fani willis, finding was no evidence of an actual conference of interest. despite an appearance of impropriety, the case could move forward. but, the judge gave fani willis an ultimatum. either you or wade goes. which he did hours later, when he resigned as a special prosecutor. as trump's many legal cases continue to >> all of the oxygen from the room, with justice ever be served before this year's battle at the ballot box? joining me now is msn legal analyst, former u.s. attorney and professor at alabama school of law in one of the cohosts of # this is my podcast, joyce vance. let's start with what judge mcafee did yesterday in terms of mixing legal standards to reach a decision, what are your thoughts? >> katie, you know my view from

the get go on this one was that the only relevant determination under georgia law was whether fani willis had a financial conflict of interest in this case. it was clear she did not. the defendants were obligated to prove it up if they wanted to see her disqualified. they never got there. ultimately, the judge reaches the correct view. there has been some discussed -- discussion of what he went too far in the opinion. he did seem to stray into areas he did not need to go into to reach this decision. ultimately, the question now is what is in the best interest of this case going forward? and, how does the da office t this one up for a speedy trial and convictions of the defendants named in the case? >> joyce, i have concerns about some language that judge mcafee included in his ruling yesterday. one phrase for example being, and the odor of mendacity remains.

did he consider in any way, do you think, the impact of that type of finding could have on the other cases that fani willis is prosecuting in fulton county? >> he certainly should have. this is a high immediate interest case. the judge should have known that anything he wrote in his opinion would be disseminated. people who viewed the testimony in this case viewed it differently. the judge has his view and he is entitled to his view. the reality is the trial is months away at a minimum, if not longer. it is unlikely this language will linger in the minds of jurors. we are hyper- focused on the news in this moment. people tend to forget overtime. at the end of the day, i do not think this impacts the ability of prosecutors and defendants to select a fair jury. overall, this really became a sideshow. it became a real debacle. looking at it in hindsight, it

is possible that fani willis could have cut it all off by filing a response to the defendants and their initial motion acknowledging the relationship saying it was not a conference of interest. like everything else involving trump, and this is an important point, it is something that has been blown out of focus for political purposes i defendants in a way that judges would not tolerate a normal course in the ordinary course of business. it is a cautionary tale for every prosecutor who is involved in a case against trump. they had to be prepared to move the case forward. as prosecutors do, focused on the best interest of the case while trying to minimize the sideshow. joyce, let's switch gears. with scott north to manhattan. let's deal with the fact that trial was supposed to happen beginning march 25th for donald trump. instead, we will have discovery violation hearing. something you and i are familiar with his former executors.

can you plan for our viewers why a discovery violation could have as big of an impact as having witnesses stricken or case dismissed. >> under new york law judges have broad discretion when prosecutors violate their obligation to turn information over to a criminal defendant for trial. we do not have trial by surprise in this country. defendants in criminal cases are entitled to the prosecutions evidence far enough in advance to prepare a defense to the case prosecutors will bring. this situation is confusing. trump's lawyers have alleged the manhattan das office that indicted this case is in violation of their discovery obligations. the question here is about federal prosecutors across town in the southern district of new york. the da reached out to them over a year ago. asked for information. some of which was turned over in which the state prosecutors,

who are in charge of the case, probably provided to trump following his indictment. the complaint now is trump submitted a subpoena to the federal prosecutors. in the course of the last month, they have begun to produce documents that trump did not have previous sleep. -- previously. the state prosecutors have told the judge, this is not our mistake. we have turned over everything we have. we have complied with our obligations. the judge's says he wants to see timelines on discovery submitted by both prosecutors and the defense and he will evaluate whether any discovery abuses occurred here. >> we all will be tuning in march 25th to see what is the paper trail between the manhattan das office and the southern district of new york and to see whether or not we continue to maintain the future trial date, 30 days from yesterday, which was march 15th. my friend, thank you for getting the show started today. i always appreciate you.

says i am not waiting until i do my term, i am gone now. how to get aid bills done for not only israel, but ukraine and taiwan? how do we get things done for americans where we are about to kiss up again for another government shutdown? >> here is a thing i want viewers to know. time and time again in the last year and a half, the democratic showed up as the adults in the room to make sure that government is funded to make sure packages get through. will continue to do that. will find every possible way to get the funding bill through that need to get through. speaker johnson has no choice. he has hemorrhaging members of his conference. he has to work with us, which is what we have said the entire time. you are right. i have concerns with someone like ken buck leaves. although we disagree on many things, he is a man of character and integrity. he literally said, you have no case for impeachment. this is a sham. you are lying

march 25th is when the trial was supposed to start. instead, it will be used for a hearing on potential discovery violations by the manhattan da office. trumps team is seeking to strike witnesses like you. are you concerned at all that your role as a witness may end up being collateral damage because of a discovery dispute? >> listen, if that is what happens, i am okay with it. i want the viewers and the world to know i did not volunteer to be a witness in this case. i am subpoenaed by the manhattan district attorney's office and i will comply with that subpoena. if by chance, i am removed as a witness that is okay. the da has plenty of documentary evidence. there are plenty of other individuals that will be called as witnesses. they will hold donald trump a cannibal for whatever it is that he is been charged with. do i think it is going to happen? no. what i be okay if it did? absolutely.

>> michael, while trump is not fully planning to use the advice of counsel defense, he has filed notice to say he intends to make the case that he lacked the required criminal intent to commit the charged crimes against him because of people like you who were handling the hush money payments. what do you make of trump trying to thread the needle helping to keep his attorney- client privilege sacred and in tact while still trying to punt all of the blame on you? >> of course, that is exactly what donald does deflect, deflect, deflect. as you said, delay for another day. katie, i do not want to get into too much of the case itself . the manhattan da case. i do not think it is fair to them. let me just say there is something called the crime for exception rule, which would negate this altogether. i do not want to get into too much of the case. one of the things we do know is

that there are documents that donald and his legal team were not given. i stand with-who was an issue a few moments ago. everyone, including donald trump , is entitled to the full set of discovery in order to defend themselves except for michael:. one of the things i speak about in my book " revenge , specifically page 235, is getting documents from the government. especially when the government knows they have done something wrong. and i am not talking about the manhattan da here. i am talking about the southern district of new york. we have been asking under for your four units both from the southern district of new york and from department of justice for three years. now, it is not just michael: asking for it. and i do have mark laying. in in case i have jeff levine.

we have been asking them for three years you know who else asked katie for the imitation so that they could look into it to investigate the weaponization of the justice department by donald trump, bill barr and others? hakeem jeffries, ted lieu, jamie raskin, steve koehn, dave goldman-they have all but the step up. senator durbin . so far, nothing. up until one week ago. it is not a surprise. one week ago, i finally received, out of 456,000 plus documents, 32 documents. the document happened to really to the upcoming, we will call it hush money/business/record fraud case. >> michael, i want to take a moment, and 30,000 foot view of what is going on. you do

different shows. you to your podcast and have written books. you talked about what you have been through. i always want to emphasize when you come on my show, the humanity behind what is going on here. a lot of us zoom in and look at the case and we zoom out and go about our day. i want to know from you, as we are on the eve of the first criminal trial for former president trump, what accountability means to you. you up and went to go to prison as a result of doing work for former president trump. you are the only one, who after all of these years, is still at the front of this war. at the front on the battle lines with the goal of trying to make sure that justice is realized. to be this close to the first criminal trial of donald trump starting, what are your thoughts? >> again, donald will be tried in this case. no doubt in my mind. it is going to be based upon the determination of the jury, not on me.

not on any of the witnesses. it will be looked at based upon the credibility of the witnesses. more important than the credibility of the witnesses, is that documentary evidence. if the jury believes so, it will ultimately show he is guilty of the charges that are being brought against him. and my prediction is that donald trump will be held accountable. >> michael, let's also talk about some of the financial challenges that donald trump has been facing. you are 70 who is intimately familiar with the trump organization and its finances. donald trump still has not posted a bond to stay execution by letitia james, the new york attorney general on half billion dollars judgment that she obtained against him. some of his adult children and businesses also. your thoughts about what donald trump is doing in order to secure the very large bond. >> donald trump will do anything

within which to ensure the bond gets obtained and the bond gets posted. this is a real problem for him. he had a hard enough time getting the $91 million, which again, i can understand how a publicly traded company like federated, which is chubb insurance, was able to justify responded to a guy that does not pay his bills. that is something we all know for sure. rest assured of something else. the last person that donald trump right now wants to scrap with is our unsinkable attorney general letitia james. she knows what will happen come the day the bond is not filed. she will start seizing the assets. to be a major sale of assets. one of the things i talk about quite often that people do not realize. just because you sell the asset does not mean the full sale price goes to let's say trump

or letitia james in order to offset the amount of the $500 million bond. with $110,000 per day of accruing interest. there are taxable consequences that take place on these assets as well. because his basis is substantially low. on top of that, many of these assets are also encumbered with mortgages. it is not as if 100 cents on the dollar will go toward paying off that $500 million obligation. >> do you spell it? it's not like desperation. donald trump. michael cohen, thanks for being here and thanks for sharing your insight. i appreciate you. . after the break, pt in crisis. how a band of violent gangs over to the capital city

hundreds of americans are desperately trying to get out of haiti after this week's resignation of its embattled prime minister accelerated the violence across the capital city of port-au-prince. the united nations estimates armed militias and violent gangs currently control about 80% of port-au-prince, including the country's largest port. sparking fears of widespread famine and disease. meanwhile, the spiraling crisis is creating international concern as tens of thousands of displaced haitians search desperately for safety.

during his four years in office never had an recollection. when he was killed in the middle of the night, he was one of 11 elected officials. he and 10 centimeters. the 10 senators left. today, your country whose constitution cannot be applied. what we saw this week was the international community, caribbean leaders with united states, secretary of state antony blinken personally stopped everything he was doing. he flew to jamaica and with haitians on a zoom call. they cannot get out of the country because no major carriers are flying there as a result of the unrest. they said okay, we need to put together a deal that you guys cannot do when the president was in power. and you did not do when ariel henry was there. we need to figure out what the transition will look like. today, we are waiting for the names of the nine individuals who were going to make up some presidential counsel. then, they had to get a prime

minister. then, they had to prepare the country for multi-natural -- multinational support from kenya. if it comes. and then eventually elections. in the meantime, 360,000 people who have been forced from their homes by gangs. we have ongoing gang violence. after couple of days of quiet mesclun has restarted. you have police force overworked and outgunned. >> is unbelievably sobering. i started the interview talking about americans tried to get out. let's talk about haitians trying to get out. on thursday, the u.s. coast guard stopped 56 haitians trying to flee haiti by boat and set them back to haiti. what a lot of people do not know , and this is familiar to us because we are in miami this is two hours away from miami. there is a wet foot/dry foot policy where cubans could flee the island of cuba to come to the united states to seek asylum here and they can be taken on by our country if they

got one foot on dry land. i want people to understand haitians never had the benefit of this. if haitians made it to florida shorelines for example, they were turned away immediately. they were also fleeing political unrest. political violence. why are they still being turned away if they are fleeing a country that is in such a state of chaos? >> most haitians do not know when they get stop at the coast guard they had to say, i have a fear of being returned. only then will the coast guard put them into a second interview to acknowledge or see if there is a credible fear. what we see is people are leaving. there has been a lot of focus on migration. makes mine to you, right now port-au-prince is more than 80% controlled by gangs. it is land-locked in the gangs control all of the roads out of the capital. should they decide that they are going to open the roads, then we had to be concerned as you may then see people try to get to the coastal areas in

order to get on boats these individuals we have seen that were picked up our people but left the northern part of haiti. today in turks and caicos, you bahamas and jamaica and they are all very concerned that you will start to see people get in boats because of the squeeze. if the seaport is shut down an airport is shut down, and this is a country that depends 50% on imports. food is not getting in. potable water is a luxury. every day we are in this crisis every day we are pushing humanitarian crisis. you may see people decide they will leave. let me add, the dominican republic has said they will not return the country to refugee camps. we are told they are not even allowing anyone with a haitian passport to get on the helicopters that are charging huge amounts of money for people to leave. if we continue to see deportations from the dr, people will say i am not going back there if this place will be overrun by gangs let me take a chance at the city -- sea.

will never be to use it ever again -- is that what they are proposing to do with the bill? >> >> that would be the result of the bill. the way it currently stands it forces a sale. enforces a sale under the terms that the company could possibly never meet. they want tik toc to divest itself from bytedance, which is a chinese-owned company. a portion of the company of two to is owned by bytedance. to for the divestiture to meet all the qualifications in the bill that the company has said they cannot meet even if they wanted to. and they are going to sell. it would effectively result in a ban. the lawmakers who pass the bill refer to this as a de facto ban in the press release they issued about it. >> taylor, at the beginning of your interview i was talking about how many people get their news from two to. it is not as i was joking tongue-in-cheek in the beginning, just the latest dance et cetera.

it is people getting news and there are major news outlets, including mine msnbc, on tik toc talk about the impact it could have if there were even a curtailment of access to an app like to. >> this ban could have devastating effect on free speech and civil liberties. it absolutely impact journalists as their ability to reach people. we saw elon musk taking over twitter and banning tons of journalists and forcing us off the platform. tons of people get their news from tik toc. myself and other journalists have hundreds of thousands of followers. use it to connecticut directly with the public. also, it is where people go to make news and break news i always say, when you see something on the side of the highway you see something crazy, often the first instinct is not to tweet about it. it is supposed to talk video. major news stories have broken. millions of people have been following the war happening right now in israel and gaza.

it is a primary news source for people and it is terrifying to see it ripped out. in -- it could affect 100 million users in the u.s. alone. >> of less than 30 seconds left. i have to ask and and my dad here. is not just us going as consumers, there are people to make their livelihoods off of tik toc, right? >> absolutely. the band could result in over 300,000 jobs lost wrigley. -- directly. it is contributing $24 billion to the u.s. gdp last year. hundreds of thousands, if not millions of small businesses affected by this ban. people that rely on tik toc every day for their livelihood. not just a bunch of influencers. rail, hard-working business owners all over the country. >> is not a whole bunch of young people doing it. i will admit, i maybe spent too much time to take to. taylor, thank you so much for being here. thanks to all of you for
