a very good day to all of you from msnbc headquarters in new york., and went to "msnbc reports with alex witt" . we begin with breaking news and fast-moving developments in the terror attack outside of moscow. the death toll is rising with at least 130 people, 133 rather, dead after shooting at a fire inside of a concert hall. today, u.s. officials say no americans are believed to have been killed. a branch of isis is claiming response ability, but so far, not offering solid proof of the claim. today, russian president vladimir putin addressed the nation suggesting ukraine played a role without providing evidence. kyiv denies the claim.

right now, russia says a dozen suspects are under arrest, including the alleged gunman as police and fire crews remain on scene at this hour. right now from london is matt probably. what is the latest on the victims and also, russia's investigation into who is responsible? >> to be on the casualty numbers but the victims have been describing horrifying scenes. there were at least three helicopters deployed to rescue people off of the roof of the building. even as a third of the roof burned down. here is one woman who survived the attack and what she had to say. >> translator:

>> and now, the manhunt. russian authorities say they have arrested 11 people, at least four of whom were directly involved in the attacks. we know that isis course on, based in afghanistan and pakistan, have claimed her subtlety for the attack. u.s. intelligence officials say they believe the claim. american intelligence and tipped off the russians that isis had plans to attack weeks ago. but that has not stopped- as you mentioned, russia politicians and nationalist figures oddly up to present himself blaming ukraine. a much more familiar enemy and one has been locked in war with russia for the past two years. something the ukrainians have denied. russian president vladimir putin said the attackers tried to hide and move toward ukraine. ukrainians have been preparing to welcome them, he claimed.

there is no evidence of that other than what we hear from the russians. alex? >> matt, do they think firefighters and first responders on the scene think they have recovered everyone? has there been any update that way? >> in terms of the dead, the death toll is rising and jumped up in the last couple of hours. it looks as though there are expeditions people can be buried under the rubble given certain and clear that they have arrested just about everybody who they say played a role in the attack. as far as the russians are concerned, they have everyone in custody that they think is responsible. the dragnet may not continue. we will be hearing about the political invocations of this for quite a while. >> we appreciate you telling us about that. matt bradley, thank you. more breaking news from overnight. the senate passed a $1.2 trillion government funding bill at the last minute. it is soon headed to the president for him to sign.

julie sirkin is joining us from capitol hill. it was in the wee hours it came together. talk about how it happened. what was the process overnight? >> reporter: it was back and forth alex. i was talking to sources before he went to sleep late in the night who told me there was no way to get an agreement on the mimic process to get it done in time. they are going to come back on sunday to do it. obviously that would mean a lapse in government funding, although not a serious one because operations would not be affected until monday. you see what is on your screen. 70% of the government agencies were funded. i woke up in the middle of the night to see that perhaps the jet fumes and the two resist the congress started today got them to muscle this through and get the agreement done. they voted faster than i have ever seen them vote on anything to get out of town to get the process over with. it is the sixth time we have been near a shutdown this fiscal year alone, since october certainly, lawmakers were sick of it. they wanted to get through the

operations process and last night we finished here is chuck schumer on the floor. >> it is no small feat to get a package like this done through the government. the past few months have shown yet again, that when bipartisan has room to work, we can get the job done. a deep and sincere thank you to all of my colleagues on both sides of the aisle for their good work. >> reporter: look, good news for our viewers as well. i am sure they are tired of seeing the shutdown clock on their screen. we do not have to talk about this again until october. i cannot underscore enough how behind they are on the process. member, it was conservatives in the house i wanted to break this apart and do the lateral approach to fund the government instead of muslims or a big package at the end of the year, like they typically do. i guess they succeeded, but really, it was two massive spending bills split into two deadlines instead of one and a lot of headaches. >> a very late, late friday night on october coming. joined me now, democratic congress and from

massachusetts, seth bolton did a member of the armed services committee and a good friend to us. how much copied to the sensors go through last night? what was it like at 1:00 and 2:00 in the morning x it is a lot. >> given the average age of the senate a means a lot of coffee. >> before we get to the government funding bill it is not a laughing matter. i want to get your reaction to the deadly attack in russia yesterday. here is the thing, u.s. intelligence warned americans to stay away from large gatherings in moscow after sharing intelligence with moscow. what is your response to all of this and moscow has with pipit to saying let's looked to ukraine for this? >> not only is vladimir putin blaming ukraine now, which is totally false, this is isis khorasan. which shows they are a continuing threat. not only that, the "wall street journal" is reporting that vladimir putin told america that our warnings were trying to distract the russian people.

this is a massive intelligence failure on the part of vladimir putin. even worse, he told his own people to ignore the american intelligence which was spot on. we deserve a lot of credit for not only getting this right, but sharing it with the russians. even though russia is an adversary. america stood up for its principles and decided to see innocent people killed, no matter where they live on the globe. i want to say again, we had the commander of sitcom in charge of the middle east for the united states before the house armed services committee this week. i asked him if it would be wise to withdraw from iraq. we have heard really, but recently he said absolutely not. is number one reason was because 16 is still a threat. we have to keep that in mind. >> we just got word from the control booth. president biden just signed the funding bill and it is official. we are funded in the country through october.

look, in the whole process we have both sides touting success, right? more republicans voted against the bill then voted for it share with me the highlights as you see them, and what would disappoint your constituents that is in the bill? >> look, one thing is that this is merely continuing last year's budget. there are some increases, but they do not necessarily keep up with inflation. we have not done anything to address the fundamental injustice in america. the fact that so many of the wealthiest people in america, including the largest corporations, paid next to nothing in taxes and yet our deficit keeps going up. our deficit ballooned radically under trump. this does not really address that on one hand we averted a government shutdown and kept things as they are. on the other hand, we have not done a lot to make the situation better. the fact that so many republicans voted against the bill is pure political

opportunism. of the first things i learned in congress is that it is much easier to come up with a reason to vote against a bill. if there is one thing embedded in thousands of pages you do not like and get a lot of political hay railing against it. and gets, what we really needed to do here was save us from shutting down the government and keep it open. even though republicans control the house right now under speaker johnson, it is democrats who saved the day. >> that ideology there, angered by the government funding bill, congresswoman marjorie taylor greene filed a motion yesterday to oust speaker mike johnson. saying it is a warning. as the speak -- speaker shifts to ukraine and will have to tread lightly with the far right, what kind of threat does this mean for the prospects of a foreign aid package passing in april? do you expect democrats to protect the speaker if his

removal comes up for a vote? >> first of all, this all makes it difficult to do the right thing. not only for ukraine, but for taiwan. of course, the want to fund the border also to actually address the crisis that trump wants to turn into a political football. that is what trump just told the republicans in congress, do not fund the border and make the chaos worse. that is what we have got. marjorie taylor greene is an agent of chaos. really, the entire republican party is in chaos and in a civil war across america. has come to a head in the house it was not that long ago the republicans kicked out speaker kevin mccarthy and gave us for the first time in american history that we have not had a speaker the house. representative marjorie taylor greene is continuing the chaos and that is why it is so critical that democrats take back the house in november. i am working very hard to get good veterans in key races to

win the seats we need to swing because the chaos will only continue under republican leadership. >> one more thing about this legislation because it put a one-year ban on federal funds for the u.n. relief agency that supports gazans. was at the right decision's >> no, i do not beget was the right decision. i am very upset about the reports confirming that there were some employees of this agency actually aiding hamas. but, the agency is much bigger than that. that needs to be squashed. they do important relief work all across the globe and we have to continue funding them. the good news is there is funding through the end of the year. if we can make the necessary reforms to this agency, we can find them again in 25 >> when my question to you on the situation in gaza. russia and china vetoed the u.s.-led u.n. resolution which called for immediate and sustained cease-fire tied to the hostage release.

it was a public change in stands for the u.s., which had previously vetoed measures that called for a cease-fire. this week, you personally issued a statement calling for immediate bilateral cease-fire. a shift for you as well. explained the newfound urgency in stopping the conflict. >> actually it is nuanced, but not a shift. what other countries and certain activists in the united states and called for is the unilateral cease-fire. to stop the fighting and do not get hostages in return. that is a bilateral cease-fire and part of a hostage deal. which both the biden administration and myself, as you said, have called for this week. the reality is we have a deal on the table it took a while to get israel to agree to it. now it is hamas that refuses to follow through. hamas is once again holding onto the hostages. 167 days and refuses to give them up. the fact that we do not have a cease-fire today is the fault of hamas. let's not forget the entire company could end if this

the public may see the royal family imploding. i think a large part of it is about being pushed from outside and a sense of protecting the children as well. >> i am curious about her request for privacy. let's take a look at her living as she released. >> we really hope that you understand that as a family we now need time, space and privacy while i d treatment -- complete my treatment. my work is was probably a deep sense of joy and i look forward to being back when i am able. >> will kate be left in peace and privacy. clearly wants british media outlets say they support her. does that mean no kate headlines? might there be respect for her young children? >> alex, i am not sure. it seems to me that you are right that everybody is saying the right thing today and

everyone is full of compassion -- compassion and care student everyone cares about her children. but, she is one of the most popular of the royals. is a sense of speculation about what type of cancer she has. these are the conversations people are having in pubs and illich shops and will be going on before in the pages of newspapers. my sense is that it has not put it to bed. it is changed the tone. a lot of repentance on social media for people who have been saying pretty vile things. they are not eating their words. even the press here, which this week i was asked to comment on the historic nature of the royals needed to be visible in public. that has all changed in terms of tone. but, i suspect people want to know that she is well and they will continue to be asking that question about what sort of cancer it is. >> the file comments. summit fun of her and there

have been apologies for all of that. we know that william has continued his royal duties as kate has been recovering from surgery. how likely is that we will even see kate out anytime soon wasn't there and the event, something with military, scheduled for june? they removed her name from a website saying she would be in attendance. ! yes, we cannot expect to see her at anything. we will not see her at easter service or the tube of color. chemotherapy is grueling and we do not know what cancer she has it potentially is one of the more difficult ones. and the sort of chemotherapy you have for that is something that makes you very ill. we probably will not see her for a very long time. i have been struck how much we've seen prince william recently. perhaps, we will see less of him also because he now has a justifiable reason to be with his wife and family. i do not think we will see her anytime soon.

it is an interesting moment for the royal family. we go back a decade and we heard charles, when he was prince charles, wanting to slim down the monarchy. now, he has got it and i am not sure it is what he wanted. really, now we have the queen camilla, princes and edward doing his duties. and prince william but he can't. it is very slimmed down and a time of great concern on a personal level. you have three members actually of the royal family with cancer. the duchess of york has it as well. yet, we have a job that must continue. the show must go on. that needs to go on in such a way that continues to inspire the faith and trust of the appellation. -- population. >> i want to ask your thoughts on that tense relations between the whales family and the sussex family? what you make of harry and meghan's message of support?

>> everyone feels they had to do it. it is a brief message. it feels perhaps pointed to indicate, as they have voice said, that actually these things need privacy and peace. they are kind of vindicated in what they have said. actually, a family needs privacy if it is dealing with big news or, if it is bringing up young children. we have both of those in this instance. i think that sense of what they are saying is absolutely truthful. people agree with them, let's hope, about privacy and peace. yet, at the same time, we all are responsible for not allowing that privacy. we are all hungry to know she is well. hungry to know it will be fine. i do not know whether it will rehabilitate meghan and harry. unfortunately, they seem to have some of the lowest popularity figures. recent polls in january put

". and here with me onset is the vascular reporter of the guardian. who can still come to the rescue of trump, outside of something with really deep pockets? do you expect any intervention from any of new york appeals courts? >> i do not think we will see the court way in -- weigh-in, in terms favor.

letitia james said he could turn over titles, real property to support the judgment to the new york trial court. i think we can look forward to seeing trump try to angle for 11th hour deal. that is what he did in the e. jean carroll case. he came up with $83.3 million bond at the last minute. now that he has a new deal for his social media company in the works, perhaps he will be able to leverage that and find another deep pocket lender. someone with conservative ties, to help them out. i would not be surprised if we see that happen. >> something you just said about letitia james. saying she is willing to take the deed, where he to have it over. what is it of its making that and seizing the property? is it the end the same result and just a nicer way of going about it? >> when you are in the attorney general's position, what you are looking for is something that firmly guarantees you will

collect the judgment, even if it is years down the road following an appeal to the easiest thing and most careful deal if you are the party like letitia james, who has prevailed here, is to have a security bond. that means that the defendant does not pay up the assuredly will do so. there are other sorts of sureties that are slightly less desirable. the problem with real poverty is it is not liquid. she would be gambling on the liquidity and value of the property down the road. it is not her first choice, but it may be the best choice to secure the judgment. >> hugo, to you now. trump's lawyer sort of explained the challenge with getting a bond for the full $454 million. it flies in the face of donald trump's own words. >> a handful of sureties, as we stated, are approved by the united states department of treasury to underwrite bonds of

the size. of those, even the very limited handful amounts they are limited to policies with single bonds up to $100 million. none of them except hard assets and require cash or cash equivalents such as markable securities >> i do not need the money did you publishing the cash. we have a lot of cash. we have substantially in excess of $409 in cash. >> what are you hearing from your sources? does he have a backup plan if money does not matter less by monday? >> trump has several hundred million in cash and he alluded to that and is truth social post is a separate point is the problem having trump as a client if you have a lawyer. you are making as additions to the court in one instant and then trump comes out and says the opposite. we do know he has several hundred million dollars from real estate deals he has done since leaving the white house, including a big development. he

does have some cash. there was the idea which was he could get a rich donor to finance this. there was the idea that he could use his holdings in truth social >> that takes a while the. >> if it gets approved and it happens it would be a good six months. >> a could get a waiver from the board. the board includes people like his adult children. and kash patel. the problem with the waiver is the moment you publicly announce my holdings in truth social will be use to pay the judgment, he then needs to sell them. it reduces the value of his holding and is dependent on market conditions. that is why think it is not something that any surety or bond company would look at as a serious proposition.

>> was moved to this question with a big court hearing taking place on monday. involved his hush money case and the new york judge has denied donald trump's request to exclude testimony related to michael cohen, stormy daniels, karen mcdougall and also the "access hollywood" tape. was there in trump's own statements here is what stormy daniels said this week. >> are you ready? >> i am absolutely ready. i am hoping with all my heart that they call me. as i showed on the stand against michael avenatti, i do not need someone to speak for me . i relish the day i get to face him and speak my truth. >> joyce, what are you expected when he shows up in court on monday? >> this hearing on monday will be about a discrete discovery issue. trump has asked the court to dismiss the case entirely or, impose a significant delay, perhaps 90 days, because he says the das office failed to

disclose materials and discovery they were obligated to disclose. the more we have learned about it, it looks like it is not a major issue. in fact, fewer than 300 documents are involved. this is not about a failure on the manhattan das office. rather, it is an internal doj issue where the southern district in new york and manhattan-that office in the process of turning documents over to trump pursuant to a subpoena for access to materials involving michael cohen and his grand jury proceedings and other statements. they were as late as december and they are only now being turned over. not the district attorney's fault and not something the district attorney can be held accountable for that at this point, the expectation is this case could be back on track for an april trial. alex, the rulings you listed on admissibility of evidence and witness testimony are important because the judge has been very

balanced. given prosecutor some, but not all of what they want, which suggests if there is a conviction in this case the court will not be reversing it an appeal because the judge had his thumb on the scales for trump. very balanced and straight up the middle. >> hugo, if this case goes forward, donald trump will be the first former american president to face a criminal trial. do you hear any sense of foreboding within the trump camp? >> trump himself is concerned by it on a personal level. he does not like the optics of the first president to face a colonel trial. the same issue he had at impeachment. he did not want the stain of impeachment on his legacy and likewise, he does not want the stain here. his campaign season the family. they are looking at the political consequences as far as they can tell, they think if they can do a good job muddying the facts of this case with the other two civil cases that have preceded the criminal case,

they could get into the clear. that is because they are betting a regular vote, not pay attention to the facts. the phosphorylation of business records in a criminal case sounds a lot like falsifying records in the new york ag case. when you big sums of money being thrown around, whether the ag case or e. jean carroll case, they can successfully clue in voters that do not follow the stuff that it is all one thing and it will blow over . the one thing they are concerned about is the criminal trial at the federal level. the jack smith trial that is what they are determined to push that down the line. >> you both know we can do an entire hour talking about the donald trump trials. it is simply converging with actions and a lot to keep track of. i thank you for doing so. good to see you joyce and hugo. coming up, the biggest question about donald trump's truth social mergers.

you. >> hello alex. >> what a turnaround for truth social. i remember a couple years ago- but, anyway. is it worth billions of dollars and how could it change donald trump's financial crunch? >> the reason the tournament is happened is because donald trump will be the republican nominee for president. this is a company whose entire evaluation is linked to the idea that donald trump will beat joe biden in november and that essentially is tweets are worth $6 billion. he has around half of that equity amount. a couple of things. as you noted, that is his value on paper. it is a stacked field and without getting into the nitty-gritty, this is essentially a shell company used to avoid the disclosure you would do through initial public offering. in other words, less daylight for investors. less of an ability to look under the hood to see if the financials are really solid. and, they have had a very poor track record.

to begin with, the fact that it is coming out of the stock market as a sbc should give investors pause. the fact that is linked to a highflying idea that the donald trump presidency is worth $3 billion to him and $6 billion to investors is something that should give them pause. even if he ends up six months from now having the ability to cash out his shares, i do not think it will make a big difference to surety companies that would post a bond on his behalf for the new york court judgment against him because the value of those shares are variable and the companies that back bonds did not want to have collateral that changes in value. they want things that are as solid and as liquid and predictable as possible. they certainly are not donald trump's shares and a fly-by- night social media company. >> let me back up. this just came to mind. in layman's terms from you,

does it mean that putting truth social out there and making it a public company- the timing has to be now. was a he did in november after the election and he is not elected and then the value goes down. which then begs the question, is it a good investment for somebody to put money into truth social right now? >> i am not a investment adviser and i will do a disclaimer upfront that this is not investment advice. it is like crypto or anything else that just does not have solid financial guarantees. if you are buying shares in nike or in apple, you know what their products are. they have a long track record of sharing shoes or computers. they have very discoverable public financial statements you can scrutinize to make sure the evaluation is correct. everything around truth social lacks those. >> while dumbbell considering

you put out the disclaimer. donald trump has to play -- paid the bond or they can begin to seize his assets. yesterday, donald trump posted eagerly have almost $500 million in cash and he intended to use it for his campaign for president. is there reason to believe that he's a-has the money. even if it contradicts his lawyer's claims they struggling to secure a bond. is it worth noting that he is not contributing his own money to his presidential campaign since 2016? >> alex, these are all such good points. i am shocked to discover donald trump is not heeding his own lawyers' advice. let's think of the trajectory that he is made over the last year about how much cash he has on hand under oath in a deposition a year ago he said, i have $409 in cash on hand and i am adding significant amounts of money to that total each month.

then when he got the massive judgment against him a year later about $454 million court judgment, he suddenly said, i do not have the money on hand. which is under oath, he was possibly lying, which is he perjured himself. or, he somehow blew through the stack of money over the last year. or, it went somewhere else. he didn't want to touch it perhaps and he wanted to lay it off on small donors. he said, i don't have it. he goes to republican administrations about a firesale. i am up against the wall et cetera lo and behold, he is going to court to say i need to catch a break because i do not have the money. and then he takes to social media a day or two ago and says, i have $500 million. i am really rich. from a legal standpoint, it is about the dumbest thing he could've done. because the court now has two wonder about his truthfulness and his track record of

right now, new weather alerts in place across the country as storms bring heavy snow and rain for millions of us. the east coast faces risks of flooding while heavy snow is falling in new england. the west is bracing for another big storm. nbc news meteorologist michelle grossman has more what to expect this weekend. it is looking ugly out there michelle. >> it is so soggy out there. looking at heavy rain falling. we are looking at snow, a lot of it in some spots.
