good. the place room 244 san francisco, california 94 102 and madam chair. items acted upon today are expected to appear on the board of supervisors agenda of july 9th, unless otherwise stated. madam chair, thank you. i just wanted to let the public know how we're going to proceed today. this morning we will finalize items and issues from last weeks deliberation from last week's, department and budget hearing and today's is really deliberation day, and then we can move forward with the balanced budget package to the full board. we will not have public comments on today's items for the budget and appropriation committee, this meeting is a recess comm meeting from the from, public comment day from from the really the entire budget process and the budget and finance committee is for the 1030, which is a reschedule, meeting. so i just want to be

clear. if you're here for budget and finance, please wait until 1030. there will be public comments on those items on those agenda. and with that, we have few items from last week's department budget that we need to resolve. and we need to handle those items first. and so with that, mr. clerk, can you please remind the committee and the public the items that we have before us today, yes, madam chair, in today's meeting, we will be considering items two three and four, which is the mayor's proposed budget for the departments of city and county for the fiscal year 2024 to 2025 and 2025 to 2026. item three is the appropriation ordinance item four is the annual salary ordinance. we have also yet to dispense with item number 12, which is the ordinance amending the park code to authorize recreation and park department to charge a fee for reserving tennis and pickleball courts at locations other than golden gate

park tennis center, we and item number 13, which is an ordinance appropriating 400,000 of assessment appeals fee revenue from filing fees, hearing fees, and finding of fact fees collected in fiscal year 2023 to 2024 to support the assessment appeals boards. cost of operation, including the development of online assessment , appeals application filing system and also dispensing with the proposed aao and aso for the departments are heard during our may budget hearings. madam chair, thank you, mr. clerk. so first i would like to dispense with the following departments that were outstanding from, last week. and some of these items we discussed but did not make, did not announce a decision or clarify our decision. so first i, i move that we, accept all outstanding budget and legislative analyst's recommendation, except for the following that we're rejecting which is the dec department of

early childhood for the facilities grant, and then also for the department of homelessness and supportive housing for the transgender subsidies. so it's a c h o m one. and then also rejecting is for the human rights commission recommendation seven for the reinvestment initiative. and then also for the public defender. three, four and five for the clean slate program. and then for the economic office of economic and workforce development is the downtown core, which is, recommendation four and five. so those are the list of recommendation that we're rejecting. second by vice chair. oh, sorry. oh wait. sorry. vice chair.

mandelman, i just, i, i want to start by thanking, chair chen and your staff for, doing all the hard work over these last over this last week to try and get a sense of the committee. and i want to thank you for a number of the items of mine that you have. tried to accommodate. i appreciate that very, very much. and i think, i mean, i'm trying to track kind of what, what i thought was up in the air out of last, last week and the only item that i think i might have a question about, is whether we might want to look at the human rights commission, not necessarily on the particular item. i understand there may be a notion of getting us the same amount of money, but allowing for some restructuring that, that, that department thinks could be helpful to them. i

don't know much about the proposal. so i you know, this might be not a good thing to do but i just wanted to kind of like, at least i haven't had a chance to digest the idea. and so i just i'm a little that's the only one that i'm a little not sure about, basically. so i call you or could i respond to that? yeah. okay. i think that what is happening here though like, so i want everyone to start thinking and understanding that some of these, has implications also for the second year. so meaning like you may be cost neutral on the first year, that it will then be different the second year because we're really approving a two year budget. so there and i don't know, i'm not speaking on specifically on what we're proposing. and right now, at this moment about the so the staffing, especially for both upward substitution or a new positions or however way that we think that the cost neutral at the moment for this year or for this time, it will not be for

the second year and onward because typically then that is where the pension and everything else, like all the other costs that go with it. so i think that will be something that we need to discuss and consider if that's the case. and we will have to redo some of the math like if this is the we cannot like make the decision to do that right now, i'm happy to recess and then start to have those conversations. and with that those dollars look like. but again, i think given the fact that we went through beilinson hearing yesterday and all that, again, i think when it comes to the staffing and i think i've made really clear about that, is that it's not just about a one time spending. it's really a structural spending that we're tackling with when we start talking about staffing changes like be it, be it additional staffing or lack of or even the up, including the upward substitution that seemingly for individual is 20 $30,000. but then at the long run, i mean, don't forget, even with the clean slate program that we're right now making this

this structural, it's a structural changes that we're, we're, we're making to the general fund. and i think it's totally possible that we in thinking about this today, we end up exactly where our chair is. but i just that's the one issue where i'm curious. i do think that this particular department has been asked to like, just deal with a lot of stuff thrown at it. and the org chart may or may not make sense. and so i maybe just a little more thought on that one, which again, may well end up exactly where we are. because if it's that's the case, i would also then like to bring in the office of victim services and, and the sharp like conversation back into the fold because technically the cost neutral that is, it's really indicated in the revised proposal from the human rights commission is inclusive of sharp, positions, which is the one manager and one positions. no, i mean, i think that that was actually originally i mean, i think that it was never clear to me because both in the presentation of the

city department in its org chart, which is inclusive of, sharp and then eventually we we're, we're unsure. i think even in the revised proposal was not sure that whether the sharp is going to be transferred or eliminated altogether. so it's not clear to me what that is. and in that case, it's the same thing with and it's i mean office of victim services didn't come to us as a department on its own, but it's not clear to me how it's actually organized either. i mean, but i understand because it's a new department. thank you, supervisor chan. so i think there are there are two issues there, somewhat related but one question is that the human rights commission and the mayor's proposed budget proposed substituting a handful of their positions, which were recommendations by the bla, to reject the department has come back with an alternative proposal that makes some substitutions, and changes their org chart a bit to reflect what

some of the concerns in the bla report, the concerns that the bla raised and they are here today to speak to that specifically the alternative proposal does not speak to the specific plan for sharp. the assumption there is that those positions will eventually be transferred to the new office of victim services, following legislation that is passed by the board and over the next year, they and the mayor's office and others will work to identify exactly which positions, which functions and which departments will fold into that office. but i think that is separate from their proposal to make some other changes on their organizational chart, including one position that supervisor walton has raised for the office of racial equity. yeah. i mean, i think just to be clear about just transferring out sharp out of a human rights commission, though, it's very it's very straightforward, as i think transferring the office of

transgender initiative into human rights commission, the mayor can actually also do a memo and transferring the staff and transfer function. clearly, the board has the right to, you know, have a hearing if necessary. but i just also want to be clear, like, you don't really necessarily have to have, a legislation if it's a transfer of function. but clearly, if you do emergent, that's a, that's a different story. but i'm going to leave it that way like that for now. so supervisor walton, thank you, chair chan. i had the same concerns as supervisor mandelman. i mean, if you're saying we're going to continue having conversations and talk more about this, then i'm okay with that because i know the director of the hrc was here to present more of what our budget the mayor's budget team was discussing. but i do just want to say, like, i have to say this publicly, philosophically, we budget for two years, but we do not budget for two years. our budget is a year budget. and we

come back next year and do it all over again. so to say that these these are second year costs will come back to the table next year. and this thing will be baked and cooked and look different. so we don't budget two years in san francisco regardless of what we say, i beg to differ when it comes to people. i agree that when it comes to like, i should say when it comes to like employees and city workers, it is true that we don't budget for contracts and from time to time in grants that like by two years, sometimes actually wish that we do grants and some contract more than two years so that we have stable services and programing. the, the, the thing about i think when we start talking about structural deficits is that and it's really one thing that i really supervisor ronen and i had this like really back and forth about as well, is that at the end of the day, when you start allowing new ftes and upward substitution, for example, a cost of an individual when they

are different classification, we're not we're not going to get rid of that person. well, at least i hope not. like i hope i really don't i mean, i'm, i'm actually in a space where i think that we, we should respect city workers work and we want them to be here, and then we actually want them to be here for the long haul. and we want they are assets. they are when people actually are our assets. however to start doing this in a time when the city actually is facing deficits and what i'm when i'm talking about structural deficits is that we sort of just start, pick and choose certain individuals and certain groups and then to say well, let's do that. instead of being able to take a step back and say, well, at some time, at some point the city may end up in a space where we really have to start talking about cuts to city services and city staffing it's a it will be a very

difficult. i just think that it will be a very difficult situation and conversation. and instead of adding to that deficits on an ongoing can we like pause for a minute and to say, what can we do in the moment and to really evaluate and understand that, frankly, i have said this again, this budget that we're looking at, colleagues is stitched together, really just to get us through the next six months. it's not even long term. and i, i get it like but it's basically we do what is feels good right now to kick the can down the road and not to really have a consideration about the, the, the well-being of the even within that city department and the entire budget. but i think so that's that's just my philosophy. and to look at it i'm happy to have these conversation. clearly like i, i think that we can continue to talk about it and then let's talk about like what it's actually cost right now, but also what's the cost, like down the road for, for even for this

very department itself, like at some point, what if it does have to cut back. so does that mean you know what i mean. like i'm just trying to my statement wasn't, you know, the beginning of my statement was most certainly about a particular department. but the second part of my statement was realistic. i mean, i definitely don't want to you know, have a philosophical conversation about our budget, and go back and forth here in the chamber. but i will say, just like our midyear reductions last year, that tells you that our budget changes and we can say we do two year budgeting and that's fine. and, you know, we can tell the world that that's the case. but we really do the budget every single year here in the city. and county of san francisco and i think that not only that, the challenge from the last year's budget, which is like very frustrating, is that like we thought we have a lot of agreement, which we did. we allocated a lot of funding for a lot of things and what we consider quote unquote as i think everybody likes to throw around during this time of

budget, is the add back. and the challenge with that is even what we have all said and done, what we have experienced is $48 million of cuts in the mid-year. so i just again, wanted to say like, this is a moment i'm glad that we're starting to like to make all these decisions, be it balanced and yesterday and be it the motion that we introduce and, you know, to co-sponsor and support and try to move this forward, even that list. let me just also be on the record, even for that list of things that we wanted to support and the people that we want to support at the end of the day, like if the reality, the financial reality hits us in in 2025, which we will, i, i'm very sure of it because the revenue projection is not going to be significantly increased. we have spent down so much of the one time reserve and one time spending. we're going to be in a tough space if we

keep thinking that, you know, this is not going to cost us so that that just that thought like, i am where i am and i think that i'm happy to entertain these conversations. so with that, then i'm going to strike out i think that also give me some pause about rejecting human rights commission i7 recommendation seven for reinvestment initiative. so then let's pause the entire human rights commission's, recommendations and then to, to recess when we come back. and so but the rest i think we can move forward, i see nodding okay. second. so i'm going to i'm going to reread this, what we're moving again on the record is the department of early childhood. one for the facilities grant and then for the department of homelessness and supportive housing, which is

act. madam chair, thank you. and this item again is continue from the conversation that we have from last week and that i believe that, we have a conversation with the mayor's office and that we also understand the challenges that we need. we need to figure out, like, really about the core court reservation fee structure and i am going to assume that we're in agreement that we could table this item for the time being until we know exactly what we want to do with the court reservation fee. vice chair mandelman. i mean, since some things are still open, i'm wondering if that's something that needs to be continued until later today. no, i think we can vote on it. i mean, i mean, i think that like, this is so if we continue to this like, i mean i think this is part of the calculation of like the budget as well. so i think that my question is like what is the like like we at some point i get it, it's hard to make these decisions and i'm never going to

say that it's easy. like, but at some point we need to start making the decision because like as we know, all the in the entire budget, including the motion that we have, introduced yesterday, all these actually are layers of like real budget decisions that we have to make. and then to say, why don't why don't we say this like, director dunning, can you actually tell us exactly how much is the fiscal impact of this reservation court reservation fee right now, as it currently stands? yeah, the current estimate that in the proposed budget for each of the coming years, there's about $475,000 of revenue related to this fee. so i mean, i think that like at this moment, like, sorry, like i think at this moment, like i think that there's like a thoughts and agreement that, that i thought we reach. but

apparently we did not. i'm happy to continue this, but i am okay. i mean, i thought that we have an agreement to, to, table this item for now, but but then again, i thought that we also have agreement on other items. so supervisor chan respectfully, i think we are very close. that is a cost. and so we want to make sure we understand how to fit that cost into the greater budget package as we proceed throughout the day. so, i think we're close on this but i'd, ask this committee to, to hold until we have a full understanding of the package of potential costs as we finalize the budget. that sounds good. so then if that's the case, then let's also continue this. then can we at least dispose item number 13? all right. wait. i i actually do need control controller to say

recommendations, except for hrc human rights commission one human rights commission seven. so the hrc one is a substitution for a management position. and then for the hrc is, of course we're rejecting the recommendation. and accepting the. reinvestment initiatives. and then we're going to also reject bla recommendation on ecm for ecm five and ecm six total of $18.6 million, out of which $15 million for the downtown core $3.3 million for the tourist district. for the welcome ambassador. the committee is also accepting the budget and legislative analyst recommendation for the following , which will be included in the mayor's technical adjustment

encumbrance. close out in various departments totaling over 7 million. well i should read it out. 7,399,099 $4 of the general fund and 10,860, 990 $955 of non general fund savings, and those those are the sorry that over that, over that $10 million is the non-general fund saving for the 20 for the fiscal year 24, which is the current savings of the various departments total of 2,397,000 and $190 of the general fund savings. we also need to combine items 16 and 17 with items three and four. so with that, that's the motion that i just read out

230, but i do want to thank you chair chan and your staff you're going to thank all the. i'm not going to think to thank all the people who ought to be thanked, but you know, this was not an easy budget year, to the mayor's staff and the comptroller who have been working on this for a very long time, you know it was, it was not easy for you all, and it was not going to be easy for this committee. but i want to thank you, chair chan, again for for getting us here and getting us, getting us out, relatively early. and i want to thank henry druff on my staff for his work. thank you. and supervisor melgar. thank you. chair chan. i also want to thank you for your strategy and vision in what has been the toughest budget year that i remember since 2008,

nine, and i also want to thank, our new comptroller, greg wagner, and sophia kittler and anna dunning for your transparency, collaborativeness and willingness to always help understand. i also want to say that i want to thank from the bottom of my heart all of the advocates for children's services, so we fought hard to protect, child care subsidies baby prop c, and children's services, i just want to say that, you know, we came out of a really tough pandemic that upended everything, particularly children's lives. and while our schools were closed, the people who were on the front line taking care of kids so that people could work in our economy, could, you know survive, were folks in

children's services. it was a child care workers. it was people working, you know, in the community hubs who kept us going so that we could you know, survive until another day. and so here we are, having experienced cuts to these services after people expanded the services to meet the need of the moment. and here we are but i just want to say thank you to all the folks who put in their work so that we could support our kids as best we could through some really tough years and we're still not out of it. so thank you, chair chan for prioritizing, the needs of kids, i appreciate it. and i think future generations will appreciate it. and to my colleagues who also, have always stood by community on those issues. thank you. thank you supervisor walton. thank you

chair chan. i'm just going to be brief. i want to thank, of course, the chair. this entire budget and appropriations committee controller's office, all of our legends and, of course community for the work, but of course, we'll be giving comments again at the full board. so i just say thank you for to everyone for participating in the process and really just am thankful that we were able to restore, most of the budget reductions that were made. that is important because a lot of critical services will be able to continue. so thank you to everyone. supervisor melgar, sorry, i forgot somebody and that is francis shea. you're the bomb. thank you. francis. thank you. i did not forget that. we still have to vote on the budget. francis shea reminded me that you have yet to vote on the actual budget. and i

was like, yes, i realize that, but i think i just wanted to give a moment for before we actually cast our vote and make sure that all the committee members had a chance to not only comment on it, but in the last, like whatever else that we wanted to talk about and take action. i just really want to make sure we do leave that opportunity before we cast our final vote, to, to the budget, so now that we all have, let me let me say this, though, in years past, this would be a moment, i think for a while now i agree with, supervisor melgar that if you have been through the 2008 budget process in the city, and i certainly did i would say that in the years past since then, in the years past, this would be a moment of celebration because we carry out a budget that truly serves all san franciscans. at least that's usually, you know, really the feeling and the at least we can put our best foot forward. i have to be very honest.

unfortunately, in my opinion not to put a damper on this moment, but but i really don't think this is that that moment for celebration. when we began this process, we face a stark reality, a ballooning $1 billion budget deficit, as a chair, i've been very clear and consistent in my instructions to departments and to the public that we must be very controlling our spending and that if we continue to add to our deficits we would face a very real fiscal cliff much sooner than projected. while on one hand, yes, thanks to colleagues, all the stakeholders in this chamber and most definitely all the people, the good people sitting across from me right now, you know, be it the mayor's office, and the mayor herself, through through through her team through director anna downing and sofia kittler and definitely our comptroller, greg wagner, and definitely devin mcculley and michelle lerma and the entire team of the comptroller. i really am grateful and definitely our city attorney for

all her work and definitely brant khalipa, our clerk every day, every day, you know, throughout, not just during budget process, but but just year round really appreciate it. and of course, francis shea and who i want to say that we've been thinking about this for, not just today. i think we've been thinking about this since i would say you know, the day before we signed the last budget . so while on one hand, we should be very proud of all the work that we have collectively done we negotiated a budget that saved many vital services. we have restored funding for public health, including funding for oral health for kids, food access through neighborhood based or grocery access, youth and family services like child care and violence violence prevention programing. but i also have to say, on the other hand, we also have conceded to funding a light show and free parking for downtown. if we're

be the extent of the additional technical adjustments that the mayor will be making to the budget that accompanies the list of, the spending plan that was also passed out and described by supervisor chan, a few things to highlight from that list. i'm not going to read the whole thing. but it restores funding for community flea market operations at the office of the city administrator. we're rebalancing expenditures in the mta's budget, we're allocating staffing funds and reclassifying positions for illegal vending enforcement at public works. it adds fte in the public defender's office, which. will be placed on mayor's reserve pending further. discussions between the mayor and the public defender, and then finally and.

it's a great place to learn and have fun. on a season day like this, it was the perfect spot to be. i find fly casting very relaxing and also at the same time very challenging sport. takes me out into the nature. almost like drawing art in the air. and then i can make these beautiful loops out there. >> even though people from across the globe come here to compete, it's still a place where locals in the know relax and enjoy some rely unique scenery. until next time get out and play!
