i'm katie fang in for ari melber. big developments in two cases involving donald trump. the new york election interference hush money case, that trial now delayed by at least 30 days for the judge to consider arguments about evidence in that case. the southern district of new york has only now handed over more than 100,000 documents to manhattan district attorney alvin brag in recent weeks with 15,000 pages turned over just today. also today a long-awaited ruling in the georgia rico case with a big decision. the judge overseeing the case against donald trump declining to disqualify district attorney fani willis ruling one of them must step down from the case to continue. the lead prosecutor, nathan wade, this afternoon taking the fall, resigning his position, quote, in the interest of democracy and, quote, to move this case forward as quickly as possible. today fani immediately accepting his resignation. the judge may have shot down his attempt to disqualify willis. he did find that their relationship does raise a, quote, significant appearance of impropriety that infect

joining us now, msnbc chief legal correspondent and anchor of the beat on msnbc, ari melber. attorney for palm beach county florida, darren ehrenberg, i'm going to ask you the same question. they've, all start with you. were you surprised at this really? >> i was shocked, mika. the five justices who granted the state through sand in the years of justice and they further delegitimized the supreme court in the eyes of so many. chief justice roberts cares deeply about the perception of the high court. he wants people to believe that they are above politics. that is why it's mystifying to me that they put their hands on a hot stove here. the dc circuit court of appeals path decision was powerful. it was comprehensive. it was convincing. visible issue of absolute immunity is an easy one. it's illegal layup. there is a reason why we let the crown 2050 years ago, we have a president, not a king. the whole issue is a certain loser for trump. he wins by losing because now it is unlikely that the case will go to trial before the election , not impossible, just unlucky. even though the

i'm katie phang in for ari melber. we begin with house republicans using the power of their gavel to drive home one critical point that could shape the entire 2020 election, that donald trump is facing multiple criminal charges for mishandling classified documents. i mean that was ultimately the result of their much hyped hearing featuring robert hur, the special counsel who investigated president biden's classified information. today hur repeated his report's findings, that the evidence did not support any charges for biden. >> we did not, however, identify evidence that rose to the level of proof beyond a reasonable doubt. because the evidence fell short of that standard, i declined to recommend criminal charges against mr. biden. >> republicans had hoped that the hearing would amplify hur's claims about biden's age and memory, but that was before biden's fiery "state of the union" address. so in the end the key take-aways today were about why trump was facing criminal charges. at one point hur, who's a gop appointee

i'm katie phang in for ari melber. we begin with donald trump doing what he does best, trying to delay justice by claiming, wait for it, presidential immunity yet again. today trump's legal team filing a motion to delay his new york criminal hush money trial, which is currently set to begin march 25th, just two weeks away. trump argues the trial should wait for the united states supreme court to weigh in on his presidential immunity claim. those arguments are scheduled for april 25th. trump's legal team writing, "the court must preclude the people from offering evidence at trial of president trump's official acts as the commander in chief." trump claiming that even though stormy daniels was paid off in the fall of 2016 trump didn't reimburse his then personal fixer and attorney michael cohen until 2017, when he was president. and thus, all of those actions are going to fall under the category of, quote, official acts. trump's attorneys also arguing that trump made statements about it as president and on official premis

and ari melber. many more of our colleagues are going to be joining us throughout the very, very long, awesome, interesting night. america has not had a rerun of the same two presidential candidates in back-to-back subsequent elections since 1956 when the incumbent president dwight eisenhower beat his democratic challenger adley stevenson. eisenhower won by kind of a lot. when they ran stevenson against eisenhower again in the next election in '56, eisenhower won again except he won by more. nevertheless, the republican party seems poised to nominate the same candidate again but donald trump does have a republican primary opponent who is, as of this moment, holding on. tonight is an important one for her. we will have more on that. it's 6 p.m. on the east coast and voters are casting ballots. we are just getting our first super tuesday results though from iowa. in iowa the democratic caucus has never been on super tuesday before tonight. famously iowa is the first in the nation and it goes on january
