a very good day to all of you from the tom brokaw news center in los angeles. welcome to "alex witt reports". breaking news to share. police are closing in on a gunman suspected of killing at least three people in two separate shootings in false township just north of philadelphia. police say he got away in a vehicle. he carjacked the vehicle at gunpoint. let's go to nbc's george celisse in the area. he joins us on the phone. let's talk about what we know about the suspect and the victims. what is the timeline here? >> reporter: good afternoon alex. of fluid and developing scene. what we are hearing from police sources, is the suspect is currently tracked to home in winds, new jersey. and neck area he has ties to it appears that s.w.a.t. and the police to permanent on

the scene. l back it up for how we ended up here. to false township police, just before 9:00 this morning they were dispatched to a home. it is roughly an hour away from philadelphia. be determined and verified the shooting suspect as 26-year-old andre gordon, who they said was driving a stolen car. he killed two people at this home. following the shooting at home, he moved to a new area in the stolen car present monthly, and shot another person. a few minutes later, he carjacked a person at gunpoint at a nearby dollar general in bristol. this all happening relatively close in park city. that person fortunately is not suffering any injuries according to authorities. police say, it appears gordon the suspect, knew all the victims except the one involved in the car jumping. they believe he has ties to the winds area, which may bring us to why we are seeing these images over winds right now at this home. it is where we are told they

recovered the stolen vehicle which was last described as a honda crv with pennsylvania plates. a number stay -- namaste sticker on the back bumper. and police with looking photos of andre gordon. discovered, 6'1 with a thin build, last seen wearing a dark hooded sweatshirt again, police telling us it does appear that all of the people killed seem to have a connection to the suspect. except the person carjacked. all of this commenting in winds. we are working to get details. to find out who was shot and why they may have been shot. we know for while in false township, there was a lockdown issued in place. some of the recreational areas, like the parade, or canceled because of the shooting. a lot of people on high alert. resolutely, we know a number of agencies are involved in this

investigation. we have not confirmed if atp that atf will come out, as we usually see in the shootings this is obviously very harrowing and developing and it is an ongoing situation alex. spotted a couple of questions george. first of all, with and how much time did it take place in false township? an hour or two hours? secondly, do you know how far away false township is from winds, new jersey. i am curious how long it would take to flee, presumably at high speed on the highway. lastly, do we know if the suspect has any sort of a criminal history? >> reporter: to your first question. this all seems to have happened relatively soon. looking at the information i have, this all happened within the 9:00 hour. the first call coming in at 8 152 this morning. you hear about the shooting roughly around 9:01 and the

second scene of the shooting was at 9:13 this morning. your last question, it is close in proximity. with a vehicle you could get into winds, depending on the area, roughly within 20 to 25 minutes or so. right now, it does appear the suspect has a criminal history, given the have provided a booking photo. just how extensive, our teams are still coming through his history. given that he may have been known to authorities, it paints a picture them -- there may have been one or two criminal records we need to look into closer. overall, it all seems to have happened relatively soon this morning. >> george solis, thank you for staying on top of that. we appreciate the live pictures you are providing. tony finau is jim cavanaugh, retired atf special agent in charge, a former atf hostage negotiator, now msnbc terrorism analyst. one report we heard was the

suspect appeared to be in possession of an assault rifle, as well as additional weapons. at this stage, how does law enforcement go about approaching someone who is essentially this dangerous? >> the first thing alex, now that you have located him, you will contain him. the biggest question for the on scene commander is, is he alone in the house? that is the seminal question you had to know because it helps make your decisions going forward. if he is alone in the house and is just a barricaded gunman, then s.w.a.t. will surround and begin negotiations and to talk to him. w is a throw phone, a hard-line phone you try to throw in to communicate on that line. that is preferred. sometimes you have to do it via cell phone or text. sometimes you yell back-and- forth out the window. ideally, you want a throw phone in there and you want to negotiate with him and talking out. of course, he will be tough.

he killed three people. he may be suicidal. he may want to die of suicide by cop. of course he has an assault rifle. if he presents himself in a menacing manner at the window or the porch with a rifle, along rifle from s.w.a.t. team will kill him. his way to live is to negotiate and try to calm down. it takes some time alex to be able to make a reasonable decision like that when you are so emotionally charged in a murder spree like this. it will take some time for him to realize that maybe he could make a decision to live. of course, they may use teargas to try to get him out as well. >> when you look at what george solis was reporting . the fact this area of winds, he is known to be associated with this address. we do not know if it is his address. it was 20 to 25 minutes to get to the place where he went on a

killing spree and it happened so quickly. that would indicate it was targeted. am i wrong in that assumption? >> yes, it looks like he probably knew the people from the early reports. the first two he killed in a residence and he went to another residence and killed a person. then he carjacked a person at the dollar general store, who did not injure. he went to winds. this is probably unknown place to him as well, because he is reported to be homeless. here is the good news in the bad and horrible case he could be loose and officers would have to deal with him on the highway where he has a rifle at a traffic stop or in a crowded shopping district. when s.w.a.t. has a suspect irritated and contained in a home, it is tried-and-true practice for all s.w.a.t. operators, negotiators and commanders to deal with a guy like this. remember, the seminal question is, is he there alone? if he is holding someone, it

changes the equation for health operation moves forward. if he is alone, he will lose. as long as officers do not give him something to shoot at, time, they can manipulate. they can negotiate. they could put gas in there or send robots i have dealt with guys like this for many days sometimes, just so we did not have to kill him. we do not want to kill him. keeps talking. maybe some gas. talk again. try to get him to come out. try every thing you can do. they can evacuate the neighbors alex, to make it safer s.w.a.t. is in control. now, their training, experienced and tools, they should be able to get the guy out. now, they cannot guarantee they will get him out alive. the key is, can we get him out without him hurting anyone else or other officers? it is a plus if you save his life also. that is what you want to do. it is still an a if he does not

county case against trump can continue amid a host of new legal development. we head to blayne alexander in atlanta. give us a wrap of the latest there. >> reporter: this comes alex, after a busy day at the filaments here in fulton county, george. remember, this is something that the case against donald trump here in georgia was something in large part it has been overshadowed for the past two months because of the motion to remove district attorney fani willis from the case. we saw a number of allegations against her that she was financially benefiting from a relationship with nathan wade, special prosecutor. now that the judge has ruled a mess and said okay, you can stay on the case and nathan wade has to go. this case can proceed forward it also comes on the same date we have seen another development. rather a delay. in a different legal case for the former president trump in new york. major development in two of former president trump's criminal cases a judge late

friday granted a month-long delay in the manhattan hush money case. just days before jury selection was set to begin. judge merchant ruled the defense needed extra time to review a massive trove of documents the former president and his team only just received. in georgia, the man leading the prosecution against former president trump for allegedly trying to overturn the 2020 election results in georgia has resigned. is the culmination of a month- long >> after one of trumps codefendants, michael rahman, exposed a romantic relationship between lead prosecutor nathan wade and fulton county da fani willis, who hired nathan wade on the case. roman accused fani willis of financially benefiting from her relationship with nathan wade after the two went on vacations together while working the case. in a ruling on friday, judge scott mcafee said while he did not find an actual collective interest in the case, he did find a significant appearance of impropriety that infects the

current structure of the prosecution team. and gave fani willis and ultimatum to either she and her office leave the case, or wade. in a letter wade writes, he is resigning to move this case forward as quickly as possible. for willis, friday's ruling is a legal victory, but a professional below. following this stunning two hour testimony. >> it is a lie. >> judge scott mcafee holding what he called her, a professional manner, on the stand. not dismissing the case out right as a defense that asked, mcafee takes willis to task over, " this tremendous lapse in judgment. " trump attorney says he will , " use all legal options available as we continue to fight to end this case. " alex, we have heard from a couple of the defense attorneys who are part of the motion to remove fani willis. a couple have said they are essentially considering all options in response to the

decision. one has a ready indicated that an appeal is not off the table in this situation alex. >> stay with me. i have a few more questions on the georgia case. as we have been discussing, there is a lot to discuss regarding former president trump legally our colleague katie phang, host of "the katie phang show" is joining us. as far as fani willis is concerned, judge mcafee says financial gain was not a motivating factor of her prosecution. the defendants failed to demonstrate that her conduct impacted the case to their detriment. however, can trump's lawyers appeal the decision and still try to get her disqualified? >> yes. trump's lawyers and any of the defense counsel that joint on to the motion to dismiss and disqualify can't obtain what is called a certificate of immediate review ability. they can take that and appeal with that. they can also go to the city council of prosecutors , which is the counsel that would have had the case given

to it to reassign it if judge mcafee had decided to disqualify fani willis. there are avenues legally for the defense attorneys. there also are avenues noted by judge mcafee in his ruling could be taken to directly impact the licenses for fani willis and nathan wade. alex, in my opinion, what you just read should have been enough for judge mcafee. what you just read in the fact that he did not find any material initial benefit. the fact that he found fani willis did not start this continue this because she was deriving financial benefit and it was not the motivation for her that should've been the end of the analysis he went one step further and said that as of the appearance of impropriety, there is an opportunity to cure that. in order to do so, one of the two had to step down. as you announced, it was nathan wade. >> katie, another big development. this is in the stormy daniels hush money case.

the judge has agreed to hear trumps motion to dismiss the charges on march 25th. that was the date the trial scheduled to start. it is fallen into a firestorm over allegations related to thousands of documents. , you just spoke with michael cohen on your show. what is happening here in any of it be fatal for the case? >> as it happens, when you are on the 11th hour before trial, certain things pop up. this is a big thing that has popped up. there is something called discovery that is when the state turns over to the defense, documents and materials that it intends to rely on for purposes of proving its case. the defense turned stress over as well. in this instance, hundreds and thousands of doctorates were turned over from the southern district of new york to hatton das office manhattan da office when drewitt and filtered certain documents to turn over to the defense. the problem is the defense is complaining in the information too late in the game. it needs more time. the delay is one thing alex, to

go to trial. the bigger issue is the defense is seeking to strike witnesses, including michael cohen and stormy daniels, of the witness list for the state. a are saying there are a lot of problems that came as a result of the material being turned over at a later time. they are also seeking a total dismissal of the indictment because they say that when the state has acted in bad faith during the discovery process, they did it to be able to damage the defense and there is no way the defense could get a fair shake of the leg at a trial. they are asking the judge to dismiss the entire indictment. >> we will see if that happens. one more quick question before i let you go. with so many defendants and open motions and applications of the fulton county cases, do you have any sense of when judge mcafee may set a trial date and where he may settle on all of this? >> reporter: it will likely be sometime down the road when the trial begins as for when the trial date will be set, because we have seen almost the end of the saga, we call it two in a month half saga that has in many ways almost stopped the

fulton county case in its tracks. everything we have been discussing, all of the hearings and motions for the most part of the past two and half months or so have dealt with the motion to dismiss. that, legally, is now behind the das office and is now behind the case. they are able to move forward. we could see a trial date, it depends on whether or not, as katie said, whether the defense moves to appeal it. as for when he goes to trial, it is unlikely it will happen before the election initially fani willis that the trial date of august 5th. early august. even before the motion to remove her from the case was being heard. it was an ambitious trial date. given the fact of in the past 2 1/2 month it has been delayed, it is almost impossible and almost certainly will not happen. again, very unlike -- unlikely we will see it before november. >> blayne alexander and katie phang. thank you. you can watch "the katie phang show" at noon eastern on saturdays

there are options here. he could hold off further munitions to israel, at least the offensive missions. in but conditions on them. a lot of democrats want him to do that. people in his own administration want to do that. the president has been reluctant. he has worn them for weeks about not going into rafah. israel has said, we will go into rafah , but they have not done it yet. there is a moment where you hear israel saying they will defy it, but they have not done it going into rafah, as the president has asked them not to do it be there waiting to see the latest on the talks that josh talked about and whether they can come up with a deal for a temporary cease-fire in exchange for release of hostages. >> at least they are at the table. it is a start. let's talk about the washington post reporting israel is slamming senate majority leader chuck schumer for saying its citizens should hold new elections to replace israel's prime minister benjamin netanyahu. in you knew article peter, you

said the president praised chuck schumer's remarks and did not endorse them. we heard the sound bite before you came on the air. it seems like a fine line. how did president biden manage to walk it? >> by saying it was a good speech and the senator was reflecting the concerns of a lot of americans, in effect, he was putting himself on the side of what the senator was saying without directly agreeing with chuck schumer should be new elections or that israel's prime minister benjamin netanyahu should be replaced. you can certainly see how that would look in israel . the general praise of the speech to the israeli government says he is basically getting on board with the idea we should have elections. it is not their business to say. it is our democracy and our choice it is an escalation in the friction between the biden administration and the benjamin netenyahu administration. it signals a fraught relationship has become in the four to five months since october 7th terrorist attack. >> put this in perspective. how big a deal are the comments

four the fifth time since september, congress is ready up against yet another government shutdown deadline. lawmakers must make a deal by friday night to fund critical federal agencies, like the department of homeland security and defense, or risk a partial shutdown. joining up on capitol hill, nbc julie sirkin. good to see you julie. how optimistic are lawmakers about making a deal? and what are the sticking points that have kept them from doing so up until now it's >> reporter: it is a great question. sources tell me they are very automatic about averting the shutdown deadline that would take effect a week from today if lawmakers cannot get their act together in the house and senate and pass the six remaining funding bills for the government funding deadline. remember how we got here. speaker johnson had split the

funding to give them more time to fund the full-your funding bills for all of the agencies. however, now we are facing potentially a shutdown for 70% of the government if they cannot get it together in time and told however, despite the sticking points, which we will talk about in a second, that they feel optimistic they can release the text of five of six bills sometime tomorrow potentially. of course, the house and senate will need time to take the bills up next week. the sticking point however, are large one of the bills, the sixth bill they presumably will not release tomorrow is to find homeland security department. this is because republicans and democrats are so far apart when it comes to the border and immigration. for example, democrats will ask for new resources. additional resources to the border for operational needs. and told republic of the pushback on this without significant policy change. we know what happened when they rejected the bipartisan senate

recounts how after he was hired by the trump campaign to examine claims of voter fraud months after the 2020 election he again and again saw an accurate allegations election was stolen. tony finau is owner of simpatico computer systems. ken block is the author of "disproven: my unbiased search for voter fraud for the trump campaign, the data that shows why he lost, and how we can improve our elections" . a big welcome to you. you write the very first instance of voter fraud you are asked to investigate and felt a bonkers internet election fraud claim that the manager at one of trumps golf courses forwarded to eric trump. what was the bogus allegation about and who did you report to in the trump campaign ultimately, was donald trump made aware of your findings? >> all excellent questions. i reported to a top lawyer within the camping infrastructure, his name was alex cannon.

alex did the country a great service by performing due diligence. he actually did his job as a lawyer. he wanted to make sure that any claims that would go to court were credible. not only could i not deliver credible claims of fraud that i was looking for, but i helped alex determine close to 50 different claims of fraud that others have made were false. and therefore, they did not become a part of lawsuit filed. as far as the 700,000 duplicate votes in wisconsin that a group of volunteers -- a friend said to the golfer and got the rest of the travel of that. they made a basic, simple mistake. they did not understand the data they were looking at. they did not understand the data was lacking 700,000 votes cast in person in wisconsin in 2020. what is amazing about this claim is that it was prominently talked about on a

website called the donald that went -- donald.win. which is where alex told me to go after had gone from the golf manager to eric trump to alex to me. it is indicative of what the entire 30 days look like after the election until the last week when the state certified election results. there were everybody in the closest and furthest relatives trying to come up with a proof that trumps claims of voter fraud could be proven. as far as i looked at, it did not stand up at all. >> you have said that in fact, the claims, the false claims, snowballed after the first one you like that during the time you spent with them there. and that you found absolutely zero evidence of any significant voting irregularities. and

curious, what were some of the other fraud claims he looked into? were you at all under pressure from trump allies to conclude that fraud claims were legit? >> let's start with that one. another important part of the story. no. the reason i was not put any -- under any pressure is that alex cannon made the decision that i think the for, that he would keep my identity and the identity of my company secret. so that i was not subjected to external political pressures to deliver a desired result. he wanted a honest, straight up assessment and that is what i gave him. >> i was going to say, does anything come to mind that was so absurd that you had to look into and spend time swatting down? >> certainly, the wisconsin 700,000 duplicate votes took the cake as far as the worst of them. i was asked to try to determine if a non-citizen was voting in arizona. whether dead voters were voting in pennsylvania.

whether nursing home pallets were being valid-harvested in pennsylvania, even though in 2020 pennsylvania allowed pallet-harvesting to happen. i knocked down as sidney powell- sponsored claim of fraud. i bumped into several of the same analysts across multiple different claims, who were doing really bad work and providing the people paying them for the work awful data. that is what happened. >> mentioning powell and eastman brings me to this question. you write the you were surprised by how many campaign lawyers were skeptical of trump's claims. including alex cannon, the attorney that hired you and protected your identity but others, a group of lawyers led by rudy giuliani, they were not particularly concerned whether the fraud claims are true. describe for me the divide within the trump campaign.

ultimately, where the skeptical lawyers drowned out by the rudy giuliani contingent? >> yes and no. rudy giuliani, sidney powell, john eastman and others were very hard at work impugning elections with claims that were at best, shaky. at worst, outright lies like rudy giuliani's claim of ruby friedman committing election crimes. alex cannon took the totality of my findings, which was that we did not find sufficient fraud anywhere to overturn an election result and all of the other claims were false. in his january 6th deposition testimony, he told the january 6th committee that he brought the findings of no fog darkly to mark meadows. he told mark meadows we did not find fraud. mark meadows excepted the finding is true. in the last

few months, we have seen news stories that save mark meadows hold jackson's investigators that he had been taken the message that no credible fraud was found into the oval office. >> there are a lot of people in this country who should read your book. i will get the name again.
