young rice visited amelie at 11:20 p.m. in response to a sound complaint. upon arrival, he observed a dj playing inside and a sound measurement showed the volume to be at 93 dba 103 dbc, while the current approved sound limit is 87 dba 94 dbc. inspector young rice spoke with the manager on duty and advised him to have the dj end their set and switch to prerecorded music, which he did. he also reminded him of their llp permit conditions and reiterated that entertainment must end by 11 p.m. inspector young rice then took another sound measurement of the prerecorded music, which showed compliance with the approved sound limit. amelie a r violating their llp permit by hosting entertainment after 11 p.m, with the door open and exceeding their allowable sound limit. that's the only update i have tonight. thank you. questions i know that outside

lands is not under our purview as it's on the parks, site, but was there how did how was sound related to outside lands this year? do we haveny sense? we received many outside lands complain. yes i think between outside lands and then th following event at golden gate park last weekend, the deftones system of a down show we received, i'd say about 2cf■@00. roughly 200, right? that aren't supposed to come to us. so i don't know if others went to rec and park. yeah, or their hotline. they have a hotline? yeah yeah. so as usual, we'll be able to compile that information and share it with parks, through just the emmaries. but yeah, it was quite an influx. it was pretty fun to be out in the field. yeah, yeah. sifting through them all. not our problem, yeah, yeah. i mean, i have to s number

of us probably have similar, feelings like, i personally get complaints about the noise from outside lands, from people who know i'm on the entertainment commission, and i have to explain to them that it's not actually under our purview because it's in golden gate park, which is under parks and rec. but yeah, i'm just always interested. and in the interests of larger sort of venue neighbor relations, if there are ways to lessons that we can learn from outside lands or ways that we can assist parks and rec with mitigating the impact on the neighbors. yeah, it's always good for us to see, honestly, it's really, really eye opening, the best we can really do at this point is just share that information with them as quickly. and directly as possible. and they're usually very responsive to it. you know what they do with that information? i can't say, maybe caitlin could help fill in. i was just to note that right now, the way that 311 is

set up, customers can only submit a complaint of generally about outdoor sound. and so i÷w think that that's why complaints come to us in error. so i do have an email out to the 311 team asking if they can distinguish between sound coming from parks and plazas and versus, you know, otherwise outdoor sound related to events. and hopefully those can then go to rpd directly so that they are more real time. yeah. thank you. i live three blocks from the polo fields and i had a private system of the down concert in my living was awesome. all right. i have no questions. let's open this to public comment. any public comment on the senior inspectors report? no public commentor we'e public comment and move now to number six, we welcome now to the podium. one of what was

recently described as san francisco's, quote, nightmare, end quote, at a hearing in san diego. also, the. lead singer and guitarist in the number one counting crows cover band, in northeal van houten. thank you thank you, thank you. i guess. thank you, president and commissioners. ben van houten from the office of economic and workforce development, with a n. got some slides. awesome the state legislative session is movi toward its conclusion. i believe bills need toe out of the

legislature by the end of this month, and then acted on by the governor by the end of next month. so we'll have a lot pende bills very soon. the three bills that we've been tracking for the longest time, two of which are sponsored by the city, sb 969 and eight, ab , those two bills and assembly member haney's cannabis cafe legislation are all continuing to move forward, and, with, some good positive, positive moment we've also been tracking the drink spiking legislation, the, the, the set of drink spiking related bil that have been moving forward. there have been some amendments to some of ese since the last time we talked, but but all three of them are continuing to move forward. and i have it on the slide here. but requiring bars to provide drink lids for at least one of their types of glasses upon request.ost, signao

that, establishing reporting requirements around drink spiking that for type 48 bars that when a bar operator is notified of a suspected drink spiking and they're obligated to contact law enforcentnd then follow related instructions conveyed by law enforcement drik spiking education into the responsible beverage service training courses that are required of alcohol serrs. so several bills in the drink spiking field continuing■ to moe forward as well. some good updates locally on entertainment zones. i don't think i've done a presentation to this group since. since may. since then, our local legislation to implement entertainment zones and designate the front street entertainment zone was signed in july, we are currently working with city stakeholders to develop a management plan to guide operation of the front

street zone. so thevv implementg legislation designated the office of economic and workforce development to develop a management plan as an additional layer on top of any other street closure, liquor licensing, other permits. and we are in dialog with sfpd and mta and other stakeholders around the best way to coordinate and align that management plan with all the other permits and requirements. and we are undertaking now will also set a template for management plans for future entertainment zones. so it's been a fair amount of work to get this first one off the ground from a city process perspective. but i think we're we're learning a lot about how to do it more nimbly in the future, because there's certainly interest in entertainment zones elsewhere, we also recently launched an entertainment zonese that are interested in learning more at sfgov. slash entertainment zones a few updates on the local legislative front. the mayor's legislation to waive fees

associated with outdoor community events involving street closuresnd following e adoption of that legislation, sfmta board actually earlier this month adopted a companion resolution or motion on their part to waive sfmta fees, so really excited about this, this, this program for outdoor community events under the legislation, mta is leading implementation. and once a waiver is available through this program, an event will have to seek a waiver before submitting an escape permit. so i know we've had a couple of questions from people saying, when is the waiver coming online, there's i'm sure there's going to be more information about that soon, but, and i'm excited to see that move forward. additionally, the legislation to create an annual permit for food vendors that participate in special events was adopted, another another really positive development for our small food operators, who

oftenpate in dozens of events every year. they can get an annual permit instead of having to pay for a food permit for each event that they participate in over the course d around permit orhen final note process streamlining is maybe another way to think of it, the mayor recently announced new legislation to remove the requirement for architectural plans for certain changes of use. so this is a little bit technical, but really does will have a significant impactace, wo change a use, even if that involves no, modification of the space or construction on the space, that change of use can require the submission of architectu■#■>ral drawings, whih can cost thousands or, you knows just adding a beer and wine license and doing nothing else to the space, or they're adding

a place of entertainment permit and doing nothing else to an existing space, so streamlining to remove the requirement for plans in these cases is going to be really impactful for small businesses who you know, again, people can first year fees waived. but this is another this is another way of continuing to support our small businesses, next up was, we were excited to recently announce the awardees of the downtown energy grants. that's our new grant program to support downtown arts, culture,ií■> activities during evenings and weekends, with a focus really on existing businesses and organizations that are doing the work in our downtown neighborhoods to help those neighborhoods thrive. 14 grantees across downtown for a total of $500,000 in awards with a goal of in addition to every, every energy grantee is going to be doing new entertainment programing as part of their

work. but what's really exciting to me, i think about about the awardees here is that, additionally, there's work to or the grantees are going to be working to build their own long term capacity collaboration between businesses, investing in new equipme, developing new marketing campaigns and new festivals across multiple businesses, which i think is really an exciting level of collaboration that i think we're really we're really pleased to support. more information about all of the grantees on sf new deal's website. and then finally, a quick update. just anot sf live concert series, which is outdoor free events in parks and plazas around san francisco, curated by local live music and entertainment venues. there was a great concert that the great american music hall put on on saturday at china basin park, the. i was pleased to deliver a proclamation from the mayor naming it great american music hall day in support of our oldest independent live music venue in san franciscoation aboe

upcoming concerts. there's still a whole bunch going to be incredibly busy for sf live, so that is that is everything. happy to discuss anything more. do you know when the escort waiver fees will be available, you know, i will. i will work to find out. i know that there's some implementation process that mta has to do, but i'm happy to follow up with them and report back. there's also that piece of plaza legislation that through o downtown cbds that would waive some of the permitting and things. that's to keep a keep an eye on. it's not it's moving alt. it a little bit too recent for me to include in this deck. but yes, president peskin introduced legislation to streamline permitting fors the downtown cbds and with some entertainment zone implications there as well. yep any further

approved this this lp permit for indoor entertainment. however, i did make an administrative error and i failed to include their outdoor amplified sound on that permit memo. so tonight, this consent agenda item is to add the outdoor amplified sound at the front of the business, which they've requested to have daily between 9 a.m. and 10 p.m, not to exceed six hours per day in advance of the last hearing. the applicant correctly notified their neighbors the full scope of their permit application, which includes both indoor entertainment and outdoor amplified sound, and there was no opposition from neighbors nor added conditions from sfpd. tenderloin station. so the staff recommendation is to approve the consent calendar with staff recommendations. all right. is there any public comment on the coent agenda? no public comment on thisr item. close public comment. do we have a motion a motion to approve . president bleiman i■/■ commissir davis i commissioner poggio i commissioner slander i and

commissioner thomas. hi. all right we can move along the first permit on our regular agenda is for an extended hours premises permit for big baobab located at 2243 mission street, big baobab currently holds a po permit with our office, and now the owner is applying for thet entertainment and have food service until 4 a.m. friday through sunday mornings, along with the night before the 11 holidays. federal holidays listed in the staff recommendation below for outreach. the owners distributed a letter to their surrounding neighbors about the ahp permit application, and there was no opposition. sfpd mission station had no added conditions and here to speak with you tonight is owner marco, and he's represented by kevin, who is joining us virtually on zoom tonight to bring you in momentarily.

hello. good afternoon everybody. i'm marco, the owner of baobab on mission street. and definitely i'm here to apply for friday and saturday for my extension of permit to go till 4 a.m. to keep entertainment and serving food. if you have any questions for me, i'd be happy to answer. i think we have someone actually coming from the neighbors who just come who's coming right away to raise some concern. i■y. we'll do that during public comment. okay. can you hear me real quick, commissioners? yes, kevin, we can hear you. hi. thank you so much. and i apologize for not being able to be with you in person, i've had a little bit of a family issue come up, so. but i wanted to. i wanted to be here with you all virtually, as you just heard we're excited to really be coming forward to present an extended hours■j permit, you know, i think

commissioners were very,know, fs that came up a couple of years ago, particularly with the sound issues that were coming forward before the entertainment commission around the location of baobab moving from 19th to, you know, closer to 18th on mission street. and we're pleased to say that, you know, even with all of the issues that have then gone forward with that, that, you know, we've really been able to work with the neighbors to have really kind of a productive and healthy working relationship that, you know, has for the last two years, not resulted in any sound complaints since we came before the entertainment commission. we are also now a recognized legacy business as well too. and so what we're looking to do is really help continue to revitalize the mission street corridor. we're looking at doing that by having extended hours to have basically fooservice as well as, late night parties going till 4 a.m. only on the weekends from friday and saturday, but then additionally as well to, you know, looking at using food service just late

night. so that way when people come to baobab, you know, they're able to go dance, have a great time. but then also be able to have some of the food indoors as well too. so that way they're able to sober up, this will be one of the few extended hours permits on mission street. and so we think this is going to be a really good addition for the neighborhood. and, you know, and we're excited to, you know, at this time, you know, not having any opposition coming in, but then also at the same time having, you know, like, more friendly relationships with their neighbors. and there's been a lot of intentional work that marco and myself have done to really kind of bridge that going forward. so, you know, we're excited to come here really with good news and, you know, and great intentions. but we're also available for any questions as well to. no, no questions. sounds great, give us a sense of what what what kind

of entertainment you're hoping to do till for just a continuation of what you're doing currently. yes, absolutely. so the entertainment that baobab has is recognized as a live international music venue. so everything from flamenco to, salsa to afrobeats to francophone, we're looking at continuing to do all of that. but i think for the weekends, majority of the time it will be really afrobeats and francophone with some salsa parties going on on the weekend as well, too, for the majority of those parties. but you know that that being said, we're going to be open and flexible for, you know, whatever entertainment comes up, people want to have a friday night karaoke session that goes late night. we're not opposed to that. all right. i don't have any further questions. let's open you can have a seat and we'll maybe call you back up if somemark. thank you, let's openr public comment. anynt on this il

an f pass permit so they can continue to host outdoor amplified sound for their outdoor diners. the reason they are on the regular agenda versus the consent agenda tonight is because they are seeking to expandheir programing hours. this permit application requests the ability to play prerecorded music at the fro of the business for their sidewalk. diners and in their parklet for their parklet diners. monday through wednesday, 4 p.m. to 10 p.m. and thursy a.m. to 10 p.mo exceed eight hours per day. the outreach by notifying their surrounding residential and commercial neighbors of their f pass permit application. and in your file tonight are five letter letters of support. one of the letters is from their neighboring commercial business, tia margarita, and the other four letters of support are from residential neighbors who either live above the restaurant or in close proximity. additionally, in your file are two letters of opposition from neighbors who believe the permit should not be granted because they find lacma'prerecum■orded music disturbing. i would like to note that we have not received any 1 sound complaints specifically about lokma this calendar year. we have received

cuisine in our warm and bright space. as an owner, i would like to make sure my, customers having a good experience as well as i am keeping good relations with my neighbors to, with this permit, we plan to use it just as an ambient music on a low sound musicjust to keep up the atmosphere, especially our oo dining atmosphere. a little bit, and then, other than we are not planning any special events or live events or we are not planning to get any loud at all, we will, keep respectful to our neighbors, and then i personally dropped the letters to neighbors, and then, as caitlin mentioned, we got some supportive letters from our

you had ongoing conversations with them, or how has that gone, yes. so once we first got the permits, they complained about the music and the sound and noise coming from neighbors. so we put some letters. i actually, you know, you can on the right side and the left side, you see some, notes on the wall. so we put some walls and we were trying to keep the noise down. and also, even though we have a permit, we don't actually play any music on the clement side for, for almost five days. four days. if you don't have any customers, we don't even pl music outside. so i try to be respectful to them. okay thank you. yeah. i don't have any further questions so you can have a seat and we will open this up for public comment. and we may call you back up to if there's some more questions come up. thanks public comment. is

there anybody. we'll start with the room in. in here. yeah. that's you. thank you. yeah. thank you. to speak here. okay. hi. thankzk you for listening to my comments. my name is daniella rebel. i have lived at 1811 clement for over 21 years, located right■ above lacma, whh has occupied the downstairs business since february 2018. several neighbors have all lived in this neighborhood for decades. we have never had this many problems until 2020, when they moved more than when they had more than double their capacity from the parklets and increased sidewalk tables, causing increased noise among other things. this has caused us all tremendous stress and has negatively impacted our quality of life. la fema owners have demonstrated repeatedly that

they only care about their bottom line and not neighbors concerns. they don't take ownership for their actions, bud me. when the city issues a violation for compliance, they should not be issued a fixed place amplified g their jam permit music was played at various volumes from morning to nights. their music carries and vibrates into my and the neighbor's homes, who live nearby. they continue to play music even after their jam permit expired in september. they continuously played music even after their parklets were closed after 10 p.m. i have$ór repeatedly asked their workers to turn off the music when this happens, nothing changes. customers are already loud and need to speak over the music, creating increased noise. when i told the owner, his answer was simply the music makes my customers happy and i want to keep my customers happy. signs to keep voices down are never enforced, and customers continue

to talk at high volumes and the signs. by the way, weh. had to k multiple times for those signs to be put up. these examples demonstrate that they do not follow the rules and regulations mandated by the city, and this commission, due to their parklets and outdoor over pacity, noise has been layered upon noise upon noise, upon noise. in addition to the points i mentioned above, working in a kitchen built for 40 customers rather than 70 plus currently has created loud metal on metal noise, loud pounding, often starting at 7 a.m. to after■k0 p.m, especially on the brunch days. this comes directly into my neighbors and my apartment. lacma's response is tt we as neighbors are being too sensitive, and that to solve the issues, we should move somewhere quiet, not near a restaurant. we've lived there for over 20 years. is that being a good neighbor since i have lived there previous restaurant owners have been more approachable and have also made an efforto get

to know the neighbors. not in lacma's case. 25 neighbors have come to the neighbor and i to express lacma's negative impact on the neighborhood. i have a i have a list of names with addresses if you want them. they weren't able to come, but they have interacted and told us this over several years. on behalf of these 25 neighbors, i urge you to not issue a fixed place, amplified sound permit as this will not impact their business and it will be a small contribution to our quality of life. thank you. thank you. if you can please talk into the microphone either one is okay, but you can bend it. you can bend it towards yourself for there you see i

have a loud voice. it doesn't matter. it goes to the, into the public record. i take out my mask so you can hear. no mask is fine. yeah, record it. so that it goes into the public record. thank you. dear commissioners, my name is karen wong. my husband, daniel, and i own the property at 303 19th avenue. for more than 40 years. and we lived ther for more than 20 years. both we are in our 70s and i'm the primary caregiver for my husband, danie. he has serious health issues this past year, including major surgery and complicated medical problems. in the past, we had no issue with the restaurant next to us. however since the landmark began operating and constructing the public during the pandemic, we have

encountered a lot of problems which are mentioned in my email sent to san francisco entertainment commission last month. don't care about our concerns, especially t such as f the sidewalk with their customers, loud noises, smoking from them while they are waiting for seating, especially one time they even their employee parked the car. the customer parked the car by our driveway. my husband has an emergency need to pull out to emergency, but cannot because they blocked our driveway. so i have to call 911 ambulance. he calls us several thousand to send my husband to emergency. lucky saved his life and then the noises from their kitchen travel up to our bathroom window, which is in the

middle of our houses. noises from the backyard. they installed two fans, which is located underneath one of their unit and one in the roof. every dayhe morning to midnight. those noises impact my husband and me. our concern have led to health department, fire department and building inspection as document. you kno, document in 311. every time i call, i put in all my life. but the problem caused me under stress and health issue. i have included a letter from mying the external noise that would be benefit my health. we recently received the application from lama about the permit permit with with entertainment

commission during the temporary permit, the music played long past the closing time. we are worried about if granted a new permit, it will only worsen our situation. lama has a history suggests they may not comply. the regulation. okay. thank you. thank you very much. additional public comment. no more public comment for this item. okay. close public comment. i just want to say some things for the record here. so we're here tonight to decide whether or not lama has a the ability to outdor speakers, the noise of people speaking outdoors is protected by the first amendment, which we are not don't have a jurisdiction over the sounds of pots and pans and things that are small business related of the machinations. that's while i'm sure it's very disruptive or

feels very disruptive to some of the neighbors, it's not our jurisdiction. so our ju specifically whether or not they can play ambientus speakers. the other thing i will say, too, is that, no matter what has happened in the past during covid and jam, during the jam permit, if we were to grant this and this is to the neighbors as well toes happen, that means that when there are issues, like, for example, let's say music was playing after a certain time, you would have access directly to our in the field often at as quickly as possible. and certainly, if they can't come in real6y time, they come regularly and often afterwards. and i think that's evidenced by our long track record of working with them. so i think what happens here a lot is that people come in and they think, oh, if this business gets a permit, they're going to be

able to run rampant and willy nilly, when actually the opposite has been true. in my experience in that the business now is under our jurisdiction and they're subject to our rules and our inspectors. and you have somebody to call that's not the police, because the police often are very busy and don't havehe bandwidth to respond to noise complaints. so i just want to get that that down. so that sai, does anybody have any comments? do we want to call the operator back up any any questions? i have a question. so, the staff write up said that we hadn't had any 311 complaints this year. have we had 301 complaints since 2020? i looked at the queue today and i'm happy to pull it up right now. i have access to it in real time, but i can confirm that in 2024 to calendar date, we have not received any 311 complaints about lacma. i also looked at tia margarita because they're immediately across the street from one another, and we've had two about tia marrita, but the inspector checked on lokma as well because

not to take away from the concerns that people have, but it's definitely not like a party scene by any means, at least when i've been there. it's just a restaurant that has some people in it. has there been an? when deciding the new proposed hours, has there been any been any sort of compromises made between the neighbors and the ownership or i didn't. there was no back and forth between the neighbors and the owner. meaning ghbor is asking for what they hadema during the pmiough wednesday, and then is expanding that by two hours thursday through sunday. can you just reiterate what those hours are for us monday through wednesday, 4 p.m. to 10 p.m. and thursday through sunday between 9 a.m. to 10 p.m, not to exceed eight hours per day. so during the jam

era, they were■;s 4 p.m. to 10 . daily. the six hour cap just says all jam permits were. and so this application is on the regular agenda tonight, seeking the ability to expand thursday through sunday, starting as early as 9 a.m. because they serve brunch and, not having, you know, set hours so that they can modify based on their hours of operation, commissioner thomas, i have information for you if you're ready. okay. so in 2022, we received 1311 sound complaint. and it came in on a night that we didn't have an inspector in the field. so we from 2022. in 2023, we received one sound complaint that was actually sent from the shared spaces. so the complaint went to dpw. but included a piece of, you know, complaint included hao and, they did observe full compliance with the permit at that time of inspection. and

then, i already spoke about the 2020. so, you know, my personal feeling ismn that it did seem le some of these concerns are not are not in our jurisdiction. and, you know, whether or not they play ambient music on some speakers outdoors, i don't think really has much bearing on the sound of pots and pans and, and blocked driveways and, and, people sitting outside and speaking. so, you know, i, i'm personally very comfortable voting in a positive way on neighbors, have an opportunitye to meet our staff and make su that they have, you know, they know how to get in touch with us when they need to using three, one one or email us, etc. when concerns come up so that we can help to be there and mitigate

issues that are under our jurisdiction as they arise. yeah, i think, you know, one of the issues that the neighbors raise is about music being played past 10 p.m. and that is our jurisdiction, and that is so, one just to the■?, emery, to make sure that you are following that to the second and that, you know, just i would encourage you to work cooperatively with your neighbors. you're all going to be in the same buildings, in the same neighborhood, for a while. and so making sure that you are engaging with them as respectf a can, but again, the sound kitchen sound o on is not something we can deal with here. but, you know, certainly if the sound is louder

than, what we are permitting here, and certainly if it is going laterhan it is being permitted here, you know what, if we approve this permit, then 311 is your recourse on that. if it is, if it is louder or outside of these times, and certainly we would we would strongly prefer that, that we not be getting 311 calls to have to come back, on any of this. and just to make sure that they have an easy way of contacting you when these things come up, because that's the easiest way to resolve problems, is person to person. yeah. and i'll say so i've had 12 brick and mortar spots in the city, and i've had and i have bars which are a lot more loud and often more

disruptive to, to neighbors. and, 99ym out of 100 angry neighbors with me, i've been able to,ig make a connection wih and a direct nnection where they can text me or my staff or have, hey, the music is still on. it's 1005, and then you know, my staff can then act in real time to solve that issue. and when we'that, i've actually developed friendships and neighbors and relationships with people who really weremitte out of business when i first moved in. and so, you know, it's always up to the business owner to, to aro no matter what they've done. in my case, it's my job to act professionally, not their job. they can act however they want. that's their prerogative. but i have found that to be very effective. and the more that i, have, listened and prioritized and really cared, the less the issues have been in my life. so

djs, live music, comedy, karaok, fashion shows, fashion shows and drag brunches. they are also seeking the ability to have outdoor amplified sound at the front of the business to drive in foot traffic monday through friday, 1é2 p.m. to 10 p.m. and saturday, and sunday 10 a.m. to 10 p.m, not tor day. the ownersn extensive outreach and notified all of their nearby neighbors, which are mostly residential. they also included a friendly coupon in their outreach efforts as a way to invite their neighbors into the restaurant. there was no opposition for this permit, and as of today, just like mts before the hearing, there was one letter of support submitted. it's not in your file, but i do have it, and sfpd central station included their standard calendaring condition. so here to speak with you tonight is owner suki sky.

on downtown recovery held by assembly member matt haney, who's local here. but was, wanted to highlight some of the efforts that san diego is making for improving their downtown. and i was asked to speak on behalf of cal night, which is a group i'm a part of, but i was able to sneak in a couple times that i'm part of this commission, b i wasn't speaking on behalf of it, but it was a really great conversation we had with lawmakers and, some other people from the private sector about about recovering downtowns and the role that entertainment plays in that, and got some good and then we got to go out in san diego and see how they do what■" they do. and i have some takeaways. namely, they are partying harder th w should be ashamed of ourselves, and that our hk in san francisc, everybody rolls out to hookah a there all night, which is amazing. but it was a lot of fu. we had a good time and just got
