affair began, she decided it was time to tell her husband she wanted a divorce. >> i remember saying, we need to talk. nobody ever wants to hear that. he looked at me and said, are you having an affair? and i said no. >> why were you honest at that point? >> i didn't want to hurt him. >> what came next? >> we both got very emotional. he agreed to it. >> then came the shooting. day in try to think of anyone who could've been responsible. that's when she remembered a strange visit a month before the shooting from a man claiming to be a plumber. he said he was looking for a water leak in the building. >> he needed to check her pipes or something along that line. >> i said, okay. i thought what am i doing letting the strange person in my home and i had a feeling this isn't right. >> five minutes later the plumber was on his way.

did you check with your super? >> i called the office and told them the incident. they said, there should not of been anybody at my door. >> that most of been a weird feeling. the following day, the same man appeared again. right below her apartment balcony. >> he was standing on the ground by a tree and looking directly up at me. >> that is creepy. >> yes. >> are you thinking i am being stalked? dianne saw him a third time. this time immediately after sam had been shot. >> that same man. came running up the stairs towards me. i looked at him and i said what are you doing here? >> she recognized him. you can hear her on the 911 call. >> i remember him making a motion. then he ran off. >> did you start to think in

>> there's always more. >> the man identified himself as michael minor. the detectives immediately brought him to the sheriff's office for questioning. >> he is distraught but willing to talk to us. we were ready to listen to him. >> michael outline the details of the shooting. he started by insisting it was an accident on. >> but detectives weren't so sure. after all, michael shot sam not once but four times. one of the shots was to the back of sam's head. so sam is laying here in michael is right on top of him basically giving the final shot? >> he would've had to have been. >> one shot might've been an accident but not three or four that he actually fired. that was no accident. >> detectives wanted to know if

parking complex and he brought a gun because he had no idea how sam would react. >> according to michael, it didn't go as planned. when sam saw michael was armed, he fled. >> michael ran after sam up these stairs and he said at some point while they were in the stairwell, sam turned. >> michael claims he was in fear and closed his eyes and fired his gum -- gun. >> with all the things he's telling you, he's in a relationship with danielle, do you think we need to talk to danielle? >> the next step was let's hear danielle's story. >> the detective left michael

and headed to the hospital where danielle had been waiting for updates on sam's condition. all danielle had been told was that sam had been shot. no one told her by whom. >> when i got there, she was crying. >> detectives recorded the interview. at first the detective didn't reveal he knew about danielle's lover michael minor her that it was michael who shot sam. instead, he started by asking danielle about her marriage to sam. danielle candidly described it as troubled. danielle explained she knew sam was having an affair despite sam's best efforts to conceal it. danielle admitted she too was unfaithful. >> she was pretty straightforward and told me about the affair.

discovered evidence that michael had brazenly broken into dianne's apartment and videotaped the inside. >> inside, the belly of the beast. >> he is narrating. his first words were i'm in the belly of the beast. he pans over the alarm pad was not armed. >> that could've been bad. >> is michael documented every aspect of dianne's personal life, poking around her drawers, her refrigerator and insider bathroom, police said danielle played look up. in this text message danielle wrote get out if you're not already. getting bad feeling. >> he is doing it at the request, basically, of danielle. >> detectives found alarming with the text messages michael and danielle sent each other. michael minor says i want to blow his head off and put two on her. >> he goes on to say bang bang. i won't because it's wrong.

danielle responded, you would not and could not because that would be illegal. >> that was disturbing. >> in another text, danielle referred to her handgun which she called daisy, she wrote i'm close to introducing them to daisy. michael respond, we can do it together as a date. smiley face. in another she wrote, i hate them with every inch of me. revenge will be mine and it will be very sweet. >> it was very obvious that danielle had hate toward sam. that she wanted to hurt him. >> based on those text messages, it seemed clear to detectives that she persuaded michael to feel the same way. >> i absolutely think she poisoned michael's mind as far as what sam was. >> everything he knew about sam

with each other? do you think it's real? >> asked danielle that very question. why are you saying this and she said, oh, we were trying to sound tough. she tonight for real. >> that's not the way sam's sister saw it. when detectives showed those text to cindy, she was dumbstruck. >> i couldn't believe what i was reading. this is someone who has been in my family for almost 13 years. even talking right now, i have chills. >> those text she said proved how much danielle hated sam and wanted him out of the way. she is convinced danielle manipulative michael to feel the same way. do you think danielle had anything to do with your brother's death? what she directly associated? >> i think she is. i hold danielle dreher as much

if not more responsible than the man who actually shot him. >> cindy topol elected -- detectives that that wasn't her only motive and she was driven by that age-old incentive. >> i believe it was a money. to divorce him and split half to get all of it, i think it was money. >> just over $1 million in fact. >> there was a substantial amount of money she would gain if sam turned up dead. that's exactly what happened. >> we asked danielle dreher to sit down for an interview and both she and her attorney declined. during danielle's interview with detectives, she emphatically denied having anything to do with sam's murder. >> i would never kill my husband. >> the man who pulled the trigger supported danielle's claim of innocence in no uncertain terms.
