joining me now executive director of the aclu of louisiana.lso joining us msnbc columnist and chair of religious studies at the university of pennsylvania, two of the smartest women i know. thank you both so much for being here tonight. alanna, what's the impact of this law? >> hb 71 being signed into law means that children all over the state of louisiana in every single classroom whether it be their math classroom, their art classroom, bill be subjected essentially to codify christianity. our schools -- our public schools are going to be turned into sunday schools. and throughout the time that we have been studying this law, we know one thing, that the first amendment and its free exercise clause, which allows each and every united states citizen to choose their own faith or no faith at all and the importance of the establishment clause, which says that the government should not interfere, coerce, prosthalatize or choose or give one particular religion preference over another. those two clauses are still incredibly important in the united st

there are 500 anti-lgbt bills that the aclu has tracked.notes that there's actually been a downtick in the number of bills passed this year compared to last year. is that as a result of better organization to be able to fight those bills across the legislators? does that give you a sense of optimism or hope that these measures are creating a counterforce that may be a net positive in the long run? >> two things. the first is that we are organized, we are bringing our resistance, we are showing up in state legislatures across the country and defeating bills. legislatures passed a lot of the bills that they wanted to pass targeting trans people and are winning in court and focusing on the litigation that is moving up to the federal courts, moving up to the state courts. ultimately, they've had a lot of success. they are codifying that success in the litigation, so i wouldn't say that i feel anyway at ease, given that we are facing this assault in every branch of government. >> you wrote in an op-ed, you talk about your own personal journey as

the aclu says they're going to be challenging this, and they challenge trump's version of this.hen he enacted something similar to this during his presidency, what do you what do you make of the aclu's charge of trying to challenge this, this new move? well i think they're going to have some difficulty because the president's authority to be able to regulate immigration, at least, is being able to prohibit certain nationals from entering on a temporary basis. >> is pretty unquestioned. the section that applies is immigration and nationality act 212 f and so i think that's what they would have to be challenging. but the supreme court, both during the bush senior presidency, recognized his authority to be able to suspend certain people coming in without authorization. and then we had the supreme court decision with trump regarding the border ban. >> but were they able to repeal some of the border ban under trump? >> so, so part of it. but the authority what i'm trying to say is that i think that it's going to be an uphill battle, that the authority seems to be siding with the pres

now, the aclu saying that they plan to sue the biden administration. here's what they said. in a short statement saying, quote, we intend to challenge them this order in court, it was illegal when trump did it, and it is no less illegal now. now, what would the biden administration say to all of this criticism that is coming in to our newsroom, they would say that this executive order is legal, that the department of justice is ready to defend it in court. that they are following all international conventions and protocols, and that there are humanitarian exceptions to this rule that would bar in essence asylum on the border that their humanitarian exceptions for unaccompanied migrant children for certain medical conditions and also for severe victims of human trafficking. now big picture sure brianna, what the administration appears to be doing here is imposing legal consequences to the illegal entry into the united states. we've heard them say that before. and this just puts it right front, front, and center. i've mentioned to you before, i mean, this is really border secu
