[ laughter ] >> we are back together talk about what has happened and what is still to come. let's start with this, sentencing comes july 11th and they asked the question could chime go to prison? in deciding the sentence the judge may weigh the underlying seriousness of the charges as well as trump's decision to go to trial rather than accept responsibility by pleading guilty.

johnathon, you and i spent a lot of time in this courthouse watching this play out. with anything surprise you? >> know, after watching him in court quite frankly i would say that the very concept of jail for seven like this would be otherworldly and ridiculous. after watching the court room i say i have some doubts in my mind but it would go against the overwhelming weight of the past cases. you have a nonviolent offence by a first offender, old yulia defendant i would be very surprised what there is a menu of other options from communion service to home confinement. in my view, and dismissals about most judged to be thinking about which is basically go out and send no more type of warning. you're still under supervision. then you get really tough. if you desk it was something that's like commuting service and confining him to trump

tower. i think trump could get a suspension pending appeal from a higher court and that might weigh into the calculation. >> rbc that's coming probably saw the best bright spots for the trump legal team on that front. stormy daniels testimony and the vagueness of the underlying crime and the fact the defence expert witness was not allowed early severely limited in what he would be able to say and the issue the presidential immunity which we are all waiting on that for the supreme court, what do you think is the best option on appeal? >> i think they have another up -- number of options at their disposal. i think challenging this notion that the da took this collection of business fraud misdemeanours and did legal alchemy and put it in a pot and add election fraud and presto they have 34 felonies. they were instructed along those lines didn't clearly they had trouble grappling with the instructions and asked the judge to read the instructions back to
6:06 am
them. i suspect the trump legal team will come up pretty hard on the idea that there was on the underlying predicate that was sufficient for this misdemeanour to a felony. i think they also have arguments on the exclusion of the bolt of there testimony in the trump legal team was saying look the jury needed to be able to understand the ins and outs in order to decide this case and the judge prevented us from putting on the testimony the jury needed to hear. >> hindsight is 2020, how the prosecution did, what the defence did. they say this under how trump team blewett this is a guest essay, an opinion piece but they wrote and said and said telling a simple story his defence was a haphazard cacophony of denials and personal attacks and failed to focus the jury on the weaknesses in the prosecution's case and try to fight everyone and everyone even when they gained little by doing so. your response to that? >> there's always that monday morning with the members of the defence team they felt they did the best they could, and quite
6:07 am
frankly, you could be clarence darrow and loss this case i was hoping for a hung jury. i've viewed this and wants the instructions come out that it's almost guarantee for the conviction, there was not a lot of room there. this is why i tell people you shouldn't blame the jury necessarily the instructions were really a poison pill instruction. the left very little room for the jury they were told over and over again in the judge said nothing as a prosecutor said there was election violations in this case and they were ordered by trump in the defence objected to those. and the judge just overruled everyone of those. so what they heard in that courtroom, it's not too surprising in terms of a conviction. but did create this target rich environment for appeal. but the appeal is likely to play out after the election. most americans weird as divided as we are politically.

many this was a political prosecution. in my view we haven't had this type of political immunization of the colonel justice system since john adams. it's been an awakening for many people looking at this and saying maybe this is where our rages taking a semi look again at what we are becoming this will be the new norm. >> yes, and we are going to talk to the show today for republicans to respond in kind. to do what they accuse democrats of doing. wishes using the legal system for this purpose and we will discuss of this -- this is the best strategy. i want to make sure we had on the hunter biden case because this gun case, lesser last-minute deals, that goes to trial starting tomorrow which are a selection in a toggle what they would like to include as evidence and they say this. the defendants laptop, israel, it will be introduced as a trial exhibit and it contains significant evidence of the defendant's guilt.

more evident on his laptop is corroborated by independent sources including witnesses and also by the defendant's own admissions in his book. this is a legal and political heading for the biden family. >> for sure. this child will be fascinating to watch play out. the justice department saying that hunter biden light on these forms he filled that when he went to buy a firearm. and what they will use to prove their case is his own testimony in his own book where he time and how he was struggling with addiction and they will be calling people very close to him, his friends and family who will also testified that he was addicted to controlled substances at the time he filled out this form and when he possessed the firearm. i've seen the defence's arguments and i don't find the very persuasive. i think they will argue even though he was addicted maybe he didn't know he was addicted or maybe he was dating on monday but it ended by tuesday when he bought the gun, i'll find a persuasive but it will be fascinating seen the justice department move forward this prosecution next week. >> so much we have heard as the

i've been in the hundred 17 cities the first question that comes up almost in every public forum is what about the open border and why would president biden allow it? he did more than allow it, he engineered it and everyone knows that. >> we will's see what he spins out as early as tuesday of this week i want to ask you about the verdict you think it's a travesty as many people do and i think having watched the trial there is many grounds for the trope to use an appeal. there's those out there that say they need to turn around and do the same thing. republicans have to bring charges against the democratic officers, even presidents only retaliation in kind can reduce the deterrence necessary to enforce the political version of mutual assured destruction the other piece with how high the temperature is says this we have to ease up and stop enjoying our

investigate what the prosecutors are doing at the state and federal level to use politics. political retribution in the court system with the political opponents and federal officials like donald trump. it's a really important thing for us to delve into and we will look at social council jack smith who we believe is abusing his authority as well we have that mechanisms to try and get control of this. we will be doing this within the confines of our jurisdiction. i think this can have the desired effect until the people we are not going to tolerate this. people are losing their faith in our system of justice and that's a serious threat. >> we i want to ask you about something that might need clarification, on friday you said you think the supreme court should step and then you said i think the justice on the court i know many personally and i think they are deeply concerned. one of your critics out there, so one who covers the court with me mark joseph stern wrote this he says fascinating to hear the gop speaker the house admit to

>> thank you very much, you mean shannon. >> let's talk about this. the republicans been on this is it will motivate your base angry voters and motivated voters they are angry about this verdict. political -- political as this that president trump cannot beat -- beat president biden with the play? motivated scam and trump's only path to victory is a coalition that includes many republicans and independents who find him deplorable but think a second bite in turn would be even more so. what is the plan from president trump to reach out to people who might not love him at this point maybe nikki haley voters, independents and others who or sceptics other then the grievances what about campaigning a policy and reaching out to those folks directly? >> there is no doubt the verdict has actually unified our party. without any question we see people comment -- calling and saying i the bandwagon now.

i've seen this two-tier justice system working against the president of the united states, it could work against me to. i've seen donors who have been on the sidelines this entire process now jumping in and why the reasons why we saw more than $50 million raised in 24 hours. but you are a hundred percent right. the issues that will drive the results of this november 5th election will be can donald trump close the southern border and the answer is, he already has close the southern border. can you bring inflation down under 2 percent? the answer is it was 1.4 percent when he left office. and he create jobs for the poorest americans? the good news is he crated more than 7 million jobs with the highest percentage going to women, african-americans, hispanics, and asians. we know about four years under donald trump's we had low unemployment, low inflation, high enthusiasm, law and order in our street we had the exact

ban. trump is now said you will not sign a federal ban and this is to be left to the states. mike pence said this when the news came out he said president trump's retreat on the right to life is a slap in the face the millions of pro-life americans who voted for him. a majoty of americanlong to see minimum national protections for the unborn and federal law but today too many republican politicians are all too ready to wash their hands of the battle for life. i know you are passionate about this and we have talked with the fact that there is states that do not have a limit on abortion up to a due date. are you willing to concede that position or would you fight to push president trump if you are his vice president for the federal ban i know you care so much about? >> you are a hundred percent right. the democrats and republicans are all pro-life honestly. and they have already voted to allow for abortions up until the day of birth. but it goes beyond that.
6:27 am
the former governor of virginia says perhaps even infanticide is okay. i find that immoral without question. the supreme court has already wrote -- ruled this is a state issue. president trump and the speaker have both said that this will remain states issue and it is consistent with the supreme court, we must make sure we allow the american people to see the extreme position of insanity on the left in the state rate issue on the right. >> but knowing you feel this so extreme, wouldn't you want to at least have a conversation? would you think president trump, who respects you, would listen to you on this issue if you're going to say there is states out there that have no limit whatsoever? you are saying that they have a terrible position but if they do, wouldn't you want to limit it in some way? >> i can just tell you the voters focus.
6:28 am
they ran for president in the voters said not now. they want president trump leading the party they have been embracing his position on the state position of letting communities decide the issue of abortion and that's a subtle issue for our party and frankly it's one that takes the issue off the table for the democrat to the most extreme position. >> come back and let us know it's always good to see you. >> yes, ma'am. >> the congressman welcome back to fox news sunday. >> thank you, always good to be on. >> they said after this new round of tools that they are in full blown freak out mode over president biden with a pervasive sense of fear has settled in at the highest levels of the democratic party over his reelection prospects even among officeholders and strategist that previously had confidence about the coming battle with

legal issues and i think that was probably a smart move because we know one -- when voters are going to the polls are not thinking about trump's trial and thank you out hunter biden they are thinking about inflation in the situation in the pocketbook and even foreign-policy to some extent. this does not is not on the radar the same type away. however, that will change this week starting with the courthouse robert de niro, that had some mixed results. >> maybe not the way they hoped it would play out. >> yes, it it didn't hit the right know but i thought it was noticeable when president biden was asked about it he addressed to use walking out of a room at the white house and he's asked and turns around and smiles just doesn't say anything so he's walking an incredibly fine line here but i think the biden campaign, it also the trump campaign to little more difficult for them because trump is the centre of this. but to focus to campaign and talk about the economy and really creates that split screen that's what they did on friday.
