when the itc said they would have to pull the watch from shelves after a review period, that is how wechristmas and new year's, a lot of people believed there would be no way apple would get to this point. either apple would figure out some settlement, they would issue a software update, convince the biden administration to veto the order from the trade commission. it was very surprising when these got pulled from store shelves. the band only lasted a few days because apple a couple of days ago got an emergency order through an appeals court in d.c. that got them to put the watch back in market. this is temporary. apple has to put a software fix in place. that fix is being reviewed by the u.s. customs agency. there was a hearing yesterday, we don't know how the hearing might because it is closed-door stuff, but by mid-january we should have some answer on whether or not to be fixed software is sufficient enough to no longer in their view violates the patents from a company that says apple infringed and got the itc to pull the watch from stores. carol: are we to naive -- to assume that

the company believes it has a softer mixed that can mitigate these patents that the itc is saying areassets held by a company out of southern california. we believe this software fix can work around the other patents and get apple watches selling again in the united states. obviously it would have to submit its new software design. it is a u.s. customs that makes the decision if the case is to be approved or not approved. if approved, they would be able to resume sales at retail stores . paul: is there a potential political solution to this? could the white house possibly save apple here? mark: that's right, the white house could step in. the import ban goes into effect on december 20 fifth, actually christmas day here in the u.s., so if the biden administration steps in, they can veto this. there is some precedent, i should add, important for those who have been following full phone in the last decade, samsung had a similar situation here where apple was found to have violated those assets. president obama in the last minute issued a veto. now we are talking about two completely diff

january 10 is when the itc is going to respond and try to shoot down this motion.not granting these emergency lifts if they don't believe this will stick long-term. as of now, it seems likely if i were a betting man that this apple watch ban situation should be resolved by the middle of january. sonali: you have mossimo corp., the company that had bought the patent infringement claim against apple now down about 5.4% on the day. what does this end up meeting for them? >> for the stock, you had a lot of people, the stock up last month or so buying into mossimo on a more basic level. you have heard about their technology. this has been an incredible marketing moment for mossimo. that probably brought in a lot of consumer investors and day traders. on the other hand, you had people jumping into mossimo because they became under the impression there would be some sort of licensing pact or settlement from apple. mossimo generates about 2 billion in revenue on an annual basis. a settlement with apple would be worth hundreds of millions of dollars and would use the market

they tried a last-minute appeal with the itc, the agency that put into effect this ban and lost that.ekend they had until december 25th, the biden administration, to veto this. they did not do that either. the ban is in effect now and basically, scott, they have to work around these patent issues, whether that's on the software level, the hardware level or both. like to put dollars on this, morgan stanley has a note saying, you know, for every week that this ban continues in the march quarter starting after the new year, they have -- they could potentially lose or they won't be getting rather $135 million of revenue. overall this could have a 2% impact on revenue for apple for the quarter if it goes the entire quarter without figuring this problem out. as you know, as apple tries to look to return to the top line revenue growth in the holiday quarter and throughout 2024, they're going to need every advantage they can get because demand has been low for smartphones and the vision pro will not do it, the renewed growth in services isn't going to do it so they need every little bit they
