9:06 am
the monitoring policies and other systems and resources to make sure program success. those riementsdz were implemented by the sfpuc over the course of the next year and closed in early 2021 advertised a follow-up by csa the result of this bill at-risk four-year olds was that was a validation of the responses received by the controller's office and a reaffirm mansion of recommendations fulfilled with the improvements and in place by the sfpuc. the bureau actively monitored the bills to make sure their implemented according to the or not deadline as of

9:09 am
slide 5 the open audit and recommendations (clearing throat) if i'm reading this right do we have - we have for the completed any 6 these um, r50e789sdz but have a target close date of next month? >> yes. so um, actually are some improvement on those particular recommendations list as open remember this is a snapshot that up to this point in time as of 31st december activities have been for the that of january this month in february and closing out in march. >> that is the reasonable expectation they'll be closed out no march. >> we're hoping for more traction so, yes it is
9:10 am
reasonable. >> thank you. >> can you give me an example of what contract improvements will look for puc should approve the contract management can you give me an example of what they use. >> for this report they focused on an improvement of programs and policies throughout the agency around contract management that are better tracking of changes to in any contracts we know there is a lot of the amendments in the contracts and sometimes can be better tracked um, i think we attached the report if i'm not mistaken and those areas that csa are provided in the report as well. >> i believe that was included if not we can make sure we get you the full report so you can see the specific works that csa
9:11 am
outlined. and some thought we feel you (unintelligible) in a couple of weeks. >> has been transaction that is a san francisco transportation authority plans & programs committee in time of december 31st last year and traction and i feel those march timelines are still reasonable. >> some of the things were carry officers from other audits have been done before. >> it is stand alone audit from a stand alone audit we track those in the internal system and make sure there is no overlap between those two. >> thank you. >> any more questions of commissioners or comments and and do want to note in the meantime, all commissioners raise your hand i'm having trouble with the queue. >> any other questions from
9:12 am
commissioners? >> okay. thank you for your report we labored to every time you come up here for the part of our performanceing so thank you. can we have i guess open up for public comment mr. general manager anything. >> we have to go to public comment first. >> go to public comment. >> any members of the public wish to provide comment on item 5 no callers in the queue. >> okay. thank you. um, mr. general manager. >> um, that that's my report. >> thank you. >> okay. 5 b is a report on activities anything else needs to be covered today?
9:13 am
>> seeing none, let's go to the consent calendar. >> a whole pile of stuff on consent calendar any things to discuss let's start. >> thank you. i had a question on (clearing throat) 6 a the wastewater treatment and increased if contract contingency for the west side pump station on the wastewater treatment are we replacing it exactly with the same kind of wastewater treatment any upgrades? >> i think i see somebody to address that, please come. >> and identify yourself
9:14 am
please. good afternoon, commissioners my name is at&t to the project manager the project and, yes there are going to be modernization we have details of that particular organization and usage for the last 5 years and introducing the capacity of their wastewater treatment. >> and it will use the same techniques. >> use for wastewater treatment and on 6 i adding about money and time and to the west side pump station item i. >> i have a we also. >> adding to the cost and contingency is that because we're spent down some of the
9:15 am
contingency money or you anticipating will occur more time and costs adding to the contingency now? >> good afternoon commissioners president paulson i'm the senior manager for the project and um, expended approximately $975,000 of the existing contingency and expecting additional costs due to unforeseen things on the site over 50 construction complete a need additional time and funding for those unforeseen expected conditions that we've experienced to date and as we track the project to one hundred completion. >> when do you expect to spend down o contingencies? >> conditions of the gm
9:16 am
approval we expect to spend down the contingency and additional request we requested. okay. >> thank you. (clearing throat). >> commissioner stacy. >> okay. commissioner maxwell. >> thank you um, item g and h and item - we've it says um, o joe informed san francisco puc was taken over by another firm what do we know about that firm and do we go through the same process, you know, and find out what they do with the o jim. >> hello commissioners. i'm amanda higgins with the security and so similar the commission awarded the contract to o
9:17 am
technology and in december the food us they've been acquired by conversion technologies and so that's the purpose of notice but able to evaluate the retailer and working on the security system. >> thank you. >> yep. >> and then um, on h-6 h um, a little bit more information regarding the sole responsible bidder like - (no audio). >> good afternoon commissioners my name is tracey project manager for the groundwater project and the reason for only one bidder that is because some of the reasons that we got from the contractor
9:18 am
phase one is close to the holidays and two, also there are other projects that they feel more like doing instead of this project and that is specialized and not many contractors have that much experience. >> okay. >> and then the ones we had experience had other. >> yes. that's correct. >> i noticed during the bid opening date of the contractors 3 hundred the experience bid on another project and not this project. >> all right. and then so have we decided maybe mother to open up bidding during the holidays is that something maybe - >> yes. that's one good lesson learned in the future definitely will bid after the holidays.
9:19 am
>> and have any of the contractors working for us already? >> one of the contractors that didn't bid after the award of one of the original - local ground water projects so it is just a matter of choosing which project fits they're also the priorities they have on their company. >> is there any concern that because we only had one bidder that the price goes up and still competitive we've gotten - >> the jerks estimate $6 million and the lowest bid the single bid is less than $7 million so we've building that the estimate for the proposal received in the bidder is prior at that time and no change orders will bring it up.
9:20 am
>> we don't anticipate but because um, part the soak is absolutely excavating leaving the roads so we will never know if we have investigation and included in our - there are salesmen's activities you don't know they're captured during the investigation those are the unforeseen conditions but the same thing will be change orders. >> okay. thank you. >> commissioners. >> commissioners any other questions regarding the consent calendar? >> seeing none, open up for public comment members of the public present to provide comment on the consent calendar? >> seeing none, we have no
9:21 am
callers. >> so can we have a motion and second to approve the consent calendar. >> mo. >> first and second roll call. >> president paulson, aye. >> vice president rivera, aye. >> commissioner maxwell, aye. >> commissioner stacy. >> four i's number 7 please regular venture, to increase the contract amount by $1,000,000, for a new total contract amount of $10,950,000, and to increase the contract the contract the contract duration by three years, for a new total contract duration of 16 years and six months, due to a delay in the project schedule for the westside enhanced water recycling project resulting from the premature failure of critical equipment, and to provide continued engineering support during construction and the treatment facility commissioning process, subject to board of supervisors approval under charter section 9.118. >> good afternoon, commissioners barbara prosecuting for the west side enhanced recycling project the item before you is amendment 5 to 1345d for recycled water
9:22 am
projects this amendment will allow the sfpuc to have engineering and technical support services related to the construction of the new west side water recycling and due to the failure of the treatment facility is delayed by two years and the replacement equipment the administration of the contract no. cs-109 make sure the project has engineering support for the team and the remainder of the consumer price index process through early operations in addition we're also working to add additional things to the system like the lower housed and the san francisco zoo the team will help with the permitting process. with that, open to your
9:23 am
questions. >> so i have just one quick we want to make sure this is what wisp reported on maybe a few months ago because of happenings there were readjustment in the equipment that was put together thereof some erosion whatever based the details an opportunity to change did engineering put together a piece that was going to, you know, that took place am i correct? >> essential what this big part was this consultant tame analyzing still in the process of root cause failure analysis for this equipment. >> maybe i misstated so you can help us get this thing put together? >> that's your question. >> yeah. providing engineering
9:24 am
support services. >> got it. >> not the contract itself. >> got it got it any other questions on 7? >> seeing none, let's see - open to the general public comment. thank you. >> thank you for your presentation. >> members of the public present to provide comment on item no. 7? >> seeing none, to callers in the queue. >> okay. so can we get motion and second on number 7 please. so moved. >> second. >> motion and second roll call, please. >> president paulson, aye. >> vice president rivera, aye. >> commissioner maxwell. >> commissioner ajami, aye. >> four i's. >> okay. thank you. let's go to project; and authorize the general manager to take such actions deemed necessary or appropriate to implement or modify the mou.
9:25 am
>> mr. richie steve richie this item go to a 340u between the rec and park department and the puc port of san francisco zoo recycled water project. okay. >> um, the project will supply 200 thousand gallons to the san francisco zoo for animal wash down and irrigation for the highway. the project will offset close to 100 percent groundwater use with the recycled water and use that water out of the ground water project and i will say 12
9:26 am
used by the zoo is, you know, one of the fewer views for the recycled water tripped we're part of here. we'll construct a pipeline for the highway and take over the groundwater infrastructure and which use for back up for the recycled water san francisco rec and park department will continue to own and operate and maintain the reservoir and highway system. and just to make sure you're aware the zoo rec and park department that is why the pow is with the rec and park department. >> um, we will reimburse the rec and park department for the expenses from and fund a staff
9:27 am
position for the water recycled will be the biggest yours of the kr50irgd water in this to make sure that we stay connected with all the projects and we'll compensate them for the well and pipeline and then we'll charge the recycled water for the rec and park department as the cost is equal to the historic cost of groundwater and they'll be responsible to implement the great are highway. this the highway in the center lane for recycled water on the left will be the zoo area the solid purple line alongside that will be the existing pipeline we constructed for the recycled water and delivered up to golden gate park and the dashed line there will
9:28 am
be the recycled waterline to the pipeline and the purple areas on the map show where it will be used (clearing throat) excuse me - and that green arrow on the left to the upper arrow where water will be taken up and actually and fairly syrup water for the recycled water so with that, we recommend the option for the anyhow and i'll be happy to answer any questions you may have. >> commissioner maxwell. >> are those by any other name i want to mention the few zoo is in the country. >> i don't have an exact number we started to talk about that years ago and they were a
9:29 am
lot of concerns about the recycled water with animals. that has been researched over time i think the zoo might have been the first one, aye. >> so we're the few zoos around the country doing that. >> ? a reorganization process; is that correct? >> at the west side project you heard discussed earlier trying to get through problems that includes ultimately um, reverse osmosis that is removing the salt it is highly treated wastewater more than the middle wastewater for irrigation of the farmland for example. >> so it is almost. >> (multiple voices.) >> this is pretty darn close to drinkable.
9:30 am
>> (microphone distorted.) >> go ahead and you might answer any question and commissioner stacy. >> i just had a question hesitate happening in the lower grade highways are there pipelines three we are connecting to or have to lay pipelines for that irrigation system. >> i don't think we need to lay pipelines and a big no, if staff the retrofits are for the suitable recycled water the delivery so that area is recycled or gaited portal water to the extent that is or gated and shifting to the recycled water not a big yours right on the ocean. >> yeah. and it seems to me
9:31 am
there are a few policies that the puc is pursuing are the project and with the park that we're putting up groundwater. >> uh-huh. and valuable in other context in a way not just about this is the water for the park and zoo but thinking about the system and how the groundwater how that water. >> absolute; correct for the parks that water is suitable for purposes we take those irrigations uses, you know, pools with kr50irgd water is really a great example of the appropriate water quality
9:32 am
appropriate use so lesser we can use the entire policy groundwater for drinking purposes. >> thank you. >> questions commissioner maxwell. >> so the madam's can drink this water? i mean. >> i'm sure they'll love it again, this is not suitable for human but a lot of the research in the last, you know, decade or so to make sure the water is safe for animal usage. >> after that water is recycled does the water change? i mean it's taken things out of the water and now, maybe some things are put back i don't know if the water is drunk. >> the water itself animals will do a lot of things to the water. >> yeah. i don't mean their water i'm wondering about the
9:33 am
process. >> um, you know, if- >> (multiple voices). >> the recycling do we end up with a bunch of at the end of the day, when it goes out because i mean- >> (multiple voices). >> the recycled water process at the west side includes reverse osmosis that concentrates as part of that project will be discharged through the wastewater out flow along with the secondary treated water with the plant. >> that's what i was referring to. >> always revisuals have to go someplace. >> seeing none, open up for public comment to public comment please.
9:34 am
8. >> any members of the public present to comment? >> seeing none. >> and we have no callers in the queue. >> okay. seeing none, then let's say there a motion and second to approve this. >> move to approve the anyhow. >> second and motion and second roll call, please. >> president paulson, aye. >> vice president rivera, aye. >> a commissioner maxwell. >> commissioner stacy, aye. >> 4 i's. >> okay. so let's read >> okay. so let's read item 9 please. >> 9. approve the second amendment to the agreement between the san francisco public utilities commission and santa clara valley water district for long-term operation and maintenance of the intertie located in milpitas subject to board of supervisors approval under san francisco charter section 9.118. >> good morning, commissioners i'm chung north wastewater treatment the sfpuc and the psychos join me in
9:35 am
milpitas the supply up to 40 million gallons or water when supplemented water is needed this has been operational since 2020 the maintenance agreement allows to us do the - in practice the district has been the sole operator the operation of enterprise could impact the system unless they're the ones operating it and was a 5 year period if not to 2012 but the district service when we were in the thick of implementing if this was done there the first amendment and in 2014 maintenance with the enterprise come back to us making us the party. and starting july and
9:36 am
going forward we want to once again december national a district. and we want to do there the second amendment to the o m agreement and two main reasons one that given the for the most part the staff is very busy operating and maintaining the system added. the second reason is that more efficient for the staff to work on the enterprise because located closer to the enterprise versus our staff. the district is fine being the party going forward but want to commit to this in perpetuity we agree we'll jointly review that ever 5 years and included in the second amendment with that, i'm available for any questions that you may have. >> okay. thank you. >> for that report and update
9:37 am
commissioners any questions? >> okay. thank you. >> for the report and seeing none, let's open up for public comment item 9. >> any members of the public to provide comment on item 9? >> seeing none, and have no callers in the queue. >> okay. thank you, so do i have motion and second to approve in amendment. >> thank you. >> second and roll call, please. >> a president paulson, aye. >> vice president rivera, aye. >> commissioner maxwell, aye. >> commissioner stacy, aye. >> 4 i's so thank you, item 10 read item 10 please. >> 10. approve an amended and restated memorandum of understanding (amended and restated mou) between the treasure island development authority (tida) and the san francisco public utilities commission to continue to provide utility services for naval station treasure island, for an initial two-year term, with an option exercisable by the general manager and the tida
9:38 am
director to extend the amended and restated mou up to an additional six years. >> good afternoon, commissioners. ron deputy general manager. >> i'm here today to request approval of an amended and restated memorandum of understanding with um, the treasure island development authority is responsible for the caregiver duties on the former navy station is treasure island. >> your your bun with the repair of navy's system - have been providing services and the operation and maintenance for
9:39 am
the navy system and the delivering of utilities to the island this includes not just electricity but stormwater agent and the infrastructure on the island is transferred in the navy through tida does not meet courage sfpuc standards the infrastructure on island is the outdated infrastructure creates a condition of a risk of failure. so the sfpuc has been working with tida on the plans for the development and transfer to the city as the new utility system sfpuc standards and allows sfpuc to provide the same level of service to the island without putting the sfpuc rate payers at risk for the failure
9:40 am
of the navy infrastructure. the first transfer of some new pipes in a month through the board of supervisors and will be effect next month. the process will continue with some new pump station and, of course, the commission of the brand new wastewater treatment is on treasure island. >> meantime sfpuc continues to maintain and operate as a contractor not as the utility procedure and continues to make recommendations to tida on the improvements. the current my expired on june 30th operating as if under old terms the primary role of anyhow is to insure that the liability stays between the parties for the equipment and that tida reimburses the pub for the cost of services. so we don't make a
9:41 am
lot this anyhow is different the other ones were one year in the construction 2340sh9 and not a lot changes this one is a two-year term with the ability to continue for up to 6 years extension over the utilities to carry this forward and to maintain the amendments we have to do and other small changes for example, um, tida had a reimbursement obligation that is past due note that is getting repeated and now described in the past tense the primary difference we are going two from one year to two and tida we are asking for your approval. >> so for your explaining and
9:42 am
the details the mystery of the relationship and i'm very glad very much with saying that's not messed up to our standards i have and other commissioners have mentioned during the course of the talking about the treasure island those are some of the most disturbing of the notice we get and the fact that the power goes out so um, just saying since the continuous in many ways the status quo taking too years or 6 years sunset is negotiating my first question starting renegotiating the amendments for up to 2 years or 6 years. >> that's the term and extended for two years.
9:43 am
>> the initial one is 2. >> i got it and i guess my longer question i'm not going to ask but thank you for talking about this is like kick the can down the road but make sure that the residents do have facilities and power they need and hearing that outside loud presenting that. >> it is more the old and not the new that are coming those will be san francisco utilities. >> yeah. >> it is messy but we understand anymore questions or comments. >> how do the reservoir at 6 years. >> well, that allowed for that
9:44 am
we're hoping to have major improvements and changes coming forward if ten years has to go to the border we're just let's agree put this over here and work on the real things. >> new infrastructure and how you're accepting that. >> sure. >> got it thanks and any other questions or comments from commissioners? >> okay. item 10 go to public comment please. members of the public present to provide comment on item 10? >> seeing none, and no callers in the queue. >> okay. seeing no one, public comment cuing up motion and second to approve this amendment anyhow item 10. >> move to approve. >> motion and second to approve item 10 roll call.
9:45 am
>> president paulson, aye. >> vice president rivera, aye. >> commissioner maxwell, aye. >> commissioner stacy. >> 4 i's and item 11 please read item read item during the extended covid-19 pandemic period from june 16, 2021, to december 31, 2022, in the approximate amount of $23.3 million. >> handsome commissioners good afternoon may i have the slide (clearing throat). >> um, my name is clara are and with the financial planning team and today presenting on the
9:46 am
spend request for the california program a program to a water and wastewater customers this program will be abbreviated in the slide. >> um, the program was established on september 26th, 2021, by the american rescue plan act of 2021 as part of the covid with $985 million appointed to water and wastewater system approved in the pandemic and the control board about administer the guidelines and instead of the utilities will apply for the grants for the eligible customers the covid release
9:47 am
period was 22/and all customer types residential and commercial and others were eligible to receive the benefits and in addition eligible for funding the customers were eligible and those given to the puc for the covid discount programs for residential and commercial nonprofit customers and our regular discount through the customers assistance program for the local household. the first year and oil is applicant received the full amount of funding requests from the 2021-2022 program the puc received roughly $16 million plus governor gavin newsom extent the program for the remaining $600 million. and in the program fiesta ration the series was extended march and
9:48 am
the snapshot of 2023 program and in december 2023 the puc applied the program and today bringing this request to the commission ahead of program per the guidelines and utilities 60 days for the fund for eligible customers from the day we received the check and we expect to receive another check in march the estimation is in may and we're 2k3w5r9 adoption for the board of supervisors. and the last step return any unspent fund and submit a close out report. >> and this slide is the breakdown of requested funds so the funding requested in the application is based on the data of eligible customers were billed in the june june 16, 2021, to december 31, 2022, and for water we requested roughly $9.6 million and wastewater
9:49 am
request $14.5 million and requested a reference coverage for related it is $200,000. and i also want to note that from the time we pulled to the data to the time we receive the fund a credit changes to eligibility and customers will continue to pay off the debts in the in the meantime, that is why we'll need to return any unused fund and the delay for the funds is the request for this item today and this slide highlights the impact of the funding will have on the and i. >> from water our past due is like $8 million we can cut this down to 7 point plus and
9:50 am
$3 million in current. >> rentals - the puc will start to collect and do so in a manner that will - thank you for listening. >> any questions? >> yes. thank you for that report and 23 millions is a good story despite the debt paid for so having said that any comments. >> commissioner stacy. >> thank you i agree great to get the money what i'm asking about is the gap $10.7 million gap what is our sort of plan for that gap? are we um, getting
9:51 am
customers who are paying us back? in some extent way er grants or? >> so hi nancy our customer service bureau is working with the customers and seeing if there are um, eligible for a payment plan and encouraging them to, you know, they're doing that right now and also at the end work with communications to create more ways in addition access for the customer service program as well. >> thank you. >> so how does that work? with our um, low income program? and
9:52 am
i mean, we passed this last year a significant program how does that work? are you using that. >> do you mean how is the program fund will affect the customer assistance and yeah are those the people that basically you're helping and . >> yeah yes, so the funds we applied for from this program go to various discount services so comes not only for the customers in cap current enrolled but other programs so um, not all discounts and applications that we included are for people with rolling caps and not all caps have debt not a complete overlap. >> those people that are not in cap programs are people not
9:53 am
and they are eligible for this program? >> yes. >> and how do you - look at their accounts how do you know they're not paying. >> the data we used for our application (coughing) pulled from the customers accounts show eligible discounts (coughing) and those are past due balances beyond 90 days that that makes them eligible. >> okay. commissioner stacy, do you wish to close? does that answer your question? are you prioritizing low income customers or is this really based on how long they're past
9:54 am
due with going on is it income driven or not i'm wondering how you decide to apply the funds? >> so the funds will be applied to the customer accounts were included in the application so that was all customers in that eligible bill period um, that would have their information submitted to the state and we'll be requiring. >> how did you decide who to conclude. >> every customer is eligible no limits anyone with debt during that time period is eligible for the funding. >> got it. thank you. >> any other questions? >> okay. thank you, team for that presentation. >> let's see - open up item 11
9:55 am
to public comment. >> members of the public present to provide comment on item 11? >> here. >> no caller in the queue. >> okay. thank you. >> um, can we get to motion and second to approve. >> so moved. >> second. >> motion and second roll call, please. >> and president paulson, aye. >> vice president rivera, aye. >> commissioner maxwell, aye. >> commissioner stacy, aye. >> 4 i's. >> great. so item 12 and 13 are related to financial items and so we would like to hear them together if we could and i assume will be one presentation from the gentleman at the consumer right now. >> read
9:56 am
>> read those items please. sumitomo mitsui banking corporation, for a term of five years, and (2) a second amendment to reimbursement agreement. agreement. agreement. agreement. term of the agreement by three years for a total duration of nine years to provide credit support for the cleanpowersf program to program to program to program to restated fee agreement, subject to board of supervisors approval of the ordinance amending ordinance no. 8-18 in board of supervisors file no. 171172. >> good afternoon, commissioners. i'm with the finance and normally your capital director nick will be making three presentation but out for today. um, commissioners
9:57 am
we bring before you two credit items for your consideration for the wastewater and enterprise funding program and one for the cleanpowersf. >> this is a quick summary of what we're talking about today two separate agreements with two actions. presented in one of the first with sumitomo mitsui banking corporation for the wastewater funding program j.p. morgan chase for the cleanpowersf program and note both of those are part of fiscal year 2024 plan first item today is the item for the $150 million credit facilities for wastewater. as the commission knows we have a $75 million interim program for the water
9:58 am

public comment. we've gotten really critical written communications from people also which is helpful but i do think that the puc is probably more like the retirement board in it interested people are scattered not all in san francisco it is difficult to get here and testify in in-person i prefer the testimony in-person i feel more meaningful to me perching and have the ability to follow up with questions. i'm supportive of spending remote public comment it is something we got used to in covid for the years but i think it does allow better participation and an

important role for the commission to play to hear in the pc public. >> allow people from the public to comment on all actions in the system and especially the water system and the energy enterprise has effects throughout the state the wastewater system can't operate in isolation and all kinds of wastewater utilize that and people are affected by what we do i'd like to have the opportunity to hear from. so i'm interested in hearing the rest of confirmation if you have comments but i vote to restate public comment. >> thank you. >> vice president rivera. >> thank you president paulson. >> yeah. i've been torn with

that decision also but i did read a lot of the letters we received during our recent comments. and a lot of them stated were members were disabled and not getting down here and can't get down here we already have a mechanism for those people. he this year allowed to make public comment on the phone and can a make remote they're not being um, is he questioned and quiz about the amount amount of time they have to speak and in the public has more than 2 minutes of comments they can send an e-mail we have

e-mails very well written i understand could not be put into a two minute limit i appreciate i think we already have a accommodations and mechanisms for people who can't get down here and furthermore, i'll say that when the remote public comment was rescinded we've had a lot of people come down here in-person with extremely moving testimony and just i mean i've been very moved by the people who showed up here in-person. i think there is something to be said about the in-person testimony as opposed to the phone and sometimes not a good connection and sometimes issues to not understand the persons saying clearly. and i just feel

like that i don't really support the ongoing to remote public comment. commissioner maxwell. >> i'm definitely supportive and wait until we don't have that but when the person can call from anymore and have direct comment is that enough? that's what the country is about the problems will be extended but as far as i'm concerned, i agree with commissioner stacy and commissioner ajami and definitely in favor of that. >> everyone has spoken anyone else. >> commissioners?
