danny, we see what trump legal team is trying to do here. they have their eye on the supreme court arguments a month out. he's lost twice before. >> the arguments are no surprise. we've seen them for months for both sides the argument is straightforward from the trump team. number one, that a president is absolutely immune, even after he's out of office, for officials acts he undertook while he was in office. they say anything that's -- if you're defining official acts, anything within the outer perimeter counts for acts of immunity. they're continuing with what i call the impeachment judgment clause immunity argument, which is this, you may remember, the idea that only a president who is impeached and then convicted may thereafter be prosecuted. there's some internal inconsistencies here because on the one hand they say president absolutely immune for official acts. the impeachment judgment clause says in so many words that a president impeached, there are situations where he may be convicted or charged criminally thereafter. this has been

on donald trump in this instance.t i do expect that he's likely going to warn him to danny's point that there is a method and a proper process to go through in terms of raising concerns like this, and it is not to go out on social media and lambaste the judge or his family, per se. i think that's something that you are likely going to see. but in this instance, because of the circumstances, i don't necessarily know that the judge is going to come down too hard on donald trump. >> georgia, there was a hearing yesterday, donald trump is trying to get the georgia rico case thrown out again, this time saying he had free speech rights when he was saying what he was saying about georgia, charles. how did that go? >> not well. i mean, you know, donald trump continued to make this argument around his free speech and what it is that he is basically leaning on around all of these cases, but particularly in georgia, and, again, we're watching this play out in a way that he's sort of recycling the same arguments he's used earlier

from reciting these same lies again and again as he has. >> let's move on to georgia, danny, where wew we're waiting to hear whether the judge is going to keep fani willis on the case or whether she's disqualified from the case. we heard last week trump's co-defendant was pushing to introduce new evidence about the relationship between fani willis and her special prosecutor nathan wade. so far no word from the judge on that. do we know why? >> judicial crystal balling is so difficult and more so with judge mcafee who has been completely inscrutable. some of the questions he asked made me lean the meter one way and another question he'd ask, i'd go the other way back and forth between the state and the defense. here's a thought. if he hasn't reopened the evidence, based on the new allegations and evidence that the defense wants to introduce, maybe that suggests that he doesn't need to hear it. well, why wouldn't he need to hear it? maybe because he's already made a decision. what decision is that? does he think it's just not important to keep going over whether or not fani willis was t

, the draconian things trump talks of, are they even legal?'s a really good question. we saw early on donald trump tried several executive orders by fiat which were overturned relatively quickly. so donald trump's view of what he can do in terms of immigration is often not consistent with the law. for example, we have asylum laws that can't just be ignored or overturned by executive order. those laws, those federal laws require us to accept under certain conditions people applying for asylum. there's certain things that donald trump simply cannot do by executive order or by a wave of his hand. and we've known that since at least 2016, 2017 when he tried at the very beginning of his first presidency, maybe only presidency. but he's tried it before and he's wrong. but at this point, does anyone think he's right about the law? we just saw a clip of him saying they're trying to abort babies after they're born. i mean, that isn't even metaphysically possible. >> it's insane. donald trump loves to say that the republican party is unified. but look a

is the judge's reasoning sound, or does trump still face a lot of danger? >> it's very significant because it tells me judge mcafee was largely inscrutable like the sphinx. we hardly know which way he's leading, but motions like this which challenge the wording of an indictment or a charging instrument or a complaint, they're reviewed by a judge, and the judge gets all the deference to the state. in other words, he looks at the four corners of the document and ask the question have they alleged the bear minimum to move forward, and the answer in this case was no. in the case of a firearm or burglary, those elements are pleaded every day thousands of times a day. this is an unusual crime not pleaded very often, so for that reason that might be why this is a motion that is almost always unsuccessful, was actually successful in this case. but you pointed out correctly this is just a pleading issue. the government -- excuse me, the state could reallege these properly with more detail. as a criminal defense attorney, you file these motions. even if you win, ofte
