4:36 am
>> commissioner? >> thank you, thank you for the transport is good and promising to see the trend bunkham, right, reduced crime. >> in the areas feels like the cordination and the investment and resources targeted investments have been having an impact. i wanted ask you a question around the policing in the tenderloin.
4:37 am
dollar is good news with the collaborative i spoke to the
4:38 am
commission about this. public w and public health and homelessness and supportive housing and human services part of the drug market agency collaborative. and the some of the nonprofits one code tenderloin. i have gone out with them and saw them in action. they -- are doing an amazing job engaging with the people who have a type of substance disorder. enforcement is a component with code tenderloin worked well with the police department, they have had success. and traction with getting people to go to that service door. and public health has stepped it up in march, they piloted putting medical staff on call basically. when code tenderloin goes out,
4:39 am
they engage and there is a number they call with the doctor and get -- access to a doctor. and access if they are willing to do it to medication to deal with the addiction. pilot has been successful. extremely. so, as i said earlier, enforcement is one part. we will continue to enforce the services piece is not something as far as of the jail piece but the way this group including the police department is working with the service providers that piece holdses promise inform the 3 months they have been doing t. a number of people. i think 50 or so -- actually got off the street and in shelter.
4:40 am
need get foam a better place with treatment. this is the last thing i will say. it alleviates the officers having that responsibility because the service providers are out this in the street. code tenderloin and they are people who have been down what road. i know how to speak to people that are suffering. it is work. that is great development that was something i was hoping for. now. does this mean that in lieu of
4:41 am
an arrest people are upon begin this option? or is it -- kinds of a part of the arrest procedure? the way we done officers we do scouting reports we'll see where people are congregating to use. code tenderloin will do their thing if there are other providers street medicine time at night. they the do what they do and we may have an enforcement operations in another location. we have locations that are -- a problem and didn't service thing and everything we can do and so those other locations where enforcement is we have done all and given the opportunity now enforcement. it is trying to strike a
4:42 am
balance. so enforcement is a part of that it is not -- go to jail or there. we find is when these night navigators, when they go out. sometimes we are there and no. >> that's great this . sounds like a harm reduction strategy. first is we are going to mandate
4:43 am
stream or offer treatment if once people are detained. i love to hear more about the impact and out come when we have more information. i read there was, there is a gift of a million dollars that is coming to the department at some point once approved by the board. i want to see, or hear if you know the process is for those district stagsz. i know it will be for the well being of the officers. i think they have been work hard and double over time vivs for a couple years. had is important. and really will helpful. anything that could be don enhance their opportunity to be in a better place physically special emotionally. is there an idea how this resource will be utilize the or how the stations will be
4:44 am
developing a work plan. >> there is, that -- million dollars that was anounsd. two years ago. the foundation has been set up. we don't, it is in the our foundation. we had once a year we had to reset our foundation. so. this foundation the donor will donate upon or anyone who wants to donate donate to the foundation. but the donor is when he made the announcement almost two years ago that mission was to be divided. go to the 10 district stations. the internal process is, the captains the plan of how they intends to spend the money they
4:45 am
will be granted. when it getses to the police. the accept and extend. we will do the same we always had to do when we receive donation. that is to get the except and extend approved. foundation, accept and extend. and use the money for the purposes that the donor intends today. >> we have not received any of that money yet. upon which time captains start making their requests, it will go through me to the foundation. they approve and the money gets donated and we go throughout process we currently have. >> a time line when that will be
4:46 am
approved or authorized for to you implement y. foundation has been set up. now we have the process in place with the grant requests. and thecrament ain'ts have been adviseed look how they plan to use the funding >> within the next couple months. come for approvals. >> great. >> thank you for those updates. >> thank you. >> commissioner walker >> thank you. >> thank you, i want top applaud the work that you are doing with the other departments. i have done down a couple times to meet with code tenderloin folks to seat work they are doing. there is a need for that response out there. you know when i did the first one in the ain't ain't we had to
4:47 am
wait for an hour and a half. by that time they are not interested anymore. having a good team of people who have been what is going on and know the folks there, too, it is a good partnership to irrelevant fill in the gap. great. thank you. >> vice president overstone >> chief, wanted to follow up with one question on something commissioner young asked the million dollar donation. the foundation that was reasonable established to overwhelm seat dispursement of upon stundz everfunds. remember are combvent board members on that undz momation

4:56 am
i will turn over to the chief. thank you. it is under strategic management bureau. director and callen is the lead. >> doing a lot of work. thank you. i will be brief. there is a lot to this but the police commission and the san francisco police department have reviewed the sfpd district station boundaries. for the public you are aware but this is man dateed occur every 10 years by charter. the boundary analysis provides the commission, police department and the community an opportunity to evaluate or proo vied insight what has or not and projected to change so we
4:57 am
adjust. the evaluation considers data from 10 factors in the san francisco code. so these are stloongding factors that we need follow this to do this evaluation. per legislation the goal to mack myself effectiveness of police operations and the use of resource. the left time this was done was 2015. review this will occur over 2024 and mid 2026. and then during the 24 year the police department will garth and analyze data. the alternative bound easier and engage the public and stake holders in conversation about this issue.

how this will happen in terms of use of force? how are you going to remain compliant. >> well is a sustainability component that officer hiller
5:27 am
can speak to. there are discussions regarding the sustainability components of all recommendations that have a sustainability component. i don't think all of the answers have been quite parsed out. how is the department -- my question is -- i gus answered the department does not have a plan on how to deal with the way it will monitor prop e now? with use of force. we have written some of it in the policy. other thing that since it is you say that is in progress, right?
5:28 am
may be that should in the be zero there should be numbers in this column. i loved the slide and love your optimism. i think well is still some stuff we have to do in terms of getting prop e compliant. gabe left and the writing for the two projects plans is left with him. [laughter] so, and thank you for being here. so, the ways which we're ensure the data quality for use of force and for most data sets on a quarterly base we do a data validation. our analysts and the team confirm and check the data
5:29 am
against our incident data. and they if there is discrepancy than i go in and look at the line of data or the incident report and ensure that one or the other is correct. usually a minor correction. to use of force or more upon afternoon you know it would be something they ask if the writer or the use of force report. more often it is i situation where an officer has released the individual and not arrested them. after a use of force was conduct. yea. >> i want to break down you are using differents terms people are not familiar with. >> yea. >> my understanding is you say the analysts will review report to the data.
5:30 am
when you say incident you mean the report the officer take when is he uses use of force? less when i refer to the police department. so when an officer makes an arrest, they and other cases they complete an incident report. a police department. and provides a lot of information the use of force evaluation form. is embedded with the system this collects the report. collect use of force and come up where the use of force then that form is available and enter this information. so. this is part televisionment when they are check for example completeness and in most case there is is a use of force there has been an realist. and so that is a good check to
5:31 am
ensure that our data is complete. that's when they had anyone doing and now embed in the the system. such this it is almost uniformly well is a one to one match. >> the analyst has that information in terms of the writing. available. >> they have >> the data set. >> how is it going to happen when now for use of force if there is no long are going to be in circumstances a written report but a body worn camera. that would take the analyst long torme review the cam are to check for compliance versus they have to review incident report? >> this is part of our implementation efforts and i have been talk with how we doll that. well is likely going to have to be a technological solution. >> the department does not have that technology.
5:32 am
jury room not ready. correct. >> when will this solution be available? do you snng >> i am i than we -- there is a budget that has to be passed first s. it in the budget? if we don't have a solution when it start what is is the remedy? what will we do. >> defer to the chief. sorry. >> it is in the budget. i want to up step. analysis we'll do the use of force tracking form is where most of that information come from. >> nought supervisors instead of reading reports review cameras of the officers. if use of forts they do the tracking form and yes. right. yea. they get it and says use of force as a supervisor they go
5:33 am
back and review what the officer wrote or the base for use of force how to articulate it. and figure out whether or not it complies with the use of force policy. right? that is correct. >> when they do this, now instead of a report the supervisor reads the supervisor now will have to review camera, right? >> in some case. prop e reads is calls for efficiencies on multiple reporting. so if there are 20 officers on the seen, two use force. it calls for not of the -- witness the witness officers or officer that made everybodying involveded to document what they saw in the camera.
5:34 am
the supervisor has to review camera >> they always required. that does not change what changes how the officers whether the officers have to write a statement. so if there are 20 officers honestly -- the supervisors first will look at the officers in the use of force. they do this before the end of their shift am 20 rate of speed they will not do that. so that does not change what changes is how many people officers now will be required to write a statement or incident report. which we have been work through this. the tracking and supervisor track form nothing changes except for prop e calls for special now -- a bit different.
5:35 am
what about the technology piece >> a couple thing this is we ask requested in the budget is everyone transcription or like to get to a transcription technology. so it make its easy to take what is on the camera and transcribe
5:36 am
it. there are software connections. aural this has to link up. and now we are short with some of when we need to link up to different systems to integrate like body worn camera and other systems. that's in the budget. i think there are several million dollars of enhancements for technology to shore up some things. i don't know it all off the top. we need at this time problem is it is in the budget but you know what happens it gets cut. we need to see what in the budget is needed for implement prop sxeshg what will get cut. currently, the trend is to put everything on cam are, the department does not have a system to easily extract and distribute camera upon request. to requesting agencies.
5:37 am
i know we talked about the reduction sovt ware. i think it is important to see -- what technology is needed to make this happen. and ai software. you ton get to the information we need to quicker rather than cyst through hours of cameras. those are all advancements we have to get to which the use of force track to analyze trends and all that. that does not change that information will be reported. >> vice president carter. >> thank you. president and thank you sergeant for the presentation. i think the president asked a great question use of force and
5:38 am
prop e and obligations. to fulfill the recommendations. i will -- feel like the discussion was sufficient. il ask one other thing which is -- the -- body worn camera policy that will need to be amended in order to conform because now we -- supervisor could not just review body camera footage in the ordinary course. where for example, now under prospect e something that was reportable is no longer. . supervisor needs to consult the body camera footage. i think in many circumstances the policy would not prevent that. ; is that correct? >> possibly. threshold what is reportable it
5:39 am
changed what prop e is. there are differenceos what is reportable that is beyond. question i'm asking is now because there is no long are going to be a written report in light of prop e it does not hit anybody. under the confidentiality policy that would be reportable. under prop e not if it missed everything. notice -- i don't know. >> that's correct. >> prop e have to have caused injury. so. i am asking to cut to the chase we have to amend the body camera policy? correct? >> i want to make sure we are
5:40 am
giving the publicarcerate information if we fired a shot and missed them. that is still a reportable use of force. >> less than lethal. >> if we fire a bean bag we don't walk washing way and say, we missed. there is a written report under prop e as you read it. if we use that force, yes, for if you fiforced somebody hands behind their back there was no injury. that is no long are reportable unless there is an injury. the higher level erw's. firing a weapon. those are reportable. >> i guess may be brackett this. i read prop e that would not be reportable and may be discuss what off line. i understand when you pull out your service weapon it is reportable regardless.
5:41 am
stereotype 3's this don't result in injury would not be reportable we will move on. and circle back on that >> chemical agents are reportable. >> that don't injury. >> when i use chemical agent its is report. we call for medical attention. >> okay. whether or not they say they are injured that is reportable. >> fair enough. >> question -- so. ghan there is the outstanding 27 recommendations what other mou with doj lapse has that happened. >> it has. they are in the evaluation stage.
5:42 am
5:43 am
>> sometimes more than dozens. that was a statement. do you agree? i do. and i think this is the benefit of collaborative reform. ultimately is that if those recommendations and the ways they are not prit of in the way we impelement them we can work in this case jansen hughes. to layout something that would work and they determine whether or not they feel is compliant. and furthermore the compliance measures with cal doj helped articulate what would get you to substantial compliance. everyone knows that we had to hit those mile stones in order to be there. >> because anyone of the
5:44 am
recommendations could be satisfied in myriad of ways is it accurate to say no guarantee being in compliance is not we adopted best practice or we adopted the optimal policy. it is compliance means have you as we discussed adopted the dozens of paths that satisfy the guidance that doj provided. i think all of our responses to recommendations are included on your website and the public can decide that on their own. we spell out how we felt to apply and the doj assessment of each the 245 are up there now. once we receive word whether or not we are compliant official low, they will provide us
5:45 am
documentation saying and post that on the wines. i think that is up to the public as to when they think is compliant and we are happy to hear from them as well through the many forums we out line in the our communities recommendations. okay. i take that confirm you do glay compliance is not the same adopted the evidence based best practice or one of the top two or three best practice? >> or all of them. >> before -- director mc guire that's a yes? to the question. >> i think that the question for
5:46 am
doj. know upon on
5:47 am
the yard line of commroeth the recommendations is unmitigated good. department's work should be lotted. but i have heard folks say things like the fact we complete third degree means sfpd is a leader in reform. this is not true as a result of this. i think we need to remember the reason dj came in there was a broach of public trust. there was racist texts. you know shootings of unarmed
5:48 am
citizens. these recommendations were designed to bring us up to baseline. butt fact we completed i was -- would comment on that. with all respect, commissioner i had personal conversations with law enforcement in the united states. colorado, san diego, new york, boston, l.a. florida. to i think under mines the we s this context. if we do this we can be critical we are welcome. we have been that's why we engaged in this. >> the members of the department was difficult in the beginning. it is a cultural thing it is
5:49 am
adopt today is okay. reform is okay. we are on the right path and the yea, but approach let's have that discussion. but not today. >> yea but is not going to help us move forward to get to where we want to g. we said it the chief said it. police reform is never finished. we are not done we have people say sfpd you other best does not mean well is not higher to go. yes, we will have that discussion. yes we will continue. and and yea. >> i appreciate that feedback and the w done here was lotable i think this is the proper forum to contextualize what this means
5:50 am
the department had a celebration with member of the political branch to do what you were talking about. to cell brit this mile stone. i think this forum that's not the principle goal of the work we do here. i want top ask, are we in compliance with all of the recommendations related policy make? are those among the 27 still? those the development q. 301 are in compliance. >> okay. i will ask about a couple of the specific policy making recommendations. i think that this will put in what i'm talking about. when i talk about the gap between what it means to be compliant and to be adopting a
5:51 am
best practice. >> sorry. can i add to gabe's response. so with the policy making portion there is then recommendations related to policy development. the i think one of the things that dojmented to see wases that there was a constant upon effort being made to make the changes, update the policies and keep moving. this was untouchd and needed to change. you the folks that w on these so much recognize that that has changed in the department.
5:52 am
that is the foundation for the compliance for those recommendations. great. to take one i will do a couple. i will read recommendation 70.1 and 71.1. am sfpd work with the police commission for press for reviewing existing and new dgo that support policing with policies. related recommendation 71.1 sfpd work with the police dmoigz create a process to make timely and necessary updates to key policy. so. i presume our adoption is when drove the finding of compliance. as we discussed a meeting ago, under the current system. the department adopted and
5:53 am
declined comupon ply by doopth what i character a rad exam interpretation that now says the department has unlimited time to complete the policy making process. let me jump inform we near compliance with the recommendation. >> yes. some of this work is reform i don't care the department or the reform project is. reform does in the drive absolute protection is driveers system a mind set and attitude a spirit. and policies where we can make adjustments when we run in future problems. part of how we get to having to do reform because we have not made adjustments the issues you
5:54 am
brought up with -- policies languishing. we have already -- got on the road to address that we don't to go 15-20 years before we make a policy adjustment. that is what this is and to the sergeants's point and mc guire's point, really want to emphasize that compliance did not equal perfection. am what it equal system putting policy in place to address issues as they arise.
5:55 am
>> that's what reform is. i think we agree that substantial compliance does not equal perfection. i don't think the issue i raise side [inaudible] it is affecting several dgo's called out out by the department of justice and we are experiencing the same issues. i think it legitimate to raise that there are my clothes in the queue. i will ask about another
5:56 am
finding. which was -- finding 77. on page 170 sfpd does not conduct audits where practice are established in policy. this one stood out because it was not long ago that director mc guire was here answering questions about why sfpd was not following its own department notice to audit quarterly. we all read newspaper accounts of a newspaper that analyzed our staff data and found what it was discrepancies that could point to falseification of the data. sfpd was not doing those audits at all. again, we near compliance butt
5:57 am
facts on the grounds are at the least not a best practice we were not following our directive to odd they data. is this fair? what's the question are we in compliance. i know we are in compliance director mc guire answerd that. you would agree that we are still not auditing data we are directed to by our policy despite in compliance? that it is an accurate and true statement. we did not audit this information. we everauditings things we never audited before part of the work. and again, commissioner, when these come up, the question is
5:58 am
are we willing to adopt or correct course. dom we have the system in place to figure out ways to correct course when they come up. this is the commission and the accountability body. you north shy did pointing out the faults. if we just say, okay. the reform is about correcting the issues. putting system in place. will i will be frank with you. yes, there will be issues we don't have enough people to do all the audits.
5:59 am
is picked out a couple from a 5 page span. we could do this for every section and the goal here is i think we need to be honest with the public d about what completion means and does not mean >> there was a big celebration for completion of the report i think that was warrantied but i think we need provide accurate information about the consequence of this money and is think the two examples we discussed show that compliance is differents than evidence based best practice.
6:00 am
>> director. >> good news stop data audited by the police accountability. we should have a report shortly. hopefully that takes the air out of that. >> award wing auditing. >> thank you. >> and we have been w with. don't try to take credit for that j. no. >> no. >> yes. i saw him working today. i have 3 questions and comments if you will all indulge me and chief. i am excited hear about oei with internal affairs analysis to identify capture data. and generate quarter low report busy discipline out come. of chief, you and i meated meet and conifer about discipline.
6:01 am
one of the biggest issues we have is how to make discipline out come fair and equal. across the board. and my commented be that this report would be helpful to the department of police. one of the things we strug welis the discipline matrix we have has a wide variety of discipline for a lot of the violations. and struggled determine when would be appropriated for the each circumstance and i believe if i'm reading correct, this dataald be helpful to us so we can all get on the same page what discipline is appropriate. i than there will be quarter low the review board and will be
6:02 am
there. i wonder if we can get the quarter low reports regular low so we can try to balance out some of the discrepancies we see when trying to recommend discipline. no problem >> thank you. >> i have two more questions. i heard you say that there were going to be the use of force reports are not going. i wonder do you envision situations where than i may not be a report but a use of force report. sometimes we have situations we are evaluating force and we have both.
6:03 am
6:04 am
>> we seat software connect >> transcription of body western camera >> we do have transcription it is the in budget. when it is said and done. >> appearing when? >> friday. >> next week. we will agendaize that for next week. >> we have one more or more. >> another month. >> thank you. >> that's it. >> yep. >> thank you >> commissioner clay. >> chief, you are late to the game. mine is narrow and madam pit think she aided me i gotta catch up to stuff people had.
6:05 am
my question is for me as i go forward. i get prop e and the issue of the use of force my question is when i'm hearing here if there is a use of force in thes upon category one be in a report and documented and another may not be written report you will have your pdr cam are there available to make an inquire tow look atting something someone may make a complaint. never undocumented the question is how? >> correct. >> we will have access to see that. >> correct. >> frank low the body cameras from my point. view when i have a hearing you will finds that is the best evidence can you get you see t. and reports are sometimes written out not limp and there is a training on reports i like
6:06 am
the idea you will always have that evidence available. >> that's correct. >> that's all i want. later on. this is i'm learning thank you. keep will bridge the gam disseminate that. that is the birth issue how do we get, now staffing wise and technology the department does not have the capability of providing body camera requests to requestors in a timely fashion. dpa had this issue when they had the disciplinary cases. that's the prong of how do we we will turn it over to body camera. the other problem is if we don't have the staff or technology to disseminate it when necessary that is how we run in a stekdz
6:07 am
problem. >> well is in the a process the end of the shift the officers don't log in cameras in the fileded in document that day and time. have you that have snob retrieve it. look and review and see if they distribute it. there is a lot that goes into. upon we think, watching the camera is easy there is a lot they do to get it ready. that's the problem. the department does not have a system in place to do that section of it. >> there is an editting of the redaction. to redact. >> that's the public not larceny. they are not allowed.
6:08 am
>> all right. >> all right. >> commissioner. >> thank you. president elias. i think as we are you know informing the public of beg your pardon how we goat conclude and generate report its is helpful to get what we are measuring and how we are. in the both commune policing and advisory forum section. you know in the impact there is a statement saying you know we have establish and include diverse membership. and being -- the commissioner over seeing the community policing dgo i like it get a sense how this was measureed get to this statement. >> i'm sorry. you are referring to the project
6:09 am
3? >> page 8. >> and the impact of the 3 recommendations for community policing and forums. it says we have a diverse membership. how did we measure that? the community the chief's community forum. and the process by which we review applications and considered them. and we had a broad cross section of san francisco on that committee. i don't know if the chief wants to peek to that more. >> yes. we used to have 13 different chief's forums. what we did to have a more
6:10 am
stream lined process is one forum invitations to those of the representatives from all overnight forums. and now we have one chief's forum that brings everybody together. with this there is better tracking. communication with the group and because the thing we fell short on prior to our work and during the work until we came up with format was we had 13 forums and track was lacking. the -- yes.

so. what we have done in the last probably 3-4 months. this is the per of the work. every entity has to have a community mreegs plan we have the plans into probably a 3 inch binder. the plans are are bust. not every plan is the same. every district has a plan. that has been done. they have been checked -- approved by chain of commands. so that has been done and it is better then and there what you saw the left time. i'm sure. >> i hope.
6:15 am
>> yea. i'm sure. because i think at the last time we were not complete. we started this project when covid struck and put a damper on the ability to finish. we have finished it. and it is a very robust set of plans that every entity has the plans that's our guide line that is sprit from the chief. the stations and when they do are in writing >> great. in your -- where are we as far as we checked all the box. made a lot of progress and huge
6:16 am
lift. years of dig deep and doubling down on making sure we prioritize policy and we prioritize transparency. so we i have reduction in minority impacts as far as adverse impacts use of force or stops and churches and based on the third quarter report left year, the disprosecute portionate contacts are there. what point in this process do we gain that traction. what point does this policy and to comment made earlier does this impact the culture of the department to then reduce the numbers from 12.4, you know in use of force, 10.6.
6:17 am
you know -- in searches. you know in the african-american community. when do they come down. because 8 years down the road we are not far away from the same numbers. with the pilot will answer there were components to that question. you know of course we'll see how the dgo9 place a part and violence reduction strategies play a part. you know our crime the data
6:18 am
shoes most of our gun violence and stuff are black and brown men. right? if we focus on those people committing gun violence. focus will be on the people that are committing gun violence. now they include the gammet of out roach and service prosecute void and we are degree warrants and arresting people for committing gun violence. but our thoughts have decreased significant low. and we are still seeing tremendous reduction in gun violence where this project strategies near place.
6:19 am
i expect we will. and i than there has been progress. i am a believer in the more we
6:20 am
engage our communities the more the communities feel they have access to the leader and this department. the safer san francisco will come there will be the trust factor a gentlemen said, there is not a trust factor. there are upon communities. i brought update language access issues. there are communes who don't believe they can communicate. they don't even from the access or available of the access. so i know we have work to do and made a lot of progress and that's why we are here committed to spending our evenings and days working on these issues and. we don't want to i don't want to come off as you know, a kinds of throwing water on this or dampning the mood but there is work to be done still and we can
6:21 am
celebrate the accomplishments but i agree that they are still a big are lift to be able to impact on the number this is brought us here. thank you. joy want to go to the discussion. use. force reporting the department's interpretation. made sure that i'm accurate the department's interpretation is all use of forevers other than type one already not reportable. were reportable. so type 3 use force still reportable. and so this prospect e the changes are meant to cut down on reporting.
6:22 am
