november, voters will decide whether to enshrine marriage equality in the state constitution. yeah. that's right. marriage equality is the law of the land right now. but lawmakers here in california worry that since the united states supreme court rolled back abortion rights, they're concerned that marriage equality could be next. california has had a back and forth relationship with same sex marriage since san francisco began marrying couples in 2004. in 2008, voters passed proposition eight, changing the state constitution to block same sex marriage. the united states supreme court decision in 2013 made that amendment obsolete, but it's still there. now, state assemblyman evan low from the south bay and san francisco senator scott wiener have co-written assembly constitutional amendment five, which californians will vote on in november. the amendment removes the provisions opposing same sex marriage from the constitution once and for all. it's sort of seen as quote unquote, zombie language, but the fact of the matter is, given where the direction of the united states supreme court is,

that provides the impetus and the sense of urgency to say that we need to preempt this. the amendment has already cleared the necessary legislative hurdles and has the backing of governor gavin newsom, who worries that shifting national political tides could undo marriage equality. >> look what's happening. all these red states to voting rights, civil rights, lgbtq rights. look what's happened to women's rights. not just access to abortion, but the debate we're having today about access to contraception. this is real. >> married couples in san francisco say the battle for equality is a constant struggle, and say they will support the measure in the fall. >> absolutely. it means everything to me. i'm, you know, marriage equality should be across the nation. so if it's not enshrined in our constitution here in california, which we get looked at often for, it definitely needs to be ron bacon and john cooper say after more than 30 years together, they've had to go back and forth to get married and stay married. >> and he and i have been married three times because of the law.

>> now they say they'll vote to protect their rights and their marriage. >> we always believe that it should be a right for all. everybody, not just straight people. >> and voters here in california will have their say november 5th. we're live in san francisco. christian captain ktvu, fox two news. back to you guys and christian lawmakers say they have already heard rumblings from the u.s. supreme court that add to a sense of urgency here. yeah, that's exactly right. you know, when the u.s, when the united states supreme court overturned roe versus wade, they say that justice clarence thomas made reference to trying to overturn the 2015 decision, which allowed same sex marriage in all 50 states. so now they're saying they need to be on alert and take action now. >> all right. christian reporting live in the city tonight. christian. thank you. >> beyond the celebrations, pride month is also a time to raise awareness about mental health issues facing members of the lgbtq community. according to data from the cdc, lgbtq plus

adults are twice as likely to report they have been diagnosed with depression and nearly a third report having poor mental health. for more insight. earlier on the four, we spoke with joy alafia, executive director of the california association of marriage and family therapists. >> i can tell you firsthand that the current political climate is affecting the lgbtq plus population. it is affecting the mental health. if you're constantly having to just fight to exist and be you, that that takes a toll. >> lgbtq young people are also facing similar struggles when it comes to mental health, but alafia says she's hopeful to see more acceptance in the younger generations. >> preparations began this afternoon to set up the iconic pink triangle in san francisco for pride month. volunteers picked up supplies, including the pink tarps and spikes that hold the triangle to the hillside. every year, a bright pink triangle is installed on the north side of twin peaks. in june, it was used as a symbol in

concentration camps to identify gay prisoners. the lgbtq plus community has since reclaimed it as a symbol of pride. >> personal freedoms are definitely under attack. there are 500 laws proposed in various states across the country. anti gay anti-drag anti-trans bills. so the pink triangle is there to help stop that kind of hatred and discrimination. >> volunteers built the outline of the triangle today. they will set up the display itself tomorrow morning. >> one southern california city says it will not fly a rainbow flag for pride month. the city council in redlands, a city in san bernardino county, voted to keep the flag down this june. the decision comes after the city flew the rainbow flag for the first time in 2021, then again in 2022. it did not fly it last year, one of the council members who voted against flying the flag said flying it would create a rift in the community. >> well, for the first time, california prison staff are allowed to wear rainbow patches during pride month. the

california department of corrections and rehabilitation says the move is meant to show the department's support for the lgbtq plus community. staff can purchase and sew rainbow embroidered patches onto their uniforms, but officials say those must be removed before july 1st. >> all right, we're following some breaking news out of santa clara right now. both directions of el camino real between calabasas and keeley are currently closed due to police activity. this is some video from a short time ago from sky fox. police say a community member reported a suspicious package and out of an abundance of caution, santa clara pd requested assistance from county sheriff's office bomb squad. police are asking everyone to avoid the area and take alternative routes. for now. we will bring you any updates as they come into our newsroom and developing news here in the east bay, where an overturned army vehicle caused a major traffic backup on interstate 580 from sky fox, you can see the 25 foot long truck on its side and soldiers standing on the shoulder of eastbound 580 in san

leandro. >> fortunately, no reports of any injuries, but the accident did force the closure of two lanes. it has caused a backup that stretch for a couple of miles from the scene, all the way. at six 164th avenue, the lanes reopened just about 30 minutes ago. >> the golden gate fields racetrack is closing this weekend, and the final horse races are already underway at. the historic venue has been open for about 80 years, but has faced controversy because of a number of horse deaths. ktvu is henry lee is live at the track with this story. henry >> yeah. after 83 years in business, golden gate fields is shutting down on sunday. they're consolidating operations with santa anita racetrack in southern california. animal rights advocates say it's their pressure that helped lead to this closure. >> the industry of horse racing is not worth a single moment of cruelty. >> samantha fay rides and trains horses and her great grandfather, second from the right, was albany mayor. when golden gate fields first opened. although the track has been a key part of her family's

history, fay says she's grateful it's closing on sunday. >> these horses, while they're still babies, are are overworked. they're stabled for nearly 24 hours a day, and they are coming off the track traumatized. >> on friday, as we conducted interviews, word of another horse dying just hours earlier, the seventh fatality at golden gate fields this year, the animal was named sam spade after the detective. >> it's kind of a mystery. we don't know exactly what's happened. all we know is that it didn't happen to him while he was racing, and he's an unraced two year old. >> martha sullivan is an organizer with kill racing, not horses. she says the track's closure has to do with financial reasons, as well as pressure from animal advocacy groups. i think it's a combination. >> i think it's people are less interested in risking and taking horses live just to gamble. >> it's a sad day. after 83 years, that golden gate fields is coming to an end. >> david dugan, the track's general manager, says they're consolidating with santa anita,

the racetrack in southern california. he said friday's horse death was related to an internal issue at the horse, not linked to racing or training, despite the best efforts of our excellent veterinary team here, we weren't able to reverse that process that had set in, dugan said. the track did not give in to animal rights advocates like these, who chain themselves together across the track. >> back in 2021, that wasn't a factor in the decision to close. >> horse racing fans are making their final visits. >> it's been here for 80 years. it's kind of an end of an era. i think maybe a lot of it is because people do mobile betting now, and the last few times i've been here, the grandstands have been so empty here on closing weekend, my thoughts and my heart are with the horses that we weren't able to save. >> so still unclear is what exactly will happen to this prime 140 acre property along the bay. the stables are in berkeley jurisdiction. the actual track in albany. it could either be turned into a park or housing, and for now, any

market with better than expected results, many of which are better than before the pandemic, ktvu tom vacar reports with a look at the numbers through the eyes of a true labor expert who's been in the employment law profession for more than four decades. >> the u.s. job count increased by another 272,000 jobs last month. that's way more than the 180,000 that had been forecast, and well above the recent running average of 232,000 a month. >> at the same time, i think it's important to note, the main sectors of job growth nationwide

continue to be ones connected to government spending, employment lawyer and former edd director michael bernick cautions that health care, social services and direct government jobs account for 46% of the new jobs. >> much of it driven by tax money. >> private sector, construction, manufacturing, showed modest, far more modest gains. nonetheless yes, the total national unemployment rate ticked up a notch to 4, still low by the, standards of the past half century, but above the 3.7% we had a year ago in may 2023. >> wages compared to a year ago are 4.1% higher. but stubborn inflation at 3.4% eats up most of that. >> and i think that explains why polling shows most most americans dislike, or at least

very worried. >> the number of posted jobless meetings has come down a bit to 8.1 million, but still well above pre-pandemic numbers. >> but it's well below what we were two years ago in may 2022, which was 11.7 million. >> the number of people voluntarily leaving their jobs, as opposed to being fired or laid off, is also down to 3.5 million. also so well above pre-pandemic levels. what we know about the quits rate is that it reflects a lot the confidence people have in the economy, the confidence they can get other jobs. all of that seems hopeful and manageable. but here is what is not declining consumer spending, declining retail spending, declining industrial production, as well as this, stubbornly high inflation rate. >> that was our tom vacar reporting spirit airlines is

grounding any possible plans for bankruptcy. the budget airline's ceo says it is no longer considering a chapter 11 bankruptcy filing, and is encouraged by its plan after a failed takeover by jetblue airways, spirit has been struggling with shifting travel demand, increased us competition and a pratt and whitney engine recall that grounded dozens of its airbus planes earlier this year. a federal judge blocked jetblue's planned takeover of spirit on antitrust grounds. the faa will continue to allow airlines to have fewer flights in and out of airports in the new york city area through october 2025. despite high demand and the beginning of the busy summer travel season, fox's richard jacobus has more one by one jumbo jets took off into the puffy dark clouds tonight at laguardia. >> the good news almost all of them were on time, but the busy summer travel season is just getting started. a month from now, things may look a lot different. the faa saying this week it will allow major airlines to cut the number of

flights they operate out of new york city airports by 10% for the second straight summer. the decision causing concern for potential delays and higher fare prices. >> i actually got this flight for he and i for $150, two tickets, round trip, and that would make me very sad if it would make it impossible for us to come see my sister. >> the faa extended the measure through october of 2025 to address what it calls high demands and staffing shortfalls. specifically, there are not enough air traffic controllers to deal with the normal volume of flights. i'm frankly more worried about this from a passenger stand point based on, you know, i just don't want there to be not enough staff in these control towers. the points guy managing editor clint henderson says despite concerns over delays and higher fare prices, travelers should not worry. in fact, henderson says airlines are using larger aircrafts to fit more passengers and fares have leveled off. >> i will say prices have

stabilized, so we're not seeing the huge spikes that we did in 2021 2022. >> time consuming enough as it is having to travel like to the airport, through the airport and back. any extra on top of that just makes it a really uncomfortable experience. most major carriers say that less air traffic means less time trying to get those planes off the ground, even though summer storms halt just about every flight. >> we're at laguardia airport. richard jacobus, fox five news everything is going well aboard the international space station since boeing's astronaut capsule arrived yesterday. >> nasa plans to keep the boeing starliner at the space station for a few more days before guiding it to a landing in the western u.s. its launch on wednesday started a successful week for space exploration. spacex's starship also blasted off on thursday. it's the largest and most powerful rocket in the world. nasa hopes it could bring people to the moon and mars in the future. it also returned to earth and successfully landed in the indian ocean. this was the craft's fourth try to make it to

space, and back without exploding. >> another wildfire to tell you about this one near brentwood. skyfox was overhead at albers court and deer valley road. cal fire says that fire burned about 23 acres in a rural area before crews on the ground and in the air got a handle on the flames. more than 60 firefighters worked to contain the fire. no structures were damaged and no injuries were reported. crews remained on scene this afternoon to monitor for hot spots. >> pg and e says there have been over 1200 wildfires in its service area so far this year, and things have ramped up in the past couple of weeks. >> we've actually seen probably one third of the fires from this year have happened during that time, and the vast majority of those fires are grass fires. you can have a grass fire that hits into brush land, that hits into forest. and what started as something relatively small becomes something massive. >> pg and e says it's growing. camera and remote sensor system is helping to improve their efforts to keep small fires from

getting out of control. >> state regulators are considering new rules which would not only protect workers from extreme heat, it would also extend a school children. the proposed standards would require indoor workplaces to be cooled below 87 degrees and below 82. in places where workers wear protective clothing or are exposed to radiant heat, schools and other work sites that do not have air conditioning would be required to use fans, misters and other methods to bring the room temperature down. cal osha is set to vote on those rules june 20th, and they could take effect this summer. >> here in the bay area, the heat has moved out, at least for now. temperatures a cooler for inland cities today, and that cooldown expected to continue into your bay area saturday. a live look outside our doors. here's a view sfo. we have low clouds there. you can see up against the hills, mid and high level clouds as well. the ridge is moving out and a trough will be moving in. and that again is going to keep this pattern going

continuing west coast fundraising swing this after he reportedly raised $12 million at last night's event in san francisco. the high dollar fundraiser, hosted by venture capitalist david sachs and reportedly attended by other silicon valley investors, this is mr. trump's first fundraising tour after he was convicted of 34 felonies in new york. mr. trump met by both protesters and supporters on the streets of san francisco. backers of the former president say he's gaining support among the tech elite. >> tech leaders in san francisco and silicon valley. and i would say california in the broader sense, have been deeply troubled by the economic environment here for their workers, for their growth of their businesses. >> it seems pretty clear that most of trump's largest donors, not just in silicon valley but around the country, are driven primarily by economic and financial questions. these are

very wealthy people who generally benefit from lower taxes and less regulation. >> mr. trump will also hold an event in newport beach this weekend. president biden has been in europe this week, though he's planning his own major california fundraiser next weekend. >> prosecutors have rested their case in the trial against hunter biden on federal gun charges. as fox's rebecca kaster reports, the defense is still deciding whether to call hunter to the stand. >> hunter biden's daughter, naomi, said she was nervous while on the stand in his federal gun trial friday. her testimony brought her father to tears as she talked about his struggle with addiction. yet she painted a positive picture of hunter when she saw him in october 2018, the time he bought the gun at the center of this case. he seemed good and i was hopeful, is what naomi told the jury. as many legal experts say, sympathy is hunter's only hope for an acquittal. >> every juror says they know someone who struggled with drugs . and the combination of that, i think the defense hopes might get a couple of them to look

beyond the evidence, hunter pleaded not guilty to three felony charges tied to purchasing and possessing a gun while using drugs. >> but over the last four days, prosecutors have stacked their case against him through evidence and witness testimony. now, hunter's lawyer is debating whether or not to put him on the stand. on monday. >> i don't like it. look, 99% of the time in the 30 plus years i've been trying cases, i don't put my clients on the stand because it shouldn't have to come down to that. >> the first lady's presence in the courtroom could also have an impact on the jury. she made the whirlwind trip from france to delaware to attend the trial again friday, before traveling back to europe saturday. >> he may be facing 25 years in prison if he's convicted of all three charges. it is absolutely reasonable for her to be there. >> president biden has said he will accept the jury's verdict and will not pardon his son if he's convicted. in washington, rebecca castor, fox news. >> conspiracy theorist alex jones wants to convert his

personal bankruptcy into a liquidation. jones filed a motion thursday asking the court's permission to convert his chapter 11 personal reorganization case into a chapter seven liquidation. the move would help pay off some of the $1.5 billion that he owes relatives of the sandy hook elementary school shooting victims. the families won a lawsuit against him in 2022 over his repeated claims that the sandy hook shootings were a hoax. jones and his media company, free speech systems, both filed for bankruptcy reorganization after the verdict. >> the federal communications commission is launching a cybersecurity pilot program for libraries and schools. the fcc announced this initiative, a $200 million cyber program, to determine how the country's schools and public libraries could be vulnerable to ransomware attacks and cyber threats. the fcc says those systems face a number of growing risks. schools say cybersecurity attacks are one of their biggest concerns. the goal of this pilot program is to gather data and find out what works best to protect learning institutions

former giants player hunter pence and joins us live with why he's excited about this effort in the city. jana >> well, hunter pence has not slowed down in his retirement. he says that he is dedicated to helping san francisco become the best, most sustainable city and he said it is a perfect partnership with the yes sf coalition's mission. >> you have your pre-assigned groups. look for your leader who's holding up a flag, a brigade of brightly colored vests descended on downtown san francisco friday with some all star power tackling trash in a pick up with pence cleanup. >> it's been a really fun transition. >> yes, that is hunter pence, the retired san francisco giants baseball all-star and world series champion, is celebrating one year since the launch of his nonprofit called healthy planet project. on friday, pence and his nonprofit joined with deloitte and other members of the yes sf coalition. yes sf is a public private partnership on a mission to revitalize san francisco by bringing sustainable urban startups and

innovators to the city. >> the sf is completely aligned with the same things that healthy planet project is aimed at doing, which is you know, creating a sustainable san francisco. >> as the team picked up trash through downtown friday, allison hagan, deloitte's san francisco managing principal, said this is one of many partnerships underway. >> this is our one year anniversary of launching sf with the sf chamber of commerce. the world economic forum, salesforce and citi. one of the things that's so special about sf is the collaboration between the private sector, the nonprofits, the innovators and the city. >> hagan says yes, sf is on course to open its new headquarters this coming fall on montgomery street at busch, providing a hub to help many of the yes sf startup innovators that are already scaling up, potentially developing new jobs and helping support how we live in an urban setting. >> when we launch the challenge last year, we had 150

submissions and from that group chose 14 innovators. so today, sort of the call to action was hopefully we can get 300 people submitting. >> just amazing to see the impact that they've made in just a year. you're feeling the uprising. the city is getting more vibrant. there's more people walking around. it's cleaner, it's feeling safer. so it's very exciting times and we still have a lot, a lot left to do in the movement. >> and there was a lot of energy out there in downtown san francisco today. yes sf says that they are hoping to continue partnering with nonprofits like pence's to improve downtown san francisco. >> and we also know that, yes, sf wants more innovators to apply and help improve the city. did they say when they plan to open up the program to new applicants? >> well, right now they are hoping to launch another innovation challenge in the fall that could be possibly coinciding with when their headquarters is ready to open. so we could be looking at just months away. all right. >> thank you for that live report from our newsroom, jana katsuyama. thanks >> second harvest of silicon

valley is closing its largest warehouse because of a looming rent increase. the 90,000 square foot warehouse on brennan street in san jose receives more than 85 tractor trailer loads of food a week. all of that food is distributed at second harvest facilities. officials say the closure will make it harder logistically to store and distribute food. it will be especially difficult at a time when the need for food assistance is greater than ever. >> we're serving 100% more people than we did before the pandemic, and we're doing it on a budget that's 40% less than at the height of the pandemic. so as what is really a challenge to us, and that's why we need people's support. >> a second harvest officials did not say how much the rent increase is. it is currently working on getting donations to build a new, larger facility, which it hopes to open in a couple of years. meanwhile, plans to work out of its existing smaller facilities. >> seniors in san francisco's chinatown are receiving bags of food to make nutritious meals. 5000 bags of food are being

distributed at the chinese newcomers service center's chinatown food giveaway. people started lining up early at cameron house on sacramento street for this giveaway. each bag contains over $75 in groceries. mayor london, breed and city attorney david chu were at the event as volunteers began distributing those bags. >> this is an opportunity for us to come together as a community and to support and to uplift one another, and there is nothing better to do that than with food. and it brings people together, but it also allows people to take care of themselves with dignity. >> organizers say more than $75,000 worth of groceries were donated, and over 100 volunteers put those food bags together. contra costa county is getting nearly $1.5 million in state funds for development of its resilient shoreline plan. >> the funding is from the california ocean protection council sea level rise adaptation planning grant program. team officials say the

funding will provide an essential foundation to create consistent sea level rise planning across the county, from the san francisco bay to the sacramento, san joaquin delta. the contra costa resilient shoreline plan addresses sea level rise across the entire 90 miles of the county shoreline, with a focus on impacted communities. >> stanford is joining a growing list of colleges and universities that are reinstating the use of standardized admissions tests. the university says it will require either the sat or the act test for students who are applying for admission in the fall of next year. tests are optional for next fall. applicant applicants stanford paused its testing requirement in 2020 during the pandemic, but they say a review found test performance was an important indicator of academic performance. harvard, yale, brown and cornell are all among the number of schools that are reinstating standardized testing. >> the 4th of july is just weeks away, and the san mateo county sheriff's office is reminding residents all fireworks are

the situation in gaza is becoming more complicated for israel's military, as it works to draw hamas militants out of areas that it's already cleared. the idf announced a new ground and air assault in central gaza, even as israel is facing fresh condemnation for a strike on a un school in a refugee camp. the idf says it was a targeted surgical strike on hamas militants, but dozens of civilians were also reportedly killed. it comes at a sensitive moment when some officials accusing israel of violating international law by targeting un facilities. >> when we refer to an unwashed school, i think we should really refer to a building that was once used as a school that is just currently being used as a shelter, trying to keep people safe. >> prime minister netanyahu is expected to address a joint
