we're not sure if the owner even knows that this has happened, as of this morning. but that's something that these fire crews are actively trying to do to, connect with the owner, let them know the extent of this damage will also try to figure out themselves how this all started in the first place. of course, they've only been here for a couple of hours. they haven't had a chance to really look through everything within inside the building. so it may be a while until we learn what the cause of this fire was. in the meantime, traffic around the area is going to be a little tough. we're on the corner of quail avenue and lake chabot here in castro valley, a thoroughfare here through the area to get you to the freeway. if this is part of your normal commute, if you drive by the

companies plan on leaving california and leaving homeowners in the dark. many of them already have. state farm recently announced it would not be renewing more than 72,000 homeowners policies in the state. governor newsom argues that in order to get some of those insurance insurers back to california, the state needs to offer them some concessions. under his plan, state insurance officials would have just 60 days to review and approve a proposed rate hike from an insurance company right now, the process can take up to two years. the governor's office says the sped up timeline cuts out red tape and makes it easier for insurance companies to do business here. but consumer watchdog groups argue it will make it easier for insurance companies to increase rates, and it doesn't guarantee that they'll end up offering more homeowners policies that will make it harder for the public to protest and challenge improper rates and practices. >> people who want want our elected officials to do their job and need to contact their local legislators and say enough

oh yeah, it's ball park season. that ended in a fiery crash in sacramento and they did it while live streaming that chase to social media. the sacramento county sheriff's office released these photos of how the chase ended on a freeway in downtown sacramento. the sheriff's office says armed gang members led detectives on a pursuit. both gang members were 16 years old. we're also told that one of the people in the car live streamed part of the chase on their

court now under control. but now firefighters are telling us the lake chabot public market is destroyed. >> ktvu james torres is there in castro valley. you just talked with the authorities. so what are they saying? >> well, they're telling us this is practically a total loss at this point date. and david, pam, good morning to you. here you can see the lake chabot public market just behind me where the smoke is still coming just from outside the building through the windows, the broken windows that they needed to break in order to get some of the water in there. you can see just how much of the roof is gone, how much of it is burned down. you can only imagine what is left inside, and it's all just completely charred. at this point, we're not seeing any more flames from the scene, but we can certainly see that destruction. we'll show you what the fire looked like earlier this morning. crews got here around 2 a.m. after someone called in the emergency, though firefighters aren't sure how long the building had been burning before they arrived, and they tried fighting the fire from inside. but notice the roof started to give. so out of

safety they pulled out and started spraying water from above. we spoke to a battalion chief. he gave us an update earlier this morning. he says this scene hits close to home. >> the owners, you know, childhood friend of mine, we grew up together, you know, went to high school together. so it's a pinnacle in the community, it's really sad to see this happen. we tried the best we could. we were in there for about an hour on the interior working, and the roof started to give way. and we had to pull out . >> we talked to some people who live nearby, some of them in their robes and pajamas, who either caught wind of the smoke or just heard about the fire, wanted to come check it out and see for themselves what was going on. several of them told us that this is a place to go. after a long hike in the east bay hills. it's a food court full of different vendors, full of options like robin barbecue. there's even a dessert shop inside as well. now, firefighters still haven't actually reached the owner of this building yet. that's one of the goals that they're trying to accomplish this morning as they continue to investigate this

fire. and they say it will be a long time until we know exactly what caused whatever happened here. of course, once we have more updated information, we'll pass along those details to you. we're live this morning in castro valley. i'm james torres, ktvu, fox two news. >> okay, james. thank you. time is now 604. a man from richmond filed a claim against the city of richmond and its police department, saying he was injured during an arrest back on may 5th, 44 year-old kweisi gus says he was filming the police as they were arresting a suspect involved in a high speed chase. now you're looking at police body cam video obtained and edited by mr. gus and his lawyer that was given to ktvu. the video shows police confronting him, pinning him to the ground and then handcuffing him. according to gus, they used unnecessary force, leaving him with a head injury, bruised ribs and back pain. >> he wasn't giving me any orders when he was pushing me.

it was like a fight, combat, fight. i could feel my face literally cutting in the ground. the reason why this case is so troubling is that this was a cop who was out of control, who in many ways is a throwback to an old period of time that i thought we had resolved. >> now, the police arrested mr. gus for obstructing an officer. he was booked into jail and later released. the claim filed by mr. gus alleges violations of freedom of speech, assault and battery, false imprisonment and other civil rights violations. richmond police told ktvu the sergeant involved has been temporarily reassigned, assigned to an administrative role where he won't have contact with the public. >> we have an update now on scott peterson's bid for a new trial, 20 years after he was convicted of killing his wife, laci, and their unborn child. peterson's new attorneys were seeking to have some of the original evidence retested for dna, but a san mateo county judge ruled against testing all but one item. that one item is a piece of duct tape found on his

wife lacey's body. the judge rejected the defense request for dna testing on a mattress found in a burned out van. prosecutors argued the defense was relying on pure speculation and had no proof that the items they wanted tested were connected to the case. >> repeated lie after lie after lie after lie. so we're not saying, yeah, he's met this particular point because i don't think you can believe what he says. >> and all of my years i have never had to litigate a dna motion to this extent, because dna is just a no brainer. it's very concerning that they are so vehemently opposing dna testing in this case. >> peterson is expected back in court in july. >> our time is now 6068 students at a middle school in novato were arrested after a school fight that went viral. the students, who were between 12 and 14 years old, are accused of by police of a targeted attack on two students who ended up in

the hospital. that we do have cell phone video from sinaloa middle school. what the parents say is the latest violent incident on the campus. it happened friday, just after lunchtime. police say a female student was targeted by this planned attack by a group of students. a second student who tried to stop the fight was also attacked. the eight students who were arrested were booked into marin county juvenile hall on charges of conspiracy and felony assault. >> governor gavin newsom has unveiled a new plan to keep insurance companies in california. the governor's proposal would speed up the approval of home insurance rate hikes. newsom says this will help lure some insurers back to the state. but consumer watchdog groups argue the move will cost homeowners billions in the next half hour. allie rasmus will join us in studio with the details on the plan and its potential impact on californians. >> our time is now. 607 the city of oakley is changing some of its policies on cultivating

cannabis. growers may see tougher penalties for cultivating an excessive amount of the marijuana plants. now, under the new rules, growers can be fined even more for each cannabis plant over a six plant limit that's allowed by the state. this only applies to plants grown in unlicensed commercial grows. the new rules also clarify how property owners can pass the responsibility to their tenants, who may be running illegal grows. leaders in oakland are planning to replace the city's gas cars and trucks with electric vehicles. >> most of the police patrol vehicles, fire engines and city employee sedans are failing when graded for their environmental impact and age. city managers say the total cost of electrifying police patrol cars and their charging infrastructure alone would cost about $75 million. the city plans to research available options when they're ready to buy new vehicles, but there is currently no timeline or budget for replacing the city's fleet.

police about a series of purse snatchings. >> yes, several of these incidents were actually captured on security cameras. >> ktvu is andre senior back here with more details on these crimes. a definite and important warning for people. >> important warning. scary indeed. yes. well, berkeley police say in each case, these criminals strike quickly and leave within seconds. or just a few minutes. and so far there are no reports of any injuries. but they're very frightening. police tell ktvu there have been at least five similar purse snatchings at local gas stations in berkeley within the past week, all during daylight hours. surveillance video shows a black lexus sedan pulling up to the victim's car at a shell gas station on university avenue last saturday morning. someone gets out of the passenger side of that lexus, opens the door to the victim's car and takes off with an item. the same thing happened the next day at a chevron station on telegraph avenue. >> she just mentioned that, you know, somebody stole the purse out of her car, and she had

asked if we had cameras on the pumps. you know, i informed her that we did these crimes really have the appearance of being crimes of opportunity because rouz there. >> they are happening in some cases, like 20 minutes, one after the other. >> and it's not just happening at gas stations either. police say on tuesday, a black sedan approached a parked car with a woman inside at the berkeley bowl west supermarket parking lot. a person got out of that sedan and tried to punch and break the victim's window, but the woman smartly honked her horn, scaring off the robbers. >> it's good to know, and i'll think about it the next time i park and look around more. that's a concern in broad daylight in a in a heavily trafficked place, berkeley police say they have some leads they're investigating now, but it's too soon to tell if these crimes are all connected. >> now, investigators say in each case, there were two people wearing black masks, their masks in a black sedan. everyone advised to check your surroundings at all times and to make sure your car doors are

now cesar chavez park between 1960 and 1971. city leaders say the required testing is precautionary and all regulatory requirements have been met. testing is expected to be complete over the next several months. today, the international bird rescue will release the first group of rehabilitated brown pelicans into the wild. the pelicans were among hundreds found starving since mid-april. scientists say the birds are having difficulty finding food because they can't reach it. the fish are either too deep or too far offshore. that's causing the birds to be anemic, dehydrated and often injured because hungry pelicans take extra risks to reach the food. some bay area school districts are getting money to replace school busses with more environmentally friendly ones. the biden administration announced the recipients of the epa's 2023 clean school bus competition, 530 school districts around the country were selected. those districts will split nearly $900 million in funds to replace older, diesel fueled school

the state needs to offer some concessions and make changes to the way insurance rate hikes are approved. now, the governor wants lawmakers to approve his plan that would allow insurance companies to raise their rates more quickly. state insurance officials would have just 60 days to review and approve a proposed rate hike from an insurance company. right now that process can take up to two years, the governor says. that sped up timeline cuts out red tape and makes it easier for insurance companies to do business here. but consumer watchdog groups argue it removes important oversight. they warn this change will ultimately make it easier for insurance companies to make their services more expensive, costing californians billions of dollars over time. while the proposal does nothing to guarantee those companies will actually offer more coverage or more policies, that will make it harder for the public to protest and challenge improper rates and practices. >> people who want want our elected officials to do their job and need to contact their

deal on the budget. leaders of both chambers say the agreement addresses the projected shortfall of about $75 billion over the next two years. they also say the plan also leaves half the state's rainy day fund untouched, in order to be used for future budget years. lawmakers have the next two weeks to finalize a deal with the governor. they have until june 15th to pass a state spending plan. in san francisco, the city broke ground on two new affordable housing complexes south of market. the projects will be built at the temporary site of the transbay terminal. they will serve senior citizens, low income families and formerly unhoused individuals. there will also be child care, retail space

and supportive services. more than 700 people are expected to live in the two buildings. thousands of community college students in santa clara county will have their tuition automatically waived, starting next year. it comes after state lawmakers passed a bill that will speed up the process of getting free tuition for the west valley mission community college district, the mercury news reports. the new legislation will benefit nearly 15,000 students across west valley college in saratoga and mission college in santa clara. students will only need to provide their address and fill out a federal student aid or california dream act application to qualify. dollar tree is getting bigger. the discount store says it is taking over more than 100, recently shut 99 cent only stores. the massive acquisition includes about 170 stores nationwide. at least 90 here in california, $0.99 only stores filed for bankruptcy back in april, closing all of its 371 locations. dollar tree now plans to reopen its newly acquired

this weekend, celebrating independent filmmaking. the festival will be saturday at the amc kabuki theater, eight near japantown. it's a chance to bridge the networking gap between smaller filmmakers and hollywood executives. it's now in its 12th season. this festival is normally held in los angeles, but the festival's founder, san francisco native dave brown, wanted to bring it home after the pandemic. >> there's a lot of talent in the bay area, so it's time for me to come back there, you know, shine some light on the city, give us the opportunity to show that there are talented people in san francisco. so this is a great thing. >> it really is. the festival also features several documentaries highlighting san francisco's evolution and the challenges the city has faced in recent years. movie star morris chestnut, who a lot of people love it, will be hosting the event well recently announced a rave plan for this saturday
